Abstract

Children are the best hope for the future of any country, community group or family; they are a gift from God to those blessed by their presence. The emotional, mental, and social well-being of their children primarily falls within the purview of the child's parents. Children's journey towards adulthood and the development of their capacity to live independently is the responsibility of parents. This article was created with the aim of enlightening readers regarding the responsibilities of parents for petty theft committed by their children while they are under their supervision and while the children are in their care. Researchers will use normative legal research techniques to ensure that they have a comprehensive understanding of the criteria they will use to analyze results and find solutions to the problems they pose in their research. Legal case analysis, legal literature analysis, and regulatory analysis are some of the methodologies used. The authors of this study draw several conclusions regarding children's responsibility for their financial well-being as perpetrators of criminal acts. The author then outlines the need to dispel doubts regarding responsibility towards minors, while emphasizing the need to monitor children's psychological development. The uniformity of children's responsibilities in long-form fairy tales is a stumbling block for writers.

Abstract

The privacy movement was created by Warren and Brandhuis, who wrote an article in Harvard Law School Journal title "The Right to Privacy" is the right to a person's privacy not to be invaded by others or the government. Laws must recognize and protect an individual's right to privacy. Personal data protection at the global level is regulated by several regulations such as the UDHR and ICCPR.The writing method used in this paper is a normative juridical research method which uses literature references as research data in this paper. The results of this research, namely in ratifying the UDHR and ICCPR regardingThe Right to Privacy As part of the protection of human rights, the Indonesian government is seen as not yet serious about implementing it thoroughly. The PDP Bill, which should be the main focus of the government, is to protect the privacy and security of citizens' data, which has not yet become a top priority. The use of personal data in registration of various applications and regulations for private interests, especially NIK, is not in accordance with the required purposes and creates a potential risk of misuse by cybercriminals and corporations who use the personal data collected. Problems in law enforcement in Indonesia related to privacy violations still occur frequently because there is no national data protection authority that is specifically responsible for data privacy.Keywords: The Right to Privacy, Human Rights, Personal Data

Abstract

The Village Head, based on Article 26 Paragraph (4) letter (l) of the Village Law, is tasked with resolving community disputes in his/her village. This research aims to analyze the role of the Village Head as a Mediator, how the Village Head as a Mediator faces obstacles, and the division of roles between the Village Head as a Mediator in resolving inheritance disputes in Sempol Village. The research method used in this research is empirical legal research method. This research shows that: First, the role of the Village Head in the mediation process to resolve inheritance disputes in Sempol Village is considered not optimal, such as the absence of mediation minutes and written agreements containing the agreement of the parties. Second, the Village Head faces obstacles in the mediation process by first identifying the obstacles and then resolving them according to the characteristics of each obstacle, but it is still not optimal because the Village Head has not been equipped with Mediator knowledge. Third, there was no division of Mediator roles between the Sempol Village Head and the Pagak Village Head. All of the shortcomings in the mediation process could be avoided if: 1) The Village Head actively equips himself with mediation knowledge. 2) The government facilitates the Village Head with training and certification of Mediators, to strengthen the competence of the Village Head, improve community justice, reduce the burden on the courts and provide clear and legal guidelines for dispute resolution in practice.

Abstract

Terorisme merupakan extraordinary crime yang tidak hanya menimbulkan korban jiwa dan kerugian material, tetapi juga meninggalkan luka psikologis dan sosial yang mendalam. Di Indonesia, kebijakan penanggulangan terorisme masih lebih berorientasi pada aspek penindakan terhadap pelaku, sementara korban atau penyintas kerap diposisikan sekadar sebagai saksi dalam proses peradilan. Padahal, peristiwa bom Surabaya tahun 2018 menunjukkan betapa berat penderitaan yang ditanggung korban, mulai dari trauma jangka panjang, kehilangan anggota keluarga, hingga stigma sosial yang tidak dapat dipulihkan hanya melalui bantuan medis atau kompensasi finansial. Penelitian ini bertujuan untuk mengidentifikasi kebutuhan utama penyintas terorisme di Kota Surabaya dalam proses pemulihan psikososial, menganalisis hambatan yang dihadapi dalam pelaksanaannya, serta menggali harapan korban terhadap keberlanjutan program pemulihan. Metode penelitian yang digunakan adalah penelitian hukum empiris dengan pendekatan kualitatif, melalui wawancara mendalam, observasi, serta studi dokumentasi terhadap peraturan perundang-undangan dan kebijakan yang relevan. Hasil penelitian menunjukkan bahwa pemulihan psikososial korban terorisme belum berjalan optimal karena keterbatasan sumber daya, koordinasi antarlembaga yang lemah, dan birokrasi yang berbelit. Korban pada umumnya masih membutuhkan pendampingan psikologis jangka panjang, jaminan sosial ekonomi, serta pengakuan negara yang lebih konkret atas penderitaan yang mereka alami. Penelitian ini menegaskan pentingnya penguatan mekanisme perlindungan hukum yang berpihak pada korban, agar implementasi pemulihan psikososial tidak hanya bersifat formalistik, tetapi juga mampu memulihkan martabat dan kehidupan korban secara menyeluruh.

