Abstract

Corporate Social Responsibility (CSR) is a concept that states an organization (Company) has a responsibility towards consumers, employees, shareholders, communities and the environment in all aspects of the company's operations. For example, regarding problems that impact the environment, such as pollution, waste, product safety and labor. Based on Positive Law "Companies that carry out business activities in the field and/or related to natural resources are obliged to carry out Corporate Social Responsibility". This is because the company must have benefits that can be felt by the business environment and society. However, in reality, not all companies are able to realize Social and Environmental Responsibility is implemented it is not carried out well. The article with the title "Legis Ratio of Corporate Social and Environmental Responsibility towards Harmonious Interaction between Companies, Government and Society" was created for answering questions regarding how to implement Corporate Social Responsibility in companies in Indonesia, Why the Implementation of Corporate Social Responsibility in Companies in Indonesia is Still Many Obstacles and How to Create Harmony in the Interaction of Companies, Government and Society. Hoped that the results of this writing can be applied to create harmony in the interactions between companies, government and society.

Abstract

Di negara hukum seperti Indonesia, menaati aturan dalam bertindak di masyarakat adalah sebuah kewajiban. Namun tindakan yang tidak sesuai seringkali dilakukan oleh pihak-pihak yang tidak bertanggung jawab, terutama dalam konteks penyalahgunaan narkoba. Teknologi yang semakin canggih juga memperbesar peluang terjadinya kejahatan tersebut. Untuk mengatasi hal tersebut, Indonesia telah membentuk sistem peradilan pidana dengan memberikan sanksi kepada pelaku tindak pidana. Namun proses peradilan tidak selalu menghasilkan penjatuhan pidana yang sebanding dengan perbuatan yang dilakukan. Penelitian ini menggunakan metode penelitian hukum normatif untuk menganalisis alasan-alasan meringankan hukuman pidana dan dampaknya terhadap masyarakat. Diuraikan kasus tindak pidana narkotika, di mana tersangka mendapat pengurangan hukuman dari 10 tahun menjadi 8 tahun setelah melalui proses banding dan kasasi. Alasan meringankan pidana antara lain pertimbangan hakim terhadap berbagai faktor, seperti upaya terdakwa untuk mengurangi berat ringannya perbuatannya atau keadaan pribadi tertentu, meskipun hal ini diharapkan dapat menciptakan keadilan, namun tidak dapat dipungkiri bahwa hal tersebut mempunyai dampak. efek negatif. Konsekuensi ini mencakup peningkatan kejahatan, ketidakadilan dalam sistem peradilan, berkurangnya efektivitas rehabilitasi, potensi ancaman terhadap keselamatan masyarakat, dan berkurangnya pencegahan kejahatan. Mengurangi hukuman pidana juga dapat merugikan korban kejahatan, yang mungkin tidak puas dengan penyelenggaraan peradilan. Oleh karena itu, penelitian ini mencoba mendeskripsikan dampak tersebut secara rinci.

Abstract

The formation of legislation in Indonesia has been regulated through Law Number 12 of 2011 concerning the Formation of Legislative Regulations, where formal and material principles must be fulfilled so that they do not have the potential to become the object of formal review and the object of material review after being ratified by the Republic of Indonesia's House of Representatives Indonesia. The Draft Health Law for 2023 which was passed by the DPR RI received rejection from various parties. It has the potential for Discourse Network Analysis to be utilized in legal research to map the potential for judicial review of the health bill. Arguments expressed by actors through reporting in the digital mass media detik.com. From 42 valid news stories, 120 statements, 34 discourses (concepts) and 35 actors. The results obtained are that the discourse "Public participation is a consideration for ratifying the health bill" is the dominant discourse. Conflicts between actors indicate the principle of openness as a formal requirement for the formation of legislation is not fulfilled. After ratification of Law Number 17 of 2023 concerning Health, it has the potential to be submitted as an object of formal and material review to the Constitutional Court.

Abstract

The phenomenon of juvenile delinquency, or child crime, is currently frequently encountered, especially crimes that harm society or other people, such as criminal acts of theft committed by children. The purpose of this research is to determine the factors that influence children in committing a crime of theft and to analyze the decision of the Semarang District Court judge No: 2/Pid.Sus-Anak/2023/PN Smg in the crime of theft committed by a child. The method used in this research is the Normative Juridical Method, the specifications used are Analytical Descriptive, and the method used in this research is Literature Study. The influencing factors are caused by heredity and environmental factors. Congenital or hereditary factors are the first factor that influences a child's growth and development. This factor can be interpreted as all individual traits or characteristics that are inherited from children or all the physical and psychological potential that a person has from the time of conception as an inheritance from parents. Based on the provisions of Article 5 paragraph 1 of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, in resolving juvenile cases through the Juvenile Criminal Justice System, it is mandatory to prioritize a restorative justice approach.

Abstract

Development of technology today, the development and competition in the business field has also greatly increased. With the review column feature in the online application, business actors have many effective ways to promote products to be in demand by consumers in order to provide good reviews and reviews in the column provided by the application. In this regard, business actors need to pay attention to product reviews provided by consumers. Because the reviews given by consumers, both positive and negative, are very influential in the decision to buy products. However, many individuals are irresponsible in providing fake reviews that are not in accordance with reality that aim to bring down business actors. The purpose of this study is to analyze criminal sanctions for defamation actors in conducting business product reviews. This research uses a type of normative research, where normative legal research can be interpreted by doctrinal legal research and understanding the law to be a positive legal system in laws and regulations. The process of finding rules in law either regarding legal principles or doctrines that aim to answer legal issues. The results of the study frame that the activity of reviewing business products online is regulated in Article 27 Paragraph (3) of Law Number 19 of 2016 concerning amendments to Law Number 11 of 2008 concerning Electronic Information and Transactions, to aim to protect business actors in ecommerce in defamation.

