Abstract

This research aims to analyze how parents are responsible for children who commit criminal acts. Children often do not receive the right parenting style by parents or institutions for child development and education, so many children are trapped in juvenile delinquency. Giving permission for minors to drive motorized vehicles is a form of lack of parental responsibility towards their children, because apart from requiring driving skills, a strong mentality and a sense of responsibility are needed when driving, this is necessary to prevent undesirable things from happening. like a traffic accident. However, if the child is the perpetrator of a traffic crime and the parents find out, they can be held criminally responsible for the traffic crime committed by their child. So it can be concluded that in this research the author describes the requirements for criminal responsibility of a child as a criminal as well as the role of responsibility of the child's parents in the responsibility of parents towards children who are perpetrators of criminal traffic accidents which cause death in Pematangsiantar.

Abstract

The Indonesian government's legal policy in the environmental sector has been regulated in Article 28H paragraph (1) and Article 33 paragraph (4) of the 1945 Constitution of the Republic of Indonesia, namely regarding the right to a good and healthy environment as a human right and the implementation of the national economy based on the principles of sustainable and environmentally sound development. To increase investment and make it easier to obtain environmental approval, the Government made changes to regulations regarding the environment which were previously regulated by Law Number 32 of 2009 concerning Environmental Protection and Management. The problems discussed in this study are how the shift in legal politics in the environmental sector after the enactment of Law Number 6 of 2023 concerning the Stipulation of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation into Law, how changes in environmental regulations after the enactment of Law Number 6 of 2023 concerning the Stipulation of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation into Law, how is the settlement of environmental disputes through filing an administrative lawsuit at the State Administrative Court after the enactment of Law Number 6 of 2023 concerning the Stipulation of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation into Law. This research uses normative legal research methods by examining library materials and the type of research used in this research is an inventory of positive law. The results of this study indicate that the government's legal politics in the environmental sector has shifted after the enactment of Law Number 6 of 2023 concerning the Stipulation of Government Regulation in Lieu of Law Number 2 of 2022 concerning Job Creation into Law because of the ease of obtaining environmental approval and increasing investment, not in accordance with the legal politics of environmental management and protection stipulated in Article 28 H paragraph (1) and Article 33 paragraph (4) of the 1945 Constitution of the Republic of Indonesia and the environmental development agenda which is a national priority agenda in the 2020-2024 National Medium-Term Development Plan. The ease of obtaining environmental approval can be seen from the loss of public participation in the AMDAL document, the change of environmental permits to environmental approval, the withdrawal of the authority of the Regional Government to the authority of the Central Government, the revocation of the provisions of the article regarding absolute liability without the need to prove the element of fault (stict liability), the revocation of the provisions of the article regarding the cancellation of environmental permits through court decisions, the revocation of the provisions of the article regarding the right to administrative lawsuits in environmental disputes in the State Administrative Court, and the change of articles regarding environmental crimes from formal crimes to material crimes. The settlement of environmental disputes through administrative lawsuits at the State Administrative Court after the enactment of Law Number 6 of 2023 concerning the Stipulation of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation into Law is Individuals, business entities incorporated or not incorporated, and / or Environmental Organizations whose interests have been and / or have the potential to be harmed by State Administrative Decisions and / or Government Administrative Actions can file a lawsuit at the State Administrative Court with the legal basis of the Supreme Court of the Republic of Indonesia Regulation Number 1 of 2023 concerning Guidelines for Adjudicating Environmental Cases.

Abstract

Children are basically the buds, potential, and future generations of the nation's aspirations. In the juvenile justice system, a child in conflict with the law is a child who is aged 12 years or older but has not yet reached 18 years of age and is suspected of committing a crime. It is not uncommon to find children committing a crime; fundamentally, there are so many different forms of crimes that can be committed by children, one of which is gambling crime.Research uses the type of normative juridical research through an empirical approach. In this research, it employs the statutory approach (statute approach) and the case approach (case approach). The data sources used are secondary data, consisting of primary, secondary, and tertiary legal materials. Data collection is conducted through library research and interviews, which are then processed and analyzed using qualitative analysis methods.Sanctioning minors involves two dimensions: Diversi and Restorative Justice as stipulated in Articles 1 paragraph 6 and 7 of Law No. 11 Year 2012 concerning the Juvenile Justice System. Factors underlying juvenile gambling offenses include internal factors such as religious factors and factors of curiosity or desire to try, and external factors such as economic factors, environmental factors, and family factors. The judge's consideration in imposing sanctions on juvenile gambling offenders must be based on the principle of the best interests of the child as mandated in Law No. 11 Year 2012 concerning the Juvenile Justice System. From a criminological perspective, it is important to prevent minors from being labeled as gambling offenders, which can affect their life development.

Abstract

In Indonesia, the development of internet and social media usage has shown significant growth. In 2024, there are 204.7 million internet users in Indonesia, indicating an increase of approximately 2.1 million users from the previous year. Furthermore, internet penetration has reached 73.7% of the total population, while the number of active social media users stands at 191.4 million or 68.9% of the population, with an annual growth rate of 12.6%. This trend reflects the integration and importance of social media in the daily lives of Indonesian society, as well as the potential for misuse such as cyberbullying. This article focuses on an in-depth analysis of the dynamics of cyberbullying in Indonesia within the context of existing laws, with the primary aim of identifying gaps in current regulations and advocating for stronger legislation. The research method used is normative juridical. The study finds that cyberbullying in Indonesia is a serious issue affecting the mental health and well-being of individuals, particularly children and teenagers. Although regulated by the Electronic Information and Transactions Law (UU ITE), this regulation requires adjustments to be more specific and adaptive to technological developments. A holistic approach involving education, psychological support, and stakeholder collaboration is necessary to create a safe and supportive digital environment.
