Abstract

The Tablighi congregation often carries out its da'wah activities by leaving his wife, who is called khuruj. Ideally, in Islamic law, a partnership must be built to form a family, what happens in a family but the husband only preaches outside (khuruj), giving the impression that he does not take care of the household. A husband and wife partnership is built on the relationship between husband and wife in building a household to achieve common goals. This study aims to examine the relationship between husband and wife in the Tablighi congregation family, especially in the Medan Amplas Tablighi congregation family. This study is also to analyze the partnership that is built within the family from the perspective of Islamic Family law. Using qualitative methods, data was explored using interviews. This study found that basically a good and harmonious family is a commandment in Islamic teachings. Then from the thoughts above the question arises, what is the actual relationship between husband and wife among the tabligh congregation. Do they really have an ideal partnership as suggested by Islam? What about their partnership from a gender perspective? Why is it necessary to look at it from a gender perspective because the relationship between husband and wife is always related to gender, is that true? The purpose of this writing is to determine the suitability of Islamic family law and its implementation for husband and wife partnerships among members of the Medan Amplas tabligh congregation. The research methods used are library research and field research. The results of this research are that the husband and wife partnership built by the Medan Amplas tabligh congregation family is very organized following the procedures taught by the Prophet and according to Islamic law.

Abstract

The impediment to make a sale act by the ppat because its conditions are not met, of course, will create uncertainty for the parties who conduct the sale. The agreement is a binding agreement. The parties entered into an agreement for binding the sale of the land which has not been inherited depending on several factors such as the buyer needs time to carry out the payment of the sale price while the seller takes time to process the inheritance certificate of the right to the land, the purchaser has paid the purchase price but the unity of the rights to the ground has not yet been made to inherit, and/or payment of income tax (PPh) and customs duties on land and building (BPHTB) have not been issued by the parties. The contract of sale of land that has not been inherited is based on the agreement of the parties, which is then continued with the application for the drafting of an act before a notary, the approval of the law by a notar, the submission and inspection of documents, the verification of certificates of the right to the land, the preparation and drawing of acts, and the signing of the act. The Civil Procedure Act against land not inherited made before a notary has legal certainty, because the notary as a public official authorized to make an authentic act subject to the regulations of the laws and the code of ethics of the office of the notar has ensured the validity of the civil procedure act against land that has not been made in heritage made against him and by referring it to a civil proceeding act against the land noted in the notarial act can provide legal protection to the parties in the event of legal protection of an authoritative act.

Abstract

Street lighting is one of the regional government services that is used for the benefit of the general public in daily life. Minister of Transportation Regulation No. 27 of 2018 concerning Public Street Lighting Equipment is to optimize road equipment facilities in the form of street lighting devices. In order to realize safety, security, order and smooth traffic as well as convenience for road users in traffic. Providing street lighting facilities is a form of successful development in an area. However, the reality found in the field is that there are still street lights in the city of Medan that are not functioning or are not on. Malfunctioning of street lights can cause accidents, theft, and so on for road users. Therefore, the physical form and function of street lights must be in accordance with the regulations or procedures, and also the form of operation of street lights must be in accordance with the needs of the community in general and avoid waste and wasteful use of resources and budgets as explained in Minister of Transportation Regulation Number 27 of 2018 concerning Street Lighting Equipment that the government does not implement the points in this regulation properly, so the construction of public facilities for street lighting. From the perspective of Fiqh Siyasah, and Minister of Transportation Regulation no. 27 concerning Street Lighting Equipment, there are still many things that are not in accordance with the provisions of Siyasah Fiqh.

Abstract

Criminal activities in the labor industry are illegal acts carried out by laborers, employers, or other persons not affiliated with the firm that face criminal penalties under the Criminal Code, Manpower Law, and/or other legislation, either alone or in combination. In the course of Civil Servant Investigators' criminal inquiries in the labor sector. The Manpower and Transmigration Service (Disnakertrans) employs Civil Servant Investigators who carry out their work in accordance with the Law Number 13 of 2003 concerning Manpower and the Regulation of the Chief of the National Police of the Republic of Indonesia Number 6 of 2010 concerning Investigation Management by Civil Servant Investigators (PPNS). Both laws provide authority for their operations. It seems sense in this instance that PPNS Disnakertrans's inquiry is coordinated with the police as well. One of the issues preventing the inquiry from operating at its best in its execution is the ineffective coordination. The following issues may be created based on the backdrop of the aforementioned difficulties: 1. How are criminal investigations in the area of labor being carried out by Civil Servant Investigators (PPNS) of the Manpower and Transmigration Office of West Sumatra Province? 2. What are the challenges facing the Civil Servant Investigators (PPNS) of the Manpower and Transmigration Office of the Province of West Sumatra in carrying out criminal investigations in the area of labor? Based on the study's descriptive methodology and empirical juridical approach, the following conclusions may be drawn from it: 1. The implementation of criminal investigations in the field of labor by PPNS Disnakertrans is a series of: examination, processing of crime scenes, Sprindik, SPDP, examination of witnesses and suspects, completion and submission of Case Files to be submitted by PPNS to the public prosecutor through police investigators. 2. The obstacles experienced by PPNS Disnakertrans in carrying out criminal investigations in the field of labor are the lack of supervisors and PPNS both in quantity and quality. In addition, the lack of facilities and infrastructure as well as limited budget are obstacles in the investigation. SOPs that are not fully implemented and lack of coordination between PPNS and the Police as Korwas are obstacles found in the implementation of criminal investigations in the field of labor. For better implementation of investigations, PPNS Disnakertrans West Sumatra must be able to improve coordination with Police Investigators. In addition, Disnakertrans is expected to be able to overcome internal obstacles so that the enforcement of criminal acts in the labor sector can run even better.

