Abstract

This study aims to examine the legal protection of unilateral termination of employment during the Covid-19 pandemic from the perspective of Siyasah Dusturiah. The method used is literature research with a juridical and normative approach to syar'i. The results showed that one of the reasons for employers in terminating their employment was a decrease in turnover during the implementation of Large-Scale Social Restrictions (PSBB) as a government policy to minimize the spread of Covid-19. But regulatively, unilateral termination of employment is not allowed, and if under certain circumstances and forced to do so, then the employer must still fulfill the rights of workers in accordance with labor legislation. In the perspective of Siyasah Dusturiyah, the policy is one way to avoid greater mafsadat (ugliness), but this condition cannot be used as legitimacy for employers to unilaterally terminate employment, without going through negotiations to ensure that workers' rights remain protected and fulfilled.

Abstract

This study aims to find out how the implementation of the Uninhabitable House Rehabilitation Program in the Selayar Islands Regency in the Perspective of Siyasah Syar'iyyah. This research is a field research with a juridical approach and a syar'i approach. The rehabilitation program for uninhabitable houses launched by the Selayar Islands Regency Government has been implemented well and has a positive impact, especially for underprivileged residents. As a priority program, the rehabilitation of uninhabitable houses is carried out through several stages, starting from the planning, data collection, and implementation stages. Rehabilitation of uninhabitable houses is a program that provides benefits because it directly touches the basic needs of underprivileged residents.

Abstract

This study aims to examine the provision of Hamlet-Based Capital Assistance and Community Associations in Bantaeng Regency. The writing method used is qualitative writing with a juridical and normative syar'i approach. The results showed that the Hamlet-Based Capital Assistance program and Community Pillars are regulated in Regent Regulation Number 20 of 2019, and the process starts from the stage of exploring dominant businesses in each hamlet /community harmony, deliberation at the hamlet / community harmony level, factual verification by the village / kelurahan government, deliberation at the village / kelurahan level, entrepreneurship training held by the Village Community Empowerment Office, and the last process is the distribution of funds carried out by the Cooperative Service. In the perspective of siyasah syar'iyyah, the program is a noble effort and Islam obliges the government to strive to alleviate poverty and unemployment, so that the program is very relevant and in line with the principle of benefit.

Abstract

This study aims to find out how the application of occupational safety in Parepare City, using field research (qualitative). Although in 2019 and 2020 Parepare City is not a city with zero accidents, but in general, the implementation of occupational safety has gone well and in accordance with the provisions of laws and regulations, especially for UP3 PLN Parepare City and Pertamina Fuel Terminal Parepare City which have consistently implemented a system of supervision, control and evaluation as part of the Occupational Safety and Health Management System (SMK3). In the concept of Maqashid al Syariah, life safety ranks second only to the obligation to maintain religion, if the concept is used to examine aspects of safety in labor, then maintaining the soul of each worker is not only an obligation of each worker, but also by the employer (company) and the government as a regulator.

Abstract

This article is focused on examining the postponement of the departure of prospective pilgrims, especially in 2020 and 2021 as a result of the postponement of the hajj by the Saudi Arabian Government due to the Covid-19 pandemic. This research is a field qualitative research with juridical, normative syar'i, and sociological approaches. The results of this study show that the postponement of the implementation of the Hajj by the Saudi Arabian Government has an impact on the departure of prospective Indonesian pilgrims for 2 (two) consecutive years (2020 – 2021). The main reason for the delay was to maintain the safety of the souls of prospective pilgrims (hifz al-nafs), and this was in line with one of the rules in maqasid al sharia. Although it causes disappointment for prospective pilgrims, but in general the condition is understandable. In addition, the Ministry of Religious Affairs also provides an option for prospective pilgrims to withdraw the initial deposit and repayment of their Hajj savings, with the consequence that if what is withdrawn is the initial deposit fund, then the prospective pilgrim can no longer leave except for re-registration, while if what is withdrawn is the repayment fund, then the departure queue does not change as long as the repayment is made during the return to repayment when the hajj returns to normal.

