Abstract

The Constitutional Court of Indonesia (MK) plays a strategic role in safeguarding constitutional supremacy as the foundation of the Indonesian rule of law, primarily through its authority to conduct judicial review, resolve disputes of constitutional authority, dissolve political parties, and adjudicate electoral result disputes. This article examines how the Court performs these functions while addressing challenges related to decision consistency, institutional compliance, and political dynamics affecting perceptions of judicial independence. The study introduces novelty by arguing that the Court’s role extends beyond that of a mere guardian of the constitution to that of a stabilizer within Indonesia’s evolving constitutional architecture, especially after amendments that expanded mechanisms of power control. Using a normative‑juridical research method grounded in analyses of decisions, regulations, and constitutional doctrines, this article demonstrates that strengthening the Court requires not only internal reform but also systemic support through institutional obedience and societal constitutional culture. The findings highlight that the effectiveness of the Court in maintaining constitutional supremacy depends on the integrity of its decisions, coherence of its interpretations, and its ability to distance itself from increasingly complex electoral politics.   Mahkamah Konstitusi (MK) memiliki posisi strategis dalam menjaga supremasi konstitusi sebagai pilar utama negara hukum Indonesia, terutama melalui kewenangannya melakukan pengujian undang‑undang, penyelesaian sengketa kewenangan lembaga negara, pembubaran partai politik, serta penyelesaian perselisihan hasil pemilihan umum. Artikel ini menganalisis bagaimana MK menjalankan fungsi tersebut secara efektif sekaligus mengevaluasi tantangan yang muncul terkait konsistensi putusan, kepatuhan lembaga negara, serta dinamika politik yang memengaruhi persepsi independensi lembaga. Penelitian ini menawarkan novelty berupa argumentasi bahwa peran MK tidak hanya sebagai guardian of the constitution tetapi juga sebagai stabilizer dalam arsitektur ketatanegaraan modern, terutama setelah perubahan konstitusi yang memperluas ruang kontrol terhadap kekuasaan. Dengan menggunakan metode penelitian yuridis‑normatif berbasis analisis putusan, regulasi, dan doktrin ketatanegaraan, artikel ini menunjukkan bahwa penguatan MK tidak hanya memerlukan reformasi internal, tetapi juga dukungan sistemik melalui kepatuhan institusional dan budaya konstitusional masyarakat. Hasil analisis menegaskan bahwa efektivitas MK dalam menjaga supremasi konstitusi bergantung pada integritas putusan, konsistensi tafsir, serta kemampuan MK menjaga jarak dari kontestasi politik elektoral yang kian kompleks.

Abstract

The rapid advancement of Artificial Intelligence (AI) technology, particularly deepfake, has triggered a significant escalation in cybercrime. An alarming trend is the unauthorized manipulation of doctors' biometric identities to promote illegal drugs, which severely threatens public health and damages professional medical reputations. This research aims to analyze existing legal policies and formulate robust protections for doctors victimized by such biometric manipulation. Utilizing a normative legal research method, this study applies statutory, conceptual, and comparative approaches. The findings reveal that while Indonesia's Electronic Information and Transactions (ITE) Law and Personal Data Protection (PDP) Law provide a basis for prosecution, the PDP Law offers a more precise framework under the Lex Systematische Specialiteit principle concerning biometric data. Current repressive measures include criminal prosecution and the "right to erasure," yet preventive frameworks remain limited to non-binding guidelines. Consequently, this article urgently recommends the enactment of a specific AI Law in Indonesia, adopting the risk-based approach of the EU Artificial Intelligence Act to effectively mitigate the looming threat of an "infopocalypse."   Pesatnya kemajuan teknologi Artificial Intelligence (AI), khususnya deepfake, telah memicu eskalasi kejahatan siber yang signifikan. Salah satu tren yang mengkhawatirkan adalah manipulasi identitas biometrik dokter tanpa izin untuk mempromosikan obat-obatan ilegal, yang tidak hanya mengancam kesehatan masyarakat tetapi juga merusak reputasi profesional tenaga medis. Penelitian ini bertujuan untuk menganalisis kebijakan hukum yang ada serta merumuskan pelindungan hukum bagi dokter yang menjadi korban manipulasi data biometrik tersebut. Menggunakan metode penelitian hukum normatif, studi ini menerapkan pendekatan perundang-undangan, konseptual, dan komparatif. Hasil penelitian menunjukkan bahwa meskipun UU ITE dan UU PDP memberikan landasan penuntutan, UU PDP menawarkan kerangka yang lebih komprehensif berdasarkan asas Lex Systematische Specialiteit terkait data biometrik. Upaya represif yang tersedia mencakup penuntutan pidana dan pemulihan melalui "hak untuk dilupakan" (right to erasure), namun instrumen preventif masih terbatas pada panduan etika yang tidak mengikat secara hukum. Oleh karena itu, artikel ini merekomendasikan urgensi pembentukan Undang-Undang AI khusus di Indonesia dengan mengadopsi pendekatan berbasis risiko dari EU Artificial Intelligence Act guna memitigasi ancaman infopocalypse di masa depan.

