Abstract

The importance of maritime development legal politics is because the Indonesian nation until now has not had a national policy on the development of an integrated archipelagic state, weak understanding and awareness of Indonesia as an archipelagic state, has not set the boundaries of territorial waters even though the territorial waters, weak defense and state resilience from the seaside. Based on these problems, efforts to protect and ensure state security by sea are absolute. How is the legal politics of maritime development within the boundaries of territorial waters in Indonesia and how the enforcement of maritime law in Indonesian maritime waters is related to the country's maritime security? This research uses empirical juridical research methods, through tracing and reviewing secondary data, in the form of laws and regulations, academic manuscripts, policy recommendations, and scientific works of experts in the field of maritime development. The results of the discussion of the internationally recognized politics of maritime development law are very important, as a rule that can be used as a reference, especially by countries that have ratified it in determining maritime policy. The government has set various development policies and development of the maritime sector and is still weak in consistency and priority of implementation of these programs. Law enforcement in the maritime sector of Indonesia related to state maritime security is indispensable for the implementation of state maritime security in inland waters, archipelagic waters, Indonesian territorial seas, sea lanes, straits for international shipping of the Indonesian continental shelf, EEZ, and additional zones due to various forms of threats and threats to the Indonesian sea which has abundant natural resource potential and geographical position and strategic geopolitics.

Abstract

During the implementation of the Bedugul Geothermal Power Plant (PLTP) project, Bali received protests from the Balinese people which has caused the project to be neglected until now. In addition to the rejection from the Balinese people, the Government of Bali also refused to continue the Bedugul PLTP geothermal project, where the refusal was stated in the juridical provisions of the Governor of Bali's Rejection Letter Number 660.1/1497/Bid.1/Bapedalda dated 17 October 2005 addressed to the Minister of Energy and Mineral Resources Mineral Resources and Bali Governor Regulation No. 45 of 2019 concerning Bali Clean Energy which emphasizes that PLTP construction cannot be carried out in the Bedugul sacred area and indirectly this has hampered geothermal permits in the Bedugul working area. The approach method used in this legal research is a normative juridical approach, research that is based on existing legal principles and also looks at the facts that occur. The results of this research reveal that the case of rejection of the Bedugul PLTP project by the Bali Regional Government can be resolved through a lawsuit  regarding unlawful act by government agencies and/or officials (onrechmatige overheidsdaad) with regard to the requirements for submitting administrative procedure at first as stated in Article 75 paragraph (1) of the Law Number 30 of 2014 concerning Government Administration.

Abstract

Currently, the implementation of legal education in Indonesia has completed by including Clinical Legal Education (CLE). Legal higher education is expected to prepare law graduates who do not only serve as guardians of laws or the rule of law or, more extreme, known as (la bouche de la loi). Consequently, such law enforcement will only be subject to established procedures. Thus, a CLE development concept is needed that prepares lawyers who are committed to substantial justice. To development concept of developing CLE based on an equitable legal approach. The conclusion that can be conveyed is that the ideal CLE to apply is to use a doctrinal approach that puts forward a juridical-philosophical approach. This approach uses an analysis of the basic tenets of a norm to realize the settlement of legal cases based on the values of justice. In addition to the doctrinal approach, introduce a non-doctrinal approach that is based on the constructivism paradigm. Law in this approach is conceptualized contextually, relatively or plurally based on social, individual, local and specific experience. With this approach, it is hoped that later the values of justice will be realized as the main goal, in solving legal problems faced by them.

Abstract

The phenomenon that occurs in Indonesia today is the increasingly widespread distribution of narcotics which causes the emergence of victims of narcotics abuse from a fairly large number of people, including students and undergratuade students as, then sentenced to imprisonment. Based on field observations, Investigators and Public Prosecutors still prioritize the provision as stated in Article 111 Section (1) and Article 112 Section (1), even though the facts show that to use Narcotics, a suspect / defendant is almost certain that they carry, buy or store and possess narcotics, then sentenced to imprisonment on the basis of Article 127 Section (1)a, Law Number 35 Year 2009, without considering Article 127 Section (3) which reads that the abuser must undergo medical rehabilitation and social rehabilitation, not prioritizing legal certainty. In 6 (six) judgement of the South Jakarta District Court, the Suspects or Defendants were all detained starting from the Investigation, Prosecution and judicial processes with a duration of detention between 104 days and 184 days, even though the actual proof was not too complicated because it started with a case of being caught red-handed until a sentence of imprisonment was sentenced by the South Jakarta District Court Judge.

Abstract

Omnibus Law is a new legal product designed as a form of breakthrough to replace existing regulations or laws. This is inseparable from the advantages possessed by the omnibus law itself. As a regulation that contains more than one regulatory content, Omnibus Law is able to overcome overlapping regulations. the application of the Omnibus law can simplify regulations by revoking or amending a number of laws that have been in effect previously. Abstract

Human Resources has an important role in creating organizational success which has the function of planning, organizing, directing and supervising, procurement, development, compensation, integration, maintenance and termination of employment with the intention of achieving organizational goals in an integrated manner able to achieve success in achieving the vision and mission of the organization. The implementation of Law Number 13 of 2013 concerning Manpower is an important target of this study, to test the extent of the effectiveness of the policy. The method used in the study is normative juridical which focuses on the analysis of legislation. This approach aims to analyze the extent of the meaning and implications of the norms of laws and regulations that become a legal policy. So that with this approach it is possible to identify the relationship between these norms and the existing reality. Abstract

