Abstract

This article discusses the existence, function and legal position of the Land Bank after the Constitutional Court Decision and also examines the existence of Customary Land after the existence of the Land Bank Institution in Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja. Where after the birth of Undang-Undang Cipta Kerja, there were several test applications submitted to the Constitutional Court and ruling on this formal test case, the Government was ordered to make improvements within a period of 2 years if within that period no improvements were made, then UU Cipta Kerja would become permanently unconstitutional and it was also not allowed to issue new implementing regulations relating to UU Cipta Kerja. UU Cipta Kerja is also reviewed in relation to licenses to use customary land of indigenous peoples, where indigenous peoples feel they are losing their rights because there are no legal remedies against business actors who use customary land as land for business without having to get approval from indigenous peoples.

Abstract

The purpose of this study is to determine the implementation of the supervisory function of the Regional People's Representative Council of the City of Bukittinggi in the 2021-2022 drainage development project. The drainage project implemented by the Bukittinggi city government has had an impact on community activities. Therefore, the role of people's representative institutions is needed to oversee so that good governance is realized. This research is descriptive in nature, namely research that aims to obtain a complete picture (description) of the legal situation that applies in a certain place, using an empirical juridical approach. The data sources consist of primary data and secondary data. Based on the results of the research, the supervisory function of the Regional Representatives Council of the City of Bukittinggi has not been carried out optimally. The form of implementation of the supervisory function is by summoning the relevant offices for hearings and conducting field inspections. The obstacle faced in carrying out the supervisory function by the Regional People's Legislative Assembly for the City of Bukittinggi is the lack of responsibility for members of the council in carrying out their duties according to their authority, as regulated by law.

Abstract

Deviant behavior is behavior that violates the moral principles of decency, both in terms of individual humanity and justification as a characteristic of social beings. Not only adults, children also currently show deviant behavior. The current speed of communication flow can foster children's curiosity and encourage them to try new things. The purpose of this study is to explain deviant behavior that often occurs in the environment around PPA and what factors influence children to carry out deviant behavior. In addition, this study aims to explain the efforts made by PPA in preventing deviant behavior in children. This research was carried out using sociological juridical research methods, the specifics of this research are descriptive. The research data was sourced from interviews. Data analysis using qualitative methods. The results of the study (1) factors that influence children to carry out deviant behavior are biological factors, psychological factors, and sociological factors, besides that there are factors from a bad environment, lack of attention from parents and influence from friends. (2) Efforts to overcome deviant behavior in children can be carried out with prevention efforts without punishment, such as the participation of community social institutions. PPA is a community social institution that in responding to children's deviant behavior is by providing infrastructure that accommodates children's creativity, improving children's mental health.

Abstract

Penelitian ini menganalisis kelayakan angkutan kota di Kabupaten Karawang berdasarkan Peraturan Daerah (Perda) Nomor 2 Tahun 2020 tentang Penyelenggaraan Perhubungan. Penelitian ini bertujuan untuk mengevaluasi kepatuhan dan kesesuaian operasional angkutan kota dengan ketentuan dalam Perda tersebut. Metode penelitian melibatkan survei lapangan, analisis dokumen perundang-undangan, dan wawancara dengan pihak terkait. Hasil penelitian menunjukkan bahwa implementasi angkutan kota di Kabupaten Karawang belum sepenuhnya mematuhi ketentuan yang diatur dalam Perda Nomor 2 Tahun 2020. Beberapa aspek yang dievaluasi termasuk jadwal, rute, tarif, dan standar pelayanan. Kesenjangan antara implementasi dan ketentuan Perda telah mengakibatkan ketidaksesuaian dalam pengoperasian angkutan kota. Kesimpulannya, meskipun telah ada Perda yang mengatur penyelenggaraan perhubungan di Kabupaten Karawang, masih ada tantangan dalam memastikan kepatuhan penuh terhadap peraturan tersebut. Diperlukan tindakan lebih lanjut untuk mengkaji dan memperbaiki pelaksanaan angkutan kota agar sesuai dengan standar yang ditetapkan dalam Perda, sehingga masyarakat dapat menikmati layanan angkutan yang aman, nyaman, dan efisien.

Abstract

This journal discusses the Legal Protection of Child Victims of Sexual Exploitation. What is meant by child sexual exploitation is the use of children for the purpose of fulfilling sexual desires. Children as victims of criminal acts need to be protected in accordance with what is regulated in Law No. 35 of 2014 concerning Child Protection so that in the future the child is expected to be able to continue his life like children in general and no longer have the feeling that he is a victim of crime. This paper uses a juridical-empirical legal research method with a qualitative approach. The results that can be taken from this paper are that the legal protection of children as victims of sexual exploitation based on Law No. 35 of 2014 concerning Child Protection has provided legal protection in general for children as victims of crime and specifically for children who are sexually exploited.

