Abstract

BPN has partners to help carry out its duties and functions, one of which is PPAT, which is a public official who is given the authority to make authentic deeds regarding land rights, which has a working area that has different rules in Government Regulation Number 24 of 2016 which regulates PPAT's working area is one provincial area, whereas in Regulation of the Head of the National Land Agency Number 1 of 2006 it is one working area of the Land Office. This resulted in losses for the PPAT that forced to follow the BPN. This writing was carried out using the Statute Approach and Conceptual Approach, which aims to obtain legal certainty regarding the PPAT work area that should be followed. From the discussion, it can be seen that the source of BPN's authority to divide the PPAT area is based on the Head of Land Agency Regulation Number 1 of 2006 which regulates the work area of PPAT which follows the land office, and that the legal relationship between PPAT and BPN is specifically in the scope of the transfer of land rights is a horizontal legal relationship (mitra) so it should not be appropriate for one institution to impose its will which is contrary to the applicable laws and regulations

Abstract

The phenomenon of the birth of civil case decisions that do not reflect the fairness and balance of litigants will injure justice and legal certainty. The legal principle of hearing parties is a manifestation of the principle of balance in the litigation process in court, but in practice this is often violated because there has been no strict sanction for violations of legal principles in judges' decisions, and is only subject to violations of the code of ethics. This has legal implications for the final decision, whether it provides justice and balance for the litigants. Similarly, the real truth of a formal nature will be sought in the trial of civil cases in a fair and balanced manner. Using qualitative approach methods with primary and secondary data sources which will then be analyzed in an analytical descriptive way to answer legal issues and research objectives. The results showed that the application of the principle of balance of parties in the trial of civil cases that are fair and balanced, does not cause problems if applied by judges in accordance with the process in the HIR / RBG legislation. But if it is the other way around, it will have implications for a final verdict that does not reflect the fairness, balance of the parties and the sense of justice of the community.

Abstract

Pernikahan dini adalah peristiwa dimana pasangan melakukan pernikahan di bawah umur dengan batasan perempuan dan laki-laki dibawah umur 19 tahun. Untuk itu yang menjadi permasalahan dalam penelitian ini yakni apakah faktor-faktor yang mempengaruhi terjadinya pernikahan dini, bagaimana pengaruh pernikahan dini terhadap tingkat perceraian, bagaimana cara atau solusi yang efektif untuk menghindari terjadinya perceraian pada pernikahan dini yang berlokasi di kecamatan medan belawan kota medan. Penelitian ini bertujuan untuk mengetahui mengetahui penyebab, dampak atau pengaruh dari pernikahan dini di Kecamatan Medan Belawan Kota Medan juga untuk mengedukasi masyarakat mengenai pengaruh dari pernikahan dini. Penelitian ini menggunakan metode pendekatan kualitatif yang bersifat empiris, penelitian ini dilakukan dengan observasi lapangan, wawancara dan dokumentasi di lokasi penelitian yaitu Kecamatan Belawan, Medan, Sumatera Utara juga pengambilan data dari Lembaga yang berkenaan dengan penlitian penulis sebagai data pendukung. Kasus pernikahan dini di Kecamatan Medan Belawan setiap tahunnya mengalami kenaikan dan penurunan, bahwasanya setiap tahun ada kenaikan kasus perceraian pernikahan dini yang jika dipersentasekan adanya kenaikan 50% kasus pada setiap tahunnya di Kecamatan Medan Belawan. Kasus pernikahan dini yang terus ada setiap tahunnya di Kecamatan Medan Belawan disebabkan dari beberapa faktor yaitu kurangnya pendidikann sex (sex education), faktor pribadi, faktor ekonomi, faktor lingkungan. Pengaruh dari pernikahan dini yang terlihat di Kecamatan Medan Belawan ini terlihat pada terus meningkatnya kasus perceraian yang terjadi di Kecamatan Medan Belawan, solusi terhadap permasalahan pernikahan dini di Kecamatan Medan Belawan ini adalah mengefektifkan peran BP4 Kecamatan. Peneliti menyarankan kepada para orang tua untuk melakukan filtrasi terhadap setiap perkembangan sang anak agar hal-hal negative yang tidak diingkan tidak terjadi pada anak juga pendidikan sex (sex education) sangat diperlukan, hal itu dapat dilakukan oleh Lembaga-lembaga pemerintahan yang terkait. Penelitian ini dapat ditarik kesimpulan yaitu kasus pernikahan dini di Kecamatan Medan Belawan masih mengalami kenaikan dan penurunan setiap tahunnya yang berakibatkan pada tingginya angka kasus perceraian setiap tahunnya di Kecamatan Medan Belawan.

