Abstract

 The regulation of human rights in the Indonesian constitution, the 1945 Constitution can be interpreted as an effort of citizens to guarantee their protection in the law, so that the constitution can serve as a legal instrument to warn the government not to violate the human rights that have been imposed in the constitution. It is recognized that the protection of human rights is a requirement of the state law, which has been pinned on the Republic of Indonesia. then the protection. Concepts, thoughts and ideas about human rights in Indonesia's constitution have been the pros and cons since the beginning of independence. Certain community groups consider that the human rights contained in the Indonesian constitution are a Western human rights concept that must be rejected because they contain individualistic values and are far from local, religious, especially Islamic values. If more closely scrutinized human rights arrangements in the Indonesian constitution contain Islamic values, characterized by justice, usefulness and public interest; the values contained in the holy book of the Qur'an and the Medina Charter are also recognized as the world's human rights charter. This human rights regulation is closely related to the objectives of Islamic law, namely "maqashid shari'ah" whose existence to protect the five things of religion, soul, mind, descent and property.

Abstract

The era of the economy globalization is a movement that has a nationalism dimension because infinite flows of investment and capital that begin to penetrate the strategic sector economically result in fundamental problems given that this strategic sector is related to the livelihoods of the people (the basic needs of citizens) that demand protection from the state. In the field of water management that is not spared from the current globalization of the economy it has a complicated problem because the policies in the exploitation of water are considered to be contrary to the 1945 Constitution. The peak, with the issuance of Constitutional Court Decision Number 85 / PUU-XI / 2013 which decided to reject the entire contents of Law Number 7 of 2004 so that it essentially returns the exploitation of this water to the state. This writing is a conceptual legal thought that aims to find answers to the regulation of water management in Law Number 7 of 2004 concerning Water Resources contradicts the 1945 Constitution, and seeks the concept of good water regulation that can be used as a means of protection for citizens in the era of economic globalization after Law Number 7 of 2004. The results of the discussion concluded that Law Number 7 of 2004 concerning Water Resources denies the 1945 Constitution because in terms of law enforcement both ideally and normatively it has lost the constitutive elements of the enactment of a law. Meanwhile, the concept of good water regulation as an effort to protect citizens in the era of economic globalization after Law No. 7 of 2004 is regulation that adheres to the state ideology, and are able to respond to global pressures and challenges, namely with efforts to harmonize the law in the field of water.

Abstract

Television as one of mass media, other than as a source of information for the public, in the other hand can be used also as a promotional media especially in this case during the election of regional head. The role of television as a source of information, can affect a person (voter) in determining his choice, so that the television stations should be able to maintain its neutrality. However, the existence of television stations that favor one of the candidates is very likely to occur especially in the election of regional heads that attracted a lot of public attention, one of them in the election of regional head in Jakarta. This research type is normative juridical research, and the data used for this research are some legislations, documents and books relating elections and broadcasting.The result of this research revealed that there is still any television stations that favor to one of the candidates in political contestation (election of regional head) in Jakarta, so that those television stations got warning from Indonesian Broadcasting Commission (KPI), but the current legislation regarding broadcasting was deemed necessary to revision regarding KPI's authority as well as on tougher punishment on television providers that proven to have committed such violations, so that the imposition of sanctions can be more effective.

Abstract

Carok is a social reality for the Madurese whose existence is still recognized today. The essence of Carok is more closely related to Madurese cultural values, where Carok is based on the fact that the Madurese have experienced the so-called "Malo", this feeling is caused by the Madurese feeling that their self-esteem is being harassed so as to defend the abused self-esteem then the Madurese do Carok. Law enforcement on Carok can not only be done with a positivistic approach with the nature of rigidity and see that Carok is a black and white subject matter as set forth in the Criminal Code (Criminal Code), if Carok is solved only through criminal law mechanism then no wonder then when the Carok-Carok takes place, the way through the penal law can never touch the nature of Carok, why the Madurese do Carok, and what Carok means and the defense of self-esteem for the Madurese. This research is a normative legal research, the data source used in this study is in the form of secondary data, namely books, journals, legislation, documents and other writings relating to the problem being studied. This study aims to find the law in concreto that is an attempt to find out whether the law that is suitable to be implemented in reality is carried out or obeyed by the community in relation to the settlement of Carok, the data processing method is to use qualitative methods and data analysis is deductive. Based on the results of the study, it is known that the Carok settlement model is based on the way of judging Madurese is different from the settlement model provided by the law of the country where the way of judging Madurese is a cultural approach so that Carok as a problem that comes from culture can be resolved and muted, then the presence of criminal law as the last effort (ultimum remedium) is deemed necessary after it is first settled based on how to enact the Madurese.

