Abstract

The active role of advocates in peace efforts is stated in the Indonesian Advocate Code of Ethics (KEAI). This is the role that the author wants to emphasize in the contribution of advocates in the urgency of implementing mediation in criminal cases. With the active involvement of advocates, the peace process which previously only took place in the mediation room can now expand outside the mediation room, through interactions carried out by each legal representative. This article uses normative and qualitative juridical research methods on previous data about lawyers, as well as the results of observations and insights obtained by the author while carrying out internship activities at a law office. The results of this research found that the role of advocates is also important as a catalyst for peace between victims and perpetrators of criminal acts. Advocates act as mediators whose aim is to reach an agreement on compensation for the victim as well as an apology from the perpetrator to the victim as well as a form of accountability from the perpetrator to the victim. If there is peace through agreed mediation, the legal process can be stopped if the reporter (victim) has withdrawn his report to the police (article 75 of the Criminal Code). Ordinary offenses cannot stop the court process. However, in practice, if this occurs during the court process, the agreement between the perpetrator and the victim or the defendant and the victim witness will be a consideration for the judge in mitigating when handing down a decision.

Abstract

This qualitative study analyzes public perceptions of the declining trend in local retribution within Indonesian regencies and cities. The research examines factors such as public awareness, trust in local governance, economic challenges, and their impact on compliance behavior. Findings indicate that limited understanding of retribution policies, perceived lack of transparency in fund usage, and economic hardships significantly contribute to reduced compliance. Additionally, skepticism toward local governance and perceived inefficiency further discourage retribution payments. To address these challenges, strategies are suggested to improve transparency, strengthen administrative efficiency, and enhance public services, thereby fostering trust and compliance. Policy adjustments should be made to reflect regional economic conditions and ensure fair retribution systems, supported by public education and technological improvements in payment processes. The study underscores the importance of community involvement in policy-making and tailored approaches to address the specific needs of different regions, ultimately contributing to sustainable local revenue growth and better fiscal management. By improving awareness, transparency, and economic fairness, local governments can encourage higher compliance, improve financial independence, and better support public services.

Abstract

Law No. 1 of 2004 mandates accountable and transparent management of state finances in Indonesia. To ensure compliance, efficiency, and good governance, the effective implementation of APIP (Aparat Pengawasan Intern Pemerintah or Internal Government Auditors) is crucial. Enhancing the role of APIP is necessary to address the low quality of state financial management, ensure accountability, and support bureaucratic reform for transparent and efficient governance. Purpose: This study aims to analyze the role of APIP within the SPIP (Sistem Pengendalian Intern Pemerintah or Government Internal Control System) framework to support the development of Indonesia's defense forces. The research employs a qualitative descriptive method to explore the role and impact of APIP in state financial management and defense force development. Results: The study reveals a significant improvement in the capabilities of APIP over recent years. In 2015, 85.23% of APIP units were only at capability level 1, which indicates basic operations without full adherence to professional standards. By 2022, 54.74% of APIP units had reached capability levels above 3, indicating compliance with professional standards, enhanced risk management, and improved organizational governance. This increase in capability supports more robust oversight, particularly in the Ministry of Defense and the Indonesian Armed Forces, where APIP plays a vital role in overseeing budget management, the modernization of defense equipment, and the improvement of human resources. Conclusion: While the improvement in APIP capabilities enhances effectiveness, the assessment of efficiency in state financial management remains underemphasized. Addressing this gap is essential for the country's financial reforms aimed at improving public services and ensuring fiscal sustainability. APIP not only maintains integrity, transparency, and accountability but also supports the development of defense forces through comprehensive financial, management, and social audits. The focus on both efficiency and effectiveness is critical to strengthening the relevance of these findings in achieving sustainable governance and defense objectives.

Abstract

This study analyzes the application of circular economy principles in the development of marine tourism in Bone Regency, Indonesia, using a qualitative case study approach involving local government representatives, community members, and tourists. Data was collected through in-depth interviews and field observations to understand the integration of circular economy practices, including waste management, resource reuse, and local community empowerment. Findings highlight both opportunities and challenges in implementing sustainable tourism, such as limited funding and infrastructure. However, effective practices, such as community-led recycling initiatives and government support in waste treatment, underscore the potential for circular economy models to enhance environmental sustainability and local economic benefits. The study concludes that a circular economy framework, supported by multi-stakeholder collaboration, can provide a path toward sustainable marine tourism, offering insights for policymakers and researchers aiming to balance environmental and economic goals in tourism development.

This study concludes that the implementation still faces various obstacles, such as less than optimal budget support, weak proof of ownership as a result of weak administration and documentation systems, lack of responsibility from some heads of Regional Apparatus Organizations for the management of Regional Assets, and public awareness regarding the management of regional assets still needs to be improved and former officials who use goods who still want to use Regional Assets that are not in accordance with applicable regulations. To overcome this, the Regional Government of South Sumatra Province needs to... provide training or workshops to OPD heads and their staff, allocate a special budget, including building an information system for regional asset management that can help overcome the weak evidence of asset ownership by the South Sumatra Provincial Government. If these obstacles have been overcome, it is not impossible to create effective asset management.

Abstract

This study aims to analyze the form of resistance of the Wadas Village Nature Care Community Movement (Gempa Dewa) against the andesite rock mining project for the construction of the Bener Dam in Central Java through digital activism. Using a descriptive qualitative approach, data were obtained through in-depth interviews, participatory observations, and documentation studies of various key informants, such as representatives of WALHI Yogyakarta, LBH Yogyakarta, GEMPA DEWA, and local government officials. Data analysis was carried out with Miles and Huberman's interactive model, which included data reduction, data presentation, and conclusion drawn. The results of the study show that the resistance of the Wadas people is born from a sense of injustice due to threats to their ecosystem, livelihoods, and cultural identity. Collective identity, solidarity across generations and genders, and adaptation to digital technology are key factors in strengthening this movement. Digital activism through social media such as Instagram and Twitter is effective in building solidarity networks, expanding the reach of campaigns, and countering the dominant narrative of the government. However, this movement also faces significant challenges, such as digital repression, intimidation, social fragmentation, and lack of public participation in decision-making.
