Abstract

Legal regulations related to the termination of employment for persons with disabilities, since the enactment of the copyright law there has been disharmony and blurring of norms contained in the provisions of the employment cluster. From the existence of disharmony and obscurity, it is very detrimental to people with disabilities. This research needs to be done that aims to provide input based on academic studies to overcome the disharmony and blurring of norms that occur in copyright law. Using normative juridical research methods based on a statutory approach and a conceptual approach. From this research has been found and analyzed, that it is true that there has been disharmony and blurring of norms in chapter iv of the second section of employment of the copyright law that has been contrary to disability law and contrary to the basic law. The blurring of the norm found different phrases between the two articles in the same law, namely the copyright law on the labor section, which gives rise to the interpretation of different meanings.

Abstract

As an independent country and has sovereignty, Indonesia is certainly equipped with security functions, both military (TNI) and law enforcement (Polri). The two of them used to be united in one institution called ABRI (Indonesian Armed Forces), the institution was led by the Minister of Defense and Security as well as the Commander of the Armed Forces, after the Suharto leadership stepped down, there was a separation between the TNI, both land, sea and air forces and the Police. Of course, there were many factors that influenced the separation of the two institutions, one of which was related to the legal politics that occurred at that time, the transfer of top leadership gave different policies and views on an institution and other state apparatus. The National Police itself has experienced changes from time to time, starting from the style of law enforcement, authority, to the vision and mission of the Police. The presence of the study of legal politics provides a new color and understanding in seeing law as a product of political power resulting from a long process, both negotiation and contestation of interests that work through the process of law formation.

Abstract

Amendments to the 1945 Constitution have provided even stronger guarantees for the independence of judicial power in Indonesia. The pre-amendment Constitution only mentions the promise of the freedom of judicial power in the Explanation section of the 1945 Constitution. The Explanatory Provisions have no binding legal force. The weakness of the law became a loophole for the interference of executive power in judicial power as occurred in the era of Sukarno (1959-1966) and the era of Suharto (1966-1998). In addition to strengthening the guarantee of judicial independence, amendments to the 1945 Constitution were also established by the Constitutional Court. The Constitutional Court exercises judicial power alongside the Supreme Court and the judicial bodies. Changes to the 1945 Constitution also assign duties to the Judicial Commission to supervise judges and judicial processes.

Abstract

The development of social media as a means of selling and the high number of social media users make consumer-brand engagement behavior on social media, especially Facebook, need to be studied more deeply. In line with this, this study aims to study 5 antecedents of attitudes towards consumers' intentions to engage with retail brands through social media which ultimately affect the intention to buy products, and 1 antecedent of moderation on attitudes towards product purchase intentions. The study was conducted on office workers in Indonesia with a quantitative survey method on 195 respondents. The analytical method used is Structural Equation Model I (SEM). This study found that consumer attitudes towards engagement with retail brands through Facebook were influenced by enjoyment, peer communication, and credibility, while attitudes had a strong influence on intentions to engage with retail brands through Facebook and subsequently strongly associated with intention to purchase through that Facebook page. This supports previous research. The first new things found were that consumer attitudes had a positive effect on consumers' purchase intentions and the second was that expectations of confirmation moderated attitudes toward purchase intentions through retail brand Facebook pages. The managerial contribution of this research helps retailers understand how to attract consumers to engage with retail brands on Facebook.

Abstract

Most Muslims in Indonesia in welcoming the future and efforts to estimate the possible consequences in economic life that will be experienced, need to prepare certain funds early on. One of the efforts to meet these funding needs can be tried through sharia insurance, sharia insurance is insurance with the principle of mutual assistance, protecting among participants through the formation of a collection of funds or tabarru funds'. And managed in accordance with sharia principles to face risks. Insurance is a new case that is still being questioned, how is the maqashid sharia or the method of its activities in line with the principles of sharia. Therefore, to meet the needs and respond to citizens' problems, the National Sharia Council considers and requires to stipulate MUI fatwa NO. 21/DSN-MUI/X/2001 concerning insurance that is based on Sharia principles is used as a guideline by the parties who need it. This paper aims to explore a number of thoughts related to insurance according to Maqashid sharia, and insurance principles that are in accordance with sharia and its methodology in the form of analysis, especially in the MUI fatwa NO. 21/DSN-MUI/X/2001. The results, this study found several economic principles in sharia that must be avoided such as usury, gharar, maysir, tajlis, and risywah.

