Abstract

The Association of South-East Asian Nations Enhanced Dispute Settlement Mechanism (ASEAN EDSM), like the World Trade Organization's (WTO) Dispute Settlement Mechanism, recognizes trade countermeasures in the event of noncompliance with Panel and Appellate Body rulings. However, the harmed party may encounter stumbling obstacles while proposing an authorized trade countermeasure. The pitfall emphasizes the implications of not resolving the conflict. Meanwhile, ASEAN acknowledges a system that allows disputant states to present outstanding disputes to the ASEAN Summit under Article 26 of the ASEAN Charter. Furthermore, if the injured party is harmed as a result of the ASEAN dispute settlement decision's failure to be implemented, the injured party may raise the issue at the ASEAN Summit in accordance with Article 27(2) of the ASEAN Charter. This study looks into whether the involvement of the ASEAN Summit may help solve the post-adjudication problem in the ASEAN EDSM. The research methods include a literature review and a thorough reading of Articles 26 and 27 of the ASEAN Charter

Abstract

Election dispute management is a vital element in maintaining the integrity of the democratic process in Indonesia. Electoral conflicts can arise at various stages, from the nomination process, campaigning, voting, to the determination of election results. Therefore, it is very important to have an effective and fair mechanism to resolve such disputes. This study examines the mechanisms and institutions involved in the resolution of electoral disputes in Indonesia. Reviewing the development of regulations related to election disputes and efforts to improve the system that has been done, including the role of the Constitutional Court, the election supervisory board, and the General Election Commission. The author uses qualitative research methods by collecting data from various literature sourced from the internet. This study aims to provide a comprehensive overview of how to resolve electoral disputes, as well as to identify challenges and opportunities in the improvement of the electoral dispute resolution system. With a better understanding of existing mechanisms and regulations, it is expected to increase public confidence in the electoral process and strengthen democracy in Indonesia. This study evaluates various efforts that have been made to improve the electoral dispute resolution system, such as regulatory reform, capacity building of related institutions, and community participation in overseeing the electoral process. Thus, it is expected that the results of this study can contribute significantly to the development of the democratic system in Indonesia.

Abstract

In principle, abortion is prohibited in all forms of law, whether it be positive law or Islamic law, as it is considered premeditated murder of the life of an unborn individual. However, there are certain situations that provide exceptions to perform abortion, such as in cases of rape or when there is a serious threat to the life of the mother. In this context, there is an ongoing debate regarding these exceptions, making it important to conduct thorough research on this issue.

Abstract

Objective of Financing in Undang-Undang Nomor 1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana has included Rehabilitation as part of the financing that can be dropped for offenders. In the case of Fidelis who uses Ganja for medical purposes that are Group I Narcotics to treat his wife who has been diagnosed with Syringomyelia. Fidelis is subject to article 116 (1) of the Narcotics Act and is sentenced to eight months imprisonment, a fine of Rp. 1,000,000,000 subsider, one month imprisonement, regardless of the emergency circumstances experienced by Fidelis. Later in a similar case, Rossy was sentenced to 10 months in prison for allegedly violating article 127, paragraph 1, letter a of the Narcotic Drugs Act for consuming cannabis plants to treat the severe nervous disease he suffered. Rehabilitation, both medically and socially, is expected to be a legal breakthrough that can be applied to medical marijuana perpetrators as a form of punishment (sanctions/acts) aimed at benefiting the perpetrator. In understanding the crime policy, looking at the purposes of mediation with the various existing theories should open up new thoughts for law enforcement in terms of combating crime. Then the purposes of the investigation on the New Covenant must also be taken into consideration by the prosecution, because if the judge is not thorough in digging a problem then the scripture that is in the New covenant is only a rigid writing

Abstract

Children need special protection to maintain their dignity and dignity, in accordance with the objectives of the Criminal Justice System in the Juvenile Criminal Justice System. The Prosecutor's Office and other child protection institutions as part of the criminal justice sub-system, play a role in helping and protecting child victims as witnesses in trials. According to Article 1 Number 8 of Law of the Republic of Indonesia Number 31 of 2014 concerning Amendments to Law Number 13 of 2006 concerning the Protection of Witnesses and Victims, namely Protection is all efforts to fulfill rights and provide assistance to provide a sense of security to Witnesses and/or Victims which must be carried out by the Witness and Victim Protection Institute (LPSK) or other institutions in accordance with the provisions of this Law. The problem is that in one of the cases in the jurisdiction of the Agam District Prosecutor's Office, on the agenda of the witness examination (evidence) at the Lubuk Basung District Court, the victim's child's statement as a witness is different from the information in the Examination Report (BAP) in the case file made by the West Sumatra Police Investigator. This caused the defendant to be acquitted by the Lubuk Basung District Court Judge who was previously prosecuted by the Public Prosecutor for 15 (fifteen) years. Therefore, the defendant was proven innocent because the victim's child's testimony as a witness could not convince the judge that the defendant had committed a criminal act of obscenity. In this case, it can be seen whether the victim's child received intervention from another party when he became a witness so that his statement at trial was different from the information in the Examination Report (BAP) in the case file. The formulation of the problems discussed in this study is 1. How is the implementation of legal protection for child victims as witnesses to criminal acts of abuse in the jurisdiction of the Agam District Attorney's Office 2. What are the obstacles faced by the Prosecutor in implementing legal protection for child victims as witnesses to criminal acts of abuse in the jurisdiction of the Agam District Attorney's Office? The research method used is empirical legal research (empirical juridical) which is supported by research in the Jurisdiction of the Agam District Attorney's Office. The results of the study show that the implementation of legal protection for child victims as witnesses to criminal acts of abuse in the jurisdiction of the Agam District Prosecutor's Office has been accompanied by professional social workers, but the legal protection for the victim's child has not been maximized because there is still intervention from certain parties so as to affect the victim's child's testimony in the trial. The obstacle faced by the prosecutor is that the victim's child is limited in providing Testimony, the public prosecutor found it difficult to prove the charges at trial, the defendant did not admit to his actions. This makes it difficult for the Public Prosecutor to prove at trial and carry out legal protection for the victim's child as a witness.

