Abstract

Cyberwarfare is a warfare  with information technology that has developed. It has not been  regulated in humanitarian law. Cyber attacks have been carried out by several countries by ignoring the Just War Theory. This  article aims to analyze the implementation of the Just War theory in cyber warfare according to international humanitarian law in the case of conflict between the Russian and Georgia in 2008. The research method use the normative juridical and  using secondary data sources. Qualitative data using deductive conclusion method. Based on the research results, it is known that the just  war theory including jus ad bellum, jus in bello and jus post bellum is not applied in cyberwarfare. The Russian’s cyber attack against Georgia violates the distiction principle , the principle of proportionality and the principles of proportionality. The losses incurred as a result of cyberattacks are not compensated by Russia.Keywords: just war, cyber attack, Russia, Humanitarian law.

Abstract

The development of digital technology in the industrial era 4.0 distorts tax cuts and collections in the e-commerce marketplace. This study provides an overview of conditions in the field of compliance and voluntary intentions of e-commerce marketplace platform providers and individuals and / or entities to register as PPN PMSE taxpayers and tax collectors. In addition, it can also find out a review of the juridical aspects of the applicable regulations if the taxpayer provides the domestic e-commerce marketplace platform application if it is determined as a PMSE VAT Collector. The method used is qualitative research using an ethnographic approach which is considered appropriate for social science research based on questionnaire data, interviews and other documentary data. The level of compliance of companies providing the e-commerce marketplace platform is divided 1) the level of compliance based on deductions, deposits and reporting related to corporate tax itself where there is an attempt to comply as a form of obligation of the taxpayer. 2) the level of compliance based on the voluntary intention to register to be appointed as a PPN PMSE collector, which is still very low. In the juridical aspect, it is only found that the additional obligation lies in the collection of PPN PMSE on intangible Taxable Goods or Taxable Services from outside the Customs area whose transactions are carried out within the Customs area.Keywords: Compliance; e-commerce marketplace; PPN; PMSE; Taxpayer

Abstract

Sistem religi dan upacara keagamaan merupakan salah satu unsur keberagaman masyarakat Indonesia, sebagai bagian dari konfigurasi kultural yang terfokus pada nilai dan norma religious yang mempengaruhi perilaku dalam pelaksanaan upacara keagamaan. Perbedaan budaya inilah yang terintegrasi dalam Bhinneka Tunggal Ika dan dijamin dalam Pasal 28E ayat (1) dan Pasal 29 ayat (2) UUD NRI 1945. Hal ini menegaskan bahwa Negara Indonesia dengan sistem hukumnya, telah memberikan kemerdekaan kepada setiap warga negaranya untuk beribadat dengan menggunakan tata cara sesuai dengan budaya masing-masing daerah. Konsep ‘Ketuhanan’ dari Sila pertama Pancasila, adalah konsep ‘Ketuhanan yang Berkebudayaan ‘bukan ‘keagamaan yang institusional’. Konsep ‘Ketuhanan yang Berkebudayaan’ ini memiliki keterbukaan dan penerimaan terhadap cita rasa religius yang plural, menyebar dan hidup di hati masyarakat Indonesia. Penelitian ini dilakukan dengan menggunakan metode penelitian sosio-legal, data dikumpulkan dari tiap agama dan kepercayaan yang hidup dalam masyarakat Indonesia. Proses Sosial dalam struktur sosial termasuk perubahan sosial merupakan faktor yang mempengaruhi perilaku dalam berbagai segi kehidupan bersama, khususnya keagamaan. Perlu adanya kesadaran akan keragaman budaya yang melengkapi dinamika dalam norma religius, sehingga terwujudlah keserasian dalam kehidupan masyarakat Indonesia yang heterogen, melalui inkulturisasi keagamaan dan kepercayaan di Indonesia.