Abstract

Study This discusses the arrangement of juridical Income Tax (PPh) deductions on Holiday Allowance (THR), as well as analyzing the justice and equality law on the difference in tax treatment between the employee sector, the private sector, and civil servants (ASN). Background study. This is based on the existence of different mechanisms of taxation for THR: employees are privately charged, cutting Income Tax in general, while for ASN, THR is taxed by the government through the Government-Paid Tax (DTP) scheme. Research this aim: for the study's arrangement, analyze the laws governing the mechanism and their suitability with the principles of justice in law, taxation, equality in law, and public administration. Research This uses a methodological approach to jurisprudential norms, with an emphasis on legislation and conceptual analysis of taxation regulations, doctrine, and relevant scientific literature. show that, in a way, normative cutting Income Tax on THR for employee private sector and permanent civil servants is, within the framework law, the same taxation. Still, there is a difference in the mechanism for guaranteeing the tax burden. The difference is part of the policy of fiscal government, but it can potentially spark debate over the implementation principle of horizontal justice in the tax system. Therefore, an evaluation of the policy taxation related to THR is required to ensure that the system of taxation continues to reflect the principles of justice, equality, and certainty in the policy state's fiscal policy.

Abstract

A Strategic Lawsuit Against Public Participation (SLAPP) refers to the misuse of legal instruments to hinder or silence public engagement, particularly within the environmental sector. Rather than seeking substantive truth, SLAPPs are intended to create protracted, costly, and exhausting legal proceedings that serve as a deterrent. This phenomenon occurs not only through civil litigation but also through criminalisation and other repressive measures. This study analyses the protection of public participation against SLAPPs within Indonesia’s environmental legal framework and examines the enhancement of Anti-SLAPP mechanisms to provide effective legal safeguards for environmental matters. The findings aim to contribute to the development of environmental law and offer recommendations for policymakers and law enforcement officials. The research is normative, utilising a legal and conceptual approach through literature review and qualitative analysis. The results indicate that Anti-SLAPP protections have been incorporated into Indonesian environmental law; however, their implementation remains limited due to insufficient procedural legal mechanisms. Legal reforms are necessary to integrate Anti-SLAPP provisions into both civil and criminal procedural law, including the introduction of case screening at the initial stage and the development of guidelines for law enforcement officials to effectively identify and halt SLAPPs, thereby ensuring the protection of public participation. Strategic Lawsuit Against Public Participation (SLAPP) merupakan penyalahgunaan instrumen hukum untuk menghambat atau membungkam partisipasi masyarakat dalam memperjuangkan kepentingan publik, khususnya di bidang lingkungan hidup. SLAPP tidak berfokus pada pencarian kebenaran materiil, melainkan menciptakan proses hukum yang panjang, mahal, dan melelahkan sehingga menimbulkan efek jera. Fenomena ini tidak hanya muncul dalam bentuk gugatan perdata, tetapi juga melalui kriminalisasi dan tindakan represif terhadap pembela lingkungan. Penelitian ini menganalisis perlindungan peran serta masyarakat dalam menghadapi SLAPP dalam sistem hukum lingkungan Indonesia serta mengkaji penguatan mekanisme Anti-SLAPP untuk memberikan perlindungan hukum yang efektif bagi pembela lingkungan. Penelitian diharapkan berkontribusi pada pengembangan hukum lingkungan dan menjadi masukan bagi pembentuk kebijakan serta aparat penegak hukum. Metode yang digunakan yuridis normatif dengan pendekatan peraturan perundang-undangan dan konseptual melalui studi kepustakaan serta analisis kualitatif. Hasil penelitian menunjukkan bahwa perlindungan Anti-SLAPP telah diakomodasi dalam hukum lingkungan Indonesia, namun implementasinya belum optimal karena belum didukung mekanisme hukum acara yang memadai. Diperlukan reformasi hukum yang mengintegrasikan Anti-SLAPP ke dalam hukum acara perdata dan pidana, termasuk penyaringan perkara sejak tahap awal serta pedoman bagi aparat penegak hukum untuk mengidentifikasi dan menghentikan SLAPP secara efektif guna menjamin perlindungan partisipasi masyarakat.

