Abstract

Perkawinan ialah ikatan lahir batin antara seorang pria dengan seorang wanita sebagai suami istri dengan tujuan membentuk keluarga (rumah tangga) yang bahagia dan kekal berdasarkan Ketuhanan Yang Maha Esa. Perkawinan pada umumnya harus di catatkan di pegawai pencatat nikah. Akan tetapi sampai sekarang masih ada kurang lebih 33 orang di Desa Pasir Jae yang perkawinannya belum terdaftar atau belum di catatkan. Berdasarkan Pasal 2 ayat (1) dan (2) Undang-Undang Nomor 1 Tahun 1974 tentang perkawinan. Ayat (1) menentukan bahwa perkawinan adalah sah apabila di lakukan menurut hukum masing-masing agama dan kepercayaan. Ayat (2) menentukan bahwa tiap-tiap perkawinan harus di catatkan menurut peraturan perundang-undang yang berlaku. Dari pasal tersebut dapat di pahami bahwa sebuah perkawinan sah apabila dilakukan menurut hukum masing masing agamanya dan kepercayaannya itu. Ini berarti bahwa jika suatu perkawinan telah memenuhi syarat dan rukun nikah atau ijab kabul telah dilaksanakan (bagi umat Islam). Maka perkawinan tersebut adalah sah terutama di mata agama dan kepercayaan masyarakat perlu di sahkan lagi oleh negara. Perkawinan yang tidak memenuhi Pasal (2) ayat (2) Undang-Undang Nomor 1 Tahun 1974 ini menimbulkan banyak kerugian bagi istri maupun anak yang dilahirkan. Terkait dengan hak-hak mereka dalam menuntut pembagian harta benda, dan lain sebagainya. Tuntutan pemenuhan hak-hak tersebut manakala terjadi sengketa akan sulit di penuhi karena tidak adanya bukti catatan resmi perkawinan yang sah. Tidak dapat di pungkiri bahwa untuk menentukan ukuran tentang sah dan tidaknya seorang anak yang dilahirkan. Hal tersebut tidak terlepas dengan persoalan keabsaan perkawinanyang di lakukan oleh kedua orang tuanya. Hak-hak anak tersebut dapat terlanggar, seperti tidak dapat mewarisi dari ayahnya secara hukum negara, meski secara agama anak tersebut mempunyai hak atas hal tersebut. Berdasarkan latar belakang tersebut di atas, maka penelitian ini membahas lebih lanjut mengenai status hukum hak anak yang lahir dari perkwinan tidak tercatat di kantor pegawai sipil. Rumusan masalah yang akan di bahas adalah mengapa masyarakat di Desa Pasir Jae melakukan perkawinan tidak tercatat, faktor penyebab perkawinan tidak tercatat di Desa Pasir Jae Kecamatan Sosa.

Abstract

This study aims to (1) find out the factors behind the ban on marriage for prospective brides who are still in education and (2) find out the analysis of sharia maqashid related to the ban on marriage while still in the study period. This study was designed with qualitative methods to be able to explain in detail about the prohibition of marriage while still in education. This research is a type of field research that takes references from books whose subjects prohibit marriage. While the object of this study is the bride and groom who are prohibited from marrying while still in education. To collect data, researchers use reading techniques and then record the results. While the analysis technique is descriptive. The results of this study are: The ban on marriage made by parents is only temporary and not eternal, so it is in accordance with the order of Maqashid Sharia, namely hifz aqli (maintaining reason / science) both religious science (ukhrawi) and knowledge (worldly) obtained by learning the main. With Science will be fulfilled another primary need. Seeking knowledge in Islam is compulsory for every Muslim, it is contained in the Qur'an and Hadith. Then the background of the ban on marriage for brides who are in the study or education period, one of the factors is the concern of the elderly about the future of their children, the economy, social norms and factors of the development of the times and technology that is growing rapidly.