Abstract

Impeachment is an important constitutional mechanism to maintain checks and balances in the presidential system. Indonesia and the United States, as countries that adopt presidentialism, have different constitutional frameworks in regulating the impeachment of presidents. This paper aims to provide a comparative analysis of the impeachment models in Indonesia and the United States. This study employs a normative juridical method with a comparative constitutional approach. The findings show that the Indonesian model emphasizes the juridical dimension through the Constitutional Court’s involvement as a legal filter, whereas the American model highlights the political aspect by granting Congress dominant authority. The Indonesian system guarantees due process of law but is procedurally complex, while the American system is simpler but vulnerable to politicization. These differences demonstrate that institutional design significantly shapes the balance of power in each country. Abstract

The advancement of time brings more complex challenges, including the circulation of narcotics. Narcotics abuse has become an increasingly serious issue in many areas of Indonesia. This phenomenon occurs not only in major cities but also in regions such as Sambas Regency. This research aims to examine the efforts made by the police to combat narcotics abuse in the Sambas Regency area and to identify the obstacles faced by the police in tackling narcotics abuse. This study uses a qualitative approach with descriptive analysis, utilizing primary data obtained through direct interviews and secondary data gathered from literature sources. The results of this study indicate that the police efforts in combating narcotics abuse in Sambas Regency include pre-emptive, preventive, repressive actions, as well as rehabilitation and guidance. The obstacles faced by the police include internal challenges such as limited personnel, inadequate facilities and infrastructure, difficulty in obtaining strong physical evidence, and challenges in legal proof. External factors from the environment and society include limited public information and participation, environmental influences, geographical factors, and uneven dissemination of education and outreach programs.

Abstract

This research aims to analyze the level of legal awareness and the obstacles faced by Micro and Small Enterprises (UMK) in the trademark registration process in Tanah Pinoh District, Melawi Regency. In an increasingly competitive global market, protecting intellectual property, particularly trademarks, is crucial to ensuring product identity and market competitiveness. However, many UMK actors are unaware of the legal importance of trademark registration, resulting in a lack of protection for their business assets. The study employs a juridical-empirical approach, with primary data obtained through interviews with UMK actors and related agencies, and secondary data from literature reviews. The findings reveal that low legal literacy, limited government outreach, and the perception that trademark registration is complicated and costly are major obstacles. Even when free registration programs are available, participation rates remain low.Trademarks serve not only as unique identifiers but also as legal safeguards that ensure business continuity and prevent infringement or duplication. Registration enhances product credibility and consumer trust. Therefore, more effective strategies are needed to raise awareness among UMK actors through sustained legal education, simplified administrative processes, and stronger regional government support. This research aims to inform policymakers in designing fairer and more inclusive intellectual property protection strategies for small-scale businesses.

Abstract

Marriage Registration is very important in the legal system in Indonesia because it functions to provide certainty and legal protection for married couples and their children. However, in practice, not all Chinese people in Pontianak City prioritize ancestral customs and beliefs in carrying out marriages. This study aims to analyze the level of legal awareness of the Chinese community towards marriage registration and find out the legal impact if the marriage is not officially registered. The method used is empirical legal research with a qualitative approach. Primary data was obtained through questionnaires, interviews, and documentation, then analyzed descriptively. The results of the study show that although some Chinese people already understand the importance of marriage registration, there are still many who have not registered their marriages due to cultural reasons, processes that are considered complicated, and lack of socialization from the government. As a result, various legal problems arise such as unclear marital legal status, neglected civil rights of couples, and difficulties in taking care of documents needed by children. This research proposes the need for a collaborative approach between the government and customary/religious leaders in increasing legal awareness, as well as simplifying the registration administration process to make it more accessible to the public.

Abstract

Vehicle leasing agreements in Pontianak City, West Kalimantan often cause legal problems, especially in relation to deviations from the principle of good faith as stipulated in Article 1338 paragraph (3) of the Civil Code. This principle requires each party to the agreement to carry out obligations honestly, fairly, and in accordance with the norms of decency prevailing in the community. This research aims to identify concrete forms of deviation from the principle of good faith in the practice of vehicle leasing and analyze its legal impact on the relationship between business actors and consumers. This research uses an empirical method with a socio-legal approach, and data collection is carried out through interviews with vehicle rental business owners and consumers who have suffered losses. The results showed that deviations occurred at the stages before, during, and after the implementation of the agreement, with forms such as embezzlement of vehicles, use of vehicles for criminal acts, late returns, and dishonest utilization of contract concessions. These deviations cause financial losses, legal uncertainty, and decreased trust between parties. Therefore, it is necessary to increase legal awareness, formulate more detailed and firm contracts, and equal legal protection for both parties in order to enforce the principle of good faith in every vehicle rental transaction.

Abstract

This research aims to describe and analyze the implementation of prisoner guidance at the Class IIB Sanggau State Detention Center. The study was conducted using an empirical legal research method, supported by field observations and interviews with correctional officers and inmates. The research found that the guidance program is implemented based on the Correctional System as regulated in Law No. 12 of 1995 concerning Corrections and Government Regulation No. 31 of 1999 concerning the Development and Guidance of Inmates. The implementation focuses on moral, religious, and skill development to support the prisoners’ reintegration into society. However, the study also found that human resource limitations, insufficient facilities, and lack of training programs have affected the program’s effectiveness. Overall, the guidance process has been carried out in accordance with existing regulations but requires improvement in infrastructure and management to achieve optimal results.
