Abstract

This article will examine the Criminal Law loophole which can still be found in the qualification of the crime of, “having intercourse with a woman out of wedlock”. In Verdict Number 30/Pid.B/2017/PN.bdw the perpetrator of crime and the victim who are both adults and without marital ties have intercourse without coercion, threats of violence and/or violence in different private areas. The Bondowoso District Court judge sentenced the perpetrator to three years in prison with a subsidiary indictment of the Public Prosecutor, namely Article 5 paragraph (3) letter b of the Emergency Law Number 1 of 1951 jo. Article 289 of the Criminal Code in Verdict Number 30/Pid.B/2017/PN.Bdw. This article will examine the accuracy of Article in Verdict Number 30/Pid.B/2017/PN.Bdw which uses Article 5 paragraph (3) letter b of the Emergency Law Number 1 of 1951 jo. Article 289 of the Criminal Code regarding the criminal act of obscenity and to examine the application of Article 412 in the new Criminal Code no. 1 of 2023 for perpetrators of criminal acts in Verdict Number 30/Pid.B/PN.Bdw.The research uses normative juridical research with statute approach and a conceptual approach.The temporary conclusion of this article is that the act of two single adults who have intercourse with the promise of marriage is still not punishable by crime. Indonesia's positive law and criminal law reforms still have legal loopholes, so they require government regulations to regulate actions that are considered morally bad. Law enforces need to take a legal sources outside of the appropriate law to convict perpetrator of criminal acts are that unequaled in the Criminal Code to fill the legal vacuum so that it does not become arbitrary space for law enforcers.

Abstract

Penelitian ini bertujuan untuk mengetahui pertimbangan hakim dalam tindak pidana penggelapan dalam jabatan dan untuk mengetahui penerpan sanksi dalam putusan Nomor 90/Pid.B/2021/PN Bkt. Penelitian ini tertuju pada penelitian kepustakaan, mempelajari, mengkaji dan menjelaskan mengenai tindak pidana penggelapan dalam jabatan. Hasil dari penulisan ini menunjukan bahwa 1) pertimbangan hukum bahwa fakta-fakta dipersidangan sekaligus kesesuaian diantara keterangan saksi-saksi akan serta hal-hal yang meringankan dan hal-hal yang memberatkan akan mempengaruhi putusan Hakim. Dalam hal ini terdakwa Eka Sari panggilan Eka memang telah terbukti bersalah sesuai dengan pasal yang didakwakan oleh Jaksa Penuntut Umum. 2) Terkait pertimbangan hukum oleh hakim terhadap pelaku tindak pidana penggelapan dalam hubungan kerja, nomor putusan 90/pid.B/2021/PN Bkt. Ini masih kurang tepat, karena sanksi pidana yang diterima terdakwa belum sebanding dengan jumlah kerugian materil yang diterima oleh cv merapi argo sejati. Dengan kerugian materil yang mencapai Rp. 87.092.000,- (delapan puluh juta Sembilan puluh dua ribu rupiah) dan kerugian non materil seperti nama baik perusahaan yang sudah dinilai menurun sehingga membuat perusahaan tersebut tutup sementara.

Abstract

The division of inheritance is a very sensitive issue and there are even frequent disputes between the heirs because it relates to the dissatisfaction and selfishness of the heirs. The type of research used is normative research based on secondary data from primary, secondary and tertiary legal materials. This study analyzes the problems of implementing Decision Letter Number: 2508/Pdt.G/2022/PA.Mdn regarding the distribution of inheritance to heirs in fleeing lawsuits (Abscruur Libels). from the Compilation of Islamic Law; and the basic considerations of the Medan Islamic Religious Court judge in deciding the inheritance case Number: 2508/Pdt.G/2022/PA.Mdn with an escape lawsuit (Abscruur Libels). This study concludes that in the opinion of the plaintiff's lawsuit registered in the partnership of the Medan Religious Court Number: 2508/Pdt.G/2022/PA.Mdn contains material defects in the form of lack of parties (Plurium Litis Consortium) and blur (Abcsruur Libels). Therefore, the Panel of Judges stated that the Plaintiff's claim was unacceptable, all evidence and rebuttals as well as the final conclusions submitted by the litigants were not considered again.

