Indonesia have regulated the trafficking since the Criminal Code (KUHP) era, the Act 39 of 1999 concerning Human Rights, the Act 23 of 2002 about Protection Child until currently we have the Act 21 of 2007 concerning Trafficking in Persons. However, the trafficking in persons cases increase dramatically and the law enforcement of trafficiking in persons was not function well. There are caused by some factors such as: the lack of sanction, the lack awareness of society, lack socialization of Trafficking in persons, and lack of victim awareness reporting the trafficking in person’s case to the police. From the social perspetive, the poor condition of the victim also become crusial factor caused weak of the law enforcement of trafficking in persons. Trafficking in persons in reality is not only breaking the Act 21 of 2007 and others trafficking in persons regulation but also tend to against the principle humiliated standard and human dignity and against of the human rights.

One of the fundamental changes on judicial power in the third amendment of UUD 1945 is the distributionof judicial review power to Supreme Court and Constitutional Court. The Supreme Court has the highestjurisdiction to execute the cassation cases and authority to review inferior regulations under law. TheConstitutional Court has the power to review laws against UUD 1945. Unfortunately, the judicial reviewmodel has several potential problems which can ruin the implementation of legal principles. That is whysome changes have to be taken. Salah satu poin mendasar dari penataan kekuasaan kehakiman pada perubahan ketiga UUD NRI Tahun1945 adalah dilakukannya pengaturan kewenangan judicial review atau hak menguji yang dijalankan oleh lembaga pelaksana kekuasaan kehakiman, yaitu Mahkamah Agung dan Mahkamah Konstitusi. Mahkamah Agung berwenang mengadili pada tingkat kasasi, menguji peraturan perundang-undangan di bawah Undang-Undang terhadap Undang-Undang, sedangkan Mahkamah Konstitusi berwenang menguji Undang-Undang terhadap Undang-Undang Dasar. Namun ternyata model kewenangan judicial review semacam ini rentan melahirkan persoalan hukum yang dapat merusak pilar-pilar hukum, sehingga perlu dilakukan penataan ulang.

Terrorism has become the most serious issue in Indonesia after terrorist attacks in Bali, November 2002. With the current condition where Indonesia still faces a key risk of new militant attacks with new cells and more bomb experts, this paper aims to analyse the way Indonesian government fight against terrorism. Terorisme adalah permasalahan yang sangat serius di Indonesia, pasca serangan bom di Bali pada November 2002. Dengan keadaan sekarang di mana Indonesia masih menghadapi permasalahan serius serangan militan dengan jaringan baru dan lebih banyak ahli bom, tulisan ini bertujuan menganalisis cara yang ditempuh pemerintah untuk melakukan penanggulangan tindak pidana terorisme.

The result of this research indicates that the rights and obligations of abdi dalem in Kraton Yogyakarta have varieties, it depends on their status and function in the government of Kraton Yogyakarta. Some consideration or motivation to be abdi dalem kraton which are taking part in feeling kraton owned, maintaining of kraton culture, alive to be more meaningful, continuing of tradition from generation to the other, a tool of maintaining to magersari right or obtain the sultan’s blessing.

This research was conducted to identify the values of Pancasila in business activities with case studies of cooperation and limited liability company in Indonesia. This research is a socio-legal studies that discuss the relationship values of Pancasila as the nation’s philosophy of life and economic law as the legal basis for the development of business activities in Indonesia. The results showed values of Pancasila very relevant to be applied in business activities, most of which have been accommodated in the laws and regulations governing business activities in Indonesia, but there are also some content of value that has not been accommodated. Penelitian ini dilakukan untuk mengidentifikasi tata nilai Pancasila dalam kegiatan usaha dengan studi kasus koperasi & perseroan terbatas di Indonesia. Penelitian ini merupakan kajian sosio-legal yang membahas keterkaitan nilai-nilai Pancasila sebagai falsafah hidup bangsa dan hukum ekonomi sebagai landasan bagi pembangunan hukum kegiatan usaha di Indonesia. Hasil penelitian menunjukkan nilai-nilai Pancasila sangat relevan untuk diterapkan dalam kegiatan usaha, yang sebagian besarnya telah diakomodir dalam peraturan perundang-undangan yang mengatur kegiatan usaha di Indonesia, namun terdapat pula beberapa kandungan nilai yang belum terakomodir.