Abstract

In recent months the world has faced a serious case in the form of the Covid-19 pandemic. All work together in order to reduce the number of increasing cases of Covid-19. Including among them is the state of Indonesia. Where Indonesia is slowly but surely increasing the number of victims from both ordinary people and medical personnel. The mortality ratio is 8%. Some of the deaths were due to Covid-19 medical personnel. The ratio of the death rate due to Covid 19 in Indonesia is recorded as the highest in the Southeast Asia region. Medical personnel are a profession where handling Covid-19 is at the forefront. However, the Indonesian government has not been able to meet the needs of medical personnel in order to serve or treat positive COVID-19 patients. Several government referral hospitals for covid-19 patients do not yet have sufficient medical equipment such as PPE, N95 Mask, Hand Sanitazer and others. This of course is not in accordance with Law Number 36 of 2014 concerning health workers. The research method used in this article is a normative research approach with a statute approach. The purpose of writing this scientific article is to provide recommendations regarding the government's responsibility for the rights of medical personnel as stipulated in Law Number 36 of 2004 concerning Health Workers.Keywords: Health Workers, Covid-19, Legal Protection

Abstract

Orientalist studies of Islam and hadith have generated mixed responses from Muslims. Some were loud, extreme and quite harsh by rejecting the studies conducted by the Orientalists. However, some other Muslims are gentler by taking the positive side of the studies they have carried out, namely that they can contribute to Islamic knowledge and assets and also study of hadith in particular. Several names emerged which were later considered as orientalists who were quite intense in studying Islam and hadith, they were: Ignaz Goldziher, Duncan Black, Carl Becker, Snouck Hurgronje, and Louis Massignon, A.J. Wensinck, G.H.A. Joynboll, Daniel W. Brown, Alois Sprenger, Sir Willian Muir, A. Guillaume, S. Mackrnsen Ruth, J. Schact, and others. The orientalists who departed from a skeptical attitude began to cause uproar among Muslims by saying that the hadith was only made by the Companions and not from the Prophet. They also criticize the hadith in terms of sanad or matan, whose authenticity is still considered very dubious and lean made by certain parties.Keywords: orientalis, critic, sanad, Matan

Abstract

AbstractLegal protection for the auction buyer/auction winner means that there is legal certainty of the auction winner's rights to the goods he bought through the auction, obtaining the goods and material rights to the goods he purchased or in other words the auction winner can control the auction object which he has legally and materially. And if there is a lawsuit, the winner of the auction should not participate as a defendant. This study discusses how the legal protection for the auction winner of the execution of mortgage over the control of the auction object and the obstacles experienced in the legal protection for the auction winner of the execution of the mortgage over the mastery of the auction object. The method used in this research is the normative juridical method, carried out through a literature study which examines mainly secondary data. The law has guaranteed legal certainty for auction buyers which is clearly stated in Vendu Reglement, HIR, and PMK Number 106/PMK.06/2013 concerning Amendments to PMK Number 93/PMK.06/2010 and PMK Number 93/PMK.06 /2010 Concerning Auction Implementation Guidelines. The Vendu Reglement is a regulation that regulates the basic principles of auction which has been in effect since April 1, 1908. In general, the Vendu Reglement only regulates the implementation of auctions, the auctioneer or currently referred to as the auction official, the parts and contents of the auction minutes. Article 42 of the Vendu Regulation states that the winner of the auction has the right to obtain a quote from the minutes of the auction as a deed of sale and purchase of the object of the auction. The excerpt of the minutes of the auction which will later be used as a deed of sale and purchase for the benefit of changing the name of the auction object if the object being auctioned is an immovable object. Keywords: Execution, Mortgage, Legal Protection, Auction Winner. AbstrakPerlindungan hukum terhadap pembeli lelang/pemenang lelang berarti adanya kepastian hukum hak pemenang lelang atas barang yang dibelinya melalui lelang, memperoleh barang dan hak kebendaan atas barang yang dibelinya atau dengan kata lain pemenang lelang dapat menguasai obyek lelang yang telah dimilikinya secara yuridis maupun secara materiil. Dan apabila terjadi gugatan, seharusnya pemenang lelang tidak turut serta sebagai tergugat. Penelitian ini membahas bagaimana perlindungan hukum bagi pemenang lelang eksekusi hak tanggungan atas penguasaan obyek lelang dan hambatan-hambatan yang dialami dalam perlindungan hukum bagi pemenang lelang eksekusi hak tanggungan atas penguasaan obyek lelang. Metode yang digunakan dalam penelitian ini yaitu Metode yuridis normatif dilakukan melalui studi pustaka yang menelaah terutama data sekunder. Undang-undang telah menjamin kepastian hukum bagi pembeli lelang yang secara jelas dinyatakan dalam Vendu Reglement, HIR, serta PMK Nomor 106/PMK.06/2013 Tentang Perubahan Atas PMK Nomor 93/PMK.06/2010 dan PMK Nomor 93/PMK.06/2010 Tentang Petunjuk Pelaksanaan Lelang. Vendu Reglement merupakan peraturan yang mengatur prinsip-prinsip pokok tentang lelang yang telah berlaku sejak 1 April 1908. Secara umum Vendu Reglement hanya mengatur tentang penyelenggaraan lelang, juru lelang atau saat ini disebut sebagai pejabat lelang, bagian-bagian serta isi dari risalah lelang. Dalam Pasal 42 Vendu Reglement, menyatakan bahwa pemenang lelang berhak memperoleh kutipan risalah lelang sebagai akta jual beli obyek lelang. Kutipan risalah lelang mana nantinya akan dipergunakan sebagai akta jual beli untuk kepentingan balik nama obyek lelang apabila yang dilelang adalah benda tidak bergerak.Kata kunci: Eksekusi, Hak Tanggungan, Perlindungan Hukum, Pemenang Lelang

