Abstract

In organizing personnel services at the Office of the Ngada Regency Personnel and Human Resources Development Agency (BKPSDM), the main obstacle faced is the lack of application of work discipline and supervision within the Ngada Regency BKPSDM Office. The objectives of this writing include: to determine how much influence work discipline has on the performance of employees of the Ngada Regency BKPSDM office, to determine how much influence supervision has on the performance of employees of the Ngada Regency BKPSDM office, and to determine how much influence work discipline and supervision have on the performance of employees of the Ngada Regency BKPSDM office. This research was conducted at the Office of the Ngada Regency Personnel and Human Resources Development Agency (BKPSDM), with a population of 36 people using the census method, namely all the population was sampled. The independent variables in this study are work discipline and supervision while the dependent variable is employee performance. Measurement of variables in this study using a Likert scale and SKP BKPSDM Kab. Ngada employees. Data processing with a statistical approach of multiple regression analysis using SPSS 22. From the standard estimated for the variables of Work Discipline (X1), Supervision (X2), Employee Performance (Y), the structural equation can be made as follows Y = 368.232 + 0.544 + 2.224. the results of data analysis show that work discipline has a significant effect on employee performance within the BKPSDM of Ngada Regency with a coefficient of determination of 31.2%, Supervision has an effect of 37.1% on performance, and Work discipline and Supervision have an effect of 39% on performance and the rest is influenced by other factors not examined.

Abstract

Crime or criminal act is a word that is familiar to the public. Crime is increasingly common in society and its presence is very disturbing to society, because the losses it causes are not only material losses, but also the loss of a person's soul or life. The provisions of Law Number 35 of 2009 concerning Narcotics (Narcotics Law) have also mentioned several terms that have the same essence as narcotics users themselves, including narcotics abusers, victims of abusers, former narcotics abusers and patients. There are examples of cases of implementing medical rehabilitation. and social issues regarding narcotics abuse in the jurisdiction of the West Pasaman District Prosecutor's Office. Where the West Pasaman District Prosecutor's Office stopped the prosecution or Restorative Justice of three narcotics case files with five suspects to undergo rehabilitation because the suspects were narcotics addicts, not dealers. The suspects are suspected of being users or addicts of class I narcotics, not methamphetamine, violating Article 127 paragraph (1) letter a of the Narcotics Law. The Problem Formulation is (1) How is the termination of prosecution of narcotics abuse cases as an implementation of restorative justice at the prosecution stage (Case Study at the West Pasaman District Prosecutor's Office) and (2) What are the obstacles in terminating the prosecution of narcotics abuse cases as an implementation of restorative justice at the prosecution stage (Case Study at the West Pasaman District Prosecutor's Office)?. The conclusions of this research are: (1) The implementation of restorative justice in cases of narcotics abuse has been implemented at the West Pasaman Prosecutor's Office for 4 (four) suspects. The West Pasaman Prosecutor's Office has implemented Prosecutor's Guidelines Number 18 of 2021 concerning the Resolution of Handling of Narcotics Cases through Rehabilitation with a Restorative Justice Approach as an implementation of the Prosecutor's Dominus Litis Principle. (2) In its implementation, of course the West Pasaman District Prosecutor's Office also experienced obstacles that affected the implementation of restorative justice in cases of criminal acts of narcotics abuse.

Abstract

This research aims to analyze the implementation of traffic laws regulated in Law Number 22 of 2009 concerning Road Traffic and Transportation in Indonesia. The methodology used is normative juridical research which involves analysis of normatively applicable laws to understand their implementation in a wider context. The relevance of this research lies in the need to identify the effectiveness of the implementation of the Law, the level of public compliance with traffic rules, the performance of law enforcement officers, as well as the factors that influence the effectiveness of traffic law enforcement in Indonesia. This research contributes in the form of an in-depth understanding regarding the implementation of traffic laws in Law Number 22 of 2009, by highlighting aspects of safety, compliance and law enforcement. The research results show the implementation of traffic laws through consistent enforcement of rules, effective handling of violations, and cross-sector cooperation can improve traffic security and order. Recommendations for this research include increased outreach and education to the community, stricter law enforcement, regular evaluation of the performance of law enforcement officers, as well as investment in improving road infrastructure. In conclusion, the implementation of traffic law in Law Number 22 of 2009 in Indonesia has a significant impact on the safety of road users and improving traffic quality. With a holistic approach and cross-sector collaboration, it is hoped that a traffic culture that is good, safe, orderly and adheres to the rules can be created in society.

