Abstract

Waqf is known as an asset of the people that can be utilized at all times. However, the productive management and development of waqf assets for social welfare has yet to be realized optimally. The enactment of Law No. 41 of 2004 concerning waqf has become a momentum to realize waqf productively. The waqf foundation Ar-Risalah and Persyarikatan Muhammadiyah which acts as nazhir waqf has the duty and responsibility to manage and develop waqf assets from wakif to productive ones. The research method used in this study uses empirical juridical research method. Based on research that productive waqf management implemented by the Ar-Risalah waqf foundation is by empowering plantations such as oil palm, banana and coconut plantations as well as renting shops, mini markets and renting waqf houses. Whereas the management of productive waqf by the Muhamadiyah Association is in the form of increasing the value of waqf assets by utilizing the functions of buildings such as the Muhammadiyah Taqwa Mosque and Muhamadiyah Dakwah Building which stand on waqf land to be developed into rental shops as a place to sell and use excess land to gain profits from renting parking spaces. The efforts of the Ar-Risalah Wakaf Foundation in developing waqf assets to become productive waqf for social welfare by managing waqf assets to be used as a source of income, one of which is by investing in the development of waqf land. Meanwhile, the efforts of Persyarikatan Muhamadiyah to form a cash waqf body as a form of management and development in a productive direction. The form of increasing social welfare carried out by nazhir waqf is by carrying out social empowerment, such as providing a place of business to be used as a place to open a business by the local community.

Abstract

In practice, there are often irregularities committed by the founders of the Limited Liability Company (PT) which are inconsistent with the purpose of the PT he founded. This not only has the effect of hampering the development of the company itself, it is also detrimental to the creditors. The purpose of this research is to find out and analyze the realization of the responsibilities of the founders of a Limited Liability Company (PT) in a credit agreement and to find out and analyze the legal remedies that can be taken if there is an abuse of the establishment of the Company. This type of research uses empirical and normative aspects with explanations. The results of the study state that the position of the Founder of a Limited Liability Company (PT) is only as a shareholder, and the founder is not responsible for any engagements that have been made by the company. And founders or shareholders cannot be burdened with the obligation to pay losses suffered by the company in excess of the value of the shares that have been taken. However, at PT AJP, who is a thorough researcher, the founder still participates in the credit agreement process that the PT does because the founder of PT AJP, who is a research researcher, is part of the PT's organs, namely as a Director

Abstract

Berdasarkan ketentuan Pasal 5 ayat (1) Undang-Undnag Nomor 25 tahun 2007 tentang Penanaman Modal dijelaskan bahwa dalam rangka menyelenggarakan pembanguan nasional, pemerintah juga dapat mengikutsertakan peran serta dari pihak swasta (investor). Kerjasama tersebut tentu harus didasari dengan suatu kesepakatan atau kontrak yang jelas. Sehingga dapat mengakomodir segala hak dan kewajiban para pihak. Berkaitan dengan skema kerjasama tersebut, pemerintah dapat menerapkan kerjasama operasi atau konsorsium atau Joint Operation (JO). Skema tersebut akan melibatkan minimal 2 (dua) pihak ysng bertujuan untuk mengerjakan suatu projek bersama. Para pihak akan terikat dalam suatu kontrak tertentu, sehingga segala sesuatu yang memiliki akibat hukum pada pihak ketiga wajib dipertanggungjawabakan oleh anggota konsorsium. Akan tetapi bentuk pertanggungjawaban pada konsorsium tidak dilakukan oleh seluruh pihak, pertanggung jawaban hanya berlaku pada pihak yang melakukan kesalahan saja. Hal tersebut dikecualikan apabila seluruh anggota konsorsium mendapatkan keuntungan atas tindakan yang dilakukan oleh konsorsium. Metode penelitian yang digunakan dalam penulisan ini adalah penelitian hukum normatif dan doctrinal dengan menggunakan pendekatan undang-undang (statute approach) serta pendekatan konseptual (conceptual approach).

Abstract

Saat ini perkembangan ilmu pengetahuan sudah cukup berkembang dengan hadirnya era internet. Mulai dari anak kecil sampai orang tua sering menggunakan layanan jaringan internet. Setiap infomasi yang mereka butuhkan sangat cepat dan mudah didapat. Cara kita memperoleh informasi inilah sekarang dilindungi melalui suatu peratutan perundangann yang ada di UU no. 11 Tahun 2008, dikarenakan banyak orang yang sering menyalah gunakan penggunaan Informasi secara elektonik ini olek karena itu dibutuhkan sesuatu aturan perundang – undangan untuk melindunginya. Berdasarkan Pasal 11 Undang-Undang No. 19 Tahun 2016 tentang Perubahan atas Undang-Undang No. 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik maka kekuatan pembuktian dokumen elektronik tersebut yang ditandatangani dengan digital signature sama dengan kekuatan pembuktian akta otentik yang dibuat oleh pejabat umum yang berwenang. Tanda tangan elektronik secara keabsahan telah diatur pemerintah mengeluarkan beberapa peraturan resmi. Mengenai keabsahan atau kekuatan hukum dan akibat hukum, tanda tangan elektronik ini disamakan dengan tanda tangan manual seperti dijelaskan di dalam Pasal 11 Undang-Undang No. 19 Tahun 2016 tentang Perubahan atas Undang-Undang No. 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Penelitian ini menggunakan metode penelitian hukum doctrinal, Dan menggunakan pendekatan konsep (Conceptual Approach) serta Serta pendekatan perundang-undangan (Statute Approach).

