Abstract

The research on civil law evidence on malpractice cases in Yogyakarta was conducted through field and literature studies. The conclusion is that civil law evidence in malpractice case which happened in Yogyakarta is subjected to the civil law procedure. However, the special character of the case creates some deviation on the procedures. Penelitian tentang pembuktian perdata dalam kasus malpraktik di Yogyakarta dilakukan melalui studi lapangan dan studi pustaka. Kesimpulan penelitian ini menunjukkan bahwa pembuktian perdata dalam kasus malpraktik di Yogyakarta masih menggunakan prosedur hukum acara perdata yang berlaku positif. Namun, karakter khusus dari kasus ini menyebabkan beberapa penyimpangan prosedur.

Abstract

The practice of yield-sharing among fishermen community in Pandangan Wetan, Rembang, are often followed by various agreement disputes. Such disputes include death compensation for deceased deckhands and also unfair and corrupted sharing of fish. This research aims to study such practice and its dispute settlement mechanisms.  Praktik pembagian hasil tangkapan di antara nelayan di desa nelayan Pandangan Wetan, Rembang, sering diikuti dengan berbagai perselisihan perjanjian. Perselisihan tersebut termasuk ganti rugi atas kematian anak buah kapal dan pembagian tangkapan yang tidak adil dan korup. Penelitian ini bertujuan untuk mempelajari praktik tersebut dan penyelesaian perselisihan yang timbul darinya.

Abstract

AbstractThe land of Manggarai Timur and Ngada in Flores, Indonesia, is facing complexities in the agrarian sector. There is an overlap of laws on land tenure in the border area between the regencies based on the Regional Spatial Plans of both Manggarai Timur and Ngadha regencies. Not only that this creates horizontal conflicts between the peoples, but the overlap of mining policies also affects the environment. This research investigates the problems and discovers that the complexity can only be untangled by creating a ‘Strategic Area’ which can be implemented with a reconstruction of the current system of spatial planning law. IntisariTanah Manggarai Timur dan Ngada di Flores, Indonesia, menghadapi kompleksitas serius di sektor agraris. Ada tumpang tindih hukum tentang kepemilikan lahan di daerah perbatasan antar kabupaten berdasarkan Rencana Tata Ruang Wilayah Kabupaten Manggarai Timur dan Ngadha. Hal ini menyebabkan konflik horizontal antara masyarakat. Selain itu, tumpang tindih kebijakan terkait pertambangan juga mempengaruhi lingkungan. Penelitian ini menyelidiki masalah dan menemukan bahwa kompleksitasnya hanya dapat dilepaskan dengan menciptakan 'Kawasan Strategis' yang hanya dapat diimplementasikan dengan adanya rekonstruksi terhadap sistem hukum penataan ruang saat ini.

Abstract

The verdict of Bandung State Court No 49/Pdt.G/2003/PN.BDG about the application for compensation claim case of Dedi et.al, September 4, 2003 on the landslide of Mount Mandalawangi Kadungora Subdistrict Garut District, implemented the principle of strict liability and precautionary. The implementation of strict liability and precautionary principles has contradicted the laws, but has fulfilled the need of just in general. The judge’s verdict has given enlightenment to other judges on the duties of a judge in finding justice, and has offered a new understanding on the sources of law. Putusan Pengadilan Negeri Bandung Nomor 49/Pdt.G/2003/PN.BDG perihal Permohonan Gugatan Ganti Rugi perkara Dedi dkk, 4 September 2003 mengenai peristiwa longsor Gunung Mandalawangi Kecamatan Kadungora Kabupaten Garut, mengimplementasikan prinsip strict liability dan precautionaryprinciple. Implementasi prinsip strict liability dan precautionary telah bertentangan dengan Undang-Undang, namun berhasil memenuhi rasa keadilan secara umum. Putusan hakim telah memberikan pelajaran bagi hakim-hakim lainnya mengenai tugas hakim dalam menemukan keadilan, dan memberikanpemahaman baru mengenai sumber-sumber hukum.

AbstractThe scheme of profit sharing contracts has been significantly changed due to the enactment of Ministerial Regulation of Energy and Mineral Resources No. 8/2017 concerning the Gross Split Revenue Sharing Contract on January 16, 2017.This research focused on: First, the relationship between the change of PSC Cost Recovery form to PSC Gross Split with the mechanism of Administration of Land and Building Tax and its addressat; and Second relationship between change of PSC Cost Recovery form PSC Gross Split with procedure of Land and Building Tax calculation at exploration and exploitation stage.IntisariSkema kontrak bagi hasil mengalami perubahan yang sangat signifikan akibat diundangkannya Peraturan Menteri ESDM No. 8/2017 Tentang Kontrak Bagi Hasil Gross Split pada tanggal 16 Januari 2017. Penelitian ini difokuskan pada: Pertama, hubungan antara perubahan bentuk PSC Cost Recovery menjadi PSC Gross Split dengan mekanisme penatausahaan Pajak Bumi dan Bangunan dan addressat-nya; dan Kedua hubungan antara perubahan bentuk PSC Cost Recovery menjadi PSC Gross Split dengan tata cara perhitungan PBB pada tahap eksplorasi dan eksploitasi.

Abstract

EBA is one of alternatif of financing for business world and investment instrument for investor. Yet, until nowdays, no company issued EBA in Indonesia capital market even though there have been quite number of Indonesia that companies that become originator of foreign securitization. Unvalailability of EBA in Indonesia capital market is because of the lack of knowledge of capital market participants in understanding EBA. The capital participant still consider that existing rule and regulation are in insuffient for the EBA to take place.

