TAKAMUL is a journal of Gender and Child Studies is published by Pusat Studi Wanita Universitas Islam Negeri Ar-Raniry Banda Aceh. First published in 2012, this journal is published twice a year in June and December. This is a scientific communication media for enthusiasts and observers of gender and children study. The editor receives articles of gender and children study from academics, researchers, practitioners, and postgraduate students. The articles will be published after a mechanism of selection, being examined by the expert, and editing process. This journal is open-access which means that everyone can access for individual or institution for free. A user will be allowed reading, downloading, copying, distributing, producing, creating a link from the article, or using for academic writing under the condition of publication ethics. This journal has been indexed by national and international indexing website, such as CrossRef. And this journal has Digital Object Identifier (DOI). Abstract

Women's struggle through policy advocacy is an emerging strategy among women’s movements in post-conflict and post-tsunami Aceh. Policy advocacy has been viewed as a strategic entrance to create an equal development for women and men. Before and after the tsunami, women and children in the area have been in a subordinate position in which they have not got their rights of justice and equality. Looking at the existing women’s conditions as described above, the women’s Empowerment Bureau (Biro PP) viewed the importance of initiating a regulation ensuring women’s right’s and children ‘s protection.  Biro PP  (now BP3A) submitted Draft of Women’s Empowerment and Protection Qanun or Qanun Pemberdayaan dan Perlindungan Perempuan (QPP) and the draft of Child Protection Qanun or Qanun Perlindungan Anak (QPA). After several years, since the Qanun initiated, it has not been implemented as a regulation for empowering and protecting women’s rights. It is believed that the efforts to achieve gender equality and equity in Aceh will be accelerated if QPP and QPA are implemented with strong support from all social elements in the area. The successful implementation of QPP and QPA depends on the capacity of BPPPA a governmental leading sector that having a mandate on women’s empowerment and children’s rights protection.

Abstract

Women are part of society. If people ignore them this means ignoring the society. Self-actualization as a form of manifestation of the creative potential of women is something that every woman should have. Because nowadays women have higher education and have an extensive knowledge, they should have been able to apply what they have known into tangible forms. Women also have many useful skills. Therefore, there are no more reasons to restrict their activities. Restrictions on women's self-actualization is a form of castration for women's rights. For this, the opportunity and the support from their family, especially from their husband are indispensable.

Abstract

This article discusses about the role and position of women scholars in Bireuen and Aceh Besar district in order to see the progress and what areas could be run by women scholars and to look at some obstacles faced in carrying out that role. The goals are to obtain some important infor- mation about the presence of women scholars in both areas, with their certain characteristics. The method used in collecting data that is unstructured interviews with a number of women scholars and comparative study to identify some similar aspects and find the differences between the two districts as the basis of women scholars in Aceh. From the results of this study indicate that although the role and position of women clergy (ulama perempuan) has changed from year to year, but the recognition of the public still places men (Tgk agam) as the dominant figure of scholars in all fields. It is well understood as a social construction that apply fully in the two dis- tricts. Besides, for the women themselves do not have enough confidence to be called as "ulama perempuan". This condition in fact will affect the community recognition. Normally, some roles that are common done by ulama perempuan such as teaching, preaching, teaching rituals of Hajj and implementation burial (jenazah). Meanwhile, in the areas of writing and involved in religious organizations and political parties are still very seldom. It shown that the formation of ulama perempuan from the boarding itself, and the government even non-government parties still do not maximized. So it is needed some serious efforts through socialization and more at- tention later on.

Abstract

This paper discusses the persecution of Lesbian, Gay, Bisexual, Transgender (LGBT) groups in Indonesia. Several cases of persecution against LGBT have become more prevalent in the past few years, as reported by the Indonesian Legal Aid Institute (LBHM) throughout 2017 in Indonesia, there were 973 people who were victims of stigma, discrimination and violence based on sexual orientation, gender identity and expression outside heteronormative binary norms. This paper argues that the persecution of LGBT people in Indonesia occurred because of the oppression of minority groups. The situation is further complicated by the existence of religious views which are increasingly aggressively denominating LGBT groups. This sensitive issue about LGBT is an area of counseling that should be an important concern at this time. Therefore this paper will describe the relationship between LGBT and sensitive counseling on religion and culture.

Abstract

This article is aimed at discussing about the status of women in Islam and investigating whether or not Islam has contributed to the oppression of women all this time. It is uncovered in this article that Islam has never taught people to treat men and women discriminately. Instead, Islam puts women in a very glorious position. There are a lot of verses and hadits showing the notion. The prevailing distortion of many verses and hadits leading to discrimination against women is largely due to literal comprehension and disregarding the historical background or the context of the sacred texts revelation. Therefore, it is necessary that efforts be made to correct the wrong interpretation of Islamic teachings.

Abstract

Gender equality is the most important thing to prevent discrimination in the community. One way to achieve gender equality is by providing access to women to influence political policy, such as participating in politics, becoming legislative candidates. The low percentage of women legislatures, especially in Aceh shows that women are still not actively participating in politics. The cause factor is low motivation. This study aims to see the motivation of legislative candidates in terms of sex. The result of the research shows that there is a difference of motivation between male and female legislative candidates. The motivation of male candidates is more dominated by need for power which is a need to influence and control others. In contrast to female legislative candidates who are more dominated by need for affiliation which is a need to develop and maintain interpersonal relationships with others.

