Abstract

The most popular case of online fraud is fraud using online invitation mode on social media. Law enforcement against criminal acts of fraud using online invitation mode is very important. Lack of strict and clear law enforcement is the trigger for this criminal act of fraud to continue to occur. This research aims to describe the regulation of criminal acts of fraud in Indonesian law and analyze law enforcement against criminal acts of fraud using the online invitation mode. This type of research is normative legal research. This research uses a statutory approach. The data source for this research uses secondary data. The data analysis technique used is qualitative data analysis technique. The research results show that criminal acts of fraud in Indonesian law are regulated in the Criminal Code and the Information and Electronic Transactions Law. In the Criminal Code, fraud is regulated in Chapter XXV Book II of the Criminal Code Articles 378-395 and specifically regulated in Article 378 of the Criminal Code, online fraud is regulated in Article 28 Paragraph (1) of the Information and Electronic Transactions Law. The online invitation mode for criminal fraud is relatively new. Law enforcement is carried out by the Police against perpetrators of fraud using the online invitation mode, namely arresting perpetrators who create online invitation applications. Law enforcers usually impose multiple articles as regulated in Article 378 of the Criminal Code and Article 28 Paragraph (1) of the Information and Electronic Transactions Law with the threat of imprisonment for a maximum of 6 (six) years and/or a fine of a maximum of IDR. 1,000,000. 000, to prove error, Article 5 and Article 6 of the Information and Electronic Transactions Law are used as recognition of information, documents and electronic signatures as valid evidence in court.

Abstract

Believers are a group of people who experience discrimination in the administrative system in relation to the religion column in the e-KTP. In general, when viewed from the population administration, the location of adherents of beliefs, adherents of ancestral religions and the implementation of rituals in adat makes it difficult for them during state administration in personal documents such as electronic identity cards (KTP), family cards (KK), marriage certificates. , and birth certificates. Based on the article of the Population Administration Lawwhich explains that religion in the religion column on the family card (KK) and electronic identity card (KTP) for adherents of faith is not filled in fundamentally, this is because the sect has not been recognized as well as other religions. another, so that in the electronic identity card (KTP) there is no record that someone is a believer. Meanwhile, the Population Administration Law is factually or at least potentially detrimental to constitutional rights. This is where discrimination arises against people who do not yet have an awareness of human rights. Cases of discrimination against adherents of certain religions are even carried out by bureaucracy, although the 1945 Constitution has stated to free people to practice their respective religions and beliefs.

Abstract

The emergence of digital-based health services has garnered increased attention following the onset of the COVID-19 pandemic. The utilization of these services involves the collection of user data, a sensitive matter that holds the potential for giving rise to legal issues, thereby calling for the need for regulations concerning the protection of personal data. Indonesia has established provisions to safeguard personal data in the health sector through various legal instruments. However, the effective protection of users' data in the digital transformation of the health sector has not materialized. This is evident in instances of personal data breaches involving participants of the Health Social Security Administering Agency. The research is conducted using normative juridical legal research methods. The findings highlight the context of personal data protection in the health sector within the digital era, which is regulated in, for example, article 26 of the ITE Law, Law Number 43 of 2009 regarding Archives, article 57 of the Health Law, Minister of Health Regulation Number 24 of 2022 concerning Medical Records and Law Number 36 of 1999 on Telecommunications. Nevertheless, the occurrence of data leaks from BPJS Health indicates the failure to ensure personal data protection in the health sector in Indonesia. As a result, regulations and stringent supervision within health institutions, particularly in the digital sector, are crucial. The appointment of Data Protection Officers in health service agencies represents the solution to these issues, and it is imperative to realize digital protection of personal data in the health sector.

Abstract

Seiring majunya perkembangan di bidang trasportasi laut sebagai konektivitas pelayaran di Indonesia, sebagai Negara kepulauan yang juga menghubungkan kepada dunia internasional. Hal tersebut telah membuka peluang besar bagi perkembangan Badan usaha bidang trasportasi laut di bidang kepelabuhanan seperti Pelindo. Pelindo sebagai badan usaha pelabuhan yang berada di bawah naungan kementrian badan usaha milik Negara, yang terdiri dari Pelindo I dengan pusatnya di Belawan, Pelindo II berpusat di Jakarta, Pelindo III di Surabaya dan Pelindo IV berpusat di Makassar. Dalam mendukung perkembangan kinerja pelabuhan di Indonesia, pada masa pemerintahan presiden RI Joko Widodo telah meresmikan penggabungan (Merger) Pelindo 1,2,3,4 menjadi satu Pelindo atau yang dikenal dengan istilah Pelindo bersatu atau Pelindo (Pesrero). Dengan penggabungan Pelindo memberi angin segar terutama dibidang permodalan, karena terjadi penggabungan modal sehingga saham yang dimiliki semakin besar yang akan membawa peluang besar dalam pengembangan pelabuhan, terutama pelayanan B/M petikemas tingkat dunia, bahkan menjadi operator petikemas terbesar 8 dunia fersi ocean week 14 April 2023 https://oceanweek.co.id. Abstract

ABSTRACT; The Government of the Republic of Indonesia issued Regulation of the Minister of Law and Human Rights (Permenkumham) Number 22 of 2023 concerning Visas and Residence Permits as well as Regulation of the Minister of Finance Number 82 of 2023 concerning Types and Tariffs for Types of Non-Tax State Revenue. The Minister of Law and Human Rights Regulation and the Minister of Finance Regulation function as regulations for granting golden visas to investors who wish to invest their capital in Indonesia. The approach method used is empirical juridical with research specifications that are descriptive analytical. The things studied are the policy of granting golden visas to foreign investors in Indonesia and the form of incentives for granting golden visas to foreign investors to invest in Indonesia. In the end, the researchers concluded that the golden visa imposed by the government on foreign investors was a temporary residence permit with a period of 5 (five) years for individual investors and a temporary residence permit with a period of 5 (five) years to 10 (ten) years for corporate investors, then get ease in entering and exiting Indonesia, and ease in not processing a limited residence permit in Indonesia.

