Abstract

Abstract

Keselamatan berlalu lintas merupakan kebutuhan dasar manusia yang berkaitan dengan hak untuk hidup dan merasa aman. Namun, tingginya angka kecelakaan lalu lintas di Indonesia menunjukkan masih rendahnya budaya hukum pengemudi. Penelitian ini bertujuan untuk menganalisis potret budaya hukum pengemudi kendaraan bermotor di Indonesia dan faktor-faktor yang mempengaruhinya terhadap keselamatan lalu lintas. Metode penelitian yang digunakan adalah dengan pendekatan yuridis sosiologis dan memanfaatkan Teori Sistem Hukum Lawrence M. Friedman. Hasil penelitian menunjukkan bahwa budaya hukum pengemudi di Indonesia masih rendah, ditandai dengan kurangnya pengetahuan dan pemahaman hukum lalu lintas, sikap yang mengabaikan keselamatan, serta perilaku yang cenderung melanggar aturan. Faktor-faktor yang mempengaruhi budaya hukum pengemudi meliputi faktor internal (usia, jenis kelamin, tingkat pendidikan, pemahaman agama, dan pengalaman berkendara) dan faktor eksternal (lingkungan sosial, penegakan hukum, kondisi infrastruktur jalan, dan akses terhadap informasi serta edukasi lalu lintas). Upaya perbaikan budaya hukum pengemudi perlu dilakukan secara komprehensif dan berkelanjutan melalui peningkatan efektivitas penegakan hukum, optimalisasi program edukasi dan sosialisasi, penguatan peran serta masyarakat, pemanfaatan teknologi, serta kerjasama antar stakeholder.

Abstract

In practice, loan agreements involve borrowing and lending activities between individuals, typically with money as the object of the loan, and are established based on a contractual agreement. The provisions governing such agreements are stipulated in the Indonesian Civil Code, which sets out the rights and obligations of the parties involved. However, in practice, the legal relationship between creditors and debtors, particularly in contractual aspects, often encounters issues, leading to breaches of contract (wanprestasi). This study focuses on the legal consequences of wanprestasi in loan agreements, specifically in the context of working capital loans, and examines whether the relevant court decisions align with Article 1754 of the Indonesian Civil Code. This research employs a normative legal method, utilizing primary and secondary legal materials, which are subsequently analyzed through a descriptive-analytical approach. The findings conclude that money borrowed for business capital is based on a contractual agreement. The defendants were found to have breached the contract (wanprestasi) and are therefore obliged to repay the loan.

Abstract

AbstractThis study examines the legality of establishing a Sole Proprietorship Corporation in the era of regulatory reform through the implementation of Law No. 6 of 2023 on Job Creation, which offers an alternative for creating legal entities with single ownership. It further explores its relationship with the traditional legal framework as stipulated in Law No. 47 of 2007 concerning Limited Liability Companies. The research analyzes the fundamental principles of company establishment—such as freedom of enterprise, transparency, legal protection, and accountability—and observes how these principles are integrated into operational practices through the Regulation of the Minister of Law and Human Rights No. 21 of 2021 regarding the Requirements and Procedures for Registration, Amendment, and Dissolution of Legal Entities of Limited Liability Companies in conjunction with Law No. 6 of 2023 on Job Creation. The findings indicate that the regulatory innovations introduced by the Job Creation Law have created opportunities to enhance bureaucratic efficiency and attract investments by streamlining the establishment process. However, the implementation also faces challenges, including bureaucratic cultural adaptation, digital infrastructure disparities, and the necessity for a deeper understanding of corporate legal principles among business actors and government officials. The study concludes that synergy among these three regulatory frameworks is essential for fostering a more dynamic, transparent, and accountable business environment, thereby supporting national economic growth in a globally dynamic context.

Abstract

 This article analyzes the role of the Unit Leadership Council (PUK) of SP LEM SPSI at PT Steel Center Indonesia in developing industrial relations based on Pancasila values. The study emphasizes the integration of ideological foundations and practical strategies in advocating for workers' rights and fostering harmonious work relations. A qualitative descriptive method is employed, gathering data through observation, interviews, and document study. The findings reveal that PUK functions not only in normative roles within Collective Labor Agreement (CLA) negotiations but also as a transformative social agent through economic advocacy programs and social collaboration. Pancasila values are implemented through organizational activities such as bipartite communication, cadre consolidation, and cooperative management. These results demonstrate that trade unions can become a collective force not only to protect rights but also to promote social justice and sustainable welfare in the workplace.

