Abstract

The judge basic consideration in condemning discharge sentence can be seen from the crime which is committed by military and its effect to the name of Indonesian National Armed Forces (TNI). When the crime which is committed by military gives negative effect to the norm of TNI, so it can be used as a basic consideration to give discharge sentence. Besides, it can be seen from the status of the military who committed a crime. When the military did a crime repeatedly, it can be used as a basic to give a discharge sentence. The existence of discharge sentence still need to be taken care in the future to give deterrent effect to the military. The regulation of discharge sentence in KUHPM must be separated with Civil Penal Code (KUHP) in separated codification. In the future, KUHPM has to formulize explicitly about criteria in discharge sentence application to military as an offender.

Abstract

This study is an empirical legal research that uses primary and secondary data. The result of this  study is to be used f or the handling of  E.  coli  contamination where it  is the government ’s role to procure chlorine diffusers and monitor the quality of drinking water. The high level of contamination caused by the E. coli bacteria is due to the poor sanitation system and the close proximity of wells to septic tanks. Meanwhile, other constraints faced by the government include the lackof routine monitoring, lack of sanitation workers, and lack of proper implementation of the standardtechnical guidance on Procedures Planning Septic Tank with Absorption Systems. Penelitian ini merupakan penelitian hukum empiris yang menggunakan data primer dan sekunder. Hasil penelitian ini adalah dalam rangka penanggulangan pencemaran bakteri E. coli dimana Pemerintahberperan dalam pengadaan alat chlorine diffuser, sosialisasi hidup bersih, pengawasan kualitas air minum, dan sebagainya. Tingginya pencemaran bakteri E. coli dikarenakan sistem sanitasi yang buruk, dan jarakyang dekat antara sumur dengan saluran septic tank. Sementara itu kendala yang dihadapi antara lainPemerintah tidak melakukan pengawasan secara rutin, terbatasnya petugas sanitasi, tidak dilaksanakannyapetunjuk teknis SNI tentang Tata Cara Perencanaan Tangki Septik dengan Sistem Resapan.Kata Kunci: peran pemerintah, pencemaran, bakteri E. coli.

Abstract

Annual field records show a failure in the regulation of land conversion, a situation which reflects the poor implementation of numerous Indonesian agrarian policies, including farmland conversion, land use, and spatial planning. Six attempts to control the land conversion and land use in Indonesia are formulated in this writing.  Catatan lapangan tahunan menggambarkan adanya kegagalan pengendalian alih fungsi tanah, yang secara umum menunjukkan kegagalan implementasi berbagai kebijakan agraria yang termasuk di dalamnya alih fungsi tanah pertanian, penatagunaan tanah, dan penataan ruang di Indonesia. Tulisan ini merumuskan enam upaya untuk mengendalikan alih fungsi dan penatagunaan tanah di Indonesia.

Abstract

AbstractAs extra ordinary crime, corruption which may be done in several ways is hard to be eradicated. One of the ways is money laundering. The problem which arises is that KPK has no authority to prosecute money laundering of corruption proceed. This research aims to explore the authority to prosecute money laundering of corruption proceed based on existing legislations and to also provide the reform of law regarding to that issue. The research shows that there is no regulation which authorizes KPK to prosecute money laundering. To cope with that problem, the reform of laws is necessary by: First, combining the regulation of money laundering and corruption in one legislation; and Second, authorizing KPK to prosecute money laundering of corruption proceed by putting the authority in a legislation.IntisariSebagai extra ordinary crime, korupsi dengan berbagai modus operandi tidak mudah diberantas. Salah satu modus operandi yang kompleks adalah TPPU. Permasalahan yang timbul dalam TPPU hasil tindak pidana korupsi adalah dimana KPK tidak diberikan kewenangan melakukan penuntutan terhadap TPPU hasil korupsi. Penelitian ini bertujuan untuk mengeksplorasi kewenangan penuntutan terhadap perkara TPPU hasil korupsi dalam hukum positif dan memberikan reformulasi pengaturan terhadap hal tersebut. Hasil penelitian menunjukan bahwa terdapat kekosongan hukum dalam penegakan hukum pada perkara TPPU hasil tindak pidana korupsi yang ditangani KPK. Untuk mengatasi permasalahan tersebut perlu reformulasi peraturan dengan: (1) mengatur secara tersendiri TPPU dalam UU PTPK; dan (2) memberikan kewenangan KPK untuk melakukan penuntutan terhadap perkara TPPU hasil tindak pidana korupsi.

Abstract

This study was submitted to answer two questions, first, whether the reclamation obligations of license holders have conformity with the principles of forest protection. Secondly, how the implementation of regulations regarding the reclamation of coal mining in forest areas in Kalimantan Timur. This study uses socio-legal approach to the research area in Kalimantan Timur province. Based on these results, forest destruction can not be avoided because the current rules justify coal mining in forest areas. Implementation of the regulations on reclamation of coal mining in forest areas can be performed without re-vegetation and reduce the number of forest in Kalimantan Timur province. Penelitian ini diajukan untuk menjawab dua pertanyaan, pertama, apakah kewajiban reklamasi pemegang izin memiliki kesesuaian dengan prinsip perlindungan hutan. Kedua, bagaimana implementasi peraturan mengenai reklamasi pertambangan batubara di kawasan hutan di Kalimantan Timur. Penelitian ini menggunakan pendekatan sosio-legal dengan area penelitian di Provinsi Kalimantan Timur. Berdasarkan hasil penelitian ini, kerusakan hutan tidak dapat dihindari karena aturan saat ini membenarkan pertambangan batubara di kawasan hutan. Implementasi peraturan tentang reklamasi pertambangan batubara di kawasan hutan dapat dilakukan tanpa revegetasi dan mengurangi jumlah hutan di Provinsi Kalimantan Timur.