Abstract

This study aims to identify and analyze forced withdrawals carried out by PT. ACC Padang Branch and the problems faced by the company in the process of forcibly withdrawing collateral objects. This research was conducted by juridical-empirical research. The data source for this research is primary data from key informants at PT. ACC Padang Branch and secondary data derived from legal reference sources. The results of the study at the ACC Padang Branch found that the forced withdrawals based on the two cases analyzed had been carried out according to the requirements stated in the UUJF and the Constitutional Court Decision Number 18/PUU-XVII/2019. Based on these two cases the debtor has defaulted and has no good faith to settle his obligations. This study found that the debtor had violated Article 23 UUJF, by transferring the collateral object without the creditor's approval. By UUJF, in this case, the creditor can not only make withdrawals but the debtor can also be punished according to Article 36 UUJF.

Abstract

Hacking is used for other purposes that are detrimental. Legal protection for hacking is regulated in Law Number 19 of 2016. Problem Formulation What is the legal action taken by law enforcers regarding the eradication of criminal acts related to data theft? What is the legal protection for victims of hacking crimes related to data theft? What obstacles do law enforcers encounter in legal protection for victims of hacking crimes related to data theft? Type of research Normative legal research is supported by interviews. Data sources include primary data and secondary data. Data collection techniques are document studies and interviews. Data were analyzed descriptive-analytical. Conclusion of the research results: Law enforcement against hacking or hacking still does not reflect effective law enforcement due to a lack of understanding by investigators. Legal protection is divided into two kinds of preventive legal protection and repressive legal protection. Obstacles encountered by law enforcers in protection law against victims of criminal acts of hacking related to data theft, consists of several aspects, namely: investigator aspects, aspects of evidence in the investigation process, aspects of facilities, aspects of jurisdiction

Abstract

This study aims to find out and analyze how the power of underhanded deeds legalized by a notary as evidence in the trial process at court in civil cases, to find out and analyze the judge's consideration of civil case decisions, and to find out and analyze the notary's responsibility for the deed has been legalized in the Civil Code. The research method in this research is the normative research method. Normative legal research is legal research carried out by examining library materials or secondary data. The results of this study, want to show how the power of underhanded deeds legalized by a notary in civil cases, basically the strength of proof of underhanded deeds legalized by a notary the power of proof cannot be equated with an authentic deed, underhanded deed legalized by a notary if denied the power changes as proof of the beginning of writing.

Abstract

This research aims to find out and analyze the provisions for tax imposition in the transfer of inheritance in the Bukit Tinggi City Area as well as understand and understand the income tax imposed in the inheritance process in the Bukit Tinggi City Area. This type of internal research is empirical juridical research which is carried out by researching and collecting initial data that has been obtained through direct observation of related problems. Based on the results of the author's research, BPHLTB Tax Management uses a Self-Assessment System. The tax object in BPHLTB is specifically inheritance tax as stated in Article 85 paragraph (2) letter a Law No. 28 of 2009 n Law No. 1 of 2022 concerning Financial Relations Between Regional Government and Regional Government. The basis for imposition of PPLh tax is contained in Article 2 paragraph (1) ULU PPLh, the subject of which is one of the inherited assets that has not been divided into one unit to replace those entitled to it. Meanwhile, in Article 4 Paragraph (3) ULU PPLh is excluded and one of the tax objects is inheritance.

Abstract

Public Prosecutor is a prosecutor at the Attorney General's Office of the Republic of Indonesia who is authorized by law to conduct prosecutions, which process includes the authority to compose indictments. In exercising this authority, Article 15 and Article 137 of the Criminal Procedural Code (KUHAP) provide limitations for Public Prosecutors to conduct prosecutions within their jurisdictions, however, in practice it is found that Public Prosecutors indict criminal offenders who committed crimes outside their given jurisdiction (extra-jurisdictional). To study this phenomenon and its legal consequences, this research examines the consideration of the Public Prosecutor at Padang Panjang District Prosecutor's Office who indicted the perpetrator of criminal offense outside its given jurisdiction, as found in indictment No. PDM-15/PPJNG/Eoh.2/03/2021 on behalf of the defendant Aziarlis Bin Ameh Pgl Ziar, by employing empirical legal research methods based on primary data obtained by interviewing related Judges, lawyer and Public Prosecutors and also based on secondary data obtained through literature studies of various regulations and references that are analyzed qualitatively. This study finds that despite the restrictions imposed by KUHAP, extra-jurisdictional indictment is made possible through several provision in legislation, including Article 2 paragraph (3) of Law Number 16 Year 2004 concerning the Attorney General’s Office of the Republic of Indonesia. This study also recommends that the Supreme Court should consistently apply Article 4 paragraph (1) of Law No. 49 year 2009 concerning the Second Amendment to Law No. 2 Year 1986 concerning General Courts, which is included as a consideration in Chief Justice Decree No. 200/KMA/SK/X/2018.

Abstract

This research focuses on; 1) control and management of Government Land by the Regional Government, 2) control of Regional Government Land by the Padang City Government, and 3) control and security of Regional Government Land which can create legal certainty and provide maximum benefits. The research method in this study uses a normative juridical, empirical, and conceptual approach. The data sources used come from regulations, documents relating to the management of land assets as well and the results of interviews with parties involved in the management of Regional Property in the form of land of the Padang City Government. Based on research that has been carried out, the implementation of the management of Regional Government land assets has been carried out by the Padang City Government through regulations governing the management of Regional Property. However, several obstacles cause less than optimal management of land assets by the Padang City Government by OPD land users. Furthermore, 3 (three) efforts to secure land assets must be implemented as an inseparable unit, so that legal certainty of land assets of the Padang City Government can be achieved which can provide maximum benefits.
