Abstract

This article aims to examine the construction of divine principles in realizing the actualization of muamalah (Islamic economic transactions) in accordance with the theological values of Islamic economics, as a solution to modern economic problems that are laden with social inequality, individualism, and market exploitation. The benefit of this research is to contribute to the development of economic practices that are not solely profit-oriented but also emphasize social welfare and economic sustainability. This article is categorized as field research with a qualitative approach, using a descriptive-analytical study as its methodology. The results conclude that economic theology is not merely a normative study discussing the relationship between humans and God but also serves as a fundamental basis for building spiritual awareness in muamalah activities. The construction of divine principles becomes a key pillar in shaping fair, transparent, and community-oriented muamalah, as well as offering a resolution to the distortions of the modern economic system.

Abstract

Ideally, the organization of Hajj as a comprehensive act of worship should include the fulfillment of pilgrims' fundamental rights, including the biological needs of legally married couples. However, in reality, facilities that accommodate these needs, such as Kamar Barokah, have not yet been incorporated into official policies for Hajj accommodation services. This study aims to analyze the urgency of Kamar Barokah as a civil right for Hajj pilgrims and its implementation within the framework of syariah accommodation. This article falls under library research with a qualitative approach. The methodology used is policy research, presented in a descriptive-analytical narrative. The findings indicate that Kamar Barokah is an urgent necessity that must be systematically facilitated to maintain the biological, emotional, and psychological well-being of pilgrims throughout their pilgrimage. Therefore, the state, through the Ministry of Religious Affairs, needs to formulate regulations that integrate this service into Hajj accommodation contracts and ensure proper dissemination of information during the manasik (pre-Hajj guidance) phase to optimize its implementation in alignment with syariah accommodation principles.

Abstract

This study aims to analyze the regulatory issues in the supervision of Sharia compliance within the Peer-to-Peer (P2P) Sharia Fintech system, particularly in the implementation of Financial Services Authority Regulation (POJK) Number 10/POJK.05/2022. The contribution of this research includes strengthening Sharia fintech regulations through more specific and collaborative supervisory recommendations between the Financial Services Authority (OJK) and the National Sharia Council of the Indonesian Ulema Council (DSN-MUI). This article falls under qualitative library research using a normative legal study method. It examines legal rules, regulations, and fatwas while evaluating the effectiveness of Sharia compliance supervision in practice. The findings indicate that the supervision mechanism of Sharia fintech remains weak due to the lack of direct monitoring by OJK and DSN-MUI, the absence of binding supervisory standards, and the reliance on internal reports from fintech platforms. Strengthening OJK's role in establishing stricter Sharia supervision guidelines and implementing a periodic audit system is necessary to ensure compliance with Sharia principles.

Abstract

This study aims to analyze the concept of revitalizing productive zakat from the perspective of Maqasid Asy-Syari'ah according to Ibnu ‘Asyur and to formulate strategies for strengthening the economic empowerment of the Muslim community in the digital era. The benefits of this research include academic contributions to enriching the discourse on Islamic economics and practical advantages for zakat management institutions in developing a more transparent, fair, and inclusive distribution system through the utilization of digital technology. This article falls under library research with a qualitative approach, employing a descriptive analytical study methodology to examine the relevance of productive zakat in the context of the digitalization of the Islamic economy. The findings indicate that the revitalization of productive zakat from Ibnu Asyur's perspective not only emphasizes the five core concepts of Maqasid Syariah but also integrates three of his unique concepts: al-‘adalah (justice), al-ḥurriyah (freedom), and al-musāwah (equality). The strategy for strengthening the Muslim economy through digitalization, according to Ibnu Asyur, remains highly relevant, particularly in ensuring a more transparent, inclusive, and equitable distribution of zakat to achieve sustainable prosperity.

Abstract

This study aims to analyze the influence of Islamic education on Generation Z's entrepreneurial decisions from the perspective of maqashid syariah. The research employs a quantitative methodology by collecting data through questionnaires distributed to Generation Z in Jepara, using the Slovin formula for sample determination and the Likert scale for data measurement. Statistical analysis was conducted to obtain a descriptive overview of the results, which were then analyzed based on maqashid syariah. The findings indicate that Islamic education significantly influences entrepreneurial decisions, particularly in safeguarding religion (hifz din) and wealth (hifz mal), thus encouraging the formation of ethical and socially responsible entrepreneurs. This demonstrates that entrepreneurship in Islam is not merely aimed at achieving material gains but also at attaining holistic community welfare in line with maqashid syariah principles.