Abstract

Impartiality is basically a principle that is applied to the mediation process, where the mediator is obliged to apply this principle without taking sides with either party. However, as development continues to progress, it is found that there are parties who actually litigate issues based on bad faith. This is usually called a vexational lawsuit, which is filed by a party with the sole aim of annoying the opposing party. Based on this, it is then worth exploring the position of the principle of impartiality by mediators in the mediation process when faced with filing a lawsuit which is indicated to be a vexatious lawsuit which could of course end up harming one of the parties. The type of research used is normative juridical. The approach is towards statutory regulations and legal concepts. The research results found that the principle of impartiality is a basic principle that must be applied by mediators in the mediation process. The indication that there is a vexatious claim does not actually constitute the mediator's authority to assess further to side with one of the parties. The mediator only focuses on reconciling the parties. The position of the principle of impartiality must therefore still be upheld, because it is a standard concept in civil law which is related to the realization of legal certainty.

Abstract

Insurance is a form of transferring personal risk into shared risk. Likewise, what happened with health insurance in Indonesia which was formed based on Law Number 24 of 2011 concerning Social Security Administering Bodies. The fact is that in implementing this Law there are still many complaints from people using government insurance regarding health services both in hospitals and health services. others are not optimal. The community as participants in the Social Security Administering Agency for Health who are also consumers whose rights are not fulfilled feel that they are served in a discriminatory manner by hospitals and family doctors, of course for various reasons given. The aim of this research is to find out to what extent BPJS is responsible for reducing the class category of BPJS participants based on the premiums that have been paid. The research method used is normative juridical research which refers to library research through data collection and then data analysis and drawing conclusions based on deductive thinking methods. The place of research is not research because the nature of the research is library research. The research results show that consumers in health services often receive unfair treatment, namely not in accordance with the rights they should receive. Even though patients as consumers have the right to receive compensation, compensation and/or reimbursement for the difference in the value of contributions paid. This is clearly regulated in Law Number 8 of 1999 concerning Consumer Protection Article 4 Paragraph (8) that "Consumers have the right to receive compensation, compensation and/or replacement if the services received are not in accordance with the agreement or are not as they should be.”

Abstract

The existence of regulations regarding Collective Management Institutions (LMK) in Law 28/2014 and the existence of monetization on YouTube should prevent YouTubers from copyright violations, because Article 87 of Law 28/2014 regulates that the use of works and/or is not considered a violation of Law 28/2014. Related Rights products commercially by users as long as the user has carried out and fulfilled the obligations in accordance with the agreement with LMK. However, there is one very interesting case to be studied in Decision 41PK/Pdt.Sus-HKI/2021 where the Defendant is the creator and owner of video content through the account/channel of YouTuber Gen Halilintar which has been monetized and has paid royalties to LMK, namely Wahana Musik Indonesia (WAMI) was sued by PT Nagaswara Publisherindo which is the copyright holder of a song creation (music and lyrics) entitled "Lagi Syantik" "Ciptaan". The purpose of writing this article is to find out and describe YouTubers' legal protection for video publications that have been monetized for distribution of royalties by LMK (Study Decision No. 41PK/Pdt.Sus-HKI/2021). The research method used is normative legal research. The results and conclusions show that legal protection is given to YouTubers who have monetized and paid royalties to their creators through LMK but must still pay attention to moral rights over the creation, namely by not making modifications to the creator's work.

Abstract

This research addresses issues related to the debt relationship in the peer-to-peer lending scheme in Indonesia, focusing on creditors' rights to file for bankruptcy against debtors and the concept of an insolvency test. In the context of technological advancements, peer-to-peer lending serves as a digital solution for the interaction between debtors and creditors. Despite providing an efficient alternative, this scheme is not without risks, especially when debtors are unable to repay their debts. Concerns arise regarding whether aggrieved creditors can directly file for bankruptcy without adequate assessment of the debtor's assets. The insolvency test concept is crucial to prevent premature bankruptcy decisions. This research employs legal research methods with literature, historical, and artificial intelligence (AI) approaches. Through literature analysis, legal regulation evaluations, and historical approaches, the study aims to understand the norms, principles, and legal aspects involved in peer-to-peer lending bankruptcy. AI and machine learning are utilized for analyzing large datasets related to bankruptcy cases, while natural language processing expedites the analysis of legal regulation texts and related documents. The research results discuss the development of bankruptcy laws in Indonesia and the regulation of peer-to-peer lending. It is argued that a profound understanding of creditor rights, insolvency tests, and the dynamics of the peer-to-peer lending scheme is essential in developing legal policies that align with technological advancements and societal needs.