Efforts to improve public services include health, narcotics, psychotropics, and other addictive substances. Drug crimes are generally not committed by individuals alone, but rather collectively, even by organized, well-organized, and highly secretive syndicates. Furthermore, drug trafficking is transnational in nature, carried out using sophisticated methods and technology. To combat drug abuse, the government has issued Law No. 5 of 1997 concerning Psychotropics and Law No. 22 of 1997 concerning Narcotics. Law No. 22 of 1997 has been revoked and replaced by Law No. 39 of 2009. Abstract

AbstractThe rapid development of digital technology encourages the implementation of electronic documents and electronic signatures (TTE) in various legal and administrative aspects in Indonesia. This study aims to analyze the validity of electronic certificates and TTE within the Indonesian legal system and the challenges of its implementation. The research method used is normative juridical with statutory and conceptual approaches. The results show that electronic certificates and TTE are legally valid based on Law Number 11 of 2008 concerning Electronic Information and Transactions and its derivative regulations. Certified TTE has the same evidentiary strength as a wet signature. However, challenges arise in terms of cybersecurity, digital literacy, and legal certainty in court. This study recommends strengthening technical regulations and public awareness to support the optimal implementation of TTE and electronic certificates in Indonesia.

Abstract

ABSTRACTThe distribution of food containing hazardous chemicals remains a serious issue in consumer protection in Indonesia. Although the Consumer Protection Law, the Food Law, and various derivative regulations have provided a clear legal basis, practices in the field show that law enforcement is still weak. This study aims to analyze the criminal liability of business actors for the distribution of hazardous food by examining the applicable legal norms and their implementation in the field. The method used is empirical legal research with a normative juridical approach and field studies, through analysis of regulations, court decisions, and data from the Food and Drug Supervisory Agency (BPOM). The results of the study show that the forms of business operator liability can be civil, administrative, and criminal; however, obstacles such as limited resources, weak coordination between agencies, low legal awareness, and inconsistent court decisions mean that criminal sanctions are rarely applied to the fullest extent. This study emphasizes the importance of strengthening coordination among law enforcement agencies, harmonizing regulations, and applying consistent criminal sanctions to realize consumer protection. Theoretically, this study enriches the study of economic criminal law and consumer protection, while practically providing policy recommendations for improving the hazardous food control system in Indonesia.

Abstract

The 2025 diplomatic tension between India and Pakistan, culminating in the mutual expulsion of diplomats under persona non grata status following a terrorist attack in Kashmir, highlights the use of diplomatic law as a political tool in strained bilateral relations. This study aims to analyze the regulations concerning persona non grata under the 1961 Vienna Convention on Diplomatic Relations (VCDR) and their application in the India-Pakistan case. Employing a normative legal research method with a statutory approach, data from primary, secondary, and tertiary legal sources is descriptively analyzed. The findings reveal that Article 9 of the VCDR grants the receiving state full discretionary authority to expel a diplomat without justification, a right exercised in this instance for political retaliation. Both nations justified their actions by alleging violations of Article 41 of the VCDR, which obligates diplomats to respect the laws of the receiving state. This case demonstrates that diplomatic immunity is not absolute and is subject to national security interests. The implication is that a legally sanctioned persona non grata action can be instrumentalized for political retribution, thereby undermining the very channels essential for communication and peaceful conflict resolution.

Abstract

The collective management system regulated by Law Number 28 of 2014 concerning Copyright, Government Regulation Number 56 of 2021, and various ministerial regulations is designed to protect the economic rights of creators, related rights owners, and users of musical works through a royalty collection and distribution mechanism. However, its implementation has given rise to various normative issues, ranging from overlapping authority between LMK and LMKN, unclear licensing mechanisms, and minimal transparency in royalty distribution. This culminated in a number of creators filing judicial review lawsuits against PP 56/2021 and Permenkumham 27/2025, objecting to the system's inconsistency with copyright protection principles. This study aims to legally examine the implementation of the collective music royalty management system in Indonesia and assess its compliance with the principles of justice, legal certainty, and transparency. This study uses a normative legal approach supported by philosophical and conceptual analysis. The results of this study found that the implementation of the collective royalty management system still faces various ineffectiveness, including potential conflicts of interest, administrative burdens, and a lack of institutional accountability. This situation indicates the need for regulatory reformulation and strengthening of institutional governance so that the royalty management system can operate fairly, transparently, and sustainably to support the national music industry ecosystem.
