Abstract

PT. Pegadaian in Indonesia are regulated in Law Number 21 of 2011 concerning the Financial Services Authority and regulated in the Civil Code. Looking at the problem of damaged consumer pawn objects due to PT. Pegadaian, four-wheeled vehicles are often the object of pawn collateral for loan funds. The debt and receivable agreement and the additional guarantees are not free from errors on the part of one of the parties, such negligence is a breach of contract. Based on the losses experienced by consumers due to damaged pawned goods, the parties must resolve the dispute. This research aims to determine the legal protection for customers as consumers for damage to collateral objects as well as to determine the resolution of disputes between the parties. The research method used in this writing uses normative juridical research methods. The author uses research methods with primary, secondary and tertiary legal materials. The data analysis method used by the author is a qualitative method, namely describing the research results from two variables, namely cause and effect by involving legal materials. The results of the research are in accordance with the problem formulation, namely that the pawnshop must take care of the collateral so that damage does not occur in accordance with existing regulations, legal protection for consumers can be given repressive legal protection, and dispute resolution can be carried out through mediation. It is hoped that suggestions regarding this problem will enable pawnshops to pay more attention to collateral items which are pledged as deposits, and to be able to care for collateral items properly to prevent damage which could result in losses for consumers.

Abstract

Ilmu mantiq merupakan ilmu yang mempelajari tentang logika, ilmu mantiq pertama kali dipopulerkan oleh para filsuf yunani yakni Sokrates, Plato, dan Aristoteles. Kehadiran ilmu mantiq di dalam Islam membawa perbedaan di kalangan para ulama, yakni dalam hal mempelajarinya, Imam An-Nawawi adalah salah satu ulama yang mengharamkan mempelajari ilmu mantiq, sedangkan Imam Al-Ghazali adalah salah satu ulama yang memperbolehkan mempelajari ilmu mantiq bahkan menganggap mempelajarinya adalah fardhu kifayah. Tujuan dari penelitian ini adalah untuk mengetahui pandangan Imam An-Nawawi dan Imam Al-Ghazali terkait dengan mempelajari ilmu mantiq, kemudian untuk mengetahui analisis perbedaan pendekatan dan sudut pandang yang digunakan oleh Imam An-Nawawi dan Imam Al-Ghazali dalam mempelajari ilmu mantiq. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian kepustakaan, data yang diambil melalui studi yang mendalam terhadap literatur-literatur yang relevan, seperti buku, artikel, dan tulisan-tulisan Imam An-Nawawi dan Imam Al-Ghazali. Imam An-Nawawi melarang mempelajari ilmu mantiq karena menggagap ilmu mantiq merupakan inti dari filsafat, sedangkan Imam Al-Ghazali menganggap ilmu mantiq sebagai penghantar dari filsafat.

Abstract

This research began with the discovery that the Al-Qur'an has advantages and superiority over the holy books of other religions, this is because the Al-Qur'an was revealed in Arabic and the unique thing about Arabic is the language that has the most and most complete rules in the world, therefore opens up opportunities for writers to highlight the superiority of the verses of the Qur'an contained in Arabic, apart from being superior in terms of rules, the Qur'an is also superior in terms of harmony. and the correspondence between the verses at the beginning of the surah and the verses at the end of the surah, the verses at the beginning of the surah are known as fawatih al-suwar while the verses at the end of the surah are known as khawatim al-suwar. The study of looking for correlations between verses in the Qur'an is called the term munasabah in 'ulumul Qur'an, this munasabah study has a broad object, so in this research the author limits the research to al-sab'u al-thiwal (seven surahs which is long in the Koran). This research is of an ijti Prize nature, therefore it requires a comparison between two tafsir books which both discuss the munasabah of verses in the Qur'an, the two books are the book Tafsir al-Bahru al-Muhith Fi al-Tafsir by Abu Hayyan al- Andalusy and the book Nazmu ad-Durar Fi Tanasubi al-Ayati Wa al-Suwar by al-Biqa'i. There has been research on the munasabah of this verse, but there has been no research on the munasabah of fawatih al-suwar and khawatim al-suwar which compares tafsir books with a lughawi style as the author did in this research. This research was carried out using a pure literature review. , using data analysis methods from various primary and secondary documents. The main primary data in this research took the book of tafsir al-Bahru al-Muhith Fi al-Tafsir by Abu Hayyan al-Andalusy and the book Nazmu ad-Durar Fi Tanasubi al-Ayati Wa al-Suwar by al-Biqa'I, while the data Secondary data is taken from other data which is considered related to the theme of munasabah between verses of the Koran. The results of this research show that there are similarities and differences in the interpretation of the two tafsir books. The similarities between the two interpreters convey the same interpretation between the verses at the end of the previous surah and the verses at the beginning of the following surah, this is found in three places, and the differences are found in four places, from the results of comparing these two tafsir books, conclusions can be drawn that in looking for the munasabah between fawatih al-suwar and khawatim al-suwar in al-sab'u al-thiwal, the interpretation of al-Bahru al-Muhith is superior, because this commentary explains the munasabah between verses complete with the redaction of the verses that are interpreted and explains in detail lughawi rules contained in each verse.