Abstract

Legal politics of regent regulation number 63 of 2016 Regency Tulungagung is involved in controlling environmental damage due to mining sand is a purposeful field study to answer the questions: 1. What is the Political Basis for Legal Regulations Regent Number 63 of 2016 Tulungagung Regency Under control Environmental Damage Due to Sand Mining and 2. What is the View Siyasah Syar'iyyah Fiqh on the Political and Legal Basis of Regent's Regulations Number 63 of 2016 Tulungagung Regency in Damage Control Environmental Effects of Sand Mining The type of research taken by the author is qualitative research with uses the nature of descriptive research, namely research directed at provide symptoms, facts or events systematically and accurate. The data sources used are primary and secondary data sources. Data Primary data is obtained from the results of analysis of statutory regulations related to research on legal political policy, regent's regulation number 63 2016 Tulungagung Regency in controlling environmental damage while secondary data from the research object is interviews, opinions of para experts in the form of books, journals and scientific works, as well as parties with related agencies. The results of this research show that legal political policy is regulatory regent number 63 of 2016 Tulungagung Regency in control environmental damage according to regent's regulation number 63 of 2016 is experiencing juridical defects and not implemented properly and do not meet standards AUPB, this is the first because there are two regulations that are the same where one of them should be removed and the contents of the implementation can be regulated more detailed and directed according to the rules above, but not here. So that In this case, the regulations alone are not appropriate, let alone the legal content where the Environmental Service should be able to take action against sand mining illegal and reclaiming environmental damage, but what is happening is not possible. that there is poor participation within the scope of correlation and regulation of the Tulungagung Regency government must be fixed immediately. Islam holds the view that it is an act of pollution The environment can be categorized as deep mafasid (damage). the principles of Islamic teachings must be avoided and overcome Regarding the solution, the author concludes that there must be firmness and role which is real for the Tulungagung Regency government, both executive and government legislative as well as improving regulations and repealing old rules with a view tidying up and strengthening the authority of the District Environmental Service Tulungagung through regent regulations

Abstract

This research discusses identity forgery in marriage. Identity forgery is a form of crime that often occurs. The focus of the research raised is: 1) What are the forms of identity falsification in the context of marriage that occur in practice in the community? 2) How is the regulatory and legal framework in Indonesia that regulates cases of identity forgery in marriage? This research uses normative legal research methods, questions are analyzed by combining legal materials (which are secondary data). The conclusions of this research are: It is important to implement security measures and conduct careful identity verification in the context of marriage to prevent cases of identity forgery, it is also important to note that regulations and laws are subject to change, and up-to-date verification from official sources or consultation with legal experts is recommended for a more accurate and up-to-date understanding.

Abstract

Competency evaluation is crucial components in the acceptance of foreign doctors in Indonesia, foreign doctor will be assessed for their ability and quality to help the improvement of health services standard in Indonesia. Many Indonesian citizen seeking medical treatment abroad and caused the country losing Rp.165 tillion, which may be due to the populace’s preference for services provided by hospitals overseas. Law are established to fulfill 3 principles; justice, benefits, and certainty. Regulation regarding foreign doctor practicing in Indonesia fulfills the principle of benefit in accordance with Article 2 letter c of Law Number 17 of 2023 concerning Health Law, which states that the principle of benefit in health development must provide the greatest benefit for humanity and a healthy life for every citizen. The method used in this research is normative juridical research with an approach through legislation and examination of norms and rules applicable in Indonesia.vThe government has made quite a lot of regulations governing the utilization of foreign healthcare workers. However it would be even better if the regulations itself could be harmonized and have many benefits to increase the quality of health services in Indonesia.