Abstract

AbstractIn Banyumas Regency, guidance for female prisoners is carried out at the Banyumas Detention Center (Rumah Tahanan, RUTAN) because Banyumas Regency does not have an extraordinary women's prison. The guidance for female prisoners in the Banyumas Rutan is almost no different from that carried out on male prisoners. The difference is only in the skills provided where female prisoners are given talents in sewing, arranging flowers, making crossbows, and cooking. The first objective of this study was to identify, identify and analyze the development of female prisoners in the assimilation stage at the Banyumas Detention Center. Second, to construct a model for fostering female prisoners in the assimilation stage at the Banyumas Detention Center. The method used in this research is descriptive qualitative with a sociological approach (social legal approach). Sources of data used in this study are primary data (obtained directly from informants in the form of interview recordings, survey results, and notes from the field) and secondary data (archives, library documents, statistical data that support the research. In this study, it was found that the development of female prisoners in the assimilation stage at the State Detention Center (Rumah Tahanan, RUTAN) Class II B Banyumas, based on the Decree of the Minister of Justice of the Republic of Indonesia Number M.02-PK-04.10 of 1990 concerning the Pattern of Guidance for Convicts or Detainees, which includes Personality and Independence Development. There are still some shortcomings in the independence development due to limited facilities and infrastructure.Keywords: Detention Center, Female inmates, Patterns of DevelopmentAbstrakDi Kabupaten Banyumas, pembinaan terhadap narapidana wanita dilakukan di Rumah Tahanan (Rutan) Banyumas karena Kabupaten Banyumas tidak memiliki Lapas khusus wanita. Pembinaan terhadap narapidana wanita di Rutan Banyumas hampir tidak ada bedanya dengan yang dilakukan terhadap narapidana laki-laki. Yang membedakan hanya pada jenis ketrampilan yang diberikan dimana terhadap narapidana wanita diberikan ketrampilan berupa menjahit, merangkai bunga, membuat kristik dan memasak. Tujuan penelitian ini yang pertama adalah untuk mengetahui, mengidentifikasi dan menganalisis pembinaan narapidana wanita dalam tahap asimilasi di Rumah Tahanan Banyumas. Kedua, untuk mengkonstruksi model pembinaan narapidana wanita dalam tahap asimilasi di Rumah Tahanan Banyumas. Metode yang digunakan dalam penelitian ini adalah deskriptif kualitatif  dengan pendekatan  sosiologis (social legal approach). Sumber data yang digunakan dalam penelitian ini berupa data primer (yang diperoleh secara langsung dari informan berupa rekaman wawancara, hasil survey dan catatan dari lapangan) dan data sekunder (arsip, dokumen kepustakaan, data statistik yang mendukung penelitian. Dalam penelitian ini ditemukan bahwa pembinaan terhadap narapidana wanita dalam tahap asimilasi di Rumah Tahanan Negara (RUTAN) Kelas II B Banyumas, didasarkan pada Keputusan Menteri Kehakiman Republik Indonesia Nomor M.02-PK-04.10 Tahun 1990 Tentang Pola Pembinaan Narapidana atau Tahanan, yaitu meliputi Pembinaan Kepribadian dan kemandirian. Dalam pembinaan kemandirian, masih ditemukan beberapa kekurangan dikarenakan terbatasnya sarana dan prasarana.Kata kunci: RUTAN,  Narapidana wanita, Pola Pembinaan

