Abstract

This study aims to analyze the influence of investment, education, health, and per capita income on economic growth in ASEAN countries during the 2014–2023 period from the perspective of Islamic economics. The contribution of this research lies in integrating Islamic economic principles—such as justice, social welfare, and sustainable development—into the analysis of the determinants of regional economic growth. The methodology employed is panel data regression using the Random Effect Model (REM) approach with the Eviews-10 software. The results show that all independent variables have a positive and significant impact on ASEAN’s economic growth, both partially and simultaneously. These findings reinforce the relevance of Islamic economic values in supporting inclusive and equitable economic policies across the ASEAN region.

Abstract

This study aims to analyze and compare the inherent risks in the three main contracts used in Sharia mortgage financing (KPR), namely Istishna, Musyarakah Mutanaqishah, and Ijarah Muntahiyah Bittamlik. This article is categorized as a literature-based study with a qualitative approach. The methodology employed is a normative legal study presented comparatively. The results indicate that each contract has distinct risk characteristics: the Istishna contract faces a high risk of delivery failure, the Musyarakah Mutanaqishah contract is exposed to risks of installment payment delays and top-up requests, while the Ijarah Muntahiyah Bittamlik contract carries lower risks with a simpler structure and flexibility in ownership transfer. These findings provide recommendations for Islamic financial institutions to tailor contract choices according to customer profiles and operational risks in order to enhance the effectiveness and sustainability of Sharia mortgage financing.

Abstract

This study aims to analyze the form of corporate criminal liability in cases of personal data misuse by online loan debt collectors through the lens of vicarious liability theory. The research contributes by providing a theoretical foundation and legal argumentation to support regulatory efforts and law enforcement against data misuse practices in the digital financial sector. This article falls under qualitative library research. The methodology employed is normative legal analysis. The findings indicate that actions by debt collectors who misuse borrowers' personal data for corporate gain may result in criminal liability for the corporation, particularly when the company fails to prevent or supervise such conduct. The theory of vicarious liability reinforces the principle that corporations cannot escape responsibility for legal violations committed by individuals acting on their behalf or for their benefit.

Abstract

This study aims to analyze the forms of legal protection against book copyright infringement, particularly in terms of economic rights and moral rights as regulated in Law No. 28 of 2014 on Copyright. The main contribution of this research is to provide a deeper understanding of the legal protection mechanisms available to book authors, as well as the role of the government and society in upholding respect for intellectual works. This article falls under the category of normative juridical research with a qualitative approach, analyzed through a literature review of statutory regulations, legal literature, and related documents. The findings of the study conclude that although the law provides a strong legal framework, the implementation of protection for the economic and moral rights of book authors remains suboptimal due to weak law enforcement and low public awareness of the importance of copyright.

Abstract

This research aims to analyze food purchase transactions and contracts through the GoFood service from the perspective of Islamic Law and Positive Law, focusing on the conformity of contracts in practice with sharia principles as well as legality based on Indonesian laws and regulations. This article falls under qualitative library research with a normative legal study methodology. The findings indicate that transactions conducted through GoFood are essentially valid under Islamic law as long as the requirements and pillars of sale and purchase are fulfilled, such as the presence of a seller, a buyer, a clear object, and mutual consent, even if the contract is made electronically. Meanwhile, under Indonesia’s positive law, such transactions are considered valid and legally binding based on Law Number 11 of 2008 concerning Electronic Information and Transactions and its implementing regulations. Nevertheless, there remain issues related to the clarity of contracts, transparency of product information, and consumer protection, which require stronger regulations and stricter application of sharia principles.

Abstract

This study aims to analyze the practices of land grabbing and environmental degradation occurring in downstream processing projects of natural resources in Indonesia, as well as the urgency of legal enforcement to address these issues. The methodology employed is normative legal research with a qualitative approach, based on literature review of legislation, court decisions, and relevant academic sources. The findings indicate that downstream processing is often used as a justification for forced land acquisition and ecological destruction, violating Articles 28H and 33 of the 1945 Constitution, as well as Law No. 5 of 1960 and Law No. 32 of 2009. The study concludes that weak law enforcement is a key factor contributing to structural injustice, thus highlighting the need for regulatory reform, stronger oversight, and a legal system that is fair, transparent, and participatory.

Abstract

This study aims to analyze the relevance between Article 8 of the Universal Declaration of Human Rights (UDHR) and the principles of Islamic law in ensuring legal protection for economic actors, as well as to identify points of convergence that can strengthen the national economic legal system to make it more just and humanistic. This article is categorized as library research using a qualitative approach. The methodology applied is a normative-juridical study. Primary data were obtained from the official texts of the UDHR, the Qur’an, Hadith, and literature on fiqh muamalah, while secondary data were derived from books, scholarly journals, and relevant legislation. The findings indicate a substantial alignment between the principle of effective remedy in Article 8 of the UDHR and the values of justice in Islamic law. Both emphasize the state’s responsibility to ensure effective, transparent, and equitable legal protection for every economic actor. Therefore, harmonizing international human rights norms with Islamic law becomes an essential step in realizing a legal protection system that is not merely legalistic but also grounded in universal morality and humanity.