Abstract

Abstract The land border for Indonesia and Timor Leste has a strategic and important meaning, for Indonesia the border region is the front page and the face of the Indonesian Nation. In this paper will explain the history and function of land border between Indonesia and Timor Leste. Indonesia and Timor-Leste have a long history of borders, before independence of Timor-Leste's border with Indonesia is not the case because Timor-Leste is still part of Indonesia but after Timor-Leste's independence, the two countries must set boundaries. This is important because the border has a function that can maintain security and create prosperity on each border of both countries.  Abstrak Perbatasan darat bagi Indonesia dan Timor Leste memiliki makna yang strategis dan penting, bagi Indonesia wilayah perbatasan merupakan halaman depan dan wajah dari Bangsa Indonesia. Dalam tulisan ini akan menjelaskan tentang sejarah dan fungsi perbatasan darat antara Indonesia dan Timor Leste. Indonesia dan Timor Leste memiliki sejarah panjang dalam hal perbatasan, sebelum merdeka perbatasan Timor Leste dengan Indonesia tidak menjadi permasalahan hal ini dikarenakan Timor Leste masih menjadi bagian dari Indonesia akan tetapi setelah Timor Leste merdeka, kedua negara harus menentukan batas-batas wilayahnya. Ini penting karena perbatasan memiliki fungsi yang dapat menjaga keamanan serta menciptakan kesejahteraan di perbatasan masing-masing kedua negara.

Abstract

The public prosecutor is not required to prosecute a person committing an offense if at his discretion, if the person prosecuted can harm the public interest. No prosecution of a person committing a crime in the public interest, known as deponering whose authority resides with the Attorney General under Article 35 Sub-Article c of Law Number 16 Year 2004 regarding the Attorney of the Republic of Indonesia. In addition to the authority of deponering, the Attorney General is also authorized to stop prosecution under Article 144 paragraph (1) of Law Number 8 Year 1981 regarding Criminal Procedure Law which is manifested in the form of Prosecution Cessation Decree (SKP2). Starting from the authority to stop prosecution owned by the Attorney there are problems, namely: (1). When the Attorney's Office actually stop prosecuting a case in the criminal justice system and is it appropriate that the Attorney's Office issued SKP2 in case the case has been registered in the district court? (2). How to overcome the problems that arise against the issuance of SKP2 by the Attorney in case the case has been registered in the district court. The study is directed to the SKP2 case study in the Novel Baswedan case. Based on the results of the study can be concluded: (1). The Attorney's Office issued SKP2 in the Novel Baswedan case with insufficient consideration of the evidence and the case was closed by law and the Public Prosecutor's Office did not properly issue SKP2 when the case was registered in the district court. (2). to solve the problems arising from SKP2 issued by the Attorney there has been a pre-trial decision stating SKP2 is not valid, it must be resolved through the criminal justice system to obtain legal certainty.