Abstract

The main factor in achieving maximum success in using BOS funds is how the school manages BOS funds. A good management system will help achieve the goals of the BOS funding program effectively and efficiently, which of course can improve the quality of education as expected. Corruption in the education sector is one of the most difficult forms of corruption to deal with. Corruption in the education sector is very dangerous, because it endangers the future of the country. The reason of this examination is to reveal the variables that driven Central SDN Kopa to commit the criminal act of debasement with regard to the School Administration Support, to find out what the legal sanctions are against a school principal who commits a criminal act of corruption against school operational aid funds, and how to analyze decision Number: 35 /Pid.Sus-TPK/2020/PN. Abstract

Criminal cases, both large and small cases or serious and minor cases, are all resolved through a judicial mechanism which results in imprisonment, as a result of overcapacity in prison, apart from that the convict and the victim still have dissatisfaction, of course, other alternatives to consider such as the concept of restorative justice . The restorative approach is a process of solving criminal acts that aims to restore the situation to its original state. The Attorney General's Office as an institution that is given the authority in terms of prosecution in criminal cases, of course, is also given the authority to terminate criminal cases, through the Regulation of the Attorney General of the Republic of Indonesia number 15 of 2020 concerning Cessation of Prosecution based on Restorative Justice, it can be possible for cases that comply with the criteria in the regulation.

Abstract

Seeing from the historical side, violence is one of the oldest social problems, which may be as old as human civilization, this is understandable because basically humans are homo homini lupus creatures, referring to the thoughts of the famous philosopher Aristotle, that humans can become wolves for others, can become "cannibals" in the sense that in certain situations humans can commit acts of violence against others both in physical and psychological forms. One form of violence that has been a serious problem for a long time is gender-based violence, especially against vulnerable groups, namely women. The phenomenon of violence against women is a global issue that continues to be discussed in various forums on a domestic, regional and international scale. Gender-based violence does not only target women, but can also occur in several other groups such as men, transgender or LGBT people. However, statistically, it does happen more to women. Gender-based violence targeting women is an act of terror against women that occurs quite a lot in various parts of the world Online Gender-Based Violence (GBV) has become a global phenomenon that is happening along with the progress and increased access to internet-based communication technologies. This research is a normative legal research that is reinforced with primary data to sharpen analysis. The results show that the forms of gender-based violence against women are cyber grooming, cyber harassment, hacking, illegal content, infringement of privacy, threat of personal photo/video distribution (malicious distribution), online defamation, and online recruitment. Legal protection for women victims of online gender-based violence refers to the regulations stipulated in the PKDRT Law, ITE Law, Child Protection Law, Pornography Law and TPKS Bill.

