Abstract

Indonesia is a multireligious country with a majority muslim population. This research aims to find out how Islamic law views religious freedom in Indonesia, especially in the reform era. The type of research used is a type of literature research with normative juridical approaches, syar'i, and phenomenology. The results showed that religious freedom in Indonesia as a country of law has been very much considered by the government, and is in accordance with the provisions of Islamic law. While in terms of regulation, the foundation of religious freedom has been very supportive, even guaranteed by the constitution and there are sanctions available for those who violate the rights of others in religion. Some conflicts involving religious people and discriminatory treatment from the government are caused more by low levels of legal awareness.

Abstract

The increasing number of pilgrims every year encourages the renewal of regulations, one of which is through the Regulation of the Minister of Religious Affairs of the Republic of Indonesia Number 23 of 2016 concerning the Implementation of Special Hajj. This study aims to find out how the service mechanism and standards for determining costs and sanctions for travel that violates the implementation of special hajj in Makassar City. The research uses qualitative methods with data sources in the form of primary data and secondary data. The results showed that ritually, the implementation of special pilgrimages is no different from regular pilgrimages, which distinguishes only in service standards such as facilities and relatively faster waiting times. Differences in service standards result in high special hajj costs when compared to regular hajj. As an authoritative institution, the Ministry of Religious Affairs has regulated the mechanism for implementing special hajj and there are sanctions for travel that commits violations, such as written sanctions, suspension sanctions to the revocation of permits adjusted to the level of violations committed by travel.

Abstract

The process of procuring land for the public interest often causes problems, especially those related to the amount of compensation that is considered not to pay attention to aspects of justice for landowners. This research aims to find out how the concept of compensation in land procurement and its settlement mechanism from the perspective of siyasah syar'iyyah. The type of research used is literature study research with normative juridical approach and normative theological approach of syar'i. The results of this study show that regulatively, the mechanism of procurement of land for the public interest must be carried out through deliberation between the two parties to determine the amount of indemnity costs. The agreement between the landowner and the government became the basis for the transfer of ownership rights. The mechanism for resolving in case of problems is pursued by deliberation, although litigation efforts are available. In the perspective of siyasah syar'iyyah, the acquisition of land for the public interest can be carried out using the maslahah mursalah method and the government is not justified in acting arbitrarily in taking over ownership of the land but must provide decent and fair compensation.

Abstract

As a public facility, the Minasa Maupa traditional market has a role in shaping and controlling the socio-economic conditions of the surrounding community. This study aims to find out how the fiqh siyasah review of the efforts to manage the Minasa Maupa Market by the Gowa Regency Government. This type of research is qualitative research with a syar'i and empirical juridical approach, data sources are obtained through primary data and secondary data. The management policy of the Minasa Maupa Traditional Market by the Gowa Regency Government is based on Regional Regulation Number 6 of 2016, although the fact is that it has not been carried out optimally, such as the lack of supporting facilities and cleanliness. In the review of fiqh siyasah, the Gowa Regency Government is responsible and obliged to ensure that the management of the Minasa Maupa Market is carried out optimally for the sake of mutual benefit, so that steps and improvement efforts must be taken immediately to maintain the competitiveness of the Minasa Maupa Market as a traditional market amid the rise of modern shopping centers.

Abstract

This study aims to provide an overview of how the efforts of Bhabinkamtibmas of Garassikang Village, Jeneponto Regency, in preventing the spread of hoax news. This research is a qualitative research. The efforts of Bhabinkamtibmas of Garassikang Village, Jeneponto Regency in preventing the spread of hoax news are carried out through a humanist persuasive approach. Persuasive-humanist steps are chosen by considering the condition of the community which still tends to prioritize customary law to solve a problem. The Quran has ordered tabayyun of any information obtained as a verifiable effort and to prevent the spread of news containing slander (hoaxes), so that the prevention of the spread of hoax news is not only the responsibility of Bhabinkamtibmas and the government, but is a shared responsibility.