Abstract

This study aims to analyze the responsibility of doctors who carry out medical procedures without written consent for patients at the Pratama Aesthetic Beauty Clinic and also to analyze the legal protection for patients who do not provide written consent for medical procedures at the Aesthetic Beauty Pratama Clinic. Administratively, it is the responsibility of a doctor to carry out medical procedures without written consent from the patient administratively. The legal responsibility of doctors, apart from civil law, is also accountable under criminal law. In Indonesia, the problem of liability for a doctor's criminal law is regulated in the Criminal Code, which includes legal responsibility arising on purpose or negligence/negligence. Forms of legal protection for patients for medical record errors resulting from the absence of informed consent in health services are regulated in Law Number 36 of 2009 concerning Health Law Number 29 of 2004 concerning Medical Practice and Law Number 8 of 1999 concerning Consumer Protection where these three rules can provide protection and legal certainty for patients who also serve as consumers about the rights and obligations of patients in obtaining health services which in practice are not by applicable laws.

Abstract

Pendaftaran tanah melalui system elektronik dan konvensional berdasarkan Pasal 2 ayat (1) Peraturan Menteri ATR/BPN Nomor 1 tahun 2021. Adanya perkembangan teknologi dalam pelayanan administrasi dan disahkan aturan Peraturan Menteri tentang sertifikat elektronik, membuat efisiensi pendaftaran tanah, kepastian hukum dan perlindungan hukum san mengurangi jumlah sengketa, konflik dan perkara di pengadilan mengenai pertanahan. sertipikat merupakan proses atau tujuan akhir dari pendaftaran tanah dan dengan diterbitkannya sertipikat akan membawa adanya suatu kepastian dan perlindungan hukum juga bagi si pemegang hak, karena Sertipikat dijadikan sebagai alat bukti yang kuat sebagaimana yang diatur dalam Pasal 32 beserta penjelasan Peraturan Pemerintah Nomor 24 Tahun 1997 Tentang Pendaftaran Tanah. Metode pendekatan yang digunakan adalah metode pendekatan hukum normatif, yaitu penelitian yang didasarkan atas peraturan perundang-undangan atau norma-norma hukum yang bersifat mengikat yang ada relevansinya dengan materi yang dibahas. Hasil penelitian Menunjukkan bahwa Pendaftaran tanah bisa dilaksanakan secara manual atau analog maupun secara elektronik dalam Pasal 2 Ayat (1) Peraturan Menteri ATR/BPN Nomor 1 Tahun 2021 Tetang Sertifikat Elektronik sebagai bentuk kepastian hukum bagi pemegang hak atas tanah. Pelaksanaan pendaftaran tanah secara digital sesuai dengan kesiapan kantor pertanahan dari segi yuridis dan fisik yang telah divalidasi dan kesiapan data pertanahan yang siap untuk diberlakukan secara elektronik.

Abstract

Ekonomi global yang semakin terbuka, ekspor pasir laut menjadi topik yang menarik perhatian di Indonesia. Pasir laut memiliki potensi ekonomi yang signifikan sebagai bahan baku dalam berbagai industri, namun eksploitasi yang tidak terkendali dapat mengakibatkan dampak negatif terhadap lingkungan dan masyarakat. Karena itu, penting untuk menganalisis secara komprehensif kebijakan hukum yang mengatur ekspor pasir laut, serta memastikan kesesuaian dengan prinsip konstitusional dan dampaknya terhadap berbagai aspek kehidupan masyarakat. Penelitian ini bertujuan untuk melakukan analisis mendalam terhadap Peraturan Pemerintah Nomor 26 Tahun 2023 tentang hasil sedimentasi di laut dalam konteks kebijakan ekspor pasir laut. Penelitian akan membahas aspek hukum yang terkait dengan regulasi ekspor pasir laut, termasuk prosedur, persyaratan, dan sanksi yang diatur dalam peraturan tersebut, serta menganalisis konsistensi antara peraturan tersebut dengan Undang-Undang Dasar Negara Republik Indonesia (UUD NRI) Tahun 1945. Dalam analisis normatif yuridis ini, penelitian akan mengidentifikasi dan mengkaji secara kritis pasal-pasal dalam Peraturan Pemerintah Nomor 26 Tahun 2023 yang berkaitan dengan ekspor pasir laut. Pendekatan perundang-undangan akan digunakan untuk membandingkan ketentuan dalam peraturan tersebut dengan prinsip-prinsip konstitusional yang diatur dalam UUD NRI Tahun 1945, seperti prinsip keadilan, perlindungan lingkungan hidup, dan perlindungan hak asasi manusia. Penelitian ini juga membahas dampak kebijakan ekspor pasir laut terhadap berbagai aspek kehidupan masyarakat, termasuk aspek ekonomi, sosial, dan lingkungan. Penelitian akan mengkaji potensi nilai ekonomi yang dapat dihasilkan dari ekspor pasir laut, serta dampaknya terhadap sektor industri dan perekonomian Indonesia. Penelitian ini akan mengidentifikasi dampak sosial dari ekspor pasir laut terhadap masyarakat, termasuk dampak terhadap mata pencaharian, budaya, dan kehidupan sosial.