Abstract

AbstractThe creative industry as one of the pillars of the future economy has a very strategic role in overcoming the problems faced by the community along with the government, especially in the field of employment, business fields, and as a source of state revenue (GDP). Therefore, creative industry entrepreneurs must be protected by their intellectual rights so that all copyrighted works are legally protected by their existence and not arbitrarily anyone can steal, trade, multiply without the permission of the owner. However apparently only 17% of the 16.7 million creative industry players registered the results of their creativity. This shows that the protection of Intellectual Property Rights towards the creative industry is still very weak due to several factors, namely; Lack of public awareness / creative industry players to register their creativity businesses; Lack / lack of understanding of the community / industry players regarding the protection of Intellectual Property Rights (IPR); The presumption of some people / creative industry players for the management of registration of Intellectual Property Rights requires quite a large fee; The registration process takes a long time and is complicated. AbstrakIndustri kreatif sebagai salah satu pilar ekonomi masa depan memiliki peran yang sangat strategis dalam mengatasi masalah-masalah yang dihadapi oleh masyarakat bersama pemerintah, terutama di bidang ketenagakerjaan, bidang usaha, dan sebagai sumber penerimaan negara (PDB) . Oleh karena itu, pengusaha industri kreatif harus dilindungi oleh hak intelektual mereka sehingga semua karya cipta dilindungi secara hukum oleh keberadaan mereka dan tidak sewenang-wenang siapa pun dapat mencuri, berdagang, berkembang biak tanpa izin dari pemiliknya. Namun ternyata hanya 17% dari 16,7 juta pelaku industri kreatif yang mendaftarkan hasil kreativitas mereka. Ini menunjukkan bahwa perlindungan Hak Kekayaan Intelektual terhadap industri kreatif masih sangat lemah karena beberapa faktor, yaitu; Kurangnya kesadaran publik / pelaku industri kreatif untuk mendaftarkan bisnis kreativitas mereka; Kurangnya / kurangnya pemahaman tentang komunitas / pemain industri mengenai perlindungan Hak Kekayaan Intelektual (HKI); Anggapan sebagian orang / pelaku industri kreatif untuk pengelolaan pendaftaran Hak Kekayaan Intelektual membutuhkan biaya yang cukup besar; Proses pendaftaran memakan waktu lama dan rumit.

Abstract

Abstract The national legislation program makes Pancasila the source of all sources of law and as the basis of the state based on the philosophy and values of Pancasila animates and influences the process of legislation formation. In the research, the author using normative legal research method. But the fact that legislation generated through the process of formulating legislation has not provided a guarantee of justice and welfare for the people, so that the resulting law is still far from the goal of realizing  prosperity for all Indonesian people.  Abstrak Program legislasi nasional menjadikan Pancasila sebagai sumber dari segala sumber hukum  dan sebagai dasar negara yang berpedoman Pada falsafah dan nilai-nilai pancasila menjiwai dan     mempengaruhi proses pembentukan legislasi. Di dalam penelitian ini menggunakan metode          penelitian hukum normatif. Hasil penelitian ini menunjukkan bahwa  kenyataannya legislasi yang   dihasilkan melalui proses pembentukan peraturan perundang-undangan belum memberikan jaminan keadilan dan kesejahteraan bagi rakyat, sehingga undang-undang yang dihasilkan masih jauh dari cita-cita yaitu mewujudkan kesejahteraan bagi seluruh rakyat indonesia.

Abstract

AbstractOne of the major changes in case management carried out by the Supreme Court is the promulgation of the Supreme Court Regulation Number 3 of 2018 concerning Administration of Case in Court Electronically. Electronic Justice as stipulated in Supreme Court Regulation Number 3 of 2018 this is an attempt by the Supreme Court to address complaints in case management which is slow and long-winded trials, costly, difficulty for access to justice, until the low integrity of the judicial apparatus due to the opening of opportunities for maladministration in conventional (non-electronic) judicial implementation. As an institution that just runs, Electronic Justice is found several      problems, one of them is disharmony with the regulation of procedural law as stipulated in  egulation Number 5 of 1986, imperfect case administration, until the coverage of electronic justice which only covers lawsuit cases in the Administrative Court, cannot be applied to the Appellate Court or Cassation and Review. Based on these problems, this normative law research was carried out, the result of which was the need to issue a Standard Operating Procedure for Electronic Justice in the State Administrative Court and revise the Supreme Court Regulation Number 3 of 2018 by arranging case audits of Appeals, Cassation and Review are carried out electronically.  AbstrakSalah satu perubahan besar dalam manajemen perkara yang dilaksanakan olehMahkamah Agung adalah pengundangan Peraturan Mahkamah Agung Nomor 3 Tahun 2018 tentang Administrasi Perkara Di Pengadilan Secara Elektronik. Peradilan secara elektronik sebagaimana diatur dalam Peraturan Mahkamah Agung Nomor 3 Tahun 2018 ini merupakan upaya Mahkamah Agung guna mengatasi keluhan dalam manajemen perkara di pengadilan yang lambat dan bertele-tele, berbiaya mahal, sulitnya akses masyarakat untuk memperoleh keadilan, hingga rendahnya integritas aparatur peradilan akibat terbukanya peluang maladministrasi dalam pelaksanaan peradilan secara konvensional (non elektronik). Sebagai lembaga yang baru berjalan, pada Peradilan secara elektronik dijumpai beberapa permasalahan, antara lain disharmonisasi dengan pengaturan Hukum Acara sebagaimana diatur dalam Undang-Undang Nomor 5 Tahun 1986, Administrasi Perkara yang belum sempurna, hingga cakupan Peradilan secara elektronik yang hanya meliputi perkara Gugatan pada Pengadilan Tata Usaha Negara, belum dapat diterapkan pada peradilan tingkat Banding maupun Kasasi dan Peninjauan Kembali. Berdasarkan permasalahan tersebut, dilakukanlah penelitian hukum normatif ini, yang hasilnya adalah perlu diterbitkannya Standar Operasional Prosedur pada Peradilan secara elektronik di Pengadilan Tata Usaha Negara dan melakukan revisi atas Peraturan Mahkamah Agung Nomor 3 Tahun 2018 dengan mengatur pemeriksaan perkara Banding, Kasasi dan     Peninjauan Kembali dilaksanakan melalui Peradilan secara elektronik.