Abstract

Fenomena tawuran merupakan bagian dari kekerasan di masyarakat dan telah berulang terjadi. Peristiwa tersebut menjadi perhatian bagi bangsa Indonesia. Marak nya peristiwa ini menimbulkan kecemasan akan generasi yang akan datang. Tidak lain pelaku tawuran dilakukan oleh anak-anak dibawah umur. Kemajemukan yang di miliki oleh bangsa Indonesia merupakan suatu yang rentan terhadap konflik karena di picu oleh hasutan/profokator dan pengaruh gejolak sosial yang dapat mendorong terjadinya disintegrasi dalam masyarakat. Perkembangan zaman dan kemajuan teknologi yang sangat berkembang pesat belakangan ini juga memiliki pengaruh yang cukup besar terhadap perubahan sosial budaya dan kultur bangsa Indonesia. Pada penelitian ini terdapat rumusan masalah, Penelitian ini menggunakan metode penelitian hukum normatif. Metode penelitian hukum normatif atau metode penelitian hukum kepustakaan adalah metode atau cara yang dipergunakan di dalam penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka yang ada. Penelitian ini menghasilkan kesimpulan: Pertama, Bentuk perlindungan hukum yang diatur dimana anak yang berhadapan dengan hukum harus terjamin hak-hak anak sebagai mana diatur dalam Undang-Undang anak No 11 Tahun 2012 tentang perlindungan anak. Kedua, Proses diversi yang dimaksud dalam Undang-Undang tersebut apabila sudah ada kesepakatan yang disetujui oleh kedua belah pihak dalam penyelesaian tindak pidana, dimana hukuman paling lama 7 (tujuh) hari setelah ditetapkan oleh ketua pengadilan negri sebagai hakim dan dilaksanakan paling lama 30 (tiga puluh) hari. Sesuai dengan putusan No 7/PID.SUS-Anak/2019/PT.BDG hakim telah mengambil keputusan pidana yang sudah sesuai dengan Undang-Undang pidana anak. Dengan demikian hendaknya, adanya edukasi baik ditingkat lingkungan keluarga,sekolah dasar hingga perguruan tinggi dalam membentuk sebuah karakter anak yang baik guna mencegah terjadinya peristiwa Tawuran. Generasi muda atau anak-anak merupakan centered attention bagi suatu Bangsa dan Negara, juga akan mewarisi hal-hal keberlanjutan sejarah suatu Negara. Oleh karena itu pembinaan generasi muda sangat penting untuk menyokong keberadaan Negara.

Abstract

A brand is an identifying mark used specifically to distinguish one product from another.With the advancement of technology and information, many trademark disputes arise. Such as the litigation between MS GLOW and PS GLOW, these brands are also involved in trademark plagiarism lawsuits. So, how is the trademark dispute resolution between MS GLOW and PS GLOW carried out, and what legal protection efforts exist for the registered trademarks MS GLOW and PS GLOW concerning trade of goods in Indonesia. The method used in this research is a legal and regulatory approach, a case approach, and then a conceptual approach. The results of this research indicate that dispute resolution takes place in two commercial courts. The trial in the Medan Commercial Court ruled in favor of MS GLOW, whereas the trial in the Surabaya Commercial Court ruled in favor of PS GLOW. The verdict of the Surabaya Commercial Court concluded that the use of the MS GLOW brand did not align with the registered trademark group. The 'first to file' system is a preventive legal protection effort, while repressive legal efforts are carried out through the imposition of criminal sanctions.

Abstract

Narapidana adalah sebutan bagi masyarakat atau warga negara yang melakukan tindak pidana dan telah mengikuti seluruh prosedur sistem peradilan pidana atau Integrated Criminal Justice System di Indonesia serta telah mendapatkan kekuatan hukum tetap atau inkracht. Negara melalui Lembaga Pemasyarakatan (Lapas) wajib melaksanakan pembinaan dan memberikan hak-hak narapidana, karena sejatinya narapidana hanya dibatasi hak kebebasan untuk bergeraknya saja. Narapidana lanjut usia merupakan salah satu kategori narapidana berkebutuhan khusus di Lembaga. Pemasyarakatan. Salah satu bentuk perlakuan khusus bagi narapidana lanjut usia ialah kemudahan dalam mendapatkan akses kesehatan, mengingat kelompok ini sangat rentan terserang resiko penyakit ditambah dengan kondisi Lapas yang overcrowded. Abstract

