Abstract

The Financial Services Authority has issued Financial Services Authority Regulation Number 45 / POJK.03 / 2020 concerning Financial Conglomerates. In the POJK, each financial conglomerate is required to make a Corporate Charter, which is an agreement between the Main Entity of the LJK and the Member Entity of the LJK in the corporation. There is a minimum of substance stipulated in the Corporate Charter so that OJK can conduct a supervisory function for the Financial Conglomeration. The main issues discussed were whether the corporate charter could be effectively used as a supervisory tool for OJK and whether the Corporate Charter would benefit the Main Entity if it was implemented. This paper concludes that the Corporate Charter will not be fully effective if it is used as a monitoring tool because the substances stipulated in the Corporate Charter are not yet perfect and need to expand the scope of duties and responsibilities between the main entity and member LJK entities. This paper also concludes that the Corporate Charter itself for the Main Entity can also provide benefits, namely serving as a tool to convey the main entity's policies to LJK member entities so that between the main entity and the parent entity there is a moving harmony.

Abstract

Small industry is a pillar of the economy for a region or a nation, its role is very vital in contributing to the per capita income of a region. Attendance is very helpful for the government in carrying out the program launched in terms of poverty alleviation and unemployment reduction. Small batik industry in Sragen is the prima donna product that has been favored so far with the hope of being able to support the regional economy of Sragen. It is undeniable that the existence of the batik industry has been able to last for many years and support the regional economy of Sragen Regency. But the fame has not been able to cover various outside markets due to the absence of business legality for the batik product. The lack of legal awareness of business actors, low information about trademarks, limited human resources and the role of local governments have not been maximized all this time. Therefore, it is necessary to conduct a direct analysis to the field using empirical research methods which combine data on results in the field and based on applicable laws and regulations. The results show that there are still many batik products that have not registered their trademarks with a background of lack of legal awareness of business actors so that it is necessary to provide socialization and direct guidance in the regions in order to assist the registration process of legal protection through trademarks.

Abstract

The purpose of this study is to find out some of the dialectical or problematic regulations of sharia-based peer to peer lending financial technology in Indonesia. The discussion in particular, this study explores the problems that arise related to the regulations used in Islamic peer to peer lending fintech which are regulated using the Financial Services Authority Regulation (POJK) Number 77 of 2016 concerning Information Technology-Based Lending and Borrowing Services. In addition, this study will also discuss the urgency behind the importance of establishing sharia-based fintech peer to peer lending regulations as well as ideas about content material that should be included in the formation of special regulations regarding sharia peer to peer lending fintech. This research is a library research through a statute approach. This research uses data collection method in the form of literature study. Through literature study, researchers collect documents and data to be processed using content analysis method. The results of this study indicate that in the regulation of sharia peer to peer lending fintech there are several problems related to the regulations used, the first is that POJK Number 77 of 2016 which is used to regulate sharia peer to peer lending fintech has more connotations of conventional peer to peer lending fintech , so that there is confusion in terms of separating the rules of conventional peer to peer lending from sharia peer to peer lending, Second, the emergence of legal uncertainty because currently sharia peer to peer lending fintech must comply with POJK rules Number 77 of 2016 and the Fatwa of the National Sharia Council of the Indonesian Ulema Council (DSN MUI Fatwa) Number 117 of 2018. Even though the fatwa should not be a statutory regulation that used to regulate because fatwas are not included in the hierarchy of laws and regulations according to Law Number 12 of 2011 concerning the Establishment of Legislations. Third, there is no regulation regarding the Sharia Supervisory Board in charge of supervising sharia compliance and is closely related to consumer protection, and fourth, POJK Number 11 of 2016 has not regulated in detail the dispute resolution mechanism