Abstract

Abstract Today, businesses in industry and technology are faced with increasingly keen competition challenges. Business in industry and technology can be done by way of technology transfer, which is expected to increase on the absorption of investment and the provision of employment. For that very necessary regulation that can support the investment climate and technology transfer such as Patent law. Not only oriented inward with the spirit of nationalism but also must globalize or in accordance with international regulations in order to avoid clash with other countries. The purpose of this study is to examine the protection of patent application rights in Technology Transfer and Investment Absorption in Indonesia. This research method is normative juridical. This approach is the legal, conceptual and historical approach. This research includes descriptive research, Data used in this research is primary data and secondary data source. Data analysis techniques, which use is qualitative normative descriptive analysis. The results of this study can be seen that there are several Articles in the Law No.13 Year 2016 on Patents that have a high spirit of nationalism that is expected to improve technological progress and increase investment in Indonesia but it is contrary to international law or agreement TRIPs, among them is Article 20, Article 4, Article 78 and Article 120. The Articles are contradictory to Article 27 TRIPs, it is necessary to amend the rules of Patent through the Act and the implementing regulations under it and to make qualification and classification of the products are required to make or use the process in Indonesia so as to appeal to domestic and foreign investors from abroad to invest their capital and bring patent technology to Indonesia.  AbstrakSaat ini, bisnis di industri dan teknologi dihadapkan pada tantangan persaingan yang semakin tajam. Bisnis dalam industri dan teknologi dapat dilakukan dengan cara transfer teknologi, yang diharapkan dapat meningkatkan penyerapan investasi dan penyediaan lapangan kerja. Untuk itu sangat diperlukan regulasi yang dapat mendukung iklim investasi dan alih teknologi seperti hukum paten. Tidak hanya berorientasi ke dalam dengan semangat nasionalisme tetapi juga harus mengglobal atau sesuai dengan peraturan internasional untuk menghindari bentrokan dengan negara lain. Tujuan dari penelitian ini adalah untuk menguji perlindungan hak paten dalam transfer teknologi dan penyerapan investasi di Indonesia. Metode penelitian ini adalah yuridis normatif. Pendekatan ini adalah pendekatan hukum, konseptual, dan historis. Penelitian ini termasuk penelitian deskriptif, data yang digunakan dalam penelitian ini adalah data primer dan sumber data sekunder. Teknik analisis data, yang digunakan adalah analisis deskriptif normatif kualitatif. Hasil penelitian ini dapat dilihat bahwa ada beberapa Pasal dalam UU No.13 Tahun 2016 tentang Paten yang memiliki semangat nasionalisme tinggi yang diharapkan dapat meningkatkan kemajuan teknologi dan meningkatkan investasi di Indonesia tetapi bertentangan dengan hukum internasional atau perjanjian TRIPs, di antaranya adalah Pasal 20, Pasal 4, Pasal 78 dan Pasal 120. Pasa-pasal tersebut bertentangan dengan Pasal 27 TRIPs, perlu untuk mengubah aturan paten melalui Undang-Undang dan peraturan pelaksanaan di bawahnya dan untuk membuat kualifikasi dan klasifikasi produk diperlukan untuk membuat atau menggunakan proses di Indonesia untuk menarik investor domestik dan asing dari luar negeri untuk menginvestasikan modalnya dan membawa teknologi paten ke Indonesia.
