Abstract

Abstract Pay later has become a popular online payment trend among the public, especially millennials. Ease of access and payment flexibility are the main attractions of this feature. However, from an Islamic economic perspective, the use of Pay later needs to be further studied because it has the potential to contain elements of usury (riba ). This study aims to analyze Islamic law related to the use of Pay later in online transactions. The method used is literature study by collecting data from various reliable sources, such as academic journals, books, and fatwas from scholars. The research results show that Pay later contains elements of usury because it charges interest and fines to users. This is contrary to the principles of Islamic economics which prohibit usury in all its forms. In addition, the Pay later payment mechanism does not comply with the qardh akad which is permissible in Islam. Based on these findings, it is concluded that the use of Pay later is not justified in Islamic law. Muslims are urged to avoid using Paylater and choose payment methods that are in accordance with Islamic law.

Abstract

Penelitian ini mencoba menguak praktek harta bersama perolehan semasa pernikahan baik si suami dan si isteri sama-sama bekerja ataupun salah satu pihak saja terutama suami. Apakah dapat dikategorikan dalam transaksi konsep syirkah (perseroan) atau tidak termasuk dalam konsep ekonomi ini. Metode penelitian ini menggunakan metode telaah pustaka. Adapun sumber pustaka ini menerapkan sumber utama daripada al-Quran dan al-Hadits, dan juga ijtihad pakar hukum Islam terdiri dari para imam mazhab serta beberapa literatur lain yang berhubungan dengan kajian ini.

Abstract

Abstract Cryptocurrency is a digital currency that is used as a means of exchange for online transactions. The use of Cryptocurrency has become a hot issue in the world, considering the significant current of change in digital technology, so an in-depth study regarding Cryptocurrency law is very necessary. This research discusses legal comparisons on Cryptocurrency fatwas in Malaysia and the Middle East. The aim of this research is to analyze and compare the legal status of Cryptocurrency fatwas in Malaysia and the Middle East. The method used in this research is a comparative juridical approach. The research results show that there are differences between Cryptocurrency fatwas in Malaysia and the Middle East, these differences are based on different legal reasons. In Malaysia, a study of sharia law explains that Cryptocurrency does not meet the criteria as a currency. In Egypt, the use of Cryptocurrency has the potential to damage the economic order considering that the transaction exchange medium used is not in accordance with Sharia law. In Pakistan, Cryptocurrency is against the terms of money set by FATT. In Saudi Arabia, Cryptocurrency opens up opportunities for illegal transactions and is contrary to Islamic economic rules. And Iran, Ayatollah Ali Khamenei's group gave a signal that it would allow the use of Cryptocurrency, but other groups opposed the use of Cryptocurrency as a medium of exchange or commodity. Abstract

Ideally, legal theory and philosophy of law can shape a legal system that is responsive to economic and social changes. However, in reality, the implementation of law often lags behind the dynamics of change occurring in society. The purpose of this study is to analyze how legal theory and philosophy of law can build responsiveness to economic and social changes, as well as the challenges faced in their implementation. This article falls under library research with a qualitative approach. The method used is normative legal study, analyzing literature, regulations, and relevant documents. The research findings conclude that legal theory ensures that law can adapt to the needs of society and the evolving economy, while philosophy of law provides normative guidance to ensure that law reflects the values of justice, morality, and welfare. Both complement each other in creating regulations that are adaptive to global dynamics while remaining rooted in ethical principles.

Abstract

Ideally, the right to associate and assemble, as guaranteed in Article 28E Paragraph 3 of the 1945 Constitution of Indonesia and Article 21 Paragraph 1 of the Universal Declaration of Human Rights (UDHR), provides freedom for individuals and groups to participate in social, political, and economic life. However, in reality, the implementation of this freedom still faces challenges, especially in the context of Islamic economics in Indonesia, where existing regulations sometimes limit the development of this sector. The aim of this research is to analyze the role of the right to associate and assemble in strengthening Islamic economic activities in Indonesia. This study uses a normative legal approach with qualitative analysis, focusing on secondary data from relevant literature and legal documents. The results of the study indicate that the right to associate and assemble plays a crucial role in strengthening Islamic economics. This freedom allows the formation of Islamic-based economic organizations that support the principles of justice and transparency. The implementation of this right, although hindered by several regulations that are less supportive, still provides a strong foundation for society to collaborate in the development of a more inclusive and just economy.