Abstract

Problems faced by Women Migrant Worker partly incurred in connection with the position of their woman role that have occurred since the time of recruitment process until departure and when returning back to their home areas. The presence of a legal loophole in the Law 39 of 2004 is one of the problems. The existence of a gender perspective of regional policy is an effort to guarantee the rights of migrant workers and as a solution to problems related to the position of migrant workers. Permasalahan yang dihadapi Buruh Migran Perempuan sebagian besar terjadi sehubungan dengan posisi keperempuanan mereka yang terjadi sejak saat proses rekrutmen sampai pemberangkatan dan ketika pulang kembali ke daerah asalnya. Terdapatnya celah hukum dalam UU No. 39 tahun 2004 merupakan salah satu persoalannya. Adanya kebijakan daerah yang berperspektif gender merupakan upaya untuk menjamin terpenuhinya hak-hak buruh migran.

Abstract

Pursuant to Act 21/2008, Conventional Commercial Banks with embedded Sharia Business Unit are obliged to spin-off their unit when its asset value has reached 50% of the total asset of Bank’s. This obligation attempts to separate the management of SBU from Banks, thus expecting higher rate of sharia compliance. Menurut UU 21/2008, Bank Umum Konvensional yang memiliki Unit Usaha Syariah wajib memisahkan unitnya apabila nilai aset unit tersebut telah mencapai 50% dari total aset bank induk. Kewajiban tersebut ditujukan untuk menjadikannya sebagai Bank Umum Syariah yang terpisah pengelolaannya dari Bank Umum Konvensional, sehingga diharapkan lebih taat terhadap prinsip syariah.

Abstract

This research identify the revitalization of Badan Penasihatan, Pembinaan dan Pelestarian Perkawinan (BP4) after The 14th BP4 National Conference in 2009, in performing Court-annexed mediation for Marital Dispute at Religious Court in D.I. Yogyakarta. This  research founds several institutional transformation of BP4 including the Legal Basis, Institutional Form, Institutional Relation with Ministry of Religious Affair, Employement/Management Provisions, and Financial Provisions. In Performing Court-annexed mediation. BP4 in D.I. Yogyakarta has been cooperating with 2 (two) Religious Courts, both in Wonosari and Yogyakarta through Memorandum of Understanding in form of cooperation in the placement of certified mediator from BP4 and cooperation in funding the certified mediators. All Mediators are bound by Regulation of The Supreme Court No. 1 year 2016 concerning Procedures of Court-annexed Mediation, related to Types  of  Cases  Mediated,  Mediator’s  Fee,  Venue  of  Mediation,  Period  of  Mediation,  and Mediator’s requirement.

Abstract

This research studies the Sasi traditional value in the Maluku Tengah adat community and investigates its possible role in reshaping and renewing Indonesian national criminal law. Sasi is a collection of regulation that is formed by member of adat community. Failure to comply with sasi would be punished according to the relevant sasi regulations. The drafting of a new national penal code that extend the punishable offense to include those regulated by adat and religious law as long as positive law has not regulated the offense is expected to serve the society’s legal awareness. Studi ini mengangkat nilai-nilai tradisional Adat Sasi yang hidup dalam masyarakat adat Maluku Tengah sebagai salah satu bahan hukum dalam upaya pembentukan dan pembaharuan hukum pidana nasional. Sasi adalah suatu aturan yang disepakati bersama oleh anggota masyarakat adat untuk ditaati bersama, apabila dilanggar maka akan memperoleh sanksi atau hukuman sesuai dengan peraturan-peraturan sasi yang telah disepakati. Pembentukan RUU KUHP nasional yang memperluas dasar patut dipidananya suatu perbuatan ke ranah nilai-nilai hukum adat dan agama sepanjang perbuatan tersebut belum diatur dalam undang-undang diharapkan dapat selaras dengan kesadaran hukum masyarakat.

Abstract

Conflict on civil matters is an absolute competency of District Court. Judiciary system includes all items in relating with a judge assignment giving justice to the justiciable through the conviction. A court judges according to law and should not make discrimination. The provision becomes a principle for civil judge to process the conflict matter which is submitted on him/her. The justice concept on the civil judiciary system is a justice which is given by a judge during the judiciary on civil conflict, to produce a conviction. In the conflict of civil matter, it known as audi et alteram partem and to each his own principle. Audi et alteram partem principle. It means that giving to that every person on conflict should be equally treated. To each his own principle, it means that every person take everything as his own. In implementation, it look both of principles is contradiction each other. Because in the law system should not have any conflict, so both of the principle should be exist in the the conflict of civil matters.
