There are various principles given in Indonesian Civil Code (KUHPerdata) and HIR/RBg in providing legal protection on good faith purchaser, but all of these principles eventually dropped their pedestal on a judge’s verdict to decide whether or not the intention of the buyer is based on a good faith purchaser. There are also many factors that can influence the decision of a judge that can lead to different conceptions of the protection provided. In addition, the rapid development of the present law requires judges to review the general principles of law and also applying existing law theories in the making of their verdict. Permasalahan perlindungan hukum pembeli beritikad baik merupakan masalah yang cukup mendasar dalam hukum kita. Terdapat berbagai prinsip yang diberikan dalam KUHPerdata maupun HIR/RBg dalam mengupayakan perlindungan hukum pembeli beritikad baik, akan tetapi upaya-upaya tersebut pada akhirnya menjatuhkan tumpuannya pada putusan hakim untuk menilai beritikad baik atau tidaknya seseorang. Di sisi lain, terdapat banyak faktor yang mempengaruhi putusan seorang hakim sehingga apabila dikaitkan dengan itikad baik, dapat menimbulkan konsepsi yang berbeda-beda terhadap perlindungan yang diberikan. Selain itu, pesatnya perkembangan hukum sekarang ini mewajibkan hakim-hakim untuk mempelajari kembali asas-asas hukum serta menerapkan teori-teori hukum yang ada dalam membuat putusannya.

This study will discuss the implementation of General Principles of Good Governance (AUPB) in the One Stop Licensing System in the city of Yogyakarta. Some things that would be an important consideration in this study were changes to Local Government Law No. 22 of 1999 as Law No. 32 of 2004 and its consequence, the issuance of Government Regulation No. 84 of 2000 governing the organization’s guidelines in the area of technical authority in issuing permits and Ministerial Decree No. PAN 63/KEP/M.PAN/7/2003 On Implementation Guidelines for Public Service and Administrative Reform Decree No. 26/KEP/M.PAN/2/2004 About Help Technical Transparency and Accountability. Penelitian ini akan membahas penerapan Asas Umum Pemerintahan yang Baik (AUPB) dalam Sistem Perijinan Satu Pintu di Kota Yogyakarta. Beberapa hal yang akan menjadi pertimbangan penting dalam penelitian ini adalah Perubahan UU Otonomi Daerah Nomor 22 Tahun 1999 menjadi UU Nomor 32 Tahun 2004 beserta konsekuensinya. Penerbitan Peraturan Pemerintah Nomor 84 Tahun 2000 yang mengatur tentang pedoman organisasi perangkat daerah dalam kewenangan teknisnya mengeluarkan ijin di daerah serta Kepmen PAN Nomor 63/KEP/M.PAN/7/2003 tentang Pedoman Penyelenggaraan Pelayanan Publik dan Keputusan Menteri Pendayagunaan Aparatur Negara Nomor 26/KEP/M. PAN/2/2004 tentang Petunjuk Teknis Transparansi dan Akuntabilitas.

Punitive attitudes of law enforcers in some criminal cases seem not to benefit the convict, as it does not support the main objective of the criminal justice system. This is because of the absence of binding direction which guides judges in making judgments. In order to benefit the convict, criminal law should formulate a binding direction as well as individualizing punishment which bind all the criminal court. Moreover, there should also be a common understanding among law enforcers that punitive attitude should be balanced with curing attitude. Therefore, physical, substantial and cultural synchronization are needed. The physical synchronization can be conducted through synergy among law enforcers as part of the criminal justice system. The substantial synchronization can be realized through the availability of common understanding among law enforces.

Fisheries subsidies have been practiced by many states in the world. Such actions are considered as one of the causes of over-fishing. Its also endanger sustainable fisheries management. There is no specific regulation on fisheries subsidies in the WTO. To date, negotiation over fisheries subsidies came out with the draft and it would be attach as Annexes VIII of SCM Agreement. The draft of fisheries subsidies specifically regulates prohibited subsidies, general exception and special and different treatment. The impact of the WTO fisheries subsidies draft will be negative to the Indonesian fisheries market, fishery resources and employment. Subsidi perikanan telah dipraktikkan oleh negara-negara di dunia. Tindakan tersebut dianggap sebagai salah satu penyebab terjadinya eksploitasi sumber daya perikanan sehingga membahayakan pengelolaan perikanan berkelanjutan. Terkait dengan perdagangan dan subsidi perikanan, belum ada regulasi khusus tentang subsidi perikanan di WTO. Negosiasi di WTO hingga saat ini baru pada rancangan yang akan menjadi lampiran VIII SCM Agreement. Rancangan subsidi perikanan di WTO mengatur secara khusus tentang subsidi perikanan yang dilarang dan pengecualian secara umum. Dampak dari rancangan subsidi perikanan WTO tersebut apabila berhasil disahkan akan memberikan dampak negatif kepada Indonesia terkait dengan pasar perikanan, sumber daya perikanan dan lapangan pekerjaan.

Labour law does not always provide a satisfactory answer to the issue on the protection of workers’ or employees’ interests. Modern corporate law gives an alternative way in promoting the interests of employees; whereby it obliges directors to take into account not only shareholders’ but also employees’ interests in decisionmaking process. Hukum perburuhan tidak selalu memuaskan dalam melindungi kepentingan buruh atau pegawai perusahaan. Hukum perusahaan yang modern memberikan alternatif untuk memajukan kepentingan para pegawai perusahaan, di mana ia menentukan agar direktur dalam mengemban tugasnya pada perusahaan, tidak hanya memperhatikan kepentingan pemegang saham tetapi juga harus memperhatikan kepentingan pegawai dalam proses pengambilan keputusan.