Abstract

Agreements based on Article 1313 of the Civil Code, namely "an agreement is an act by which one or more people bind themselves to one or more other people". Leasing is carried out by making an agreement between both parties. Implementation of a tourist bus rental agreement at PT. WIN GSP TRANS in Kendal Regency experienced a default/broken promise. This research aims to analyze the implementation of agreements and the resolution of defaults on tourist bus rental agreements at PT. WIN GSP TRANS in Kendal district. The method used in this research is a type of normative legal research, namely legal research carried out by studying existing norms or statutory regulations. The research specifications used are descriptive. The data sources used are secondary and primary data. Qualitative data analysis, namely describing data in sentence form in an orderly, logical, non-overlapping and efficient manner to facilitate understanding and interpretation of data. This research is about the implementation of tourist bus rental agreements at PT. WIN GSP TRANS in Kendal district, namely tenants must fulfill two requirements, firstly legal requirements and secondly administrative requirements. Settlement of defaults on tourist bus rental agreements with PT. WIN GSP TRANS, namely by non-litigation settlement such as negotiation or deliberation.

Abstract

Legal certainty for narcotics abusers in Law Number 35 of 2009 concerning Narcotics does not yet have legal certainty where in practice abusers are often charged and even terminated by Article 112 paragraph (1) of Law Number 35 of 2009 concerning Narcotics which is without rights and against the law depositor, owner, who controls narcotics class I non-plants. Based on the description above, the author is interested in studying this scientific paper with the title Juridical Review of the Value of Legal Certainty and the Value of Justice for the Abuse of Narcotics Group I in conviction Number 304/PID.SUS/2020/PT SMG. In practice narcotics abusers still use Article 112 paragraph (1) of Law Number 35 of 2009 concerning Narcotics which is without rights and against the law of the depositor, the owner, who controls narcotics class I not plants even though there is a Supreme Court Circular Letter (SEMA) Number 3 of 2015 to identify the accused as an abuser. In its implementation, there are obstacles that exist in the authority of law enforcers, especially judges. This research also found that restorative justice for narcotics abusers by the courts is still not effective which is contained in the Appendix to the Decree of the Director General of the General Judiciary Agency Number 1691/DJU/SK/PS.00/12/2020 concerning Enforcement of the Guidelines for the Application of Restorative Justice in the guidelines for the application of restorative justice in the General Court environment as an effort that can be made in deciding cases of class I narcotics abuse.

This article examines the problem of information security crimes in the conditions of technological progress with the globalization of international life, including relations between countries, taking into account the high level of development of technological and information resources. The importance of ensuring information security as an object of legal protection protected by written international and national law. This research method is normative with a statutory, historical and philosophical approach. efforts to improve international and national legal policies to modernize the national legal system for the prevention and eradication of cybercrime. Abstract

The social assistance program (Bansos) has become the main instrument in the government's performance to alleviate poverty and ensure community welfare. However, the phenomenon of misuse of social assistance for political purposes, especially in the context of general election campaigns (Pemilu), is an issue that raises serious concerns in realizing the principles of justice, transparency, and accountability in realizing elections that are "Luber Jurdil" (Direct, Public, Secret, Honest, and Fair). The purpose of this paper is to identify and examine carefully and thoroughly the normative problems related to the misuse of social assistance programs for campaign purposes during the general election. This research uses a normative analysis method by referring to various legal sources, regulations, and related literature. To deal with this issue, this article adress several policy recommendations, including strengthening legislative material regarding supervision and accountability, increasing the capacity of related institutions, as well as increasing awareness of law and political ethics among the public and political actors. So the misuse of social assistance programs for campaign purposes during general elections is a complex problem and requires comprehensive and sustainable action from various related parties to build transparent, clean, and accountable public governance.

Abstract

Indonesia sebagai Negara yang berpenduduk muslim terbesar di dunia mempunyai problematika yang unik. Dalam kehidupan masyarakat ada sebagian orang yang menggunakan sistem kewarisan adat, hukum kewarisan barat dan ada pula yang menggunakan kewarisan Islam. Dalam pembentukan hukum waris nasional di Indonesia, kiranya kita tidak dapat memungkiri bahwa bangsa Indonesia adalah bangsa yang kaya akan adat istiadat yang sangat bermacam-macam dan dalam hukum adat itu telah mempunyai aturan atau ketentuan-ketentuan mengenai hukum kewarisan juga, sehingga perlu dalam pembaharuan hukum kewarisan nasional di Indonesia hendaknya tidak mengesampingkan aturan kewarisan adat. Hal ini dikarenakan masyarakat Indonesia masih sangat menjunjung tinggi adat istiadat mereka yang merupakan warisan dari para leluhur mereka.Â