Abstract

This study aims to deeply analyze the concept and ideal principles of the wakalah contract in Islamic financial institutions. In essence, the wakalah contract is built upon the principles of trust, transparency, and responsibility, where the agent (wakil) acts in accordance with the authority and intent of the principal (muwakkil). However, in practice within Islamic financial institutions, deviations often occur in the implementation of wakalah, such as conflicts of interest and decision-making that does not align with the interests of the clients. This article is a qualitative study employing a normative approach and literature review, which comprehensively examines the legal foundations, sharia principles, and empirical practices of the wakalah contract. The findings indicate that while wakalah has a strong conceptual foundation in Islamic jurisprudence (fiqh muamalah), its implementation in Islamic financial institutions has not yet fully reflected the ideal values of sharia. Strengthening regulatory, ethical, and technical aspects is necessary to ensure that wakalah transactions are conducted fairly and transparently.

Abstract

This study aims to analyze the phenomenon of pump and dump in stock trading from the perspective of positive law in Indonesia as well as Islamic law, in order to determine the extent of legal protection provided to investors who fall victim to market manipulation. The method used is qualitative research with a normative juridical approach, presented comparatively between the provisions of Law Number 8 of 1995 concerning Capital Markets, Law Number 4 of 2023 concerning the Development and Strengthening of the Financial Sector (PPSK), and the principles of Islamic economic law. The findings indicate that pump and dump practices constitute a form of market manipulation that violates the principles of transparency and fairness under positive law and contradicts the Islamic values of honesty (shidq), justice (‘adl), and the prohibition of deception (gharar and tadlis). Law enforcement against perpetrators still faces technical challenges and issues related to digital evidence, thus strengthening regulation and market education based on Islamic ethics is deemed necessary.

Abstract

This study aims to analyze the influence of religiosity, the element of gharar, and wastefulness on online gaming consumption behavior among young users. The research contributes to broadening the understanding of how religious values and Islamic economic principles can serve as a foundation for shaping wise digital consumption behavior. A quantitative approach was employed using a survey method targeting respondents aged 18–25 who actively play online games and have made in-game purchases. Data were collected through a Likert-scale questionnaire and statistically analyzed. The findings indicate that religiosity, awareness of gharar, and understanding of wastefulness have a significant negative effect on online gaming consumption behavior. The higher the level of religiosity and understanding of the principles of gharar and israf, the lower the tendency of individuals to engage in excessive in-game spending.

Abstract

This article aims to analyze and compare the concept of rights that provide guarantees from the perspectives of positive law and Islamic law, as well as to examine the potential for integrating both within the framework of a plural national legal system. The methodology used is qualitative library research with a normative approach, utilizing primary sources such as statutory regulations and classical and contemporary Islamic jurisprudence literature, along with secondary sources including scholarly journals and books published within the last ten years. The results of the study indicate that both legal systems equally recognize the importance of guarantee rights as instruments of justice and legal certainty, albeit through different approaches: positive law emphasizes juridical-administrative aspects, while Islamic law highlights moral values and social responsibility. Although there is potential for harmonious integration, implementation still faces structural and cultural challenges, thereby necessitating institutional reform and capacity building within society to realize a fair and adaptive legal system in the context of national legal pluralism.

Abstract

Ideally, the publicity principle in security law functions as a transparency instrument to provide legal certainty and maximum protection for creditors over secured objects. However, in practice, this principle often faces distortions, particularly in fiduciary guarantees that are not registered, leading to legal uncertainty and weakening the creditor’s position in the event of a dispute. This study aims to critically examine the effectiveness of the publicity principle in protecting creditors’ interests within Indonesia’s security law framework. The research method employed is a literature study with a qualitative-descriptive approach, relying on primary sources such as legislation and secondary sources including legal literature. The findings indicate that the implementation of the publicity principle has not been fully effective in ensuring legal certainty for creditors, primarily due to weak enforcement of registration obligations and the absence of strict sanctions for violations. Therefore, a reformulation of the legal protection mechanism is necessary to better respond to creditors' interests.