Abstract

Acquisition (takeover) can be one of the company's development strategies for the economic interests of each takeover company or company that is taken over, one way of acquisition is carried out through a share sale and purchase agreement, either all or most of the company's shares which results in the transfer of control of the company. In this case, it will be reviewed regarding the acquisition made by a subsidiary of PT Krakatau Steel with PT Chandra Asri Petrochemical in accordance with applicable regulations. The purpose of this writing is to find out how the acquisition process occurred at PT Krakatau Steel with PT Chandra Asri Petrochemical. Next to find out what legal consequences occur after the acquisition. The research method used in this study is normative juridical, which is based on positive legal rules or norms through the relevant legislation. The research specification used is descriptive analysis, which is carried out by analyzing and describing completely and thoroughly which is associated with legal theory regarding the process and legal consequences of the acquisitions made by the two companies above. Based on the writing, it was obtained: First, the acquisition made between Krakatau's subsidiary and CAP is categorized as a vertical acquisition with the aim of strengthening the supply chain of business fields carried out by CAP. Then the process of acquiring shares carried out by CAP against KSI through its subsidiaries, namely KTI and KDL is by purchasing shares in each company as stated in the Deed of Takeover. Second, due to the law of the acquisition of PT Krakatau Daya Listrik and PT Krakatau Tirta Industry by PT Chandra Asri Petrochemical Tbk is a change in control of PT Krakatau Daya Listrik company by PT Chandra Asri Petrochemical, changes in shareholder composition, as well as the obligation to report material information to OJK and the public as well as notification to KPPU regarding the takeover. Acquisitions can also have an effect on the company's structure and workforce structure.

Abstract

Online Dispute Resolution (ODR) is a form of Alternative Dispute Resolution (APS) with the help of electronic media. This research provides a thorough analysis of the implementation of ODR in disputes that occur in the digital economy sector with a case study of Tokopedia. This research is also supported by a review of regulations and literature related to the legal issues that the author examines. Regarding the implementation and existence of Online Dispute Resolution in Indonesia, there is no specific regulation that specifically regulates it. However, the existence of Law Number 11 of 2008 on Electronic Information and Transactions as amended by Law Number 19 of 2016 ("ITE Law"), Government Regulation Number 80 of 2019 on Trading Through Electronic Systems ("PPE-Commerce"), Law Number 30 of 1999 on Arbitration and Alternative Dispute Resolution ("Arbitratrion and ADR Law") can be said to be sufficient to support the validity of ODR mechanisms and decisions. Looking at digital developments, special arrangements for ODR in an electronic or online-based transaction have become urgent at this time. This is due to the potential disputes that may arise in daily transactions.

Abstract

The practice of gender-based price discrimination is known as the "Pink Tax". The "Pink Tax" phenomenon reflects an unfair price gap (discrimination) based on the gender of consumers. Gender-based price discrimination not only harms female consumers financially, but also reflects unfairness and inequality in the market. Consumer protection plays an important role in safeguarding the rights and interests of consumers from harmful practices. This research focuses on analyzing whether the practice of gender-based price discrimination (pink tax) is a violation of consumer protection laws in Indonesia? This research uses normative juridical research methods by analyzing the positive law governing consumer protection in Indonesia, namely Law Number 8 of 1999 concerning Consumer Protection (UUPK). Although the UUPK has accommodated efforts to protect consumers from discriminatory behavior of business actors, unfortunately the term "discriminatory" is only limited to regulating discriminatory treatment based on ethnicity, religion, culture, region, education, rich, poor and other social status, not including discriminatory treatment based on sex/gender. So it can be concluded that the practice of gender-based price discrimination (pink tax) in Indonesia cannot be categorized as a violation of Law Number 8 of 1999 concerning Consumer Protection.