Standard of proof in law-finding process is a crucial step. After the occurence of a concrete event has been proven, the judge then will be able to acquire the truth regarding that disputed event. Then, he will qualify the event into a legal issue by finding the relevant applicable law. Pembuktian dalam proses penemuan hukum adalah tahapan yang sangat penting. Apabila peristiwa konkret sudah dibuktikan, hakim akan memperoleh kebenaran mengenai peristiwa yang disengketakan tersebut. Kemudian, hakim akan mengkualifikasi peristiwa tersebut menjadi peristiwa hukum dengan cara mencari peraturan hukum yang relevan untuk diterapkan.

Terrorism seems to be accepted as a grave act of international concern, but has not yet been accommodated explicitly in the International Criminal Court (ICC). This article explores the prospect of including terrorism under the crime of aggression in cases transcending boundaries, by examining whether terrorism can fit into its’ elements. While terrorism can be conducted by state and non-state actors, it will be shown that it is possible for states committing terrorism to have their officials prosecuted for the crime of aggression. For the more infamous terrorism by non-state actors, however, do not seem to satisfy the required elements. Terorisme sudah diterima sebagai kejahatan yang menjadi perhatian internasional, tetapi belum diakomodasi secara eksplisit dalam hukum pidana internasional melalui Mahkamah Pidana Internasional (ICC). Artikel ini akan mengamati kemungkinan memasukkan terorisme dalam tindak pidana agresi, terutama dalam kasus terorisme yang melampaui batas-batas Negara. Artikel ini akan mengamati konsep tindak pidana agresi dalam Statuta Roma, dan melihat apakah terorisme dapat memenuhi unsur-unsurnya. Ternyata walaupun terorisme oleh actor non-negara lebih terkenal, tapi konsep terorisme dapat memuat terorisme oleh Negara juga. Akan dijelaskan bagaimana kejahatan agresi bisa jadi dikenakan pada terorisme oleh Negara, tetapi justru tidak pada terorisme oleh aktor non-negara.

AbstractThe concept of Indonesian in Indonesia Legal Ideology Perspective is the concept of Indonesian as holistic unity which has physical and psychological nature. Indonesian shall be human who lives based on Pancasila values and lives based on the law where Pancasila is the ideology. Epistemological truth of Indonesian is human who believes in God, well behaved to others and to the world. The purpose of Indonesian is to live harmoniously with himself / herself, with the world, and with God; therefore, Indonesian can live peacefully and happily. IntisariKonsepsi manusia Indonesia dalam perspektif Ideologi Hukum Indonesia adalah konsep bahwa manusia Indonesia merupakan kesatuan holistik yang bersifat batin dan lahir dari manusia itu sendiri. Manusia Indonesia adalah manusia yang hidup berlandaskan nilai yang terkandung dalam Pancasila dan hidup berdasarkan hukum yang berideologi Pancasila. Kebenaran epistimologi manusia Indonesia adalah manusia yang bertakwa kepada Tuhan yang Maha Esa dan berperilaku baik pada sesamanya dan alam semesta. Tujuan dari manusia Indonesia adalah untuk dapat hidup serasi dengan dirinya sendiri, dengan alam, dan dengan Tuhan yang Maha Esa, sehingga manusia Indonesia dapat hidup dengan penuh kedamaian dan kebahagiaan.

This article discusses about the Askes Workers rights protection after `dissolution without liquidation of PT. Askes (Persero), which The Askes Workers turned to BPJS Kesehatan workers. This research is yuridis normative by using secondary data. The results showed that the workers’ rights protection after dissolution based on Law No.13 of 2003 and The Employment Agreement between Workers with PT. Askes (Persero). The workers’ rights changes in BPJS Kesehatan requires the worker approval. Industrial disputes can be resolved through bipartite mechanism, non-litigation and litigation. Artikel ini membahas tentang perlindungan hak pekerja Askes pasca pembubaran PT Askes (Persero) tanpa likuidasi dimana pekerja Askes beralih menjadi Pekerja BPJS Kesehatan. Penelitian ini bersifat yuridis normatif yang menggunakan data sekunder. Hasil penelitian menunjukkan bahwa perlindungan hak-hak pekerja Askes pasca pembubaran PT Askes (Persero) berdasarkan UU No. 13 Tahun 2003 dan Perjanjian Kerja antara Pekerja dengan PT Askes (Persero) dimana perubahan hak-hak pekerja memerlukan persetujuan dari Pekerja. Perselisihan hubungan industrial dapat timbul akibat pembubaran PT Askes (Persero) dapat diselesaikan melalui mekanisme bipartit, non litigasi maupun litigasi.
