Abstract

The background of this research is the BPHTB collection system carried out by the Makassar City Regional Office for taxpayers including conducting comparisons of previous BPHTB prices, interviews with new taxpayers, comparisons with advertising prices for housing and making minutes of BPHTB tax determination resulting in the role of the taxpayer being passive. results in violating the self-assessment system. This research focuses on fulfilling the self-assessment system in collecting BPHTB. However, in reality this system has not been fully implemented due to dishonest taxpayers in notifying the actual transaction price. The purpose of this research is to find out and examine the effectiveness and implementation of the fulfillment of the self-assessment system in the BPHTB collection for buying and selling land and or buildings in Makassar City. The results of this study conclude first, the effectiveness of fulfilling the self-assessment system in collecting BPHTB for the sale and purchase of land and or buildings in Makassar City is seen based on the Makassar City BPHTB revenue data that the total target and realization of BPHTB taxes for the 2020 to 2022 fiscal year has decreased in realization of revenue from the target set. Second, the implementation of the fulfillment of the self-assessment system in collecting BPHTB for the sale and purchase of land and or buildings in Makassar City has not been implemented because the tax officer (Fiskus) still intervenes in determining the transaction price for BPHTB payments from taxpayers.

Abstract

This study aims to find out and analyze the reasons why the Joint Regional Supervisory Council does not carry out its obligations in examining community complaint reports and the next purpose is to find out and analyze the legal consequences of the Joint Regional Supervisory Council that does not carry out its obligations in examining community complaint reports. This type of research uses empirical normative research, while it is descriptive in nature. The type of research data is primary data and secondary data. Primary data obtained through direct field research, namely respondents and resource people. Secondary data is regarding on the collection of materials related to the topic of research. Secondary data consist of primary legal materials, secondary legal materials and tertiary legal materials. The data analysis conducted by qualitative manner. The conclusion of the research shows first, the Combined MPD of Pangandaran Regency, Banjar City, Ciamis Regency had carried out its obligations in examining community complaint reports but did not complete the reason for the Combined MPD of Pangandaran Regency, Banjar City, Ciamis Regency for humanitarian reasons because of the conditions experienced by the Reported. Second, the legal consequences for the Joint MPD that does not carry out its obligations in examining public complaint reports are not clearly regulated in law, it's just that referring to the provisions of Article 17 of Permenkumham Number 16 of 2021, this action is included in violating the oath/promise of office which provides legal consequences for imposing sanctions in the form of dishonorable dismissal based on Article 18 Paragraph (3) letter f of Permenkumham Number 16 of 2021.

Abstract

Agar para pihak dapat menggunakan arbitrase sebagai sarana penyelesaian sengketa yang mungkin sudah ada atau belum ada, hal terpenting yang perlu mereka lakukan adalah membuat kesepakatan terlebih dahulu yang tertulis dan disetujui oleh para pihak. Berkaitan dengan hal tersebut, maka permasalahan yang akan ditelaah dalam tulisan ini adalah: Di manakah letak ketentuan ketentuan dalam Undang-undang Nomor 30 Tahun 1999 tentang Diskresi dan Tujuan Pilihan, Bagaimana kekuatan pembatas syarat mediasi dalam kaitannya dengan kesepakatan peraturan. Sistem yang digunakan adalah yuridis regulasi dan dipusatkan pada pemanfaatan pendekatan penyelesaian dan dihubungkan dengan permasalahan yang dikaji. Temuan penelitian ini didasarkan pada UU No. 30 Tahun 1999 yang mengatur bahwa para pihak harus terlebih dahulu mengadakan perjanjian atau klausula arbitrase sebelum arbitrase suatu sengketa dapat diselesaikan. Alasan kekuatan pembatas pernyataan diskresi adalah Pasal 1338 ayat (1) KUHPerdata dan Pasal 11 Peraturan Nomor 30 Tahun 1999. Sebuah kontrak memiliki kekuatan mengikat dan harus dilakukan oleh para pihak jika mengandung klausula arbitrase

Abstract

The purpose of this research is to analyze the status of inheritance rights of children of different religions with their heirs according to Islamic law and try to resolve the distribution of inheritance rights to children of different religions according to Islamic law. The problem of inheritance among different religions has now become a modern problem because neither the Koran nor the hadiths explain the distribution of assets between heirs of different religions. This research approach uses normative legal research. The results of the study show that the inheritance rights for children of different religions are regulated according to Islamic law in the hadith and the Compilation of Islamic Law, where non-Muslim children are not entitled to inheritance. However, in practice, in court decisions, judges give inheritance shares to children of different religions on the basis of a binding will. This violates Islamic provisions and the Islamic Law Compilation. However, the decision regarding inheritance is the implementation of justice, interests and legal certainty in family life. According to Islamic law, the inheritance rights of children of different religions are distributed through grants and wills. This is in accordance with the provisions of the Al-Qur'an, Hadith and Compilation of Islamic Law which are permissible in terms of scholarships for both Muslims and non-Muslims. The judge uses a will in a court decision regarding the division of inheritance.

