Abstract

The basis for land ownership can be in the form of a Sale Purchase Deed, a Will or a Grant through the transfer of rights to land or goods first. However, the sale and purchase agreement exists as an alternative to buying and selling between the parties, which can be done through a private deed or can also be done through a deed drawn up before a notary. The deed of sale and purchase binding is often referred to in the form of an authentic deed drawn up before an authorized official, either a Notary or a Land Deed Making Officer (PPAT) who has valid evidentiary powers. Every agreement entered into by the parties must be carried out in accordance with their abilities and in good faith, so that all the rights and obligations of each party stipulated in the agreement can be fulfilled perfectly. This is an ideal implementation of the agreement for the parties involved. In the community there are still many problems in the cancellation of the land sale and purchase binding agreement deed and the settlement process. These problems may arise due to differences in interpretation, lack of understanding between one party and another, as well as disputes because one party cannot comply. If the problems in the agreement cannot be resolved by way of deliberation, litigation and alternative dispute resolution, then the settlement of problems in the agreement can be done by canceling the agreement based on the applicable law. Abstrak Dasar kepemilikan tanah bisa di dapat berupa Akta Jual Beli, Wasiat atau Hibah yang melalui pemindahan hak atas tanah atau barang-barang terlebih dahulu. Namun pengikatan jual beli hadir sebagai alternatif jual beli antara para pihak dapat melalui akta dibawah tangan atau dapat pula dilakukan melalui suatu akta yang dibuat dihadapan notaris. Akta pengikatan jual beli sering disebut dalam bentuk akta otentik yang dibuat dihadapan pejabat yang berwenang baik Notaris ataupun Pejabat Pembuat Akta Tanah (PPAT) yang memiliki kekuatan pembuktian yang sah. Setiap perjanjian yang dibuat oleh para pihak harus dapat dilaksanakan sesuai dengan kemampuan dan dengan adanya itikad baik, sehingga segala hak dan kewajiban dari masing-masing pihak yang diatur dalam perjanjian tersebut dapat dipenuhi dengan sempurna. Hal ini merupakan pelaksanaan perjanjian yang ideal bagi pihak-pihak yang terkait. Di masyarakat masih banyak permasalahan dalam pembatalan akta perjanjian pengikatan jual beli tanah dan proses penyelesaiannya. Permasalahan tersebut mungkin muncul karena adanya perbedaan penafsiran, kurang kesepahaman antara para pihak yang satu dan yang lain, serta perselisihan karena salah satu pihak memang tidak dapat memenuhinya. Apabila permasalahan dalam perjanjian belum dapat diselesaikan dengan cara musyawarah, litigasi dan alternatif penyelesaian sengketa maka penyelesaian permasalahan dalam perjanjian dapat dilakukan pembatalan perjanjian berdasarkan undang-undang yang berlaku.

Abstract

In the absence of standards regarding the establishment of existing regional regulations in Indonesia related to public order by local governments which contain criminal sanctions, this creates deviations in terms of the principles of legal certainty for the community. This scientific article discusses the formation of criminal policies by regional governments that have the same cultural similarities and have the same basis for legitimacy. The research approach used is socio-legal, the related issue is regarding the study of criminal-policy legal issues and the locus of government of the Special Region of Yogyakarta. With the same cultural group, namely Mataraman in the formation of criminal policies. Based on the results of the research, it was found that the formation of the Tibum Regional Regulation in Yogyakarta shows the use of different legitimacy bases in the formation of its criminal policy. Differences in the determination of criminal sanctions for the object of the same regulation, for selling in prohibited areas, environmental pollution, erection of illegal buildings and others, the threat of administrative fines and imprisonment varies, with fines ranging from IDR 50,000,000 to imprisonment for around 6 month. The acceptance in complexiu of the living-law values ​​with their local wisdom in the formation of regional regulations in the field of public order was apparently nowhere to be found, so that the basis for the legitimacy of criminal-policy norms was built only on technocratic uptake. Abstrak Dengan tidak adanya standar mengenai pembentukan peraturan daerah yang ada di Indonesia terkait dengan tertib umum oleh pemerintah daerah yang bermuatan sanksi pidana, menimbulkan penyimpangan dalam hal asas-asa kepastian hukum bagi masyarakat. Artikel ilmiah ini membahas mengenai pembentukan criminal policy oleh pemerintahan daerah yang memiliki keserupaan kultur budaya yang sama memiliki dasar ukuran legitimasi yang sama. Pendekatan penelitian yang digunakan adalah socio-legal, isu terkai adalah mengenai kajian isu hukum criminal-policy dan lokus pemeritahan Daerah Istimewa Yogyakarta. Dengan keserumpunan  budaya yang sama yaitu Mataraman dalam pembentukan criminal-policy.  Berdasarkan kepada hasil penelitian didapat data bahwa pembentukan Peraturan Daerah Tibum di Yogyakarta menunjukkan penggunaan dasar legitimasi berbeda-beda dalam pembentukan criminal policy-nya. Perbedaan penetapan sanksi pidana pada obyek pengaturan yang sama, terhadap berjualan pada area terlarang, pencemaran lingkungan, pendirian bangunan liar dan lain-lainnya, ancaman denda administrasi maupun pidana kurungannya ternyata berbeda-beda dengan denda berkisar Rp50.000.000,- dengan pidana kurungan sekitar 6 bulan. Receptio in complexiu atas nilai-nilai the living-law dengan local wisdom-nya dalam pembentukan peraturan daerah bidang ketertiban umum ternyata tidak ada ditemukan, sehingga dasar legitimasi norma criminal-policy dibangun berdasarkan serapan teknokratis saja.