Abstract

Pasal 24A ayat (2) UUD 1945 menentukan kualifikasi Hakim Agung sebagai berikut: "Hakim Agung harus memiliki integritas dan kepribadian yang tidak tercela, adil, professional, dan berpengalaman di bidang hukum." Dalam penelitian hukum normatif ini, Penulis akan mengkaji dan menganalisis bagaimana model rekrutmen hakim sebagai penyelenggara kekuasaan kehakiman menurut konsepsi negara hukum. Jika dikaitkan dengan kekuasaan kehakiman maka setidaknya terdapat beberapa ciri negara hukum yang terkait langsung dengan kekuasaan kehakiman, yaitu: (a.) Perlindungan konstitusional; (b.) Badan kehakiman yang bebas dan tidak memihak; (c.) Hak-hak Asasi Manusia; (d.) Pemisahan atau pembagian kekuasaan. Terdapat beberapa model yang dikenal dalam proses judicial appointment, antara lain, Model Hamilton yang mempunyai alat ukur untuk menciptakan kekuasaan hakim yang merdeka dan mandiri dan Model Ginsburg yang merangkum empat model pengisisan jabatan hakim yang diterapkan pada negara-negara modern. Proses rekrutmen hakim menjamin hadirnya hakim yang berkualitas, dan proses rekrutmen hakim harus mampu menjamin kemerdekaan kehakiman pada setiap tingkat lembaga peradilan tersebut. UUD 1945 mengatur mekanisme rekrutmen Hakim Agung dan Hakim Konstitusi, yang membentuk calon hakim pada kedua puncak kekuasaan kehakiman akan melibatkan lembaga-lembaga yang berbeda. Penelitian hukum ini akan menganalisis putusan MK Nomor 43/PUU-XIII/2015 terjadi perubahan terhadap pola rekrutmen hakim pada lingkungan Peradilan Umum, Peradilan Agama, dan Peradilan Tata Usaha Negara.

Abstract

Sampai hari ini, silang pendapat dan bahkan perdebatan terkait penentuan yurisdiksi antara Hukum Administrasi Negara dan Hukum Pidana khususnya dalam rumpun pidana korupsi masih belum menemukan titik kesepahaman, khususnya terkait dengan unsur melawan hukum dalam regulasi tindak pidana korupsi dan unsur menyalahgunakan kewenangan dalam regulasi administrasi negara.. Metode pendekatan yang digunakan dalam penelitian ini adalah metode yuridis Normatif. Tipe penelitiannya adalah deskriptif. Sumber data adalah data primer dan didukung dengan data sekunder. Berdasarkan hasil penelitian, penulis dapat simpulkan pertama, faktor-faktor penyebab terjadinya divergensi hukum pidana dengan hukum administrasi dalam tindak pidana korupsi adalah karena munculnya dua pemahaman; yakni penyalahgunaan wewenang dan perbuatan melawan hukum. Kedua, Perkembangan praktik dan yurisprudensi divergensi hukum pidana dengan hukum administrasi dalam penegakan delik pidana korupsi khususnya pada pengadilan tindak pidana korupsi amat ditentukan dari keyakinan hakim dalam memutus sebuah perkara tindak pidana korupsi.

Abstract

Dalam mengadakan jual beli tanah, para pihak, yaitu pihak penjual dan pembeli memerlukan peran Pejabat Pembuat Akta Tanah (PPAT) untuk membuat akta jual beli dengan objek yang berkaitan dengan tanah yang wewenang tersebut diberikan secara atributif oleh PP 37/1998. Oleh karena itu, PPAT sebagai pihak yang memiliki keterkaitan dalam jual beli tanah dapat diikutsertakan sebagai salah satu pihak dalam surat gugatan apabila tanah yang diperjualbelikan tersebut mendapati sengketa berupa adanya sertipikat ganda. Sertipikat ganda merupakan keadaan dimana di dalam satu bidang tanah terdapat lebih dari satu sertipikat. Padahal, sertipikat merupakan bukti kepemilikan yang merupakan akta autentik yang memiliki nilai kekuatan pembuktian paling kuat diantara barang bukti lainnya.
