Abstract

The policy of formulating the death penalty for perpetrators of criminal acts of corruption in Indonesia has given rise to complex debate in society. This research explores the policy of formulating the death penalty for perpetrators of criminal acts of corruption in Indonesia with a focus on analyzing its effectiveness, impact on human rights, and moral and ethical implications. The research method used is a normative juridical approach using the analysis of law enforcement system theory and criminal theory. Data was collected through literature studies covering laws, regulations and related legal literature. The research results show that the policy of formulating the death penalty creates a complex debate in society. Law enforcement system theory provides insight into the integration of these policies with the law enforcement system, while punishment theory opens up ethical and philosophical insights. There are significant differences of opinion among the public regarding the effectiveness, morality and impact on human rights of this policy. Abstract

The thoughts of Muhammad Sheikh Arsyad Al-Banjari significantly contribute to the concept of productive zakat as a tool for community economic empowerment in Indonesia. In this context, zakat is viewed not only as a religious obligation but also as a strategic instrument for enhancing community welfare through providing capital for small and medium enterprises. This research aims to analyze Muhammad Sheikh Arsyad Al-Banjari's thoughts on community empowerment through productive zakat in Indonesia. The study falls under a qualitative descriptive cluster with a literature review; data collection is conducted by gathering previous research related to Muhammad Sheikh Arsyad Al-Banjari's thoughts and productive zakat. Data analysis is carried out through data condensation, data display, and drawing conclusions. The findings indicate that Muhammad Sheikh Arsyad Al-Banjari's thoughts on productive zakat offer a new perspective on economic empowerment in communities. The relevance of this concept is particularly important in the Indonesian context, which still faces various economic challenges. With appropriate implementation, productive zakat can not only be a solution to poverty but also promote community independence and sustainable welfare. Community empowerment through productive zakat is expected to enhance community economies, eradicate poverty, and foster community empowerment. However, the implementation of community empowerment through productive zakat in Indonesia faces obstacles, such as a lack of awareness and knowledge, as well as ineffective management and oversight. This is due to the community's mindset, which is not yet accustomed to productive zakat, as zakat management is typically consumptive or directly received by the community. Therefore, the concept of productive zakat is still not well understood, leading to a lack of trust in zakat managers.

Abstract

The verse that talks about the prohibition of drinking khamar in the Alqur'an was gradually reduced in the midst of the ignorant Arab community who had the habit of drinking khamar, getting drunk and to change such conditions in a gradual manner. First, khamar and gambling contain major sins eventhough they contain benefits for humans, but the harm is greater than the benefits. Secondly, it was stated that they were not allowed to pray drunk Third, it is expressly stated that khamar is one of Devil's actions and therefore must be shunned.The scholars differed in defining this khamar. According to Imam Malik, Shafi'i and Ahmad what is meant by khamar is intoxicating drinks, whether or not called khamar. According to Imam Abu Hanifah, it was different from the drunken Khamar drink. But regardless of the definition of the substance is the same, that everything that is intoxicating is a little or a lot of things that are still forbidden.Thus it can be concluded that the prohibition of the khamar does not lie in drunkenness or not, but the location of the substance on the substance. In other words, drinking khamar even if it does not intoxicate the law remains unclean.

Abstract

Islamic banks are banks whose products range from funding to financing. With more and more of these products, of course the risks faced by Islamic banks are also increasingly diverse. So, through this article will explain what risks are faced by conventional banking and Islamic banking. This article will also outline the risks faced by financing channeled by Islamic banks and how to implement risk management in Islamic banks to mitigate the risks they face.

Abstract

This research aims to analyze the effectiveness and efficiency of financial management in the Village-Owned Enterprise (BUMDes) "Berkah" in Ajakkang Village, Soppeng Riaja District, Barru Regency. Employing a qualitative approach, data was collected through observation, interviews, and documentation. The results indicate that BUMDes "Berkah" has successfully met community needs through three main business units: Farmers' Shop, Stationery Business, and Savings and Loans. The Farmers' Shop improves farmers' access to quality agricultural inputs at affordable prices, the Stationery Business fulfills educational and office needs of the community, while the Savings and Loans provides financial access with low interest rates. However, significant challenges remain, including lack of transparency and accountability in financial reporting, limited stock, and limited public understanding of financial services. To enhance effectiveness and efficiency, increased transparency, training for managers, and improved promotional strategies are recommended. This study concludes that with further refinement, BUMDes "Berkah" can serve as an effective model for village economic empowerment in Indonesia. Abstrak Penelitian ini bertujuan untuk menganalisis efektivitas dan efisiensi pengelolaan keuangan Badan Usaha Milik Desa (BUMDes) "Berkah" di Desa Ajakkang, Kecamatan Soppeng Riaja, Kabupaten Barru. Menggunakan pendekatan kualitatif, data dikumpulkan melalui observasi, wawancara, dan dokumentasi. Hasil penelitian menunjukkan bahwa BUMDes "Berkah" telah berhasil memenuhi kebutuhan masyarakat melalui tiga unit usaha utama: Toko Tani, Usaha ATK, dan Simpan Pinjam. Toko Tani meningkatkan aksesibilitas petani terhadap input pertanian berkualitas dengan harga terjangkau, Usaha ATK memenuhi kebutuhan pendidikan dan perkantoran masyarakat, sementara Simpan Pinjam menyediakan akses keuangan dengan bunga rendah. Meskipun demikian, tantangan signifikan masih dihadapi, termasuk kurangnya transparansi dan akuntabilitas dalam laporan keuangan, keterbatasan stok, dan pemahaman masyarakat yang terbatas tentang layanan keuangan. Untuk meningkatkan efektivitas dan efisiensi, disarankan adanya peningkatan transparansi, pelatihan bagi pengelola, dan strategi promosi yang lebih baik. Penelitian ini menyimpulkan bahwa dengan penyempurnaan lebih lanjut, BUMDes "Berkah" dapat menjadi model efektif untuk pemberdayaan ekonomi desa di Indonesia.

