Abstract

The economy in Indonesia is progressing, one of which is sourced from the insurance industry. In Article 246 of the Code of Business Law (KUHD), insurance is an agreement with which an insurer binds himself to an insured by receiving a premium to provide reimbursement to him for a loss, damage, or loss of expected profit that he may suffer due to an insanity event. In the writing of this thesis there are two problems, namely how the legal protection of PT. Kresna Life against policyholders resulting from violations of Article 12 paragraph (1) of Financial Services Authority Regulation (POJK) No. 71/POJK.05/2016 on Insurance Financial Health and Reinsurance Companies and how the Financial Services Authority as a regulator protects policyholders regarding the decision of bankruptcy cancellation by the Supreme Court. This research method is normative juridical. Due to the violation of Article 12 paragraph (1) of Financial Services Authority Regulation (POJK) No. 71/POJK.05/2016 on Financial Health and Insurance Companies by Kresna Life regarding investment management to the detriment of policyholders because they are not fulfilled claims filed. The Financial Services Authority acted by imposing administrative sanctions against Kresna Life. On the other hand, some policyholders apply for bankruptcy related to the non-fulfilment of claims and the cassation rate verdict overturning the bankruptcy ruling is increasingly unclear regarding the ffulfilmentof the insured's rights. The Financial Services Authority (OJK) should be able to intervene in the submission of the bankruptcy application from the beginning by responding in writing related to approving or rejecting the application for bankruptcy as referred to in Article 51 paragraph (3) of Law No. 40 of 2014 on Insurance as a form of protection for policyholders. However, the Financial Services Authority did not take any action in this case.

Abstract

This study aims to determine the implementation of ISO 26000 in Indonesia and also to determine the relationship between the impact of company decisions and activities and CSR. It can be seen that Indonesia itself is still trying to attract investors and create jobs and better economic growth. one of the industries that exist in Indonesia and which is no less dead are companies/industries that have direct contact with Natural Resources (SDA). Because as is known that Indonesia has a very large natural resource potential. Seeing the importance of natural resources as explained above, countries are starting to pay attention to the surrounding environment or pay attention to social aspects. Then, the demand to pay attention to the social aspects of the company appears as a reflection of corporate responsibility (social responsibility) to all of its main stakeholders, which consist of employees, buyers, investors/customers, government, community and environmental sustainability for future generations. Therefore, Indonesia also regulates related to CSR itself which is spread over several rules. As with other regulations, CSR is also experiencing developments. For example: CSR version ISO 26000. The research method that will be used in this study is normative juridical. Where, library law research is carried out by examining library materials or mere secondary data, namely: through journals, books, the internet and statutory regulations. The study results show that the lack of enforcement and supervision of company decisions and activities causes damage to the surrounding environment. Even though CSR has been carried out, if CSR is not on target, it cannot be categorized as "social responsibility".

Abstract

The Malay-Bulungan (BMB) language is unique, especially in the field of morphology. This study aims to determine the prefix and its application in Malay-Bulungan (BMB). This research was conducted using a generative morphology study with a model developed by Halle, namely the IP model (Item and Process), with data derived from interviews and observations of native speakers. The results of this study indicate that in the Malay-Bulungan (BMB) language, there is a derivation process in the use of the prefix "Be-" where there is a change in word class that changes the noun into a verb, and adjectives become verbs. However, the derivation process does not occur between verbs and verbs. This study also shows that the prefix "be-" is always followed by a derivative verb. The prefix "pe-" in Malay-Bulungan (BMB) is always followed by a verb used to indicate passive sentences without changing the word class, and the use of the prefix "agi-" is always followed by a transitive verb, and the prefix "aging-" is always followed by an intransitive verb in its use without changing the word class. These two prefixes only show the meaning "want" (want).

Business actors must apply for brand registration with a government institution where, in this case, the Directorate General of Intellectual Property Trademarks and Geographical Indications Ministry of Law and Human Rights of the Republic of Indonesia. Such shall be done so that when a product, be it goods or services, is being created and circulated in public will be protected and not claimed by another party. Registered products will have exclusive rights given by the state to the business owners. Furthermore, brands may be applied for more than one party using the same name and categories, creating a double societal brand. Such will result in legal problems and leads to dispute resolution in court. Every judge's decision should be based on the state laws to provide legal certainty for the public as the brands applied for have been through substantive examination. Therefore, for judges to hand down the decision, they should pay attention to the principles of good legislation and considerations used not only because of the well-known brand factors but also the fundamental reasons for the acceptance of the brand itself. Brand applicants are also advised to stick to something other than well-known names that have been prevalent in the public. Instead, they are advised to create and design their own brands that have selling points.

However, unfortunately, when the company continues to build but does not pay attention to the sustainability aspect of the business. The future of the business is increasingly bleak. Therefore, the concept of expansion is needed accompanied by a green economy based on sharia maqashid. This study aims to analyze the application of Green Economy in Indonesia from the perspective of maqashid syariah. This research is a qualitative research using a phenomenon approach in the form of library research. Where researchers experience events then explain in descriptive form related to the concept of Green Economy and the relevance of its implementation in the Indonesian context and how it is applied in the perspective of safeguarding religion, soul, reason, offspring, property, and the environment. The results show that in designing an implementative, reliable and comprehensive green economy implementation model, Indonesia should have a truly green economic model and relevant to the characteristics of the Indonesian nation based on sharia maqashid that is in harmony with the sociocultural of Indonesian society. The principle of low carbon is basically in line with the maintenance of soul and reason. The principle of resource efficient is also in line with the maintenance of offspring and property. Likewise, the principle of socially inclussive is found in the five aspects of maintenance in the concept of maqashid sharia. Based on the analysis, researchers concluded that in general the application of the green economy concept in Indonesia still needs to be revised. There are still many obstacles faced in the field. Among them, the company is more concerned with profits, without paying attention to business sustainability. Therefore, in developing a business, a maqashid sharia approach is needed so that the business carried out is blessed both in the world and at the end. As recommended by Islam, namely the balance of the world and the hereafter. For this reason, it is expected that companies that expand their business pay attention to the principles of green economy based on sharia maqashid.
