Abstract

Religion is a guide or guidance for its followers. Embracing a religion is a human right of all individuals which has been guaranteed and protected by the state through the constitution. The purpose of writing this article is to reveal transparently based on the rules or constitution the freedom to embrace a religion. The method used in this research is normative law. Where data obtained through legal materials and legal articles is analyzed systematically. The result is that freedom of religion based on the constitution is contained in the values ​​of Pancasila as the ideology of the nation and state, especially the first principle. The 1945 Constitution in article 28 D (1) also explains freedom of religion and this is a guideline for every religious community in embracing and practicing their beliefs. Likewise, based on human rights law number 39 of 1999 and also the Universal Declaration of Human Rights (UDHR) it is clear that it states the protection and freedom to embrace a religion. The conclusion is that embracing a religion must be based on one's own wishes and beliefs, it is not permissible for other people or certain parties to intervene in this matter because it is a human right. In carrying out religious life, there must be no discrimination, no matter how small. This is because religious freedom is regulated by the constitution, so it is obligatory to obey the law.

Abstract

This study explores efforts to optimize banking regulations as a strategy to accelerate digital transformation in Indonesia. This research uses a descriptive qualitative method, a normative juridical legal approach with literature studies on changes in banking regulations and digital transformation, as well as case studies related to the implementation of regulations in the Indonesian banking sector. The analysis results show that adequate banking regulations can accelerate digital transformation by creating a conducive environment for innovation and investment in the banking sector. However, challenges in optimizing banking regulations are also faced, including limited understanding of technology by regulators and limited infrastructure. This research concludes that to achieve a faster and more inclusive digital transformation in the Indonesian banking sector, a regulatory approach that is progressive and responsive to technological dynamics is needed. Strategic steps include increasing regulatory capacity, partnerships between government, industry and other stakeholders, as well as a regulatory framework that enables innovation while maintaining the security and reliability of the financial system.

Abstract

This article discusses the protection of women's rights in Hindu law from a Human Rights (HAM) perspective. In the context of Hindu society which has developed within strong traditions and culture, women's rights are often faced with challenges caused by normative interpretations of sacred texts and customs. Even though Hindu teachings contain values ​​of respect for women, the implementation of women's rights in social life is sometimes not fully in line with modern human rights principles. This article analyzes various provisions in Hindu law related to the position of women, including rights in marriage, inheritance, and protection against violence. Additionally, this article explores efforts to balance Hindu legal traditions with the development of more progressive human rights values, to ensure better protection of women's rights in contemporary Hindu society. Through this approach, it is hoped that awareness will be created about the importance of integration between religious law and human rights in supporting gender equality.

Abstract

This research aims to examine the role of mass media in increasing public awareness of the dangers of corruption. Corruption is one of the big problems that hinders the development and welfare of society, so public understanding of the negative impacts of corruption is very important. Mass media, as a broad and easily accessible information channel, has great potential in spreading anti-corruption messages. Through a qualitative approach, this research analyzes how mass media, both print, electronic and digital, convey information and build public awareness about the dangers of corruption. The research results show that the mass media plays an important role in shaping public opinion, educating the public, and motivating them to get involved in preventing and eradicating corruption. However, challenges in maximizing the role of mass media also need to be taken into account, such as the diversity of information sources and political interests which can affect the objectivity of reporting. Therefore, it is important for the mass media to continue to strengthen its commitment to disseminating accurate information and educating the public to be more critical of corrupt practices.

Abstract

Domestic violence (DV) is a very serious form of human rights violation, considering the physical, psychological, and social impacts it has on victims. Although various legal efforts have been made to provide protection for victims of domestic violence, there are still many obstacles in the implementation of effective legal protection. The purpose of this study is to analyze legal protection for victims of domestic violence from a Human Rights (HAM) perspective, by highlighting the extent to which the Indonesian legal system provides adequate protection in accordance with international human rights standards. The method used in this study is a normative approach with a literature review of laws, related regulations, and relevant literature. The results of the study indicate that although there are several regulations that provide legal protection, such as Law Number 23 of 2004 concerning the Elimination of Domestic Violence, the implementation of protection is still limited. Several factors that hinder effective protection include the lack of legal awareness in the community, obstacles in law enforcement, and minimal psychosocial support for victims. Therefore, further efforts are needed to increase legal awareness, strengthen law enforcement, and provide more comprehensive services for victims of domestic violence so that victims' human rights can be optimally protected.

Abstract

Law Number 4 of 2024 on the Welfare of Mothers and Children reflects the state’s commitment to ensuring the protection of maternal and child rights, particularly during the first 1,000 days of life. However, its implementation faces various challenges, including regulatory inconsistencies with the Manpower Act and weak enforcement mechanisms at the operational level. This article aims to examine the gap between legal norms and practical implementation, as well as to assess the extent to which Law Number 4 of 2024 fills the existing legal vacuum in the protection of mothers and children in Indonesia. This study employs a normative juridical approach with qualitative analysis of relevant legislation and supporting documents. The findings indicate that the effectiveness of protection for working mothers and children depends significantly on intersectoral policy coordination, regulatory harmonization, and institutional capacity strengthening. Without concrete steps in policy integration and legal enforcement, the objectives of the law risk being unfulfilled. Therefore, comprehensive reform in implementation is necessary to ensure the law’s alignment with the state’s constitutional obligation to uphold the welfare of mothers and children. Abstract

The development of Artificial Intelligence (AI) technology has brought significant transformation across various sectors, including the legal field. AI is increasingly utilized for automating legal research, analyzing contract documents, predicting case outcomes, and providing legal services through chatbots. While offering opportunities for increased efficiency and broader access to justice, the use of AI also presents serious challenges, particularly in terms of regulation and legal ethics. This study aims to examine the potential applications of AI in legal practice in Indonesia and to identify regulatory challenges arising from its use. The research employs a normative legal method with conceptual and comparative approaches, analyzing current regulations and practices in other jurisdictions such as the European Union and the United States. The findings indicate that Indonesia lacks a comprehensive legal framework to govern the use of AI in the legal sector, which poses risks related to accountability, algorithmic bias, and violations of privacy and professional ethics. Therefore, specific regulatory frameworks are urgently needed to ensure transparency, fairness, and accountability in the implementation of AI in legal practices.
