Abstract

Even though workers’ rights are generally important, this is often neglected, and changes towards neoliberalism occur. This can enrich a company and complicate the lives of workers. This research then aims to be able to see how to be able to reinvent the existence of guarantees for citizens when the country sinks into neoliberalism. The research method that will be used in this study uses a descriptive qualitative approach. The data used in this study come from different research results and previous studies, which still have relevance to the content of this research. The results of this study then found that neoliberalism eliminates the presence of guarantees for citizens to obtain their basic rights. The existence of a constitution can prevent public policy-making that erodes individual rights. Therefore, in general, the Indonesian state is not at all compatible with the concept of neoliberalism. This is because the elimination of the rights of citizens is very contrary to the contents of Pancasila itself.

Abstract

In the adat of the people of Sumatra, the majority of the people are Muslims, therefore automatically all aspects of their life must be based on Islam. Thus, from the implementation of inheritance, the community should use a system derived from Islamic law as their religion and belief. The method used in this study is a descriptive method which is carried out by observing, understanding and describing an event with a complete analysis, in this case data on the customary inheritance system in Sumatra. Thus it can be concluded that: 1) the Simalungun people continue to carry out their customary law to complete the distribution of inheritance, even though the majority of them have embraced Islam; 2) Implementation of inheritance in Minangkabau custom is divided into two kinds of ways and there are also two kinds of inheritance, namely high inheritance inherited from the female lineage; and lower inheritance which in its implementation is in accordance with Islamic inheritance law; 3) The Basemah indigenous people still adhere to the concept of patrilineal genealogy. This system is one in which the eldest son, who is often the male, becomes the sole owner of the assets of his parents and predecessors and does not transfer them to heirs.

Abstract

Structural poverty is rural poverty that has a longterm effect on poverty. This poverty occurs due to changes in the economic structure. The failure of the industrial sector to absorb labor from the agricultural sector raises the problem of unemployment and a decrease in wages for agricultural sector workers. Economists’ opinion that poverty will move from rural to urban areas, then when rural poverty decreases, it has an impact decreasing urban poverty. This study focuses on the factors affecting rural poverty, while the purpose of this study is to see the impact of the village fund program on rural poverty using the difference in difference method and to see how village funds program, allocation of village funds, local tax for village, local retribution for village and the numbers of educational facilities in villages are affecting rural poverty. The research data is in the form of a panel consisting of 416 villages in Bogor Regency with a time series of two years. Furthermore, the data is processed using the ordinary least square approach. The results of the analysis show that the village funds program has an ineffective impact in reducing rural poverty, while the allocation of village funds, local taxes for villages, and local fees for villages have a significant effect with a negative relationship.

Abstract

Humans need an activity that can produce many activities that can be carried out by humans, one of which is through work. In the current era, getting a job is not an easy thing, where a prospective worker must have the ability and experience. One of the efforts to get a job is through an apprenticeship program, this is needed to develop work competence, productivity, discipline, attitude, and work ethics at the level of skills and expertise in accordance with the level and qualifications of the position or job. Apprenticeship training is carried out by taking into account the needs of the labor market and the business world, both inside and outside the employment relationship. Apprenticeship training is held based on a training program that refers to work competency standards, and is carried out in stages.The implementation of the apprenticeship must be initiated and based on a written agreement between the apprentice participant and the apprentice organizing company which is recognized and approved by the local District/City Office. Law in society is a means to uphold order so that the interests of society can be maintained in their relations. Laws regarding the protection of human interests are guaranteed through norms or rules. Law, as a general rule and normative rule. In the labor law it has been emphasized that apprenticeship must be made based on a written agreement between apprentice participants and employers, wherein the agreement stipulates the rights and obligations as well as the period of apprenticeship, this is done to protect the rights of apprentice participants. The position of apprentices must be legally protected so that apprenticeship activities can run smoothly according to the functions and objectives of the apprentice itself and to minimize arbitrarines

Abstract

Driving license (SIM) is proof of registration and identification for a person who has met the administrative requirements, is physically and mentally healthy, as well as proof that the person understands traffic regulations and can drive a motorized vehicle, so it is granted by the Police. Making and renewing SUM is carried out at the Office of the SIM Administration Executing Unit (Satpas) which are available in several locations in each region, and when obtaining a SIM cannot be represented by someone else. There were problems in managing SIMs, one of which was extortion, which then triggered the implementation of administrative reforms towards digitizing services. There are three main principles in practice in preventing extortion in licensing and non-licensing, namely predictability, digitizing services and not burdening. Departing from public problems related to SIM services, the Directorate of Registration and Identification (Dit Regident) of Korlantas Polri innovates by utilizing technology.