Abstract

District and city governments are given authority in the implementation of spatial planning including regulation, guidance, supervision of the implementation of spatial planning of districts/cities and strategic areas of regencies and cities. This research aims to find out how the role of the Bulukumba Regency Government in the Management of Willah Spatial Planning. This type of research is field research with normative and syar'i approaches. The results showed that the role of the government in spatial planning management is carried out through the function of coordination, program preparation and implementation, preparing materials for the formulation and implementation of technical policies in the field of spatial planning for district areas and district strategy areas, conducting arrangements, supervising the implementation of spatial planning, conducting planning, and holding cooperation between regions in spatial management. In the history of Islamic rule, the concept of regional arrangement began when the Prophet and his companions emigrated to Medina, and the presence of the Prophet slowly turned Medina into a center of civilization, trade, education, and the previous government Medina was only an area that became a crossing for traders.

Abstract

The purpose of this study is to find out how the protection of the Parangkeke River, Tellulimpoe District, Sinjai Regency is carried out using qualitative field methods. The results of this study show that the pollution of the Parangkeke River is caused by factory waste, household waste and agricultural waste. The Sinjai Regency Government has tried to handle the Parangkeke River pollution case with several steps, namely facilitating the settlement of environmental disputes, issuing environmental permits, supervising activities, issuing PPLHD permits, compiling means of preventing pollution and environmental damage and providing warnings of pollution and environmental damage. Protecting the environment is a collective responsibility and obligation because damage on earth does not just happen without human intervention, and the condition has been affirmed in the Qur'an that all damage that occurs both on earth and in the sea is the result of the deeds of human hands.

Abstract

The election of village heads is a process of selecting leaders democratically at the lowest level of government and is carried out directly. The study aims to find out how the selection process for the Head of Gareccing Village in the perspective of siyasah syar'iyyah using qualitative types of research, through juridical and normative syar'i approaches. The selection process for the Head of Gareccing Village starts from the stages of forming an election committee, registering candidates, voting, determining selected candidates, and inaugurating the elected village head, and the process has been carried out in accordance with applicable regulations. Political contestation that takes place every 6 (six) years is not colored by dirty practices, such as intimidation and money politics, so that public participation is quite high. Although in the history of Islamic constitutionality there has never been an example of a direct election mechanism such as the election of the Head of Gareccing Village, it does not mean that the mechanism is contrary to the principles of Islamic teachings. Because, from the time the Prophet Muhammad saw to his companions, there was no uniform mechanism in selecting leaders.

Abstract

This study aims to examine the role of the Regional People's Representative Council (DPRD) of Gowa Regency in the implementation of Gowa Regional Regulation Number 50 of 2001 (Perda No. 50 of 2001). The research methods used fully use qualitative research. The results show that the Gowa Regency DPRD has the authority to supervise the implementation of every government policy, including the implementation of Perda No. 50 of 2001, and concretely, this role is carried out by supervising and ensuring that the government seriously performs its duties mandated by the Perda. From the perspective of siyasah jurisprudence, the government, including the DPRD, is obliged to prevent everything that can bring chaos, especially alcoholic beverages not only have the potential to damage health, but can also be the cause of actions that can disrupt order in society.

Abstract

The activity of street vendors is a sector of abuse of public facilities in the community which is rife and even has the potential to cause disruption to cleanliness, order, comfort and harm to the community. For this reason, this research is a qualitative field research with an empirical normative approach and a theological approach. The results of the study show that street vendors in Somba Opu District are still using public facilities as a means to sell, so the Government of Gowa Regency is carrying out various arrangements with the obligation for street vendors to have permits, outreach, provide land, and maintain order so that street vendors do not again destroying the order of the city. In addition, the use of public facilities by street vendors is very inconsistent with Islamic values ​​and ethics which are always honest, trustworthy or responsible, deceitful and keep promises.