Abstract

Tindak pidana perdagangan orang (TPPO) merupakan kejahatan luar biasa yang melanggar hak asasi manusia. TPPO dapat menimbulkan berbagai dampak negatif bagi korban, baik secara fisik, psikis, maupun sosial ekonomi, salah satu upaya untuk memulihkan korban TPPO adalah melalui restitusi. Tujuan dari penelitian ini adalah untuk menganalisis peran restitusi dalam TPPO. Penelitian ini menggunakan metode penelitian kualitatif. Teknik pengumpulan data pada penelitian ini dilakukan dengan studi pustaka. Data yang telah terkumpul kemudian dianalisis menggunakan tiga tahapan yakni reduksi data, penyajian data dan penarikan kesimpulan. Hasil penelitian menunjukan bahwa restitusi berperan sebagai pemulihan dan perlindungan hukum bagi korban perdagangan manusia. Dalam praktik peradilan pidana di Indonesia, hukuman kewajiban membayar restitusi dapat diganti dengan pidana penjara. Pidana bukan semata-mata efek jera terhadap terpidana saja yang perlu diperhatikan tetapi pemulihan kepada korban kejahatan itu sendiri melalui restitusi yang harus diperhatikan.

Abstract

The Civil Service Police Unit, abbreviated as Satpol PP, is an instrument of the Regional Government in maintaining peace and public order and enforcing Regional Regulations. In this article, the role of the Semarang Regency Satpol PP is to have the authority to control and supervise advertising violations related to permits and installation procedures, whether carried out in a persuasive or repressive pattern. The efforts made in the disciplinary operation for holding advertisements carried out by the Semarang Regency Satpol PP had several obstacles. These obstacles are the size of the area, the lack of Satpol PP personnel and the lack of mobilization facilities used. So the Satpol PP has a solution, namely coordinating with BKUD regarding Semarang Regency PP permits and taxes by collaborating with the Semarang Regency Regional Financial Agency (BKUD). Abstract

In the contract law that applies in Indonesia, an agreement can be canceled if the agreement is made through mistake, coercion and fraud. However, in the development of civil practice, it is also known that there is abuse of circumstances (misbruik van omstandigheden) as a reason for canceling an agreement. In the legal system in force in Indonesia, abuse of conditions in agreements (misbruik van omstandigheden) is a relatively new topic in the study of Indonesian civil law, both in theory and judicial practice. The court decision that is the study of the doctrine of abuse of circumstances in agreements is the case between Parluhutan Sirait and Benny Arifin as stated in the Palangka Raya District Court Number 160/Pdt.G/2016/PN Plk. From this decision it can be concluded that the agreement made by the parties must be balanced in terms of determining the rights and obligations given to the parties. Where debtors and creditors have an equal bargaining position. If an imbalance is found in the agreement, the judge can make his own judgment as to the basis for misuse of the conditions in the agreement. In this decision, the panel of judges had noticed indications of abuse of opportunity which became the basis for applying the doctrine of abuse of circumstances which was possible due to the imbalance and incompatibility of the positions of the parties involved in the agreement.

Abstract

In essence, law enforcement is the process of making efforts to enforce or function real legal norms as guidelines for behavior in traffic or legal relations in social and state life. Thus, in short, law enforcement is an effort made to make the law, both in the narrow formal sense and in the broad material sense, a guideline for behavior in every legal act, both by the legal subjects concerned and by law enforcement officials who are officially given duties and authorities by law to ensure the functioning of legal norms that apply in social and state life. Law enforcement efforts for violations of written orders are carried out by imposing sanctions as regulated in the provisions regarding written orders, namely criminal sanctions as regulated in the OJK Law. In its development, sanctions for violations of written orders are not only in the form of criminal sanctions but also administrative sanctions, this can be seen from the regulations in POJK Number 35/POJK.05/2016 concerning Procedures for Determining Written Orders in the Insurance Sector, POJK Number 18/POJK.3/ 2020 concerning Written Orders for Handling Bank Problems, and POJK 40/POJK.05/2020 concerning Written Orders for Handling Nonbank LJK Problems, apart from criminal sanctions as regulated in the OJK Law there are also administrative sanctions for violations of written orders, namely in the form of written warnings, restrictions business activities, and revocation of business permits, written warnings and prohibitions as the main party. This can be interpreted as meaning that criminal sanctions in efforts to enforce the law of written orders in the financial services sector are imposed as ultimum remidium.
