Abstract

The purpose of this study is to analyse and identify the factors of utilizing collaboration and exploring the strengths, weaknesses, opportunities, and threats of tourism in Kuta Beach, Bali, using a Penta helix approach that will be concluded using Porter's Diamond Model and the identification of collaborative strategies for tourism development. The research method uses a qualitative approach with RRA (rapid rural appraisal) techniques and SWOT analysis and uses Porter's Diamond Model in concluding, assisted by the N-Vivo Plus 12 application. The informants in this study totaled 16 people, with the criteria that 10 people were traditional leaders in Kuta Village, 2 were business people/MSMEs, 2 were academics, 2 were community members, 1 was a media person, and 1 was a government person, namely members of the people's representative council in Badung regency, Bali. The results of the research show that Penta helix collaboration plays a crucial role in the development of sustainable tourism. Real communication and collaboration with the same vision, namely realizing sustainable tourism by building cultural, social, economic, and environmental sustainability with crucial elements in the form of arts, health, accessibility, community, environment, and economic rotation

Abstract

The increase in the number of vehicles in Indonesia shows that there is a dynamic growth of public transportation in line with economic development. This growth requires more efficient fuel distribution management so that people's energy needs can be met according to standardization. The problem arose when Pertalite fuel allegedly caused damage to the engine of the consumer's vehicle, so the consumer demanded compensation. The purpose of this study is to analyze the form of consumer losses and legal remedies in the perspective of justice. This research uses normative research methods based on primary and secondary legal sources, as well as legislative, factual, and conceptual approaches. The results of this study confirm that losses experienced by consumers include technical, economic, and social aspects, as well as weak business actors' accountability. ha katas Compensation, the realization of compensation by business actors has not run optimally. Legal remedies can be pursued through litigation and non-litigation through BPSK which is faster and more efficient, but the challenge of proving it is an obstacle. The principle of corrective justice according to Aristotle emphasizes the importance of reparation for losses in proportion. To ensure substantive justice, the state needs to strengthen oversight and improve access to information for consumers.

Abstract

Perkembangan teknologi blockchain melahirkan Non-Fungible Token (NFT) sebagai aset digital bernilai ekonomis yang berpotensi digunakan dalam transaksi pembiayaan. Namun, belum adanya pengaturan khusus dalam hukum Indonesia menimbulkan ketidakpastian mengenai kedudukan NFT sebagai objek hukum dan objek jaminan. Penelitian ini menganalisis kualifikasi NFT sebagai benda menurut Kitab Undang-Undang Hukum Perdata serta kedudukannya sebagai objek jaminan ditinjau dari perspektif kepastian hukum Gustav Radbruch. Metode penelitian yang digunakan adalah penelitian hukum normatif. Hasil penelitian menunjukkan bahwa NFT memenuhi kriteria sebagai benda bergerak tidak berwujud, namun belum dapat diakui secara optimal sebagai objek jaminan karena ketiadaan pengaturan eksplisit, sistem pendaftaran, dan mekanisme penegakan hukum yang memadai.

Abstract

This study discusses the legal framework and the obligations of tourism operators in implementing the principles of sustainable tourism in Indonesia. The main focus of this research is to analyze the implementation of sustainability principles within Law No. 10 of 2009 on Tourism and related international regulations such as ISO 21401 and the International Tourism Ethics Code. The methodology used is normative legal research with legislative and conceptual approaches, aiming to critique ambiguities in existing regulations and propose solutions regarding the obligations of tourism operators. The findings show that there is a lack of clarity in the legal provisions regulating sustainability, which may negatively impact social and environmental aspects. Therefore, this study suggests the need for revisions to clarify the obligations of tourism operators to conduct environmental and social impact assessments. In conclusion, the study advocates for a stronger integration of national regulations with international standards to ensure the development of tourism that is sustainable, equitable, and environmentally friendly.