A judge must examine and adjudicate all charges thoroughly on the lawsuit brought to the court. The judge should not only examine and adjudicate part of the charge and disregard the rest. On the other hand, judge in his/her adjudication is prohibited to accede above the suit brought by the parties. This prohibition is called ultra petitum partium. A judge who accedes in excess of the suit partium is considered to be exceeding his/her authority. In Religious Court proceedings, the implementation of ultra petitum partium principle is an exception in several types of cases. In the procedure of divorce (cerai talak), a judge may grant something not demanded by wife either in the petition of divorce or in the reconvention by charging certain obligations upon the husband, which is the wife’s right as the consequence of the separation. In the procedure of divorce, judge may order a preliminary injunction even if such injunction is not demanded. The argument that justifies the judge’s action is the Marriage Act and the procedural law in the Act on Religious Court is a lex specialis stipulation, judge as judge made law must dig into the values of life, and the judge may execute contra legem action if the stipulation in an article considered to be in contradiction with justice and benefit.

AbstractThe 1945 Constitution of the Republic of Indonesia regulates natural recources in its particular article. Then, the Energy Law and the Oil and Gas Law regulate the state’s control of oil and natural gas. In the sectoral regulations of oil and gas, there is a public service obligation (PSO) which must be assumed by the Government and State Owned Enterprises (SOE). Meanwhile, in the SOE Law introduced entity Perum and Persero. Where in Perum entities carrying out public service, while the Persero entity to assume the role for profit. But in practice found a PSO on the oil and gas sector carried by state-run entities Persero. IntisariDalam Undang-Undang Dasar Negara Republik Indonesia 1945 diatur penguasaan negara terhadap sumber daya alam. Kemudian UU Enegi dan UU Minyak dan Gas Bumi mengatur penguasaan negara terhadap minyak dan gas bumi. Dalam pengaturan sektoral di bidang tersebut juga mengatur kewajiban pelayanan umum yang harus diemban oleh pemerintah dan BUMN. Sementara itu dalam UU BUMN diperkenalkan entitas Perusahaan Umum (Perum) dan Perseroan Terbatas (Persero). Dimana entitas Perum mengemban peran pelayanan umum (public service), sementara entitas Persero mengemban peran mencari keuntungan (profit oriented). Namun dalam praktek ditemukan kewajiban pelayanan umum pada sektor minyak dan gas bumi diemban oleh BUMN dengan entitas Persero.

Sustainable development is development that meets the needs of the present without compromising the ability of future generations. However, that concept lacks of clarity, which leads to various interpretations. Scholars have argued that the definition of sustainable development can be explained into four elements, namely the integration principle, sustainable use, intra-generational equity, and inter-generational equity. It analyses the elements of integration and sustainable using both legal and non-legal perspectives and shows how the elements have been recognized in various legal documents, while finds that various international commitments have indicated the growing concerns for conservation and sustainable use of natural resources. Pembangunan berkelanjutan adalah pembangunan untuk memenuhi kebutuhan generasi sekarang tanpa mengganggu kemampuan generasi yang akan datang. Definisi pembangunan berkelanjutan dibagi menjadi 4 (empat), yaitu prinsip integrasi, pemanfaatan secara berkelanjutan, keadilan intra generasi, dan keadilan antar generasi. Artikel ini menganalisis prinsip integrasi dan pemanfaatan berkelanjutan. Artikel ini memandang bahwa prinsip integrasi harus diinterpretasikan dalam kerangka perlindungan lingkungan, sehingga memperoleh prioritas guna menyeimbangkan antara kebutuhan perlindungan lingkungan dengan kebutuhan akan pembangunan. Di samping itu, meskipun terdapat berbagai penafsiran mengenai pemanfaatan berkelanjutan, namun pengakuan tentang pemanfaatan berkelanjutan cukup untuk menunjukkan adanya peningkatan perhatian terhadap pemanfaatan berkelanjutan atas sumber daya lingkungan.

Abstract The Administrative Court has an important role to supervise the government’s duty, based on principle of good governance and regulations. Principles of good governance have been developed for some reasons. The aim of this research are to know the role of judge’s verdict and the development of principle of good governance. This research is use normative juridis method. The novelty is to strengthened the role of the judge’s verdict to build a good governance and to improve the knowledge of the importance of principles of good governance to build good governance.Intisari Pengadilan Tata Usaha Negara memiliki peran penting dalam melakukan pengawasan terhadap penyelenggaraan pemerintahan yang didasarkan pada pengujian terhadap Asas-asas Umum Pemerintahan yang Baik dan perundang-undangan. Asas-asas Umum Pemerintahan yang Baik telah mengalami perkembangan yang penting. Tujuan yang akan dicapai adalah untuk mengetahui peran putusan Hakim dan perkembangan Asas-asas Umum Pemerintahan yang Baik.Penelitian menggunakan metode yuridis normatif. Keterbaruan yaitu meningkatkan peran Pengadilan Tata Usaha Negara dan kemampuan untuk lebih memahami arti penting Asas-asas Umum Pemerintahan yang Baik menuju tata kelola yang lebih baik.

Land acquisition is a very important activity in any kind of development programs, such as the South Ring Road Highway. Although land acquisition has been started since 2008, the project has not been completed. This research focuses on applying the principle of land acquisition to achieve the program’s objectives. Pembebasan tanah adalah aktivitas yang sangat penting dalam setiap jenis program pembangunan, seperti Jaringan Jalan Lingkar Selatan. Meskipun pembebasan tanah sudah dimulai sejak tahun 2008, tetapi belum selesai juga. Penelitian ini difokuskan pada penerapan prinsip pembebasan lahan untuk keberhasilan program.