Abstract

The purpose of this study is to find out and analyze imposition of land and building rights (BPHTB) acquisition fees on the complete systematic land registration program (PTSL). Second, mechanism for the Transfer of complete systematic land registration (PTSL) certificates of ownership to mortgage rights if the certificate of ownership is pledged as collateral to the Bank. Therefore, from these objectives, 2 problem formulations were formulated in this research, namely: First, How is the imposition of land and building rights (BPHTB) acquisition fees on the complete systematic land registration program (PTSL)? Second, How is the mechanism for the Transfer of complete systematic land registration (PTSL) certificates of ownership to mortgage rights if the certificate of ownership is pledged as collateral to the Bank? The theories used in this research are the theory of legal certainty, and the theory of authority. In this study using a normative juridical research method (legal research) Abstrak Tujuan penelitian ini untuk mengetahui dan menganalisis Pengenaan Bea Perolehan Hak atas Tanah dan Bangunan (BPHTB) pada program Pendaftaran Tanah Sistematis Lengkap (PTSL) dan Mekanisme Peralihan Sertipikat Hak Milik Pendaftaran Tanah Sistematis Lengkap (PTSL) menjadi Hak Tanggungan apabila Sertipikat Hak Milik diagunkan ke Bank. Rumusan Masalah, Bagaimana Pengenaan Bea Perolehan Hak atas Tanah dan Bangunan (BPHTB) pada program Pendaftaran Tanah Sistematis Lengkap (PTSL)? Dan Mekanisme Peralihan Sertipikat Hak Milik Pendaftaran Tanah Sistematis Lengkap (PTSL) menjadi Hak Tanggungan apabila Sertipikat Hak Milik diagunkan ke Bank? Abstract

Penelitian ini bertujuan mengetahui Implikasi hukum akibat adanya perbedaan pemaknaan terhadap kata “para pihak” yang berhak menerima salinan akta pada pembuatan akta wasiat di Kabupaten Bantul. Penelitian ini termasuk dalam jenis penelitian yuridis-empiris untuk memecahkan masalah dengan cara meneliti data sekunder terlebih dahulu untuk dilanjutkan dengan mengadakan penelitian terhadap data primer yang didapat lapangan. Penelitian ini juga menggunakan jenis penelitian yuridis-normatifdengan mengkonsepkan aturan tertulis dalam peraturan perundang-undangan dan peraturan tersebut diterapkan didalam masyarakat sebagai pedoman berperilaku. Data yang didapatkan dari penelitiankepustakaan dan penelitian lapangan kemudian dianalisis untuk mencari penyelesaian terhadap permasalahan dengan analisis data secara kualitatif. Penelitian ini menggunakan metode berpikir secaradeduktif artinya cara bernalar dari umum ke khusus. Berdasarkan hasil penelitian dan pembahasan dapat diketahui bahwa pemaknaan “orang yang berhak” dalam menerima salinan akta pada pembuatan akta wasiat di Kabupaten Bantul sampai terjadi perbedaan dikarenakan ada dua perbedaan besar dalam penafsiran para pihak dalam penerimaan salinan akta wasiat, yaitu pemaknaan dalam artian sempit yang menyatakan bahwa para pihak yang dimaksud adalah mereka yang mempunyai kepentingan dengan akta tetapi mereka yang mempunyai hak atas akta. Sedangkan menurut pendapat dalam artian luas, menyatakan bahwa mereka yang bermaksud bagi siapa isi akta itu diperuntukkan bahwa mereka yang bermaksud bagi siapa ini isi akta itu diperuntukkan, yakni mereka yang menjadi pihak pada akta itu. Sekalipun mereka tidak ikut sebagai komparan (penghadap) dalam pembuatan akta yang bersangkutan. Akibat hukum yang terjadi dengan adanya perbedaan pemaknaan terhadap kata “orang yang berhak” dalam menerima salinan akta adalah perbedaan pemberian jumlah salinan akta, sehingga dapat menimbulkan ketidakpastian hukum dalam pelaksanaan jabatan notaris itu sendiri.