Abstract

The Bilateral Investment Agreement is one of the ways that the Indonesian government and other countries have implemented to support the implementation of foreign investment in Indonesia in the hope that mutually beneficial conditions will be created for the two countries, especially with the existence of principles regarding standard of treatment in a BIT. which is expected to provide protection for both parties. This research was conducted using a normative juridical approach by conducting research on legal principles and using analytical descriptive methods. Indirect expropriation is something that can be done by the Indonesian government in supervising foreign companies operating in Indonesia, thus it is hoped that it will reduce losses experienced by Indonesia in carrying out foreign investment so that people's welfare will be realized.

Abstract

In legal matters, there are two attempts to resolve disputes between parties, one of which is by using a sharia-based dispute resolution system. Settlement of sharia-based disputes includes non-litigation (outside court) and/or litigation in court). Sharia disputes in court (Litigation) are requested through religious courts, and dispute resolution outside the court (Non Litigation) through sharia Arbitration bodies. In Indonesia, the institution that resolves sharia arbitration disputes is called BASYARNAS (National Sharia Arbitration Board), and the procedures for settlement are not much different from arbitration procedures in general. The legal basis for the settlement of sharia arbitration disputes is regulated in Law No. 30 of 1999 concerning Arbitration and Alternative Dispute Resolution and furthermore regarding the execution of sharia arbitral awards is regulated in Supreme Court Circular Letter No. 08 of 2008. This research uses a qualitative method with a normative approach and uses a library research collection method, as well as analyzing documents, data, information related to BASYARNAS. The results of research on the existence of BASYARNAS still depend on the district court.

Abstract

Surat penolakan adalah surat pernyataan yang dibuat oleh Tersangka untuk menyatakan bahwa Tersangka tidak perlu didampingi oleh Penasihat Hukum untuk memperoleh bantuan hukums secara cuma-cuma dalam tingkat pemeriksaan. Pelaksanaan Surat Pernyataan Penolakan oleh Tersangka tidak Didampingi oleh Penasihat Hukum untuk memperoleh bantuan hukum secara cuma-cuma di tingkat penyidikan adalah praktik yang tidak ditemukan aturan hukumnya di dalam KUHAP. Dalam Pasal 56 KUHAP hanya mengatur bahwa aparat penegak hukum wajib menunjuk Penasehat Hukum pada semua tingkat pemeriksaan dalam proses peradilan bagi Tersangka. Adapun Rumusan Masalah (1) Bagaimanakah tata cara pengajuan surat penolakan oleh Tersangka terkait access to justice untuk memperoleh bantuan hukum secara cuma-cuma pada tingkat penyidikan di Polresta Padang? (2) Apakah pertimbangan atau alasan Tersangka melakukan penolakan untuk memperoleh bantuan hukum secara cuma-cuma pada tingkat penyidikan di Polresta Padang dan (3) Bagaimanakah konsekuensi Tersangka melakukan penolakan untuk memperoleh bantuan hukum secara cuma-cuma pada tingkat penyidikan di Polresta Padang?. Jenis penelitian adalah yuridis empiris. Sumber data meliputi data primer dan data sekunder. Teknik pengumpulan data adalah wawancara dan studi dokumen. Data di analisis secara kualitatif. Kesimpulan hasil penelitian ini adalah: (1) Pengajuan Surat Pernyataan Penolakan oleh Tersangka untuk memperoleh bantuan hukum secara cuma-cuma di tingkat penyidikan adalah praktek yang tidak ditemukan aturan hukumnya di dalam KUHAP. Pasal 56 KUHAP tidak dilaksanakan dengan baik oleh aparat penegak hukum, terutama para penyidik dan terlihat dari rendahnya penggunaan Penasehat Hukum dalam pendampingan penyidikan di wilayah Polresta Padang. (2) Alasan Tersangka melakukan penolakan untuk memperoleh bantuan hukum secara cuma-cuma pada tingkat penyidikan adalah karena Tersangka dapat memberikan dan menjawab pertanyaan dari Penyidik dengan sendiri. (3) Konsekuensi bagi Tersangka dapat menimbulkan akibat hukum yang berat karena tidak didampingi oleh Penasehat hukum, bisa saja Tersangka yang seharusnya dapat dihukum dengan hukuman minimal apabila didampingi oleh Penasehat Hukum, menjadi mendapatkan hukuman yang maksimal karena tidak didampingi oleh Penasehat Hukum.