Tujuan dari penulisan makalah ini adalah untuk mengetahui konsep dasar hukum sebagai norma sosial (studi pada UU No 1 tahun 1974 dan KHI). Focus kajian pada aspek nilai-nilai dasar hukum dan pada aspek penegakan hukum keluarga. Adapun yang menjadi alasan mengapa dua aspek tersebut perlu dikaji karena adanya fenomena unik dalam penerapan hukum keluarga yang belum bisa diterima seratus persen oleh masyarakat Indonesia tetapi eksistensinya masih dipertahankan oleh pemerintah. Metode yang digunakan dalam penulisan makalah ini adalah metode perpustakaan (library research). Makalah ini menghasilkan dua hal. Pertama, bahwa nilai-nilai dasar yang ada pada hukum keluarga di Indonesia adalah keadilan dan kemanfaatan. Kedua nilai tersebut saling menunjang. Namun kedua nilai dasar hukum tersebut belum menghasilkan ketertiban seratus persen dalam masyarakat. Hal ini dikarenakan pilihan pemerintah dalam menggunakan metode perumusan hukum dengan metode analisis normative sehingga tidak bersifat otoriter dan tidak memiliki sasaran untuk mengharuskan masyarakat untuk tunduk pada hukum keluarga secara paksa. Namun kekurangan metode ini dapat ditutupi dengan konten hukum yang berkemampuan untuk merubah masyarakat untuk mentransformasi diri tunduk pada hukum keluarga ketika sudah mendapatkan pemahaman yang tepat dan apabila mendapatkan permasalahan hukum. Kedua, Penegakan hukum keluarga Islam telah ditunjang oleh pranata hukum dan pranata sosial. Sebagian masyarakat telah mengunakan pranata tersebut dalam mendapatkan keadilan dan kemanfaatan, sehingga hukum keluarga dapat berfungsi sebagai institusi sosial yang melindungi masyarakat.

Abstract

The practice of abstaining is still a massive phenomenon that occurs during the election season in Indonesia. In fact, data from the Central Statistics Agency (BPS) shows that the number of people who abstained in 2019 was 34.75 million or around 18.02% of the total registered voters. Meanwhile, in 2014, the number of abstainers was 58.61 million people or 30.22%. This means that citizen participation in the democratic system in Indonesia is still not good. Intentional abstention from voting is now classified as a criminal act (delict) which is expressly contained in the General Election Law Number 7 of 2017 (UU ELECTION). In its implementation, Indonesia adheres to the principle of legal fiction, where the public is assumed to know the applicable law (presumptio iures de iure). Therefore, with the provisions of regulations containing strict criminal sanctions leading up to the 2024 elections, it is hoped that citizens will become more aware and obedient to applicable laws. Criminal liability would be a solution to prevent the practice of abstaining from voting ahead of the next election.

Abstract

The progress of narcotics addictives is very concerning today and certainly requires comprehensive, integrated and continuous handling. However, in several cases, judges did not consider Article 103 of the Narcotics Law to provide rehabilitation for addicts and victims of narcotics abuse. Based on the background above, the problems that will be discussed in this study are: how is the implementation of the rehabilitation process for addicts and victims of narcotics abuse in Indonesia? And how does restorative justice apply to narcotics addicts through the rehabilitation process? This research is normative legal research with descriptive nature. The research results show that the implementation of rehabilitation for addicts and victims of narcotics abuse in Indonesia can be seen from the data for 2021 and 2022. It shows that the punishment for most narcotics addicts is imprisonment. So that efforts are needed from law enforcement officials prioritising rehabilitation for narcotics addicts to enforce restorative justice law. One of the efforts of restorative justice from law enforcement officials against narcotics addicts is the establishment of the Attorney General's Guidelines Number 18 of 2021 concerning the Settlement of Handling Cases of Crime of Narcotics Abuse through Rehabilitation with a Restorative Justice Approach as the Implementation of the Prosecutor's Dominus Litis Principle

Abstract

Skincare is a skin care product that is popular among the majority of female consumers. One way to obtain skincare products is through online purchases, which, despite its advantages, also has disadvantages such as not meeting expectations (cheap prices but containing harmful substances) and being prone to fraud. The aim of this research is to understand the regulations regarding online buying and selling and consumer protection for skincare products using the online buying and selling system, particularly in terms of negative impacts on consumer health. This research is a doctrinal study that utilizes primary, secondary, and tertiary legal sources. The results of this research are as follows: Firstly, the online buying and selling of skincare products through marketplaces, as stipulated in Articles 1457 and 1458 of the Civil Code, utilize electronic contracts that include the identification of the parties involved, object and specifications, requirements for electronic transactions, pricing and costs, cancellation procedures, rights of aggrieved parties, and dispute resolution. Online buying and selling is recognized as a legitimate and accountable electronic transaction based on Government Regulation Number 71 of 2019 on the Implementation of Electronic Systems and Transactions. Online buying and selling is also regulated by the fatwa of the National Sharia Council of the Indonesian Ulema Council, No. 05/DSN-MUI/IV/2000, which provides provisions regarding payment, goods, parallel salam, goods delivery, cancellation, and disputes. Secondly, consumers of skincare products through online buying and selling are protected by the state both preventively through legislation (Consumer Protection Law No. 8 of 1999, Health Law No. 36 of 2009, Law No. 19 of 2016 on Amendments to Law No. 11 of 2008 on Electronic Information and Transactions, Civil Code, and Criminal Code) and repressively (compensation by businesses; non-litigation through the Consumer Dispute Settlement Board (BPSK); litigation through the courts).