Abstract

Abstract This study analyzes the disparity in judicial decisions on polygamy permits by comparing two Religious Court rulings with identical legal conditions but different outcomes. Decision No. 692/Pdt.G/2019/PA.Plh granted the permit despite the applicant not meeting the alternative requirements of Article 4(2) of the Marriage Law, citing fulfillment of Article 5(1). Conversely, Decision No. 0007/Pdt.G/2019/PA.Lpk involved the same shortfall under Article 4(2), yet the judge rejected the request, deeming those requirements absolute and not subject to Article 5. Employing a normative-juridical method, this research dissects judges’ reasoning in final decisions. Findings reveal that divergent interpretations of Articles 4 and 5 are the root of the disparity. Such inconsistency highlights normative ambiguity and risks legal uncertainty. Accordingly, revisions to Articles 4 and 5 of the Marriage Law—and technical guidelines from the Supreme Court via SEMA or PERMA are necessary to prevent decision disparities and ensure legal certainty in polygamy cases. Keywords: Decision Disparity; Polygamy Permit; Judges' Consideration, Polygamy Requirement Abstrak Penelitian ini menganalisis terkait disparitas putusan hakim dalam perkara izin poligami dengan membandingkan dua putusan Pengadilan Agama yang memiliki kondisi hukum serupa namun menghasilkan putusan berbeda. Putusan No. 692/Pdt.G/2019/PA.Plh mengabulkan permohonan poligami meskipun pemohon tidak memenuhi salah satu syarat alternatif dalam Pasal 4 ayat (2) Undang-Undang Perkawinan, dengan alasan syarat-syarat dalam Pasal 5 ayat (1) telah dipenuhi. Sebaliknya, Putusan No. 0007/Pdt.G/2019/PA.Lpk juga menghadapi kondisi di mana pemohon tidak memenuhi Pasal 4 ayat (2), namun hakim di dalam pertimbangannya menolak permohonan karena menilai bahwa syarat dalam Pasal 4 ayat (2) bersifat mutlak dan tidak dapat dikesampingkan meskipun Pasal 5 telah dipenuhi. Penelitian ini menggunakan metode yuridis Disparitas Putusan Pengadilan Terhadap Izin Poligami Dalam Perspektif Kepastian Hukum (Studi Putusan Nomor 692/Pdt.G/2019/Pa.Plh Dan Nomor 0007/Pdt.G/2019/Pa.Lpk) normatif dengan melihat dan menganalisis pertimbangan hakim dalam putusan yang telah memiliki kekuatan hukum tetap. Hasil penelitian ini menunjukkan bahwa perbedaan interpretasi hakim terhadap hubungan antara Pasal 4 dan Pasal 5 menjadi penyebab utama disparitas. Ketidakkonsistenan ini mencerminkan adanya kekaburan norma dan berpotensi menimbulkan ketidakpastian hukum. Oleh karena itu, diperlukan revisi terhadap Pasal 4 dan Pasal 5 Undang-Undang Perkawinan, serta pedoman teknis dari Mahkamah Agung melalui SEMA atau PERMA untuk mencegah disparitas putusan dan menjamin kepastian hukum dalam perkara izin poligami. Abstract

Law Number 3 of 2024, as an amendment to Law Number 6 of 2014, affirms the authority of village heads in resolving community disputes. This study examines the dispute resolution model in the Pulau Sewangi Village community, Barito Kuala Regency, South Kalimantan, which has a wetland-based cultural characteristic with communal life along the Barito River. The study used an empirical legal method with a socio-legal approach through interviews and field observations. The results show that the presence of the village head plays a central role in maintaining social harmony through non-litigation dispute resolution, which is more dominant than litigation. The settlement model implemented prioritizes deliberation based on local wisdom, which is directed at forms of mediation and conciliation. However, for certain cases that meet criminal elements, the village head coordinates with law enforcement officials towards the litigation process. Thus, the dispute resolution model in Pulau Sewangi Village reflects the synergy between formal legal approaches and local wisdom, which is relevant to the development of village governance based on wetland community culture.

