ABSTRACTIn the provisions of Article 240 paragraph (1) letter g of Law Number 7 of 2017 concerning Elections and Article 7 paragraph (1) letter g of General Election Commission Regulation Number 20 of 2018 concerning Nomination of Members of the People's Representative Council, Provincial Regional People's Representative Council, and Regency/City Regional People's Representative Council, there is a provision which states that all prospective members of the DPR, Provincial DPRD, and Regency/City DPRD must fulfill the requirement of "never being sentenced to prison based on a court decision that has obtained permanent legal force for committing a criminal offense that is threatened with a prison sentence of 5 (five) years or more, unless openly and honestly stating to the public that the person concerned is a former convict." Proof that prospective members of the DPR, Provincial DPRD and Regency/City DPRD have never been convicted based on a court decision that has permanent legal force which is punishable by imprisonment for 5 (five) years or more by attaching a Police Record Certificate (SKCK). Police records are written records maintained by the National Police regarding someone who has committed an unlawful act or violated the law or is currently in the process of being prosecuted for an act he or she has committed. In practice, the SKCK is still issued by the Police, even though the applicant is a former prisoner who has been handed down a court decision that has permanent legal force and is threatened with imprisonment for 5 (five) years or more. In fact, the SKCK states that the person concerned has never been a convict. Meanwhile, the criminal records of former convicts are only police records which are stored in the Police database and are archived only. In fact, the provisions of Article 15 paragraph (2) letter b number 2 of the Republic of Indonesia State Police Regulation Number 6 of 2023 concerning the Issuance of Police Record Certificates (SKCK) clearly require that applicants have police records written down about the legal status, type and article of the criminal act committed. . This of course raises legal problems because prospective legislative members who have been convicted will be declared to have passed verification by the General Election Commission (KPU). The factor that causes the Police to issue an SKCK for legislative member candidates who have been convicted based on a judge's decision with permanent legal force in the jurisdiction of the Pontianak Police is because they want to maintain good relations with the head of the political party who is nominating a candidate for legislative member who has been a convict based on a judge's decision with permanent legal force and is not wants to hinder the opportunity for prospective legislative members to obtain an SKCK, even though the prospective legislative member who submitted the SKCK application was once a convict based on a judge's decision with permanent legal force. ABSTRAK Dalam ketentuan Pasal 240 ayat (1) huruf g Undang-Undang Nomor 7 Tahun 2017 tentang Pemilu dan Pasal 7 ayat (1) huruf g Peraturan Komisi Pemilihan Umum Nomor 20 Tahun 2018 tentang Pencalonan Anggota Dewan Perwakilan Rakyat, Dewan Perwakilan Rakyat Daerah Provinsi, dan Dewan Perwakilan Rakyat Daerah Kabupaten/Kota, terdapat ketentuan yang menyatakan bahwa semua bakal calon anggota DPR, DPRD Provinsi, dan DPRD Kabupaten/Kota harus memenuhi persyaratan "tidak pernah dipidana penjara berdasarkan putusan pengadilan yang telah memperoleh kekuatan hukum tetap karena melakukan tindak pidana yang diancam dengan pidana penjara 5 (lima) tahun atau lebih, kecuali secara terbuka dan jujur mengemukakan kepada publik bahwa yang bersangkutan mantan terpidana". Bukti bahwa bakal calon anggota DPR, DPRD Provinsi, dan DPRD Kabupaten/Kota tidak pernah sebagai terpidana berdasarkan putusan pengadilan yang telah memperoleh kekuatan hukum tetap yang diancam dengan pidana penjara 5 (lima) tahun atau lebih dengan melampirkan Surat Keterangan Catatan Kepolisian (SKCK). Catatan Kepolisian adalah catatan tertulis yang diselenggarakan oleh Polri terhadap seseorang yang pernah melakukan perbuatan melawan hukum atau melanggar hukum atau sedang dalam proses peradilan atas perbuatan yang dia lakukan. Dalam praktiknya, SKCK tetap diterbitkan oleh Kepolisian, walaupun yang mengajukan adalah mantan narapidana yang dijatuhkan putusan pengadilan yang telah memperoleh kekuatan hukum tetap yang diancam dengan pidana penjara 5 (lima) tahun atau lebih. Bahkan, di dalam SKCK tercantum bahwa yang bersangkutan tidak pernah sebagai terpidana. Sedangkan catatan kriminal mantan narapidana tersebut hanya sebagai catatan kepolisian yang tersimpan di dalam database Kepolisian dan menjadi arsip saja. Padahal di dalam ketentuan Pasal 15 ayat (2) huruf b angka 2 Peraturan Kepolisian Negara Republik Indonesia Nomor 6 Tahun 2023 tentang Penerbitan Surat Keterangan Catatan Kepolisian (SKCK) secara jelas mengharuskan pemohon memiliki catatan kepolisian dituliskan status hukum, jenis dan pasal tindak pidana yang dilakukan. Hal ini tentu saja menimbulkan masalah hukum karena calon anggota legislatif yang pernah sebagai terpidana akan dinyatakan lolos verifikasi oleh Komisi Pemilihan Umum (KPU). Faktor penyebab Kepolisian menerbitkan SKCK terhadap calon anggota legislatif yang pernah menjadi terpidana berdasarkan putusan hakim berkekuatan hukum tetap di wilayah hukum Polresta Pontianak dikarenakan ingin menjaga hubungan baik dengan ketua partai politik yang mengusung calon anggota legislatif yang pernah menjadi terpidana berdasarkan putusan hakim berkekuatan hukum tetap dan tidak ingin menghambat kesempatan bagi calon anggota legislatif dalam memperoleh SKCK, walaupun calon anggota legislatif yang mengajukan permohonan SKCK pernah menjadi terpidana berdasarkan putusan hakim berkekuatan hukum tetap. Upaya yang dapat dilakukan oleh Kepolisian agar calon anggota legislatif yang pernah menjadi terpidana berdasarkan putusan hakim berkekuatan hukum tetap di wilayah hukum Polresta Pontianak tidak diterbitkan Surat Keterangan Catatan Kepolisian (SKCK), tetap mencantumkan catatan kriminal dari calon anggota legislatif yang pernah menjadi terpidana berdasarkan putusan hakim berkekuatan hukum tetap, tanpa harus mempertimbangkan hubungan baik dengan ketua partai politik yang mengusung calon anggota legislatif yang pernah menjadi terpidana karena sudah menjadi aturan hukum.