Abstract

Economic growth, both global and national, is slowing down, prompting monetary authorities to issue effective monetary policies through credit lines to encourage economic growth. In the dual banking system where there are Islamic banks and conventional banks, it is a challenge for the monetary authorities to see the effectiveness of the two banks in transmitting monetary policy. To find out the difference in effectiveness levels, the researcher used quarterly data from Bank Indonesia interest rate variables, gross domestic product (GDP), Islamic bank financing, and conventional bank loans for the period 2014 to 2024. Using VAR-ECM analysis, it was found that Islamic banks have a lower response than conventional banks in transmitting monetary policy through credit channel. In addition, Syrian banks also have lower effectiveness than conventional banks in encouraging economic growth in Indonesia.

Abstract

Customer loyalty to Islamic banks is one of the keys to sustainability for the Islamic banking industry, especially in strong competition facing conventional banks and financial technology (fintech) innovation. Nevertheless, literature regarding this topic has not been systematically mapped. Using a bibliometric approach, this study analyzes the publication trends, leading researchers, and collaboration patterns in Islamic bank customer loyalty studies. The Web of Science (WoS) is used to collect data and the keywords for customer loyalty and Islamic banks, and the time range of 2010 to 2024 is utilized for this study. Analysis using NVivo 12 and Voyant Tools (for network mapping and descriptive statistics) In the results of the study, 174 published documents were identified, where research articles predominated, a total of 156 articles. This publication trend has been on the rise, even peaking in 2023 with 30 publications. Indonesia and Malaysia stand out geographically as the leading contributors, mirroring the role of both countries as the strategic focal point of Islamic financial development. The most highly productive institutions are establishments such as Bandung State Polytechnic (Indonesia) and International Islamic University Malaysia (Malaysia). These findings offer an invaluable literature map so that further research and strategic ante-projects could be developed, of course with some added value for Islamic banking practitioners in its context of increasing customer loyalty. This study contributes to the academic knowledge with a bibliometric method, which is not widely used in the Islamic banking context.

Abstract

The halal food industry in Bangka Belitung is a rapidly growing sector in line with the increasing awareness of Muslim consumers about the importance of halal products. This study aims to analyze the market power of halal food companies in the province using the Lerner Index, and to relate it to the price concept proposed by Ibn Khaldun. The method used is a quantitative approach by calculating the Lerner Index based on price and marginal cost data from 173 halal food companies. The research results show a variation in market power, where some companies have the ability to set prices above marginal cost, while others operate in a more competitive market. In Ibn Khaldun's perspective, excessively high prices due to market power can create injustice in the accessibility of halal products. These findings underscore the importance of policies that support healthy competition and fair pricing, to create a more equitable halal market in Bangka Belitung

Abstract

This study examines stock price dynamics amid increasing global economic uncertainty, compounded by geopolitical conflicts, bank interest rate policies, the pandemic, and financial crises, which have had a serious impact on the stability of a country's economy. In this context, the Islamic capital market has emerged as an alternative investment offering a safe haven amid global economic uncertainty. This study aims to analyze how global economic uncertainty affects stock price fluctuations in the Islamic capital market in ASEAN countries, as seen from the growth of the Islamic stock index. This study uses a qualitative approach based on a review of literature and empirical data. The results indicate that Islamic stocks can be affected by global economic uncertainty but are more resilient to external or internal factors related to usury, gambling, and uncertainty. Despite facing pressure from global market fluctuations, Islamic stocks still demonstrate growth potential, particularly in ASEAN countries with majority Muslim populations. The results of this study are expected to provide investors with insights for planning investment strategies as hedging instruments in accordance with sharia principles, while considering global economic conditions and a country's macroeconomy.

Abstract

Financial performance in general is an important aspect in evaluating the financial stability of a bank. Banks involved in green banking activities tend to have a better reputation because they show concern for environmental issues. This study aims to analyze the effect of financial performance on the stability of Islamic banks with green banking as a moderating variable. The financial performance indicators used include the Capital Adequacy Ratio (CAR), Non-Performing Financing (NPF), Operating Expenses to Operating Income (OEOI), and Financing to Deposit Ratio (FDR). The population in this study consisted of 14 Islamic commercial banks. The sample selection used the nonprobability sampling method with a purposive sampling technique and obtained a sample of 10 Islamic commercial banks with a research period of 2020–2023, so that there were 40 research data. The analysis was carried out using panel data regression with the Random Effect Model (REM) approach and variable moderation tests using Moderated Regression Analysis (MRA) through the Eviews 12 program. The results showed that CAR had a significant positive effect on stability, FDR had a significant negative effect on stability, while NPF and OEOI had no effect on stability. Green banking weakens the influence of CAR and NPF on stability, strengthens the influence of FDR on stability, but does not moderate the influence of OEOI on stability. This shows that the role of green banking is quite good, but has not been able to improve all aspects of financial performance as a whole.