Abstract

Abstract All elements contained in the contents of the Identity Card (KTP) are things that are filled in according to the provisions of the Owner's Identity, including the urgency of filling in the religious column which must be filled in according to the beliefs of the owners of the KTP. The issuance of Law Number 23 of 2006 concerning Population Administration, among others, mandates the development of a national population administration system. The development of this system is important because it not only has a significant effect on the government's agenda in optimally providing public services. With this law, population administration as a system is expected to be implemented as part of the administration of state administration. The existence of Article 61 paragraph (1) and paragraph (2) in conjunction with Article 64 paragraph (1) and (5) of the Population Administration Law violates the human rights of believers and applicants as citizens. Because Article 61 paragraph (2) of the Population Administration Law states that information regarding the religion column on the family card for residents whose religion has not been recognized as a religion based on the provisions of laws and regulations or for believers in beliefs is not filled in, but is still served and recorded in the database. population. Furthermore, Article 64 paragraph (2) of the Population Administration Law states that information about religion in Electronic Identity Cards (E-KTP) for Residents whose religion has not been recognized as religion based on the provisions of laws and regulations or for believers in beliefs is not filled in, but is still served and recorded in the population database. These two articles have the potential to eliminate the right of citizens to obtain a Family Card (KK) and an electronic Identity Card (KTP), even though in the a quo law article it is stated that they will still be served and recorded in the population database.Keywords: Identity Card, Religion and Belief, Citizen's Human Rights.AbstrakSemua elemen yang terdapat dalam isi Kartu Tanda Penduduk (KTP) merupakan hal yang  diisi sesuai ketentuan dengan Identitas Pemilik, termasuk urgensi pengisian kolom agama yang harus diisi sesuai dengan keyakinan para pemilik KTP. Diterbitkannya Undang-undang Nomor 23 Tahun 2006 tentang Administrasi Kependudukan, antara lain mengamanatkan pembangunan sistem administrasi kependudukan secara nasional. Pembangunan sistem ini adalah hal penting karena tidak saja berpengaruh secara signifikan terhadap agenda pemerintah dalam pelayanan publik secara optimal. Dengan undang-undang tersebut, maka administrasi kependudukan sebagai suatu sistem diharapkan dapat diselenggarakan sebagai bagian dari penyelenggaraan administrasi negara. Keberadaan Pasal 61 ayat (1) dan ayat (2) jo Pasal 64 ayat (1) dan (5) Undang-undang Administrasi Kependudukan melanggar hak asasi penghayat kepercayaan dan pemohon selaku warga negara. Karena dalam Pasal 61 ayat (2) Undang-undang Administrasi Kependudukan menyatakan bahwa keterangan mengenai kolom agama pada kartu keluarga bagi penduduk yang agamanya belum diakui sebagai agama berdasarkan ketentuan peraturan perundang-undangan atau bagi penghayat kepercayaan tidak diisi, tetapi tetap dilayani dan dicatat dalam database kependudukan. Selanjutnya Pasal 64 ayat (2) Undang-undang Administrasi Kependudukan menyatakan bahwa keterangan tentang agama dalam KTP Elektronik bagi Penduduk yang agamanya belum diakui sebagai agama berdasarkan ketentuan peraturan perundang-undangan atau bagi penghayat kepercayaan tidak diisi, tetapi tetap dilayani dan dicatat dalam data base kependudukan. Kedua pasal ini berpotensi menghilangkan hak warga negara untuk mendapatkan Kartu Keluarga (KK) dan KTP elektronik, meskipun dalam pasal undang-undang a quo disebutkan tetap dilayani dan dicatat dalam database kependudukan.Kata kunci: Kartu Tanda Penduduk, Agama dan Keyakinan, Hak Asasi Warga Negara