Abstract

Sebagai negara yang mayoritas penduduknya beragama Islam dimungkinkan banyak dari anggota masyarakat yang mengunakan sistem hukum Islam. Tetapi seiring dengan perkembangan zaman yang ditandai dengan kemajuan dan teknologi prinsip-prinsip dalam hukum Islam terus mengalami kemajuan yang pesat dan selalu mengikuti perubahan zaman guna untuk kemaslahatan umat di dunia. Tanpa membedakan baik laki-laki maupun perempuan. Dari uraian pembahasan tersebut di atas dapat ditarik suatu kesimpulan bahwa Hukum Waris Islam telah mengakomodir prinsip hukum yang berkeadilan gender.

Abstract

Sebagai wujud dari proses penciptaan manusia, Tuhan Swt telah memberikan masing-masing pihak keragaman dan kelebihan yang satu sama lain. Keragaman dan kelebihan ini bukan merupakan kunci pembeda yang mesti dinilai sakral, melainkan wujud kesetaraan yang saling mengisi satu sama lain. Oleh karena itu, dimensi perbedaan kendati diperankan melalui seorang wanita hanya bersifat kodrati (alamiah). Artinya, perbedaan itu hanya diukur sebatas anatomi tubuh semata yang menjadi legalisasi utama dalam menjalankan pelbagai mobilitas fenomena sosial, dan ini perlu penegasan secara objektif tanpa mengandung unsur bias, sekiranya kemampuan bertindak dari seorang perempuan melebihi standar seorang laki-laki dalam menjalankan kehendak inisiatifnya dalam rangka membela tanah air; dan itu ada pada diri Cut Nyak Dien.

Abstract

Pernikahan  merupakan suatu legalitas hukum yang menyatakan sahnya  suatu hubungan antar lawan jenis (laki-laki dan perempuan).  Dan  hal yang pasti menjadi harapan semua pasangan adalah bagaimana  menciptakan keluarga yang harmonis,  yang di dalam agama Islam lebih dikenal dengan istilah sakinah, mawaddah, warahmah. Untuk menciptakan rumah tangga yang sakinah, mawaddah warahmah, maka  diperlukan suatu keseragaman pemahaman tentang hak dan kewajiban antara suami dan istri. Secara garis besar, kewajiban suami terhadap istri ada dua macam yaitu : kewajiban yang bersifat meteril  dan kewajiban non materil. Kewajiban yang bersifat materiil yaitu mahar dan nafkah, sedangkan kewajiban non materiil yaitu pergaulan yang baik dan mu’amalah yang baik serta keadilan. Kewajiban istri yang kemudian setelah menikah menjadi  hak suami, hanya merupakan hak-hak yang bukan kebendaan, seperti mentaati suami dalam hal yang baik, sedangkan  suami setelah menikah menjadi kepala keluarga untuk menanggung semua kebendaan dalam keluarga. Namun demikian banyak istri  yang tidak mentaati dan mematuhi suami (nusyuz), dan  ada suami yang tidak melarang istri nya berbuat maksiat, (dayyuz)

Abstract

Keluarga sakinah yaitu keluarga yang dibangun atas perkawinan yang sah sehingga dapat memenuhi kebutuhan spiritual, material, sosial psikologis keluarga. Berbagai kebutuhan keluarga sakinah tersebut dapat terpenuhi apabila hubungan keluarga tersebut dibina sejak awal dilangsungkannya pernikahan. Dalam hal ini tentunya dimulai dari pasangan yang akan membina keluarga itu sendiri. Selain itu dalam kontek pelayanan negara terhadap masyarakat,  ada petugas dari pihak penyuluh Agama Islam yang berkedudukan di Kantor Urusan Agama (KUA) yang turut memberikan penyuluhan kepada para calon pengantin (catin). Metode penelitian yang digunakan dalam penelitian ini adalah metode deskriptif kualitatif. Tulisan ini bertujuan melihat sejauh mana peran penyuluh agama di Kecamatan Dabun Gelang Kabupaten Gayo lues dalam mewujudkan keluarga sakinah di daerah tersebut dan  metode apa yang dilakukan penyuluh Agama Islam Dalam Mewujudkan Keluarga Sakinah di Kecamatan Dabun Gelang Kabupaten Gayo Lues. Hasil penelitian menemukan bahwa Penyuluh Agama Islam Kecamatan Dabun Gelang Kabupaten Gayo Lues telah melakukan tugasnya dalam melakukan pembimbingan dan penyuluhan di majelis ta’lim binaannya di mana penyuluh Agama Kecamatan Dabun Gelang Kabupaten Gayo Lues melakukan upaya pembekalan berupa pembimbingan dan penyuluhan dengan materi yang berhubungan dengan cara mencapai keluarga yang sakinah, mawaddah, warahmah. Adapun metode yang digunakanPenyuluh Agama Islam dalam menyampaikan materi dengan metode ceramah.  konseling  metode diskusi, dan tanya jawab
