Abstract

Myanmar's Ministry of Foreign Affairs rejected the Myanmar Ministry of Foreign Affairs calls for an arms embargo and power struggle by the military in a UN general assembly resolution last February because the resolution was considered based on unilateral accusations and false assumptions, and the resolution was deemed not legally binding. In addition, several Myanmar statements have been adopted by the UN security council, which has the authority as well as resolutions deemed legally binding, such as the prohibition of acts of violence against protesters. In addition, the resolution calls on the military not to commit acts of violence as well as restore the democratic transition. The purpose of this study is to find out whether Myanmar may reject the UN General Assembly resolution or not. The study uses normative legal research with a case approach using qualitative descriptive methods to describe the legal reasons used in Myanmar's rejection of the UN General Assembly resolution and how to apply the principle of pacta sunt servanda in this case. The results show that Myanmar rejects the UN resolution calling for an arms embargo because Myanmar considers that the resolution is not legally binding and based on the pacta sunt servanda. Myanmar should accept the UN General Assembly resolution because it binds an agreement to the parties who made it.

Abstract

 Transaksi jual beli baik jasa saat ini cukup berkembang dan menyebabkan adanya suatu antara konsumen dan pelaku usaha yang didukung oleh kemajuan teknologi. Dewasa ini, profesi perencana keuangan banyak diminati oleh masyarakat untuk menentukan tujuan dan prioritas keuangannya. Harapan mendapat keuntungan berubah menjadi kerugian bagi para pengguna jasanya terlebih belum adanya aturan yang secara spesifik mengatur mengenai kewenangan, kewajiban, tanggung jawab dan sanksi bagi perencana keuangan termasuk tidak adanya pengawasan yang dilakukan Otoritas Jasa Keuangan (OJK) dikarenakan tidak bergerak dalam bidang keuangan. Tetapi pada kenyataanya, perencana keuangan sangat berkaitan erat dengan sektor keuangan. Penelitian yang dilakukan ini bertujuan tidak lain menelaah terkait dengan perlindungan hukum bagi konsumen perencana keuangan bila mengalami kerugian dari tindakan sewenang-wenang yang dilakukan oleh penyedia jasa tersebut. Dalam penelitian ini digunakan metode yuridis normatif didukung dengan pendekatan perundang-undangan (statute approach) serta menggunakan data sekunder. Hasil penelitian memperlihat bahwasannya perlindungan hukum bagi konsumen perusahaan perencana keuangan didasarkan pada Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen beserta aturan yang mendukung lainnya. Adanya celah hukum menyebabkan pelaku usaha bisa berbuat sewenang-wenang. Sehingga dalam hal diperlukan adanya aturan hukum yang jelas terkait dengan perusahaan perencana keuangan agar tercipta kepastian dan perlindungan hukum.

Abstract

The policy of Victor Laiskodat as the Governor of East Nusa Tenggara has highlight public attention since the obligation to start learning hours at 05.00 WITA (Central Indonesia Time) because the government has improved the allocation of education funds on East Nusa Tenggara Province is 34% of the Regional Revenue and Expenditure Budget. Besides that, the policy of the Regent of North Central Timor prohibits smoking and eating betel nut as well as requiring the demolition for smoking and eating betel nut facility. Those policy then bring up an issue about conception regulation policy as well as performance of legislation in East Nusa Tenggara. This research has formulated with normative study, supported by legislation approach, analysis and conceptual approach, and the facts approach, then the author finds the final results and recommendations that the policy does not meet the criteria intended in a policy regulation and even resulting conflicting norms while legislative performance in East Nusa Tenggara Province is still needs to be improved, especially in the aspect of understanding basic legal concepts and policy

Abstract

Artikel ini bertujuan guna mendapatkan informasi mengenai jaminan perlindungan hak-hak perempuan dan anak pasca perceraian sebagaimana peraturan perundang-undangan Indonesia. Penulisan ini menggunakan metode penelitian yuridis-normatif, yaitu studi hukum literatur dengan mengkaji bahan dari literatur atau data sekunder, dengan menggunakan pendekatan perundang-undangan. Hasil studi menunjukan hak-hak perempuan pasca perceraian di Indonesia, meskipun telah banyak regulasi terkait pemenuhan hak-hak perempuan dan nafkah anak pasca perceraian, yang dalam prakteknya belum dilakukan secara maksimal yaitu masih sebatas keadilan di atas kertas. Dengan mengkomparasikan sistem perlindungan hak-hak perempuan dan nafkah anak pasca perceraian pada sistem Family Court of Australia dan sistem Peradilan Malaysia, yang telah melakukan upaya intervensi sangat intens dan terstruktur dalam melakukan perlindungan terhadap hak-hak perempuan dan anak pasca perceraian. Family Court of Australia dan Jabatan Kehakiman Syariah Malaysia meskipun memiliki perbedaan sistem hukum yang menjadi rujukan dalam menangani perkara perceraian, namun dari perbedaan kedua negara tersebut diharapkan dapat diperoleh acuan teknis pelaksanaan putusan yang berkekuatan hukum tetap dalam memenuhi hak-hak perempuan dan anak pasca perceraian di Indonesia.