Abstract

One consumer right that is no less important is the right to choose. When choosing a product, consumers are often influenced by several considerations, for example price and brand. Price and brand tend to dominate, many consumers will be tempted to buy goods at BM because brands offer low prices. This research aims to finds and analyze legal protection for consumers regarding the circulation of branded bags that are not accompanied by official documents (for example the case of the circulation of branded bags in Batam), as well as to find out and analyze the Government's efforts or supervision from the Government to minimize circulation of branded bags that are not accompanied by official documents (example is the case of the circulation of branded bags in Batam). The type of this research is normative law in descriptive analytical. The data collection technique used is studying legal material literature which includes primary legal material, secondary legal material and non-legal material. The data analysis method is qualitative analysis. The research results shows that the practice of buying and selling branded bags in Batam violates consumer protection law because it does not provide a product certificate as an official document from the manufacturer to demonstrate the authenticity of the product. Therefore, the practice of buying and selling branded bags in Batam does not fulfill the right to correct information for consumers.

Abstract

This study are supposed to determine the criminals' criminal responsibility of persecution of debt collectors by using a case study of the Palembang District Court Decision Number 261/PID/2019/PLG. This research uses research on normative juridical that is done through looking at and studying library materials and laws and regulations or legal materials which include primary legal sources, secondary legal entities, and tertiary legal entities. This research uses a statute approach and case approach. Primary legal sources being used in this study are the 1945 Constitution of the Republic of Indonesia, Law Number 1 of 1946 on the Criminal Code, and Law Number 8 of 1981 on Criminal Procedure. Analysis method in this study is qualitative juridical analysis method. Based on the findings of this study, it could be stated if the maltreatment can cause victim unable to do his work due to the pain experienced, but does not result in serious injury or is not intended to result in serious injury, the maltreatment can be punished under Article 351 paragraph (1) of the Criminal Code or Article 466 paragraph (1) of the Criminal Code.

Abstract

The principle of territoriality is one of the fundamental principles in Intellectual Property Rights (IPR) which is regulated in Trade Related Aspects of Intellectual Property Rights (TRIPS). This principle gives authority to the state to regulate IPR according to the circumstances and needs of the state. This territorial principle allows a country to design intellectual property laws in a way that is consistent with its goals. This study uses a normative juridical method with a statutory and comparative law approach. Regulations regarding territorial principles in the regulation of Geographical Indications (GI) are contained in Article 22 (1) TRIPs, where TRIPs are the basis for the rules (minimum standards) for regulating GI protection. In addition, GI protection is contained in the Lisbon Agreement for the Protection of Appeals of Origin and their International Registration 1958 and in the Madrid Protocol. Indonesia regulates GI protection in Law Number 20 of 2016 concerning Trademarks and Geographical Indications and in Government Regulation Number 12 of 2019 concerning Geographical Indications. Indonesia must regulate GI well because it has great potential to increase people's income. Apart from that, Indonesia must also register Indonesian GIs in the international registration room, so that there is no misuse in their use.

Abstract

Aviation related issues include low supervision of airlines in Indonesia, the condition of aircraft that are old and less feasible and high rates of flight accidents. Management negligence and mistakes reach a level that endangers state security. An airline is an organization that provides flight services including cargo to passengers. They provide these services and form cooperation or alliances with other airlines for mutual benefit. However, the relationship between customers and airlines can sometimes lead to ruthless legal battles and violent conflicts. This paper discusses legal protection for airline customers in Indonesia. It seeks to investigate not only the legal arrangments regarding air transportation in Indonesia but mechanism to minimize/prevent disputes between consumers and airlines. Consumer dispute resolution with airlines refers to the Consumer Protection Act and Aviation Law. The research reveals that consumer-airlines conflicts can be resolved outside of the court through several dispute resolution models, including Consumer Dispute Settlement Agency, Non-Governmental Consumer Protection Agency, the Directorate of Consumer Protection agreed by the parties, based on Article 1338 of the Civil Code. This paper also show that it is necessary to make a simple dispute resolution system specifically for airline consumers in the form of an airline consumer dispute resolution assembly or a special arbitration agency.

Abstract

The validity of marriage in Indonesia is considered to have religious overtones, religious elements that dominate the requirements for a valid marriage, so there is a degradation of the achievement of the unification goal of the Marriage Law which refers to the uniformity of holding marriages for every citizen. Pluralism in Indonesia with its diversity of ethnicities and nations is not actually an obstacle for a woman and a man in Indonesia to get married. The vulnerability to interfaith marriages is quite high due to the large number of religious diversity that is recognized by the constitution but interfaith marriages are marriages that are prohibited and not recognized by the Marriage Law in Indonesia. In the perspective of Human Rights (HAM) religious marriage is not prohibited and freedom is given to brides and grooms of different religions to be able to carry out the marriage (non-derogable rights). This research is a legal research (doctrinal research) with a conceptual approach (conceptual approach), the legal approach (statues approach), and the case approach (cases approach). The results of this study explain first, the Court, in the life of the nation and state based on Pancasila and the 1945 Constitution, religion is the basis and the state has an interest in matters of marriage, it cannot only be seen from a purely formal aspect, but must also be seen from a spiritual and social aspect. Religion determines the validity of marriage. Second, interfaith marriage is part of the universal right that every individual has to carry out marriages to brides of different religions and marriage is part of a right that cannot be limited and reduced by differences in religion.