Abstract

Korban, keluarga atau ahli waris dapat mengajukan ganti kerugian yang disebut dengan restitusi. Korban, keluarga atau ahli waris terlebih dahulu mengajukan permohonan restitusi ke Lembaga Perlindungan Saksi dan Korban kemudian Lembaga Perlindungan Saksi dan Korban memberikan surat keputusan pengajuan restitusi ke pihak Kepolisian, Jaksa Penuntut Umum dan Majelis Hakim. Adapun permasalahannya yakni: 1) Bagaimanakah Penerapan Restitusi Dalam Tuntutan Jaksa Penuntut Umum Terhadap Korban Tindak Pidana Pembunuhan Di Wilayah Hukum Kejaksaan Negeri Bungo Pada Perkara Nomor 249/Pid. B/ PN Mrb. 2) Apakah Dasar Pertimbangan Jaksa Penuntut Umum Mengajukan Restitusi Terhadap Korban Dalam Tindak Pidana Pembunuhan Di Wilayah Hukum Kejaksaan Negeri Bungo Pada Perkara Nomor 249/Pid. B/ PN Mrb. 3) Bagaimanakah Peran Lembaga Perlindungan Saksi Dan Korban Dalam Pengajuan Restitusi Pada Korban Tindak Pidana Pembunuhan Di Wilayah Hukum Kejaksaan Negeri Bungo Pada Perkara Nomor 249/Pid. B/ PN Mrb. Jenis penelitian yang digunakan yaitu metode empiris. Kesimpulan yang penulis dapat dari hasil penelitian yaitu: 1) Penerapan Restitusi dalam Tuntutan Jaksa Penuntut Umum Terhadap Korban Tindak Pidana Pembunuhan Di Wilayah Hukum Kejaksaan Negeri Bungo Pada Perkara Nomor 249/Pid. B/ PN Mrb, Jaksa Penuntut Umum mendapatkan surat keputusan pengajuan restitusi dari Lembaga Perlindungan Saksi dan Korban. Kemudian Jaksa Penuntut Umum menggabungkan surat keputusan pengajuan restitusi kedalam surat tuntutan, dengan nominal kerugian yang dialami korban yaitu Rp 145.000.000,- (seratus empat puluh lima juta rupiah). Jaksa Penuntut Umum menggabungkan restitusi ke dalam surat tuntutan dengan mempertimbangkan kepastian, kemanfaatan dan keadilan. 2) Dasar Pertimbangan Jaksa Penuntut Umum Menjatuhkan Restitusi Terhadap Korban Dalam Tindak Pidana Pembunuhan Di Wilayah Hukum Kejaksaan Negeri Bungo Pada Perkara Nomor 249/Pid. B/ PN Mrb, penggabungan restitusi tindak pidana pembunuhan kedalam surat tuntutan yaitu dengan adanya surat keputusan pengajuan restitusi dari Lembaga Perlindungan Saksi dan Korban. Awalnya keluarga korban mengajukan permohonan restitusi terlebih dahulu ke Lembaga Perlindungan Saksi dan Korban. Kemudian Lembaga Perlindungan Saksi dan Korban melakukan peninjauan terkait tindak pidana pembunuhan yang dialami korban. Sehingga Lembaga Perlindungan Saksi dan Korban memberikan surat keputusan pengajuan restitusi kepada Jaksa Penuntut Umum. Surat keputusan pengajuan restitusi ditindaklanjuti oleh Jaksa Penuntut Umum. 3) Peran Lembaga Perlindungan Saksi dan Korban Dalam Pengajuan Restitusi Pada Korban Tindak Pidana Pembunuhan Di Wilayah Hukum Kejaksaan Negeri Bungo Pada Perkara Nomor 249/Pid. B/ PN Mrb, Lembaga Perlindungan Saksi dan Korban menerima permohonan pengajuan restitusi korban, memberikan bantuan pengobatan atau biaya medis, dan melakukan penghitungan kerugian yang dialami oleh korban. Lembaga Perlindungan Saksi dan Korban mengabulkan pengajuan restitusi korban dengan memberikan surat keputusan pengajuan restitusi.