Abstract

Implications and Factors Affecting PPAT Delay in Registering APHT to the Land Office, with the object of research is APHT to be registered APHT, this article aims to find out the Implications and Factors Affecting PPAT Delay in Registering APHT to the Land Office, with normative methods. The result is that the Land Deed Official (PPAT) in making the Deed of Granting Mortgage Rights (APHT) starts from the process of checking juridical data and documents, here the PPAT must be careful in checking the documents and is responsible for the implications caused by the PPAT's inaccuracy in checking, The second is in the process of APHT registration to the Land Office where the PPAT must be responsible for being on time according to Article l3 Paragraph (2) which states that no later than 7 working days after signing the APHT, the PPAT must send the APHT and other necessary documents to the Land Office. The 7-day grace period is calculated from the time the APHT is signed. Factors influencing the delay in the implementation of APHT making are first, from the parties who take a long time in collecting documents or exceeding the time limit, second, checking the Land Rights certificate at the Land Office which is said to be too long, third, namely writing errors in the deed, fourth, namely delays in APHT registration

Abstract

Child exploitation is the act of using children to obtain profits for personal needs without regard to the child's physical and mental condition. This research aims to find out and understand how law enforcement is against perpetrators of child exploitation, especially orphanages as one of the child protection institutions that exploit children as beggars through the TikTok application. The method used in this research is normative juridical. Data collection techniques are carried out by means of library studies and research on literature contained in journals, ebooks, and books. The exploitation of children is regulated in Law Number 35 of 2014, which regulates regulations and sanctions against perpetrators of child exploitation. The exploitation of children can be carried out by anyone, one of these perpetrators is an orphanage. Orphanages are child protection institutions, therefore law enforcement is needed against perpetrators of child exploitation to minimize the exploitation of children.

Abstract

Clothing is an essential need that is as important as food and shelter for humans. For business actors, this creates new business opportunities to provide quality clothing with various types and models but at affordable prices, so the idea arises for business actors to import used clothing. Importing used clothes is the activity of bringing used clothes from abroad into the country. These used clothes are offered at more affordable prices. This research aims to determine criminal sanctions against perpetrators who import used clothing. The method used in this research is normative juridical. The data analysis method is carried out by collecting data by reviewing primary legal materials and library materials or secondary legal materials, both in the form of documents and applicable laws and regulations. In Law Number 7 of 2014 concerning trade, regulations and sanctions are regulated against importers of used goods. The results of this research indicate that the import and trade of used clothing in Indonesia is an economic crime and is punishable by criminal penalties. Importing second-hand clothing is a criminal act of commissionism, namely a criminal act resulting from a violation of the orders of Law Number 7 of 2014 concerning Trade. Each violation carries a maximum prison sentence of 5 years with a maximum fine of 5 billion rupiah.

Abstract

This research aims to examine and analyze the implementation of restorative justice for cases of assault in the Surakarta City Police, as well as the factors that hinder its effectiveness. The methodological approach utilized is socio-legal, with a descriptive-analytical specification. Data sources consist of both primary and secondary data, gathered through interviews and document studies. Data analysis is conducted using qualitative analysis methods. The implementation of restorative justice for assault cases in the Surakarta City Police employs the Family and Community Group Conference model, involving families and community figures to reach comprehensive agreements. This formally refers to regulations such as Article 16 paragraph (1) letter L of Law No. 2 of 2002 regarding the Indonesian National Police, Article 69 letter b of National Police Chief Regulation No. 14/2012 concerning Investigation Management, and National Police Chief Regulation No. 8 of 2021 concerning Handling of Criminal Acts Based on Restorative Justice. Investigators take into consideration several aspects, including the belief that restorative justice is beneficial due to its win-win solutions principle and quick resolutions, prioritizing the principles of utility and legal fairness, as well as providing substantial understanding of law enforcement efforts that guide society. Factors hindering the implementation of restorative justice for assault cases in the Surakarta City Police include the conditions and motivations of involved parties, public unawareness of the authority of restorative justice by investigators, limited community role as social control, and cultural responses to the law. To address the challenges in implementing restorative justice, there is a need for the utilization of restorative justice within the criminal justice system through regulations governing its implementation at the investigative level.

Abstract

General elections are an important part of a democratic country. Based on Article 22 E of the 1945 Constitution, general elections in Indonesia are held periodically (every 5 years) using the direct, general, free, secret, honest and fair principles. Voting takes place during the general election process, which each voter exercises their right to vote by coming to the local polling station and voting on the ballot paper. This kind of process cannot be carried out in all provinces in Indonesia, considering the different natural conditions. The purpose of this study is to identify the voting model in the 2024 general election in the Papua Mountain Province, whose natural conditions are located in a mountainous area that is difficult to reach by road. The method of analysis that the researchers used in this study was normative legal analysis, with descriptive applications used as a specific type of analysis. Secondary data, which includes primary, secondary, and tertiary legal material is the type of data that is used in this study. Researchers use data collection strategies from literature studies to get data, the data was analyzed thorugh the application of qualitative analytical methodologies. The outcomes demonstrated that the Papua Mountain Provinces is use the noken system as its voting model for the general election in 2024.