Abstract

This paper discusses the application of the principle of freedom of contract in construction agreements in Indonesia and emphasizes the potential for injustice. Although this principle allows parties to create and design contracts freely, there is often an imbalance of power, especially between contractors and project owners. Construction work contracts are regulated by the Civil Code (KUHPERDA) and Law No. 2 of 2017 concerning Construction Services, but there are still loopholes that allow clauses that benefit project owners. Imbalance of bargaining power, unbalanced contract provisions, and disproportionate risk sharing are the main issues discussed. In order to protect the rights of all parties involved in a construction agreement, this paper analyzes the problem normatively and emphasizes the importance of implementing a fairer principle of freedom of contract.

Abstract

This article aims to analyze the provisions on parate execution of fiduciary guarantees and their legal consequences following Constitutional Court Decision Number 18/PUU-XVII/2019. Prior to this decision, creditors had the authority to execute fiduciary guarantees directly without going through the courts when the debtor defaulted. However, the Constitutional Court emphasized that parate execution can no longer be carried out unilaterally, but must be based on an agreement regarding the default or through a court order. The research method used is normative juridical with a statutory, conceptual, and case approach, with legal materials in the form of regulations, literature, and court decisions analyzed qualitatively. The results show that this decision provides greater protection for debtors because execution can no longer be carried out without judicial oversight. On the other hand, creditors lose the certainty of automatic execution, which implies increased financing risks, additional costs, and potential delays in the execution process. This condition affects the policies of financial institutions in disbursing fiduciary-based credit. Thus, this decision emphasizes the need for a balance between protecting debtors' rights and legal certainty for creditors, while also encouraging the existence of derivative regulations and technical guidelines so that the implementation of fiduciary execution following the Constitutional Court's decision can be effective, fair, and provide legal certainty.

Abstract

A notary is a public official who is authorized to make authentic deeds and has other authority as referred to in the Notary Position Law or based on other laws. The Notary has an obligation to keep everything confidential about the deed he makes and all information obtained for the preparation of the deed in accordance with the oath/promise of office, unless the Law specifies otherwise. In maintaining the confidentiality of personal data in the digital era, it is very important considering that personal data can be used by unauthorized parties for various interests, the formulation of the problem in this study is first, how is the legal protection of the confidentiality of the data of the person facing in the digital era, the second is how the role of technology in helping notaries to maintain the confidentiality of the data of the person who is confronted in the digital era, and the third is how is the responsibility of the notary for the confidentiality of the data of the person who is facing in the digital era. The research method used is normative juridical, with a legislative, conceptual and case approach, a type of secondary research, with additional interviews with the Regional Supervisory Council (MPD) of the Padang Region and Notaries in Padang City. The legal protection of the confidentiality of personal data in the digital era aims to ensure that the right to privacy is respected, prevent the misuse of personal data for various purposes, prevent misuse by establishing rules on how personal data can be collected, stored and used. The role of technology in helping notaries to maintain the confidentiality of client data is very crucial in the notary profession, by utilizing various security systems, notaries can provide more optimal protection of the client's personal data. Notary's responsibility for the confidentiality of client data in the digital era of notaries will face various legal and ethical consequences. By understanding their responsibilities and taking preventive measures, notaries can minimize the risks and negative impacts of data leaks. There are no rules regulating the confidentiality of client data and sanctions for notaries if there is a leak of client data in the digital era, creating a void in norms. So that the confidentiality of the data of the person has not been guaranteed.

Abstract

This study aims to analyze the effectiveness of the Consumer Protection Law in dealing with the circulation of illegal cosmetics in Serang City. The method used is normative juridical, with a normative analysis approach to applicable legal norms, as well as data collection from legal literature and official documents. The results of the study indicate that although Law No. 8 of 1999 provides a strong legal basis for consumer protection, its effectiveness is still questionable. The high prevalence of illegal cosmetics in the market, lack of human resources at BPOM, and low public awareness of the dangers of illegal cosmetics are the main obstacles in its implementation. BPOM has made various efforts, including supervision and education to the public, but challenges in law enforcement and comprehensive supervision still need to be overcome. Therefore, strategic steps are needed to increase the effectiveness of consumer protection and suppress the circulation of illegal cosmetics in Serang City.