Abstract

This paper investigates whether pregnant women with disabilities are adequately protected during warfare under the Convention on the Rights of Persons with Disabilities (CRPD), 2006. Using a comprehensive literature review, it evaluates intellectual works, opinion papers, and case law on rights-based protections for women with disabilities in wartime. The aim is to assess the adequacy of policy frameworks, guidelines, and practices in addressing heightened threats to pregnant women’s rights during conflicts. The review draws on global policy documents, journal articles, book chapters, and reports, offering suggestions for current and future safety strategies. Findings highlight the need to revise existing regulatory frameworks to ensure sustainable protections. The paper evaluates systematic action plans, assessing their relevance, suitability, and adequacy for sustainable maternity care for women with disabilities in wartime. It argues that, as vulnerable individuals, they require special safety measures. The paper recommends a specific convention or additional protocol to the CRPD to address their needs effectively. This study contributes to the discourse on protecting women with disabilities during wartime, emphasizing the importance of policy reforms and robust legislation for sustainable rights-based protections. Abstrak Makalah ini meneliti apakah perempuan hamil penyandang disabilitas mendapatkan perlindungan yang memadai selama konflik bersenjata berdasarkan Konvensi Hak-Hak Penyandang Disabilitas (CRPD) 2006. Melalui tinjauan pustaka komprehensif terhadap karya ilmiah, kerangka kebijakan, yurisprudensi, dan instrumen hukum humaniter internasional (IHL), penelitian ini mengevaluasi efektivitas kerangka perlindungan berbasis hak dalam menangani kerentanan interseksional yang dihadapi kelompok ini. Temuan menunjukkan adanya kesenjangan signifikan baik dalam CRPD maupun IHL terkait perlindungan khusus bagi perempuan hamil penyandang disabilitas. Risiko utama yang teridentifikasi meliputi keterbatasan akses terhadap layanan kesehatan reproduksi, peningkatan risiko terpapar kekerasan berbasis gender, serta hambatan dalam evakuasi yang aman. Makalah ini menganjurkan pengesahan protokol tambahan terhadap CRPD atau konvensi khusus untuk memastikan perlindungan yang berkelanjutan dan inklusif bagi penyandang disabilitas di masa perang. Selain itu, penelitian ini merekomendasikan adanya sinergi yang lebih kuat antara kerangka kerja CRPD, CEDAW, dan IHL. Studi ini berkontribusi pada diskursus mengenai respons kemanusiaan yang inklusif dan menyerukan reformasi kebijakan serta hukum yang mendesak.

Abstract

This article examines the wife's obligations in managing household chores from the perspective of Nasiruddin Al-Albani, highlighting the tension between classical normative constructions and the dynamics of contemporary family relations. This study uses a normative legal approach through a conceptual method, by examining Al-Albani's works as primary legal sources, supported by secondary and tertiary legal materials. The analysis is conducted in a prescriptive-critical manner to assess the relevance of this view in a modern social context. The results show that Al-Albani affirms the wife's obligation to manage domestic chores as a consequence of the marriage contract, based on the evidence of the Qur'an, hadith, and historical practices. However, when measured against contextual parameters such as changing gender roles, women's economic participation, and the principle of relational justice in the family, this view shows limited relevance. This study recommends a normative reinterpretation that emphasizes the principles of musharaka (cooperation) and ta'awun (mutual assistance) between husband and wife in managing the household.
