Abstract

Until now there are groups that continue to fight for the upholding of khilâfah islâmiyyah in Indonesia. They believe that khilâfah is the only solution for all problems of the people. And there are groups who believe that the khilâfah is difficult to realize now because every Islamic country in the world has a different system and form of government.According to this second group the state is only the will and the benefit of the people is the main goal.There are three important issues discussed in this article through the fiqh approach to state administration. First, the principles of Islamic governance from the perspective of theAl-Qur`ân dan Hadith. Second, the realization of the establishment of an Islamic state in modern times.Third, related to the establishment of an Islamic state whether included in part qat{`iyyah or ijtihâdiyyah. After going through the discussion, it was concluded that among the principles of Islamic governance were justice, equality, joint discussion, freedom and people's supervision.The establishment of Islamic state in Indonesia and even in the world is still difficult to realize because each country has a different system and form of government.The establishment of an Islamic state is included in the realm of ijtihâdiyyahbecause there are no fixed rules in the Al-Qur`ân dan Hadith related to certain forms and systems of government.Existing rules in the form of universal rules that ultimately estuary are justice and good for the people

Abstract

The pros and cons of the Bill on the Elimination of Sexual Violence (RUU PKS), one of which is caused by a conflict between two different perspectives in understanding it. The pro-camps tend to use a gender perspective, they base their support on the academic text of the RUU PKS which explicitly states that the formulation of this bill uses the perspective of women (feminist legal theory). The emphasis of this gender perspective is on the experience of victims, especially women. Meanwhile, the counter RUU PKS tends to use a religious perspective. They argue that the RUU PKS eliminates religious norms because it uses a gender perspective adopted from a secular West. For this group, the root of the problem of sexual violence that has occurred so far is not because of inequality in gender relations, but because of the malfunctioning of family institutions, so the solution should be to return to religious norms. If you catch a glimpse of the arguments of groups who reject, then it seems that the RUU PKS is against religion.

Abstract

The study assensially gender equity in the Elementary curriculum that served as a basis for a proposed guide in preparing gender fair instructional materials. A descriptive analysis of Elementary Studies curriculum was the primary method used in this study. The participants’ perceptions on gender were compared and analyzed. Gender-fair education indicators served as criteria for comparison. The data gathered were processed qualitatively. The findings revealed that: (1) Indicators of gender biases in the learning environment were manifested in the learning environment, curriculum, and instructional processes; (2) Hidden curriculum plays an important role in informally transmitting values and attitudes in schools; (3) Leadership skill and tasks formerly given to male students were checked at present by female assertiveness; (4) Private and public school teachers and students differed in their perceptions on the learning environment; and (5) Gender-fair curriculum in Social Studies is a vital instrument in achieving equality, development, and peace

Abstract

This paper aimed at investigating the criminal aspects of Islamic criminal law about politicization of mosque and their legal sanctions. This paper furthermore can contribute to policy maker for preventing the spread of this phenomenon and give an understanding of the legal sanctions from the politicization of mosque in perspective islamic criminal law. The research concludes that politicization of the mosque is in the category of jarîmah ta'zîr. The criminal aspect in the politicization of mosque perspective of Islamic criminal law are: 1). Violating religious orders about obligation to obey the leader. 2). violating the Prophet Muhammad's prohibition. 3). violates the basic principles of Islam which calls for the spread of peace on earth, prohibition to doing damage on earth, and because it causes many disobedience and obedience, such as division and speech of hatred. The legal sanctions for the actor of politicization of mosque are at the discretion of the judge The legal sanctions for the actor of politicization of mosque are at the discretion of the judge with taking into account the size of the madharat or losses incurred based on maqashid shariah and flexibility of jarîmah ta‘zîr.

Abstract

Fiqh is a product and the result of ijtihad of the Imams whose sources are taken from the Qur'an and Al-Hadith. However, Fiqh is elastic and dynamic in its application. Its Asbabun Nuzul and Asbabul Wurud in Mecca and Medina are very different in their situation and condition with Indonesia. Thus, fiqh legal products that were born at the time were of course also different from fiqh products that appeared in Indonesia. One of the causes is the social interaction and the existing situation and condition, so that the legal product of fiqh is also different

Abstract

Politics is something that is urgent in Islamic studies both in Islamic countries and in Muslim countries like Indonesia. The aim of the study is to analyze the thoughts of Mohammed Ayoob who offer the concept of modern Islamic politics and be multidimensional in nature. This study is a literature study with the main source is a book by Mohammed Ayoob entitled "The Many Faces of Political Islam: Religion and Politics in the Muslim World". The results of this study are: (1) The concept of modern Islamic politics as a complex, continuous and change political ideology; (2) Islamic political multidimensionality includes: self-proclaimed Islamic countries (Saudi Arabia and Iran), sources of Islamist ideology and activism (Egypt and Pakistan), democratic Muslim majority countries (Turkey and Indonesia), national Islamist resistance movements (Hamas and Hezbollah) and trans-national Islamic organizations (Jamaat Tablighi, Hizb at-Tahrir, and al-Qaeda). This multidimensionality of Islamic politics proves that political Islam does not have the same shape and structure throughout the Muslim world.