Abstract

Regulation is the cornerstone for utilizing marine fisheries resources, and thus Indonesian Government had implemented its Constitution as basic laws and rules. Those regulations need further elaboration. Therefore, Indonesian Government established sets of laws related to the utilization of marine fisheries resources, and in its implementation, those laws and regulations should never deviate from the Constitution of the Republic of Indonesia. The utilization of marine fisheries resources in Indonesia’s Exclusive Economic Zone enables the possibility of cooperation and colaboration with other countries. Therefore, Indonesia is required to seek by evaluating and complementing the laws in accordance with its Constitution. Pengaturan merupakan landasan utama pemanfaatan sumber daya perikanan, Indonesia telah menyiapkan aturan dasar yaitu Landasan Konstitusional. Pengaturan tersebut perlu penjabaran lebih lanjut. Oleh karena itu Indonesia membentuk aturan-aturan yang terkait dengan pemanfaatan sumber daya ikan dan dalam implementasinya aturan tersebut tidak boleh menyimpang dari aturan yang paling dasar. Pemanfaatan sumber daya ikan di Zona Ekonomi Eksklusif adalah pemanfaatan yang memungkinkan adanya pemanfaatan berbagi dengan negara lain maka Indonesia dituntut untuk segera dapat mencari dengan cara mengevaluasi dan melengkapi aturan sesuai dengan Landasan Konstitusional.

Abstract

Indonesia is a nation that has been subject to many of high profile terrorist cases. In relation to this, Indonesia’s legal framework on anti-terrorism contains provisions that have been generally practiced by other countries. After the 2002 Bali Bombing, the Indonesian government issued Government Regulation in Lieu of Law (Perpu) No. 1/2002 on Anti-terrorism and Perpu No. 2/2002 (which made the Perpu No.1/2002 retroactively applicable to the Bali bombings). The parliament adopted both in early 2003 in the form of Law No. 15/2003 and Law No. 16/2003. The Constitutional Court decided that Law No. 16/2003 was in-constitutional, because it was against principle of non-retroactivity stipulated under Article 28I of the 1945 Constitution. Indonesia adalah korban dari beberapa serangan teroris bersakal besar. Terkait terorisme ini, kerangka hukum anti-terorisme telah memuat ketentuan-ketentuan yang secara umum juga diterima oleh berbagai negara. Pasca Bom Bali tahun 2002, lahirlah Peraturan Pengganti Undang-Undang (Perpu) No. 1/2002 tentang Pemberantasan Tindak Pidana Terorisme dan Perpu No. 2/2002 yang memberlakukan surut Perpu 1/2002 untuk peristiwa Bom Bali. Dua Perpu itu kemudian diterima menjadi Undang-Undang (UU) oleh Dewan Perwakilan Rakyat (DPR) dalam bentuk UU No. 15/2003 dan UU 15/2003. Mahkamah Konstitusi memutuskan bahwa ketentuan pemberlakuan surut itu bertentangan dengan asas non-retroaktif yang tercantum dalam Undang-Undang Dasar 1945 khususnya Pasal 28I.

Abstract

This research aims to identify law enforcement efforts in controlling and empowering idle land in Nusa Tenggara Barat. Result shows that National Land Agency and government have issued numerous legal instruments to address this problem. However, they are hindered by the weak regulations and various economic, social, and political conditions.  Penelitian ini bertujuan menemukan upaya pemberdayaan hukum dalam menertibkan dan mendayagunakan tanah telantar di Nusa Tenggara Barat. Hasil penelitian menunjukkan bahwa Badan Pertanahan Nasional dan pemerintah telah menerbitkan berbagai instrumen hukum untuk menjawab permasalahan ini. Akan tetapi, instrumen-instrumen ini terhambat oleh lemahnya peraturan dan berbagai kondisi ekonomi, sosial, dan politik.

Abstract

AbstractThis research aims to examine the positions of international law and the applicable principles regarding the issues of fulfillment of international obligations under ratified/acceded international agreements by Indonesia. Upon assessment, this research concludes that: Firstly, there are two main obligations that should be fulfilled by Indonesia in an international agreement and treaties, which is legal obligation and moral obligation. Secondly, practices shown that Indonesia’s commitments in fulfilling its international obligation are still not optimal, as a solution, it is recommended that future ratification of international agreement should include additional executorial / performance provision either in the form of Law or Presidential Regulation.IntisariPenelitian ini bertujuan untuk mengetahui bagaimana ketentuan hukum internasional mengatur persoalan kewajiban hukum negara terhadap pemenuhan perjanjian internasional yang telah diratifikasi/diaksesi dan untuk mengetahui bagaimana praktik yang Indonesia terkait pemenuhan kewajiban tersebut. Hasil pembahasan menunjukkan bahwa: Pertama, bahwa terdapat 2 kewajiban yang harus dilakukan oleh setiap negara pihak terkait dengan pemenuhan Perjanjian Internasional yakni kewajiban hukum dan kewajiban moral. Kedua, bahwa praktik pelaksanaan kewajiban pemenuhan Perjanjian Internasional di Indonesia masih kurang optimal dan sebagai solusinya dapat ditambahkan beberapa penegasan untuk pemenuhan berbagai kewajiban tersebut dalam bentuk penambahan klausula dalam produk pengesahan perjanjian internasional baik yang berupa Undang­Undang Ratifikasi maupun Peraturan Presiden.