Abstract

Health is the right of all citizens as mandated in the 1945 Constitution, so health services should not discriminate against patients based on certain groups. In fact, in Indonesia there is still a phenomenon where patients are compartmentalized based on their economic and social groups. This has led to several cases of patient rejection and delayed treatment due to administrative constraints. In the light of this phenomenon, this study seeks to examine the form of legal protection that indigent patients must obtain in health services, especially for BPJS or KIS patients. The Mengwi I Health Center as a community health service center should provide maximum service, but there are still some obstacles in service related to underprivileged patients due to administration. This research is a type of empirical legal research with a statutory regulation approach, data collection is done by interviews. The results of this study indicate that the implementation of health rights services for underprivileged patients at Wangaya I Health Center has been carried out based on Law Number 36 of 2009 and Law Number 44 of 2009, Law Number 8 of 1999 concerning Consumer Protection, Law Number 36 of 2009 concerning Health and Law Number 44 of 2009 concerning Hospitals. Legal remedies that are usually taken by incapacitated patients if they do not receive health services from the hospital are to question the management of the Wangaya I Health Center and report this to members of the local DPRD. In addition, patients can also file a civil lawsuit in accordance with the Civil Code.

Abstract

The importance of the local government's role in overseeing the course of development and the economy in Indonesia is felt to be crucial, especially during the pandemic. The Government of Indonesia has declared COVID-19 a non-natural disaster in the form of a disease outbreak that must be mitigated to prevent an increase in cases. COVID-19 has an impact on almost all aspects of people's lives. The policy of the Government of Indonesia in handling and spreading COVID-19 is in the form of the Vaccine Procurement Program and the provision of COVID-19 Vaccinations as part of the Handling of COVID-19 and National Economic Recovery. The implementation of government programs cannot always run as expected. The policy in administering the COVID-19 vaccine can be interpreted as an effort by the local government to suppress and prevent COVID-19 so that it can be controlled. Implementation of the vaccination program if it is studied based on understanding Policy Implementation are actions taken either by individuals/officials or government or private groups directed at achieving the goals outlined in policy decisions.

Abstract

The presence of Law Number 41 of 2004 concerning Waqf which brings the paradigm of productive waqf management is a challenge for classic waqf institutions which have so far been dominated by forms of waqf in the form of mosques, prayer rooms and cemeteries. Classical waqf, which has so far been self-sufficient on the development of ubûdiyyah values, is required to develop itself as a waqf institution that has a socio-economic dimension in order to participate in the welfare of its people. As a consequence, these classic waqf institutions must utilize their assets to produce something that can support their own operations as well as having added value that can improve the welfare of their community. The Rahmat Kembang Kuning Mosque in Surabaya has responded to the productive waqf management paradigm by carrying out various utilization of assets owned, including land swaps, land leasing, business cooperation, tower construction cooperation, establishment of da'wah radio and education. From a juridical perspective, efforts to increase the productivity of waqf assets do not have significant problems, but managerially they encounter obstacles that lead to Nazhir's professionalism. Even so, the management of the Rahmat Mosque can be seen as productive as a waqf institution that is engaged in ubûdiyyah as its main priority scale and has tried to develop asset utilization so that it has socio-economic and cultural values as a scale of support for the waqf institution

Abstract

This study aims to find out how the implementation of strategies for dealing with slums in the Seberang Pagars Village, South Padang District, Padang City. The method used is descriptive qualitative. The data obtained is based on the results of interviews, literature studies, and also direct observation. Based on the results of the analysis and research in the field, it can be concluded that the implementation of the strategy for handling slum areas in the Village of Seberang Pagargam, South Padang District, Padang City has not run optimally because in carrying out the procedures that have been established in handling slum areas there are still some that have not been carried out according to the stipulated procedures. Even though the fulfillment of the characteristics for the development program and budget has been made properly according to the specified characteristics. The suggestions given regarding this research are The Padang City Cipta Karya and Housing Office should add competent human resources; The Padang Cipta Karya Public Works and Housing Service should conduct outreach to the public about area management programs destruction equipment to be implemented; The Public Works and Housing Office of the City of Padang should make a Standard Operational Procedure for dealing with slum areas; The Padang City Public Works and Housing Office must reactivate the website as a media for publication of activities; The Padang City Human Settlement and Housing Office must carry out close coordination with related government agencies and agencies in the City Padang; The Public Works and Housing Office of the City of Padang needs to provide facilities and infrastructure so that mobility access can run smoothly.

Abstract

This paper discusses and interprets the results of several studies related to data-based decision-making. Data-based decision-making capabilities consist of Data Governance Capability, Data Analytics Capability, Performance Management Capability, Insight Exploitation Capability, and Integration Capability. The discussion is carried out by analyzing the description of four data-based decision-making capabilities related to tuition at UIN SGD Bandung: Data Governance Capability, Data Analytics Capability, Performance Management Capability, and Insight Exploitation Capability. The approach used in this study is qualitative with a case study design. The informants were obtained through a purposive sampling technique which was then tested for the validity of the results of the interviews by triangulating the data. The goal to be achieved is to describe how the process of using data in decision-making is carried out by campus authorities regarding tuition at UIN SGD Bandung so that it can produce a policy output. The findings in this study are that determining the amount of tuition accepted by UIN SGD Bandung students has gone through various processes, including using data as a reference for decision-making. However, a capability still needs to be fully fulfilled, namely, Performance Management Capability.Keywords: big data, data driven. Decision-making, tuition
