Abstract

Transaksi jual beli dalam Islam semakin berkembang seiring dengan semakin berkembangnya zaman dan teknologi. Hal ini tentunya menjadi tantangan bagi umat muslim untuk dapat lebih menelaah lebih jauh terhadap transaksi-transaksi yang sedang berkembang, salah satunya jual beli video pelatihan pada website kartu prakerja. Apakah praktik jual beli dari pihak-pihak yang terkait sudah sesuai dengan syariat atau sebaliknya. Oleh karenanya penelitian ini bermaksud untuk mengetahui prosedur pelaksanaan jual beli yang terdapat dalam website kartu prakerja, serta pandangan hukum Islam terhadap transaksi tersebut. Penelitian ini menggunakan pendekatan kualitatif dengan analisis konsep, di mana peneliti mengumpulkan sumber-sumber bacaan yang memiliki keterkaitan dengan bahasan yang sedang dikaji. Hasil dari penelitian ini, Pertama, ada indikasi gharar dalam proses transaksi video tersebut. Kedua, Ma?qud ?alaih tidak mengetahui kadar dari video pelatihan tersebut, berapa menit atau jam, video tersebut bisa digunakan apa tidak, konten videonya apa saja kan pembeli belum mengetahui secara pasti, dan penjual juga tidak mengasih tahu. Jadi ada indikasi pembeli merasa tertipu atau kecewa dengan video tersebut karena tidak sesuai ekspektasi pembeli.

Abstract

Kehidupan berumah tangga tidak sedikit yang berakhir dengan perceraian. Pembagian harta bersama dalam perkawinan menjadi masalah lain yang timbul setelah perceraian terjadi. Harta bersama adalah harta benda atau hasil kekayaan yang diperoleh selama berlangsungnya perkawinan. Meskipun harta tersebut diperoleh dari hasil kerja suami saja, isteri tetap memiliki hak atas harta bersama. Jadi, harta bersama meliputi harta yang diperoleh dari usaha suami dan isteri berdua atau usaha salah seorang dari mereka diatur lain dalam perjanjian perkawinan, apabila terjadi perceraian maka masing-masing pihak isteri maupun suami berhak atas separuh (seperdua) dari harta bersama.Permasalahan sering terjadi antara mantan suami dan isteri dalam pembagian harta bersama.

Abstract

Tujuan mediasi bukan hanya sekedar untuk mengakhiri perselisihan, akan tetapi juga untuk membangun keikhlasan dan kerelaan para pihak tanpa ada yang merasa diperkalahkan, sehingga muara akhir mediasi yang dituangkan dalam bentuk akta perdamaian merupakan pilihan paling baik dari para pihak yang didasari dengan keikhlasan. Oleh sebab itu, kepandaian serta kepiawaian mediator sangat penting untuk menyelesaikan perselisihan diantara kedua belah pihak ini. Penelitian ini menggunakan metode literatur sehingga dalam pengumpulan datanya berasal dari sumber buku bacaan. Hasilnya adalah faktor berhasilnya mediasi dalm suatu perkara perceraian yaitu Kemampuan mediator, Faktor sosiologis dan pisiologis , Moral dan kerohanian, Itikad baik para pihak.

Abstract

Undang-Undang Republik Indonesia Nomor 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak yang lahir pada tahun 2012, mulai berlaku diundangkan pada 31 Juli 2014 menggantikan UU Nomor 3 Tahun 1997 tentang Pengadilan Anak. Undang-undang ini digadang-gadang dapat menyelesaikan berbagai permasalahan Anak yang Berhadapan dengan Hukum (ABH) yang belum bisa dituntaskan oleh pearturan sebelumnya dengan mengedepankan azas Restorative Justice. Di dalam Undang-undang tersebut dibahas khusus tentang Diversi bahkan diperjelas dengan Peraturan Pemerintah Nomor 65 Tahun 2016 tentang Pelaksanaan Diversi dan Penanganan Anak dibawah Umur 12 tahun. Tindak pidana kekerasan/tawuran yang dilakukan oleh kelompok generasi muda di Kota Cirebon cukup tinggi di akhir tahun 2019 hingga memasuki tahun 2020, sangat meresahkan karena korban terluka bahkan meninggal dunia. Penyelesaian hukum pelaku yang terbukti melakukan tindak pidana penganiayaan atau membawa sajam diproses secara hukum hingga ke persidangan, sementara itu para anak yang ikut dalam rombongan hanya ditangkap dan didata selanjutnya dikembalikan kepada keluarga. Perlakuan kepada para pengikut/partipan seperti ini, kurang efektif untuk sebuah pembinaan dan ada kecenderungan untuk mengulangi lagoi tindak pidana. Diversi yang telah diakomodir dalam Undang-Undang SPPA diharapkan mampu menjawab permasalahan ini dengan melibatkan beberapa lembaga yang berkompeten untuk pendampingan dan pembimbngan ABH.