Abstract

This study explores the role of notaries in the protection of intellectual property rights (IPR) in Indonesia compared to international standards, aiming to identify opportunities for improvement and harmonization. Employing qualitative research methods and comparative studies, the research combines literature analysis, comparative analysis, and methodologies of content analysis and SWOT. Findings reveal significant differences in the practices of Indonesian notaries compared to international standards, facing challenges such as regulatory complexity, technological dynamics, and limited IPR awareness. It is recommended that Indonesia aligns its IPR regulations with international standards, enhances notary training, adopts advanced technology, and strengthens inter-agency cooperation. These steps are expected to improve IPR protection, reinforce Indonesia's position in the global economy, and support a sustainable ecosystem of innovation and creativity.

Abstract

Sale and purchase agreements are one form of agreement that often occurs in society. An agreement will be valid if it has fulfilled the conditions stipulated in Article 1320 of the Civil Code. The sale and purchase binding deed is a preliminary agreement that binds the parties to the sale and purchase and has the right and obligation to fulfill the performance as agreed upon in the sale and purchase agreement. The research method used is normative juridical research. The nature of this research is descriptive analytical. The source of legal material used is secondary data with primary legal materials, secondary legal materials and tertiary legal materials. The research technique used is library research with a case approach to this research. The results of this study indicate that defaults caused by heirs who are reluctant to pay land and building tax and seller's tax from the late seller / heir in the deed of binding of sale and purchase even though the buyer has carried out his performance so as to obtain legal protection, he filed a lawsuit with the court in accordance with preventive legal protection.

Abstract

The legal consequences of bank secrecy in money laundering crimes in Indonesia are examined in this research. While bank secrecy is an important tool for maintaining consumer trust, efforts to reduce money laundering may face resistance. By using normative research techniques as well as conceptual and legislative approaches, this research assesses the effectiveness and impact of bank secrecy laws in money laundering crimes. The findings of this study indicate that although bank secrecy is critical to maintaining public confidence in the banking system, this importance must be balanced with the need for strong law enforcement measures to combat money laundering.

Abstract

Dalam konteks hukum arbitrase, prinsip "nebis in idem" adalah prinsip yang mengatur bahwa seseorang tidak boleh diadili dua kali atas perbuatan yang sama (double jeopardy). Prinsip ini sering kali diterapkan dalam sistem hukum pidana untuk melindungi individu dari penuntutan ganda. Namun, dalam konteks pembatalan putusan arbitrase di pengadilan, prinsip "ne bis in idem" memiliki implikasi yang berbeda. Di banyak yurisdiksi, pengadilan memiliki kewenangan untuk membatalkan atau memutuskan suatu putusan arbitrase. Salah satu pertimbangan utama dalam hal ini adalah apakah proses arbitrase tersebut telah dilakukan sesuai dengan hukum atau prosedur yang berlaku. Penerapan asas "ne bis in idem" dalam konteks pembatalan putusan arbitrase menyoroti pentingnya kepatuhan terhadap prosedur hukum dan keadilan dalam proses arbitrase. Pengadilan harus mempertimbangkan apakah putusan arbitrase yang dilakukan sudah sesuai dengan hukum yang berlaku, serta apakah ada pelanggaran yang membenarkan pembatalan putusan tersebut. Jadi, dalam pembatalan putusan arbitrase di pengadilan, prinsip "ne bis in idem" dapat mempengaruhi penilaian pengadilan terhadap kepatuhan prosedural dan legalitas putusan arbitrase yang bersangkutan.

Abstract

Criminal acts of terrorism are generally committed by men, but there is an interesting fact that these acts of terrorism are not only committed by adult men but also involve women and children in them. This is a new mode or strategy carried out by the perpetrators of terrorism in order to trick the security forces. The formulation of the problem in this thesis research is the first, namely what is the policy for punishing children who are involved in criminal acts of terrorism, second, what is the policy for punishing woman who are involved in criminal acts of terrorism, and the third, how are efforts to prevent terrorism crimes involving women and children in the future? will be reviewed based on statutory regulations. The research used is normative legal research supported by empirical juridical data by conducting interviews with North Sumatra Regional Police. The nature of this research is a descriptive analysis with a statutory approach (state approach) and an analytical approach (analytical approach) using qualitative methods to draw deductive conclusions. The results of the study show that firstly, the criminal policy for terrorism crimes involving children is that children who commit acts of terrorism cannot be subject to specific minimum criminal sanctions in Articles 6, 8 to 13 and 15 of Law Number 5 of 2018 while capital punishment or life imprisonment Life also cannot be enforced but replaced with a maximum imprisonment of 10 years. Second, the criminal policy against terrorism crimes involving women has been regulated in Law Number 5 of 2018, but nothing regulates non-penal policies against women who are involved in criminal acts of terrorism. Then the third, efforts to prevent terrorism crimes involving women and children in the future are reviewed based on laws and regulations, namely by preparing National Preparedness, Counter-Radicalization, and Deradicalization. Conclusions and suggestions can be seen that first, in the absence of laws governing the criminalization of children as terrorist actors, it is necessary to form a related regulation. Second, in the absence of anything that regulates women's non-penal policies against criminal acts of terrorism, it is necessary to establish a special regulation regarding this matter. Third, by preparing National Preparedness, Counter-Radicalization, and Deradicalization, synergy is needed between law enforcement officials, the government, the community, the private sector and other parties