Abstract

Ideally, the granting of a gift (hibah) should not violate the legitime portie, which is the mandatory portion of the heirs. However, in reality, as seen in Decision No. 17/Pdt.G/2021/PN Klb, the gift exceeded the permissible limit without the approval of the legitimate heirs. This study aims to analyze the legal provisions governing the legitime portie in the Indonesian Civil Code (KUHPerdata) and the impact of canceling the hibah deed on the inheritance of the deceased. This article is categorized as qualitative research with a normative legal approach. The methodology employed is descriptive analytical study. The findings conclude that the legal provisions in the Civil Code, particularly Article 914 paragraph (3), emphasize that a testator may not grant a gift or will that diminishes the legitime portie rights of direct-line heirs. Consequently, gifts that violate this provision, as demonstrated in Decision No. 17/Pdt.G/2021/PN Klb, can be annulled, and the assets previously granted must be returned to the inheritance pool to be fairly distributed in accordance with the rights of the legitimate heirs.

Abstract

Ideally, in resolving land disputes based on civil law, judges are expected to deliver fair, consistent decisions grounded in objective legal reasoning. However, in reality, there is often a gap in judicial decisions that reflects inconsistencies in the application of the law, which can lead to injustice for the parties involved in the dispute. This study aims to analyze the role of judges in land disputes based on civil law and identify the factors contributing to discrepancies in judicial decisions. The research methodology used is normative legal research, with data sources including legislation and relevant land dispute cases. The research concludes that the role of judges in land disputes is crucial for delivering justice, but it is often influenced by inconsistencies in the application of the law. Therefore, continuous training for judges, the development of more detailed technical guidelines, and strengthening the land information system that is accessible transparently to all relevant parties are necessary.

Abstract

This study aims to analyze and compare the legal regulations governing consignment services between Indonesia and Thailand, particularly regarding licensing, consumer protection, and taxation. This research employs a normative juridical approach with a descriptive analytical method, utilizing primary data from the legal regulations of both countries, such as Law No. 8 of 1999 on Consumer Protection in Indonesia and the Consumer Protection Act B.E. 2522 (1979) in Thailand, as well as secondary data from legal literature. The findings reveal that consignment service regulations in Indonesia are still minimal and fragmented, leading to legal uncertainty for business actors and consumers. In contrast, Thailand has more structured regulations that support consignment services in terms of business licensing and consumer protection. This study highlights the need for regulatory improvements in Indonesia to create a more conducive and harmonious business climate.

Abstract

Ideally, the dropshipping sales system implemented on e-commerce platforms such as Shopee and Tokopedia should operate with clear transparency, avoid elements of gharar, and align with the principles of Islamic economic law. However, in practice, the application of contracts on both platforms still shows differences that affect the efficiency and effectiveness of transactions. This study aims to analyze the comparison of contracts applied on the Shopee and Tokopedia platforms in the dropshipping sales system and assess how well they align with the principles of Islamic law. This article is categorized as normative legal research based on qualitative methods, using a comparative study approach explained through descriptive analysis. The research findings conclude that the contracts applied on Shopee and Tokopedia, namely salam and wakalah contracts, meet the requirements of sales contracts in Islamic law while ensuring transparency, price certainty, and delivery time. Shopee shows an advantage in faster delivery times due to its advance payment system, while Tokopedia excels in effectiveness due to policies and features that support buyer security and trust, such as buyer protection and shipment tracking.

Abstract

This study aims to analyze the marketing strategies implemented by Toko Sanamisi to increase product sales and to evaluate their compliance with the principles of Islamic economics. The research approach employs a qualitative method with an empirical legal study, relying on primary data obtained through direct interviews with the store owner, employees, and customers, as well as secondary data from scholarly journals published in the past ten years. The results indicate that Toko Sanamisi's marketing strategies—which include social media promotion, personalized customer service, utilization of digital marketplaces, and customer loyalty programs—have successfully increased transaction volume and customer satisfaction. From the perspective of Islamic economics, these strategies reflect the principles of Islamic commercial ethics (muamalah), such as information transparency, honesty, and ethical service, thereby positioning marketing activities not only as profit-oriented but also as a means of attaining blessings and fulfilling spiritual values in business.