Abstract

Islamic law which has been generally understood, the validity of a marriage will determine the legal position of the children born. However, the Constitutional Court in Decision Number 46 / PUU-VIII / 2010 places more emphasis on biological importance only. The position of the child resulting from adultery is now the same as a child born from a legal marital relationship. Therefore, the ruling of the Constitutional Court is considered to legalize extramarital relations without worrying about the future of children. This perception is formed because even though not bound by marriage, children resulting from adultery relations still have the right to support, marriage, marriage guardianship, and inheritance. Abstract

Currently, industrial development in Indonesia is growing rapidly so that Indonesia has many different types of industries. The industry in managing its activities uses various levels of technology ranging from simple technology to advanced technology. The higher the technology used, the higher the risk of hazards faced. Indonesia is currently facing many very complex manpower problems. The cumulative number of unemployed continues to increase sharply, in line with the increasing number of school graduates. The problem of unemployment must be addressed immediately so as not to increase the number of unemployed in Indonesia. Various efforts have been made by the government to solve this problem, one of which is by increasing the quality of its human resources so that the quality of the workforce in Indonesia will increase, and not be inferior to the quality of foreign workers. Increasing the quality of Indonesia's workforce, providing opportunities to find jobs, both at home and abroad, are increasingly wide open, thereby reducing unemployment. Abstract

Abstract Indonesia is a state of law, as stipulated in Article 1 paragraph (3) of the 1945 Constitution of the Republic of Indonesia. As a state of law, human rights are the main elements that must be protected, enforced and fulfilled by the state. The state has an obligation to guarantee the rights of women and children in Indonesia, which is the quality of the nation's successor. This research activity was carried out in Wilulang Village, Susukan Lebak District, Cirebon Regency, or often also referred to as the East Cirebon region. This activity, as a series of preparations for Wilulang Village, which represents Cirebon Regency in a village competition at the West Java Province level on Increasing the Role of Women Towards Healthy and Prosperous Families (P2WKSS). Domestic violence is a violation of human rights and a crime against human dignity and a form of discrimination that must be eliminated. Article 1 paragraph 1 of Law No. 23 of 2004 concerning the Elimination of Domestic Violence. Efforts to prevent and or overcome various violent behaviors experienced by women and children must receive serious attention and handling. Therefore, the approach in dealing with this problem must be integrated, where in addition to the legal approach one must also consider non-legal approaches which are precisely the causes of violence. By increasing women's awareness of their rights and obligations under the law, increasing public awareness of the importance of efforts to overcome violence against women and children. Abstract

In this writing, the author wants to analyze the crime of genocide committed by China against the Uighurs in the perspective of international criminal law and according to the Rome Statute. one of which was later included in the 1998 Rome Statute. The Chinese government has been accused of crimes against humanity and genocide against ethnic Uighurs in Xinjiang where at least one million Uighurs have been detained in the region and detained in extra-judicial camps or sent to prison. China has deliberately made a systematic, integrated policy with the so-called 'optimizing' population of the Xinjiang population, which is essentially aimed at reducing the Uighur population and the populations of other ethnic minorities in the long term which is achieved by limiting and reducing the birth of ethnic Uighurs.

Abstract

This article is intended to examine the movement of political parties towards the castration of village democracy. Based on two studies conducted before and after the birth of Law Number 6 of 2014 concerning Villages. Marking the economy and the domination of the village elite are clearly illustrated in winning Pilkades. The dominance of clients who are concerned with the services of their parents or siblings who have been approved as village heads. Issues that will be the subject of discussion concern the role of party wings in the process of castration of village democracy. The selection of political parties is not seen in the castration of village democracy. It turns out that the people who control the candidates are those who are involved in political wing organizations. Political organizations have no restrictions as long as they do not prioritize political parties. This situation basically depicts my organization as indirect politics which has castrated village democracy. The organizational movement of the political wing in the village is a problem that is determined by the political parties which include its regulation. The election of village heads in the political process related to the political interests of the people, local politics regulates more influences on the daily life of national politics. The political wing organizations have unwittingly castrated democracy at the village level. Ideally, the village as a laboratory for national democracy should serve as a model and limit the excessive role of politics in achieving democracy nationally.

Abstract

One of the functions of the DPRD is a regional people's representative institution, namely the legislative function. This function is even often referred to as the core of a representative institution, namely as a law-making body within the scope of the region, in other words having the authority to form regional regulations (PERDA). In implementing the policy of making local regulations. The role of DPRD is very large in local government because it is a regional legislative body that functions as one of the institutions that channel people's aspirations in the city of Cirebon. The problem in this study is related to the legislative function of the Regional People's Representative Council (DPRD) in forming Regional Regulations (Perda). This research method is library research (field research) which is descriptive-analytical. The results of this study are the function of the Regional People's Representative Council (DPRD) in line with the People's Representative Council (DPR) in the central government which has an important function in the implementation and administration of government in the regions. Furthermore, the revitalization of the role of the Regional People's Representative Council (DPRD) can be observed in Law Number 32 of 2004 concerning Regional Government, where the Regional People's Representative Council (DPRD) has the authority to make regional regulations (PERDA), budget preparation and supervision, as mandated in Article 41: “Regency/City DPRD has the functions: 1) legislation, 2) budget, and 3) supervision.” Paragraph (2) explains that the three functions as referred to in paragraph (1) are carried out within the framework of people's representation in districts/cities.