Abstract

The rise of Shari'ah economic discussion is something that has to happen especially for a country with a more Muslim population than a Muslim minority country. this happens because the shari'ah economy has given the biggest contribution to the improvement and economic growth of the Ummah. However, talking about sharia economics is inseparable from the history in which the shariah economy was built. History has incised its ink, that contemporary sharia economic thought is inseparable from the contribution of the thoughts of Muslim scholars in the 5th to the 11th centuries AD. This phase is known as establishing the foundations of Islamic economics, which was initiated by the jurists accompanied by Sufi figures as well as philosophers. Economic thinking based on fiqh discusses economic phenomenon by exploring the concepts of maslahah and Mafsa. Part of this thought contribution has been adopted and applied in the Republic of Indonesia today. such as the construction of zakat management bodies, supervision of product sales and so on. The application of Islamic economics is often present in the form of financial institutions such as the development of Islamic financial institutions in the form of banking or the like. The minds of scholars in the past have contributed to modern economists today, where most Muslim-majority countries prefer sharia economics as their country's economic system

Abstract

Madura society are identical with people who have religiosity, one form of their reigiosity is in the strong influence of religious symbols. In this context, religious groups such as the Madura ulama alliance (AUMA), is a contemporary Islamic movement that has significant influence, not only in terms of social religion, but also social politics. The study entitled, Neo Sufism and the Contemporary Social-Political Religion Movement in Madura. Some crucial issues discussed are; the concept of neo sufism from Fazlur Rahman, and Islamic religious-political social movements in Madura (AUMA). The two main issues above are then elaborated in two research questions; 1) What is the definition of neo sufism 2) How does the existence of AUMA, as a contemporary Islamic neo-Sufism movement, play a strategic role and function in the social dynamics of the religious-political community of Madura? This study is a field study based on qualitative research. The data in this paper were obtained through two sources, namely primary and secondary. he written findings contain an explanation of the existence of AUMA as a contemporary neo Sufism movement on Madura; the strategic role of AUMA's neo sufism in the social dynamics of the Madurese religious-political community. Abstract

This article will discuss discursive concept of Islamic State and its implication to the built norm of Muslim society; either inside or integrated nation which Islam became a major religion, such as Indonesia, Malaysia, and so on. This article also will explore the conceptions of two Nahdlatul Ulama’ scholars, the son of Religious Manister in Older Era, namely: A. Wahid Hasyim. Methodologically, this article is qualitative research based on library and phenomenological approach. In the conclusion, this article found that, rarely, Islamic stance will make Muslim become un-progressive caused their beliefs contestation inside, no solidarity action of Moslem to make mutual understanding, and in the end as critical substances of this research was Islam as ideology just appears in campaign of politics in public sphere; neither an actual beliefs to build the nation without comparing the system. Therefore, the Islamic stance on Islamic Nation, actually, must be substantive values for building the nation, not only an ideology to contest itself or political identity as a Muslim.

Abstract

: The relationship between Islam and the State becomes an actual and dynamic discourse in every phase of the development of civilization both in the Western and Eastern world. The debate revolves around the question of the form of the state, whether it is integral, symbiotic or secular. The relationship between Islam and the state is still being discussed through the media and discussions of Muslim intellectuals, one of them is Nurcholish Madjid, one of the Islamic political thinkers in Indonesia and many intellectuals who bring up ideas with nationalist insights. One of them is his thoughts on the relationship between Islam and the State in Indonesia. This thought, although quite controversial when first raised but has a major influence on national and Islamic discourse in Indonesia. Fiqh Siyasah's view of Nurcholish Madjid's thoughts is included in the study of siyasah dusturiyah. Although in Islam it never determines the particular form and pattern of a country that must be practiced by Muslims, but establishing a State is an obligation of Muslims. The state is a tool for Muslims to be able to implement the teachings of Islam, so that the goal of syara' creates benefit and rejects harm can be achieved in society