Abstract

Young marriage is one of the marriage activities carried out by underage couples or when they are still students. Young marriage has been widely practiced by Indonesian people who still do not understand harmony in the household. The purpose of this writing is to analyze the implementation of young marriage in household harmony. The method used in the research uses a qualitative type. The results obtained by harmony in a household can be seen from the achievement of good communication, relationships based on love, peace and happiness. Based on a literature study conducted, some households have not been able to achieve a sense of harmony in the household due to several factors, one of which is the age of the husband or wife. This could be caused by the psychological feelings of the bride and groom who are not yet stable or immature, so that it will be more dominant in triggering conflict in the household. Apart from that, conflicts within the household can also arise due to economic problems.

Abstract

Differences in legal systems between countries give rise to various basic rules regarding international trade contracts. Efforts made to harmonize this were by holding an international convention by The International Institute for the Unification of Private Law (UNIDROIT) which gave birth to The UNIDROIT Principles of International Commercial Contracts (UPICCs). UPICCs are actually used as a legal basis for implementing international trade contracts. The formulation of the research problem is how is the principle of freedom of contract, the principle of good faith and fair dealing regulated in international law and national law?, and what are the challenges of implementing the UNIDROIT principle in international trade contracts in Indonesia? ? This research is normative legal research and is analytical descriptive. The results of the research are that international law regulations regarding the principle of freedom of contract, the principle of good faith and fair dealing are regulated by UPICCs. Meanwhile, regulations in national law can be seen in the Civil Code and the ITE Law. S Because the UPICCs regulate many matters that are not detailed in Book III of the Civil Code, the challenge is the unification and codification of contract law to provide legal certainty, with uniform provisions that can be universally accepted by countries involved in international trade.

Abstract

The focus of this research is Decision No. 2959 K/Pdt/2022 relating to the practice of legal smuggling through the use of a nominee agreement between a foreigner (Louise Marie France) and an Indonesian citizen (Desak Nyoman Kartini) in the acquisition of a plot of land as stated in Certificate of Title No. 5030 located in the Jimbaran area, Bali. Afterwards, Desak Nyoman Kartini transferred the land to a third party through a sale and purchase transaction without the knowledge of the foreign party (Louise Marie France). The main purpose of writing this article is to examine the regulations regarding the ownership of land rights and nominee agreements in the ownership of land rights by foreigners in Indonesia. In addition, this research aims to assess the suitability of Supreme Court Decision No.2959 K/Pdt/2022 with Law No.5/1960 and its implementing regulations in Indonesia. This research uses the normative legal method (yuridis normatif), which examines and analyzes norms in the form of laws and court decisions. The research findings show that Decision Number 2959 K/Pdt/2022 has not fully complied with the provisions stipulated in Law No.5/1960 and its implementing regulations, thus not providing legal certainty for justice seekers.

Abstract

Guardians are one of the most important components in marriage. The presence of a guardian is a determining factor in the legitimacy of the marriage. In the view of some people, perhaps someone's trust is considered too great, given the right of a guardian who can force his child to marry without having to ask for the child's consent. Under the pretext of freedom to choose their own partners, so many people think that the rights of guardians in modern times need to be reviewed and some even think it is not worth implementing. This short article tries to disentangle views by exposing the opinions of scientists regarding the rights and position of guardians in marriage. This research method uses a normative juridical method, namely an approach that looks at a law or a set of regulations that are normative in nature (law in book). the scholars. The method used in this research is the analytical method. This type of research is library research, where the sources are obtained by searching scientific journal articles and books related to the topic of discussion.