Abstract

Land issues in Indonesia are increasingly complex, throughout the 63 years of the UUPA as the main land regulation it has not been able to realize justice for land. The investment climate and development complexity caused by the plurality of social structures and overlapping land policies, especially since the issuance of the Job Creation Law, has now become Law no. 6 of 2023 concerning the stipulation of PERPU Law NO. 2 of 2022 concerning Job Creation becoming a law has a great influence on land law. The problem is how the political development of land law in Indonesia is developed and how to create a legal structure for control, ownership, use and exploitation of land that can fulfill the principles of justice and investment. This research is normative research with a statutory regulatory approach, a historical approach and a conceptual approach. The results of the research are that 1. the current development of land law politics tends to ignore the principles contained in the UUPA and deny agrarian reform. This is reflected in various land law regulations which give rise to ambiguity and multiple interpretations because the issuance of sectoral laws is driven by economic growth and investment and the emergence of various land conflicts at the empirical level 2. The legal structure of control, ownership, use and utilization of land can realize justice if it continues to pay attention to the principles enshrined by the UUPA, including the maximum use of land for the prosperity of the people. Suggestions, there is a need to review land law policies in the context of balancing control, ownership, use and utilization of land between providing justice for the community and facilitating investment.

Abstract

This study aims to examine how copyright buyers are protected in sold flat sale and purchase agreements after the publication of Article 18 of the Copyright Law number 28 of 2014, where the agreement expires after 25 years. Does the sale and purchase agreement remain valid according to the Civil Code so that the copyright buyer still gets the exclusive commercial rights. As well as how the perspective of a sold flat agreement is seen from the validity and protection of copyright buyers This research is a legal research that examines the perspective of laws related to sold flat agreements descriptively.

Abstract

The purpose of this paper is to identify and analyze the existence of agrarian reform in the current resolution of agrarian disputes. The existence of agrarian reform in the settlement of agrarian disputes has not fulfilled the expected goals. The continued increase in the number of agrarian dispute cases reflects that the existence of agrarian reform needs to be used as the basis for (national) economic development in Indonesia. In addition, it is very necessary to improve and evaluate the policies drafted after the UUPA, so that the objectives of agrarian reform can proceed as they should and can have a welfare impact on all levels of society.

Abstract

The purpose of this research is to analyze the handling of Sharia economic disputes, especially in cases of default in religious courts, and the source of the decision. This research shows that the settlement of sharia economic cases is regulated in Supreme Court Regulation (PERMA) Number 14 of 2016 concerning Procedures for Settling Sharia Economic Cases. Furthermore, Article 1243 of the Civil Code states, "Reimbursement of costs, losses, and interest for non-fulfillment of an obligation begins to be required if the debtor, even though it has been declared negligent, remains negligent to fulfill the obligation, or if something that must be given or done can only be given or done in a time that exceeds the time specified.". Thus, through the judge's decision, it is decided that defendants I and II, who have been officially and properly summoned, are not present at the trial, so it is considered that the allegations made by the plaintiff are true and that the defendant has defaulted. Stating that the decision of this case is declared to be executable in advance even though there is a verzet, punishing Defendant I and Defendant II to pay immediately and unconditionally the entire remaining debt to the Plaintiff in the amount of Rp. 112,600,000, unable to pay it, the land certificate will be auctioned to pay off the financing.

Abstract

This paper provides an overview of the legal dynamics and legal sanctions of customary marriage in the parental/bilateral kinship system against the Sundanese community. The approach method applied is in the form of normative juridical or literature law research. The research specifications used are descriptive analytical. Stages of research with literature research that uses primary legal materials, secondary legal materials, and tertiary legal materials. The data collection method is then carried out through literature studies and observations (observations). The method of data analysis is carried out in a qualitative juridical manner. The results showed that customary marriage law in the parental/bilateral kinship system for Sundanese people, including the Sundanese Community in Karawang Regency, applies kinship relations from husband and wife, and so on until their descendants' children later. The marriage is accompanied by a series of traditional marriage ceremony processions from before to after the marriage contract, although some still follow the whole and some adjust. The practice in the Karawang Regency community that a series of marriage customs if there are things that are considered lacking and not in accordance with the customs that should be sanctioned only comes from the surrounding response.

Abstract

This study discusses legal protection for investors against insider trading practices in the capital market based on Law Number 8 of 1995. Insider trading is an illegal action in which individuals use confidential information that is not yet publicly available in securities transactions. This research uses normative legal research or literature law research that focuses on analyzing the norms contained in laws and regulations as well as norms governing the capital market and insider trading aspects in it. The law provides for prohibitions and sanctions against insider trading actors, including the imposition of administrative, criminal, and civil sanctions. However, there are challenges in proving insider trading cases and legal loopholes that can be exploited by perpetrators. Firm and effective law enforcement against insider trading is important to maintain fairness and stability of the capital market and provide legal certainty for investors. This study identifies efforts that can be made to strengthen legal protection for investors and provides recommendations to improve the effectiveness of law enforcement against insider trading in the capital market.