Abstract

AbstractThe purpose of this study is to analyze the appropriate employment policies for companies in overcoming the problems of workers who have been laid off or laid off due to the COVID-19 pandemic in the Banyumas Regency. This research method is descriptive with a normative juridical research approach, known as a literature approach, and an empirical juridical process is carried out by looking at the reality in practice in the field analyzed qualitatively. The results show that the right employment policy for companies in overcoming the problems of workers who are laid off due to the Covid-19 pandemic refers to the provisions of Article 151 paragraph (2) of Law No. 13 of 2003, namely that layoffs must be negotiated by employers and trade unions. If it does not result in an agreement, the entrepreneur can only carry out a discharge after determining the industrial relations dispute settlement institution. For laid-off workers, refer to Item f of the Circular of the Minister of Manpower No. SE-907/MEN/PHI-PPHI/X/2004. The government, companies, took steps, and labor unions in dealing with laid-off workers, especially in the tourism, entertainment, hotel, restaurant, and industrial sectors, firstly, bipartite or tripartite negotiations to make agreements such as work systems, wages, safety In terms of work and working time, the Manpower Office and MSMEs have held various skills training activities, and provided tax relief incentives for entrepreneurs, relaxation of bank credit, and social incentives for laid-off workers.Keywords: Employment Policy, Termination of Employment, Layoff.AbstrakTujuan dari penelitian ini adalah untuk menganalisis kebijakan ketenagakerjaan yang tepat bagi   perusahaan dalam mengatasi permasalahan pekerja yang di PHK atau dirumahkan akibat pandemi covid 19 di Kabupaten Banyumas. Metode Penelitian ini bersifat deskriptif  dengan pendekatan penelitian yuridis  normatif  atau dikenal dengan pendekatan kepustakaan dan pendekatan yuridis empiris yang dilakukan dengan melihat kenyataan yang ada  dalam praktik di  lapangan yang dianalisis secara kualitatif.  Hasil penelitian menunjukan bahwa Kebijakan Ketenagakerjaan yang Tepat Bagi Perusahaan Dalam Mengatasi Permasalahan Pekerja yang di PHK  ataupun   “Dirumahkan”  Akibat Pandemi Covid 19  merujuk pada ketentuan Pasal 151 ayat (2) UU No 13 Tahun 2003 yakni PHK wajib dirundingkan oleh pengusaha dan serikat pekerja/pekerja. Apabila tidak menghasilkan persetujuan, pengusaha hanya dapat melakukan PHK setelah memperolah penetapan dari lembaga penyelesaian perselisihan hubungan industrial. Untuk pekerja yang dirumahkan  merujuk  pada Butir f Surat Edaran Menaker No. SE-907/MEN/PHI-PPHI/X/2004. Langkah-langkah  yang Dilakukan Pemerintah , Perusahaan dan Serikat Pekerja dalam mengatasi pekerja yang di PHK/dirumahkan terutama di sektor pariwisata, hiburan, hotel, rumah makan, dan industri, pertama  perundingan baik bipartit atau tripartit untuk melakukan kesepakatan seperti sistem kerja, upah, keselamatan kerja dan waktu kerja ,pihak Dinaker dan UMKM  telah menggelar berbagai kegiatan pelatihan keterampilan,dan pemberian insentif keringanan pajak bagi pengusaha, relaksasi kredit perbankan, dan insentif sosial untuk pekerja yang di PHK/dirumahkan.Kata kunci: Kebijakan Ketenagakerjaan, Pemutusan Hubungan Kerja, Dirumahkan

Abstract

E-commerce in Indonesia is increasing, especially since the Covid-19 pandemic. Electronic transactions run effectively and efficiently because there are facilities in the e-commerce platform that provide a variety of products to help people meet their daily needs. The use of e-commerce platforms requires all users to register first using their name, phone number, e-mail, and some other personal data before they can take advantage of the facility. Unfortunately, there are cases of data leaks that are massively done by taking data contained in the e-commerce platform and sold freely on illegal websites. One of the factors that influence the occurrence of data leaks is the absence of comprehensive rules governing the protection of personal data in Indonesia. The purpose of this study is to analyze the form of the legal protection of personal data of e-commerce users in Indonesia and see the comparison of personal data protection laws in Indonesia with those in Malaysia and Singapore. The results explained that there are regulations in the form of ministerial regulations governing the protection of personal data electronically, but the rules do not provide data protection expressly and far behind the rules in some ASEAN countries such as Malaysia and Singapore, so there needs to be a renewal of the law regarding data protection in Indonesia by issuing regulations at the level of laws as regulated and implemented. n in the Personal Data Protection Act of Malaysia and Singapore which also conform to EU GDPR rules. It aims to tighten the security of data managed by private parties and impose strict sanctions on anyone who accesses, collects, and transports data in an unauthorized or unlawful manner.Keywords: Personal Data Protection, e-Commerce, Legal Renewal