This research reviews the impact of the removal of articles in the Minister of Agriculture Regulation No. 98/2013 on the regulation and dynamics of business competition in the palm oil plantation industry, as well as monopolistic practices. The removal of several articles potentially damages business relationships and leads to unhealthy business competition. This research aims to provide an understanding of the impact of regulatory changes on the palm oil plantation industry. Using a qualitative approach, it focuses on analyzing the potential monopolistic practices occurring in the palm oil industry as a direct result of the removal of Articles 13, 14, and 49. By analyzing secondary data and related literature, this research identifies new patterns in business competition dynamics and how these changes affect various stakeholders. The results of the study are expected to provide insights into the changes resulting from the removal of these articles. Recommendations provided include strengthening regulations and exploring alternatives to maintain healthy business competition.

Abstract

Penelitian ini menganalisis pelaksanaan Kerjasama Pemerintah dengan Badan Usaha (KPBU) Skala Kecil dalam perspektif manajemen perubahan sektor publik di Indonesia. Fokus utama penelitian adalah pada efektivitas KPBU Skala Kecil sebagai solusi untuk mengatasi keterbatasan anggaran daerah dalam pembangunan infrastruktur, yang mendukung desentralisasi dan meningkatkan kinerja serta akuntabilitas layanan publik. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan peraturan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa KPBU Skala Kecil, melalui model BOT, BOO, DBFOM, dan leasing, dapat meningkatkan efisiensi dan inovasi dalam pembangunan infrastruktur. Studi kasus proyek Alat Penerangan Jalan di Kabupaten Madiun menunjukkan keberhasilan konsep ini meskipun masih terdapat tantangan seperti regulasi yang rumit, pembagian risiko, dan kapasitas manajerial yang terbatas. Kesimpulannya, KPBU Skala Kecil merupakan inovasi manajemen publik yang efektif, tetapi memerlukan simplifikasi regulasi, pembagian risiko yang adil, dan peningkatan kapasitas manajerial untuk mencapai manfaat optimal.

Abstract

Customary rights are an integral part of the life of indigenous peoples in Indonesia, reflecting the deep connection between people, land, and culture. This study uses the research method of Thomas Aquinas' theory of legal certainty to analyse the legal certainty of customary rights in Indonesia, viewed from the socio-legal perspective of national law and customary law. The research method involves literature review, analysis of laws and regulations, and case studies of land conflicts. The results show that the legal certainty of customary land rights still faces major challenges, including the incompatibility between customary law and national law. In conclusion, the Ministry of Agrarian and Spatial Planning/BPN has an important role in championing customary rights through inclusive policy formulation, official registration of customary land, and fair and transparent resolution of land conflicts. These efforts are essential to ensure effective and sustainable customary rights protection for indigenous peoples in Indonesia.

Abstract

The Indonesian government itself, in terms of eradicating corruption, has made improvements to the law regarding the eradication of corruption and the establishment of a Corruption Eradication Commission institution to support law enforcement. The government has established Law Number 31 of 1999 concerning the Eradication of Corruption Crimes as amended by Law Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning Eradication of Corruption Crimes. Therefore, it is important to examine unlawful acts in Corruption Crimes. This research is aimed at analyzing unlawful acts in Corruption Crimes which cause state losses in corruption cases, how to analyze the evidence of corruption crimes in the Medan District Court Decision Number 38/Pid.Sus-TPK/2022/PN Mdn, as well as analysis in Work on Road Improvement Work Projects Which Cause State Losses in Corruption Crime Cases in Medan District Court Decision Number 38/Pid.Sus-TPK/2022/PN Mdn. The research method used is normative juridical research, which is supported by primary and secondary data sources. All legal materials were collected using library research techniques using document study data collection tools. Analyzed qualitatively. In eradicating criminal acts of corruption, especially in the application of unlawful elements, we must be able to prove whether there has been an unlawful act in which there has been a violation of statutory regulations or failure to implement statutory regulations which then has the potential to cause financial losses to the State. In this research the defendant violated the provisions of Government Regulation Number 58 of 2005 concerning Regional Financial Management, Presidential Regulation Number 54 of 2010 concerning Procurement of Government Goods/Services and its amendments, and Minister of Home Affairs Regulation Number 13 of 2006 as amended by Minister of Home Affairs Regulation Number 21 of 2011 concerning the Second Amendment to Minister of Home Affairs Regulation Number 13 of 2016 concerning Guidelines for Regional Financial Management. With state losses worth Rp. 1,173,762,681.06,-