Abstract

This research was conducted to reveal the factors that influence the image and trust through service marketing management and customer relations to the image of private universities and their implications for customer trust. The research method used is the explanatory survey method. The unit of analysis in this study is a private university located in North Sumatra Province which is in LLDIKTI I, totaling 222 private universities. The number of samples had taken as many as 73 PTS. Based on the distribution of questionnaires, only 50 private universities were willing and fully included in the unit of analysis so that the number of respondents was 550 people who were selected as the unit of analysis. Data analysis method using Partial Least Square-Path Modeling (PLS-PM).The results of hypothesis testing indicate that the university's image variable is a full intervening variable where it is proven that service marketing management and customer relations do not have a direct influence on customer trust but provide a significant indirect effect. The magnitude of the influence of service marketing management variables, customer relations, and university image shows that the largest influence on customer trust is given by service marketing management, followed by the second place is the image of the university and the third position is customer relations.

Abstract

Globalization is an opportunity and a challenge that must be faced by all citizens of the world, including Indonesia. The development of increasingly advanced information and communication technology will have a positive or negative impact on the sovereignty of a nation. In addition, globalization also makes access to information easier and faster to spread throughout the country, creating global transparency where the physical boundaries of a country's sovereignty are threatened with various disturbances and obstacles. This study uses a normative juridical approach aimed at knowing more about state defense education and its urgency in the era of society 5.0, so in order to maintain the integrity and sovereignty of the Indonesian state from various bad things caused by the development of globalization, through an integrated state defense approach in learning Citizenship at various levels of education in Indonesia is expected to foster the spirit of nationality for the next generation to always maintain the integrity of the unitary state of the Republic of Indonesia, because basically the effort to defend the country is an obligation for all citizens, which is carried out with full responsibility and is willing to sacrifice in service. to the state and nation, as for several important points contained in the concept of state defense including planning, governance, training management, learning methods, enrichment and deepening as well as real practices that can be developed in real life. nation and state, while the characteristics of students in practicing the concept of defending the state are maximizing time as good students and obeying all norms and laws that apply in Indonesia, then having good morals and attitudes, and balanced with noble national insight .

Abstract

This article focuses on the managerial competence of principals. This study uses a qualitative approach with a descriptive method. Observation, interview, and documentation techniques were used to collect data, then analyzed through the process of data reduction, data presentation, and drawing conclusions. The findings indicate that the principal's managerial planning is carried out based on the vision, mission, school goals, and needs. The principal involves all elements of the academic community in planning for school improvement and development. Planning to increase teacher professionalism is carried out in work meetings and described in strategic plans and school operational plans. Aspects of assessment in educational supervision are teacher attendance, teacher performance in schools, student development, lesson plans, and syllabus. The obstacle is competence in keeping up with the latest technology. Thus, this article contributes to knowledge about managerial competence as well as managerialism.

Abstract

Tourism must be directed to truly realize capacity, equity, empowerment and sustainability in building communities. Especially in the era of the pandemic, with the new normal, it is hoped that tourism can become one of the pillars of people's lives. Kampung Keranggan, located in South Tangerang, is one of the tourist villages that has been recognized by the Ministry of Tourism and Creative Economy as being in the "Developing" category. This study wants to examine how the implementation of tourism village development in Keranggan Village through the principles of sustainable tourism in accordance with the four pillars in Ministerial Regulation no. 14 of 2016 / Ministerial Regulation No. 9 of 2021, namely management, economic, socio-cultural and environmental sustainability. This study method is descriptive qualitative analysis, with data collection through interviews, field surveys and implementation of focus group discussions. From the study, it is identified that Kampung Keranggan has begun to implement the four pillars of sustainable tourism destinations, although there are still several aspects that need to be improved.

Abstract

This study aims to test the effectiveness of the HU-Model used in corruption detection efforts. The increasing number of corruption cases shows that the tools to detect corruption are not yet available. With the mode of corruption that is increasingly developing and complex, the existence of a corruption detection tool is a must. The focus of this research is on the causes of fraud star corruption which shows that the cause is due to abuse of power or the authority being exercised is not by the mandate. The characteristics of corruption in Indonesia are very complex, involving various elements from the government / private sector, State / Regional Owned Enterprises (BUMN / D) as well as public officials from the center to the regions. This article discusses the corruption detection model as one of the contributions to fight corruption in Indonesia. As one of the efforts to make Indonesia free from corruption outbreaks, the HU model consists of the variable lack of integrity (lack of integrity), opportunity (opportunity), pressure (pressure), rationalization (rationalization), and the ability (capability) to provide hope and answers. The HU-Model proves that despite the amount of pressure, the number of opportunities, the ease of justification, and the high position and authority will not encourage acts of corruption if there is still strong integrity. The results show that the indications of corruption are divided into three clusters, namely those with indications of corruption (red), gray (gray), and no indications of corruption (green).