Abstract

This comparative study examines the regulations and implications of allowing Legal Persons to serve as directors in Limited Liability Companies (LLCs) in the United Kingdom and Indonesia. The legal framework governing LLCs in Indonesia is explored, with a focus on the role of the General Meeting of Shareholders, Board of Directors, and Board of Commissioners. The study highlights the evolution of Indonesian corporate law, influenced by both civil law and common law. In the United Kingdom, the study delves into the Companies Act 2006, which allows for Legal Persons to be appointed as directors alongside Natural Persons. It discusses the history of the concept of separate legal personality and limited liability in company law, drawing parallels between Indonesian and UK legal systems. The research further delves into the prohibition of Corporate Directors in the UK introduced through the Small Business, Enterprise and Employment Act 2015 and examines the reasons for this prohibition, including concerns related to transparency and accountability. The study assesses the status of this prohibition and the proposed exceptions, emphasizing the importance of balancing business efficiency with regulatory safeguards. In conclusion, the study suggests that Indonesia could consider regulations regarding the inclusion of Corporate Directors in LLCs but emphasizes the need for stringent limitations to prevent misuse, opacity, and financial crime. The research highlights the ongoing legislative process in the UK and recommends that Indonesian regulations on Corporate Directors should be tailored to promote efficient business growth while maintaining transparency and accountability.

Abstract

This research aims to analyze the legal implications of the misuse of photos from individuals' social media for content creation, focusing on the perspective of the Indonesian Council of Ulama (MUI) Fatwa No. 1 of 2005 on Intellectual Property Rights. A case study is conducted on Capcut creators in Medan as a representation of this phenomenon. The research methodology involves document analysis and interviews with several Capcut creators. this research, the author chose field research as the primary approach. This approach enables the researcher to approach respondents directly through interviews and observations. Interviews are defined as a verbal question-and-answer process between the researcher and respondents, conducted face-to-face to obtain direct information. In this context, the author conducted interviews with Capcut creators in the city of Medan. The findings indicate that the misuse of social media photos of others for content by Capcut creators in Medan may involve violations of intellectual property rights. MUI Fatwa No. 1 of 2005 provides legal guidance regarding the use of others' content; however, its implementation in the practices of Capcut creators still poses some issues.

Abstract

Abstract: Buying and selling land is an agreement where the party who owns the land, called the “seller”, promises and commits himself to handing over his rights to the land in question to another party, called the “buyer”. Based on Article 1457 of Civil Code (KUHPer), sale and purchase is an agreement in which one party binds himself to hand over an item and the other party to pay the promised price. Price can be interpreted as a legal means of certain payment in the form amount of money. In order for an agreement to be valid and binding on the parties, it must fulfill the conditions stipulated in Article 1320 BW, which are: agree by those who bind themselves; Capable of making the agreement, A certain thing, A lawful cause or cause. Reclamation comes from the word “reclamation”, which in English means renewing. Meanwhile, in terms of reclamation, it is a form of effort to expand land or create land that can be utilized, it is of course. Reclamation, which is a process of restoring land and is carried out by opening up new land in coastal areas, has many concepts applied by various countries in the world to utilize coastal areas. The goal of reclamation is to create new land for housing, agriculture, and industry. The reclamation land is most often found in coastal cities to increase housing capacity and build ports.

Abstract

Adolescence is a transition period from childhood to adulthood. During this period, many changes occur in teenagers, starting from the physical, knowledge, psychological, and moral and social dimensions. Juvenile delinquency is an act committed by teenagers that violates the laws and norms that apply in society so that it harms their parents, other people, disturbs the peace of society, and harms themselves. This research aims to determine the role of parents in overcoming the problem of juvenile delinquency in terms of Law Number 35 of 2014 concerning child protection in Pematang Johar Village, Labuhan Deli District. This research is a case study using interview, observation and documentation techniques, accompanied by books, journals and other related sources. The results of this research show: that the role of parents in dealing with juvenile delinquency is that parents must be the most important role for children by educating children from an early age by teaching Islamic religious values, for fathers to carry out morning prayers with their children at school. mosque, in the afternoon parents are taking their children to the TPA, sending their children to Islamic boarding schools and youth mosques, in the evening of Muharram parents register their children to take part in competitions at the mosque, send their children to training sports, entering a drug rehabilitation center for those affected by drugs, being a role model for children regarding good words, attitudes and actions at home and outside the home environment, being a counselor or supervisor for children, acting as a good communicator to children, being patient in educate children and always pray so that children become individuals who fear Allah SWT.