Abstract

This study aims to find out how the background of land conflicts and the authority of the Head of Parinding Village, Enrekang Regency, in resolving these conflicts and how siyasah syar'iyyah views land conflicts and their resolution mechanisms. The research method used is field research with syar'i, juridical, and sociological approaches, data sources in the form of primary data and secondary data. The results showed that one of the causes of land conflicts was the absence of evidence of ownership of land controlled by the citizens of the community and based only on oral messages from each heir. The mechanism for resolving conflicts that occur can be carried out through mediation by the village head as a mediator and the results are stated in the minutes signed by the conflicting party. The conflict resolution mechanism carried out by the village head is in accordance with the principles of conflict resolution in Islam, known as Ash shulhu, which is the resolution of conflicts by peaceful means through deliberation.

Abstract

The election of the village head often caused prolonged conflicts, resulting in the tenuation of the family cord. This study aims to determine the impact of the village head election on the family system in Lera Village, Wotu District, East Luwu Regency. This research is a qualitative research, with a sociological and syar'i approach. The village head election system that was carried out directly in Lera Village resulted in the tenuous family relationships that had been well established, and even disappointment between supporters sometimes ended in acts of violence. Although some can be resolved in a familial manner, there are also those that must end up in court, and these conditions pose a threat to the continuity of the democratization system at the level of village government. The basic principle of government administration in the concept of siyasah syar'iyyah is the realization of benefits, so that the election of village heads as a process or mechanism for choosing leaders should not cause impacts that can damage the family relationship that has been a characteristic of rural communities.

Abstract

The purpose of this writing is to find out how the form of protection and empowerment of farmers in the lens of siyasah syar'iyyah. The method used is literature research and theological approach of syar'i. The results of this study show that the role of the government in implementing farmer empowerment as a regulator, facilitator, and catalyst. Concretely, the form of protection for farmers can be done by forming farmer groups to facilitate the distribution of information, dissemination, and training. Meanwhile, the form of empowerment can be carried out through 5 (five) steps, namely settlement, strengthening, protection, characterization, and maintenance. In the Islamic Perspective, the protection and empowerment of farmers is the responsibility and obligation of the government and must be carried out in a fair, mandated and non-discriminatory manner as a prerequisite for realizing welfare.

Abstract

This study aims to find out how the political dynamics in the formation of village regulations in Datara Village, Tompobulu District, Gowa Regency. The research method used is field qualitative research. The results showed that Datara Village has a very good political development, it can be seen from the government management system that involves the community, including in the formation of village regulations. The mechanism for the formation of village regulations involving the community in a tiered manner starting from the hamlet level to the village level has been in line with the principles of the formation of laws and regulations. Community involvement in the process of forming village regulations through deliberations at the hamlet and village levels reflects the application of the concept of shura' as one of the decision-making mechanisms in the concept of siyasah syar'iyah.

Abstract

Dynastic politics has always reaped pros and cons, the pro side thinks dynastic politics is not contrary to democratic principles, but the contra side regards dynastic politics as a tool for maintaining power. This study aims to find out how Islamic law views dynastic politics, especially in Balleanging Village, Ujung Loe District, Bulukumba Regency. The research methods used are field qualitative, with juridical, historical, and syar'i approaches. The results showed that historically, the leadership relay in Balleanging Village had used dynastic politics, especially during the Gallarang-an period. Meanwhile, when using a democratic system, it was recorded that there had been a transition of leadership in one lineage, namely from Bundu Boto (1965 - 1993) which was replaced through the election process by Djohan Boto (1993 - 2007), and both were considered village heads who succeeded in building Balleanging Village. The Quran and the leadership practices of the Messenger of Allah do not specifically regulate the ideal system of government, only affirm the basic principles of leadership such as siddiq, tabligh, amanah, and fathanah, and the political history of Islam after the leadership of the Prophet and the khulafaurrasidins, recorded as having used dynastic politics, namely during the reigns of the Bani Ummayah and the Abbasids.
