Abstract

This study examines law enforcement against traffic violations that lead to accidents in Sukoharjo Regency. Based on Law Number 22 of 2009 and related regulations, enforcement is carried out through preemptive, preventive, and repressive measures by the police. Violations such as negligence, traffic sign violations, and lack of driver discipline are the main factors in accidents. The effectiveness of law enforcement is still hampered by low public awareness and limited facilities. Improved technology, education, and cross-sector coordination are needed to reduce the number of accidents and maintain order in traffic.

Abstract

PPAT as a public official has the authority to create land sale and purchase deeds and is obligated to apply the prudential principle. This study of Decision Number 69/Pid/2020/PT. Smr analyzes PPAT's accountability in land sale and purchase processes resulting in criminal embezzlement. There is no concrete regulation regarding PPAT's prudential principle, creating legal ambiguity. Embezzlement by PPAT should be subject to Article 374 of the Criminal Code (embezzlement in office), but the judge erroneously applied Article 372 of the Criminal Code. Clearer regulations are needed regarding prudential indicators and embezzlement acts by PPAT, as well as more comprehensive judicial considerations in deciding similar cases to establish legal certainty.

Abstract

The Sale and Purchase Binding Agreement (PPJB) as an authentic deed has perfect evidentiary power based on Article 1868 of the Civil Code. Decision Number 27/Pdt.G/2019/PN Krs canceled the PPJB due to the buyer's default in failing to fulfill payment obligations. Cancellation of the deed results in the restoration of the parties' rights to their original position in accordance with Article 1451 of the Civil Code. However, there was an error by the Judge for not considering Article 16 paragraph (1) letter m of the Notary Position Law regarding the requirement of 2 witnesses in deed preparation, thus creating legal uncertainty regarding the evidentiary power of PPJB as an authentic deed.

Abstract

Notaries who commit forgery of Sale and Purchase Binding Agreement deeds and Power of Attorney to Sell can be held criminally liable based on Supreme Court Decision Number 933 K/Pid/2023. The notary was sentenced to criminal sanctions in accordance with Article 264 paragraph (1) in conjunction with Article 88 of the Criminal Code with a punishment of 5 years imprisonment, administrative sanctions in the form of revocation of practice license by INI and the Ministry of Law, as well as civil sanctions in the form of compensation to the injured party. Deed forgery constitutes a violation of the Notary Position Law and the Criminal Code which has fatal consequences for legal certainty and public trust in the notary profession.

Abstract

Legal certainty regarding amendments to the management deed of Bintang Laot Cooperative conducted without the Annual Members' Meeting (RAT) becomes the focus of this study. Unilateral changes using allegedly falsified documents and notarized without proper verification have caused internal conflicts, suspension of economic activities, and legal uncertainty. These actions fulfill the elements of unlawful acts as stipulated in Article 1365 of the Civil Code. Legal remedies such as summons, civil lawsuits, and criminal reports have been pursued to restore legality. This case demonstrates weak notarial supervision and legal protection for cooperatives, necessitating more stringent regulatory reforms.

Abstract

Behind her success, Karen Agustiwan was also involved in two highly controversial legal cases that caught public attention. This study aims to examine both cases using legal and philosophical foundations in the context of corruption in the state-owned enterprise sector and to provide recommendations for improvements in the framework of Good Corporate Governance to support the Business Judgment Rule, especially for business transactions abroad. Both cases indicate the abuse of authority and disregard for investment procedures in state- owned companies. To prevent similar cases from recurring, every investment project must undergo documented due diligence, feasibility studies, and risk assessments.

Abstract

Idonesia's land registration system, which applies a negative publication system with positive tendencies, has led to frequent occurrences of overlapping land certificates due to weaknesses in the verification of physical and juridical data, lack of system integration, and insufficient administrative accuracy. The research method employed is a normative juridical approach. The legal consequences of such disputes include legal uncertainty, annulment of certificates issued later due to administrative defects, reinforcement of the legal standing of certificates issued earlier based on the principle of prior in tempore potior in jure, as well as the legal liability of the National Land Agency, including the obligation to revoke defective certificates and to provide legal protection to good-faith purchasers. Supreme Court Decision Number 392 K/TUN/2022 affirms the annulment of defective certificates and emphasizes the importance of the principle of prudence as the foundation for the issuance of land certificates.

Abstract

Pejabat Pembuat Akta Tanah plays a strategic role as a public official authorized to draw up authentic deeds as well as a party responsible for ensuring the fulfillment of tax obligations, particularly the Duty on the Acquisition of Land and Building Rights (BPHTB) and Income Tax (PPh), prior to the transfer of rights. However, in Kampar Regency, practices are still found involving manipulation of transaction values, discrepancies between the Tax Object Acquisition Value (NPOP) and market prices, as well as the involvement of PPAT in assisting the reduction of transaction values in order to minimize tax burdens. Such practices potentially lead to administrative violations and undermine the principle of legal certainty. This study employs a sociological legal research method with a descriptive-analytical nature. PPAT plays a juridical, administrative, and substantive role through the verification and validation of tax payment evidence to ensure legal certainty and prevent fiscal deviations. PPAT bears juridical, administrative, and moral responsibility to ensure the compliance of the parties and to maintain the professional integrity of the office. Therefore, PPAT is advised to enhance professionalism, while the local government together with the Regional Revenue Agency (Bapenda), the National Land Agency (BPN), and the Primary Tax Office (KPP Pratama) are expected to strengthen supervisory synergy both administratively and substantively. The public is also expected to increase legal awareness regarding BPHTB and PPh obligations with proper educational support from PPAT.

Abstract

The Notary Protocol, as a state archive, must be safeguarded, preserved, and maintained. The Minuta Akta, as an integral part of the Notary Protocol, carries a crucial function as the basis for issuing copies of deeds; therefore, its existence must be guaranteed. This study analyzes the following issues: the mechanism for submitting and receiving the Notary Protocol when a notary relocates, including the legal responsibility for Minuta Akta that are not submitted; the forms of legal sanctions imposed on notaries who fail to submit the protocol completely after relocation; and the available legal remedies for parties requiring a Minuta Akta that forms part of the Notary Protocol. This research employs a normative juridical method. The results of the study show that the mechanism for submitting the Notary Protocol is regulated under Article 63 of the Notary Office Law (UUJN-P) and Minister of Law and Human Rights Regulation No. 22 of 2025. The submission of the Notary Protocol is formalized through the signing of a Handover Report (Berita Acara Serah Terima) witnessed by the Regional Supervisory’ Council (MPD).

Abstract

High ancestral property (harta pusaka tinggi) in Minangkabau is a communal right inherited matrilineally and, in principle, may not be transferred individually, which makes it highly vulnerable when land registration is conducted in a distorted manner. The research method employed is normative juridical research. The results show, that unlawful acts in the registration of high ancestral property are reflected in land registration carried out by parties not authorized as mamak kepala waris, the falsification or manipulation of genealogical records (ranji) and customary documents, and the disregard of the principle of “bulek kato dek mufakaik” (decision by consensus) in decision-making over clan land. legal protection of high ancestral property operates on multiple layers through customary mechanisms and national legal instruments, including the recognition of communal rights in the 1945 Constitution and the Basic Agrarian Law, land registration regulations, and civil lawsuits against defective land certificates.
