Abstract

This study aims to analyze the implementation of supervision and evaluation in the management of tourism destinations based on Article 11K of Law Number 18 of 2025 concerning Tourism, focusing on the culinary tourism area of Dermaga Bom in South Lampung Regency, from the perspective of siyāsah tanfīdziyyah. Academically, this research is significant due to the existing gap between legal norms emphasizing supervisory and evaluative functions and their empirical practice at the regional level. The policy gap examined lies in the absence of systematically formulated, measurable and sustainable operational mechanisms for supervision and evaluation as a derivative of Article 11K. This research employs a qualitative method with an empirical approach through in-depth interviews and field observations. The analysis is conducted using the indicators of siyāsah tanfīdziyyah, which include: (1) policy implementation (tanfīdz alahkām), (2) effectiveness of supervision (al-raqābah), (3) governmental accountability and (4) orientation toward public welfare (tahqīq al-maṣlaḥah). The findings reveal that the implementation of supervision and evaluation has not been optimal due to limited human resources, weak inter-agency coordination, and the absence of a structured and sustainable evaluation system. These conditions result in poorly organized spatial management, limited facilities, inadequate security assurance and low community participation. Legally, these findings indicate that the mandate of Article 11K of Law Number 18 of 2025 concerning Tourism has not been fully fulfilled in the practice of regional governance. The implications of this study highlight the need to strengthen derivative regulations, enhance the institutional capacity of regional governments, and develop participatory-based supervision and evaluation systems to achieve effective, accountable and public welfare-oriented tourism governance.

Abstract

A notary as a public official must maintain the confidentiality of deeds and protocols but is often involved in law enforcement processes. Law Number 2 of 2014 establishes the Notary Honorary Council (MKN), authorized to approve summons and access to original deeds. This study applies normative legal research with statutory, conceptual and case approaches based on Decision 13/G/2018/PTUN-TPI, supported by interviews. Findings show MKN functions preventively and protectively to balance law enforcement and notarial dignity. The administrative court confirms MKN approval as an administrative decision subject to review, yet unclear criteria and time limits still create legal uncertainty.

Abstract

This study analyzes normative issues in the regulation of law enforcement regarding domestic sexual violence based on Law Number 23 of 2004. The study focuses on the discrepancy between the construction of legal norms and the need for victim protection. The method used is normative legal research with a statutory and conceptual approach. The results indicate weaknesses in the norms, particularly regarding the lack of explicit regulation of the concept of consent in marital relations and the failure to accommodate the characteristics of sexual violence in the private sphere. Furthermore, a disharmony was found with more recent developments in sexual violence regulations. Therefore, operational steps are needed in the form of reformulating the norms in Law Number 23 of 2004, developing interpretation guidelines based on victim protection, and harmonizing them with related regulations to achieve more effective and equitable law enforcement.

Abstract

Minimum sentences are regulated under Law No. 1 of 2023 on the Indonesian Criminal Code. This provision reflects a retributive paradigm that may hinder the development of a criminal justice system oriented toward restorative justice. This study aims to analyze the current relevance of minimum sentences. It employs a normative juridical method using statutory, case and comparative approaches. The findings indicate that minimum sentences limit judicial independence in delivering proportionate decisions and contribute to prison overcrowding, highlighting the need to eliminating minimum sentences.

Abstract

Indonesia, as a culturally diverse country, recognizes customary law as an essential part of its social order, particularly ulayat rights as communal land rights of indigenous peoples. The development of the Nusantara Capital City in East Kalimantan, covering 256,142 hectares, raises legal issues regarding the protection of ulayat rights affecting at least 21 of all indigenous communities. This study employs normative legal research with statutory, conceptual and case approaches. The findings reveal regulatory inconsistencies and systemic failures in land acquisition. Ideal legal protection requires a holistic approach through the application of Free, Prior and Informed Consent principles and regulatory harmonization based on social justice.

Abstract

The construction of lease agreements in the utilization of Management Right (HPL) land at the Sei Mangkei Special Economic Zone by PT KINRA as an extension of PTPN III contradicts Government Regulation Number 18 of 2021, which mandates the use of land transfer and use agreements as the basis for granting Building Use Rights (HGB), Cultivation Rights (HGU), or Use Rights over HPL land. Employing a normative legal method, the findings indicate that lease agreements are not absolutely prohibited under civil law, yet they do not create real rights for investors and cannot serve as the basis for HGB certificate applications. Legal certainty can only be achieved through a deed conforming to GR 18/2021, supported by comprehensive technical guidelines/SOPs and the strengthening of the notary's preventive role. Consequently, aligning the management practices of Right to Manage (HPL) land with statutory provisions serves as a fundamental prerequisite to ensure legal protection for all parties and the sustainability of investments within Special Economic Zones.

Abstract

One legal remedy available to victims of criminal acts to obtain compensation for material and non-material losses is restitution, which can be filed through the public prosecutor during the trial, after a final and binding decision, or through the Witness and Victim Protection Agency (LPSK). Applications must be submitted within 90 days of the victim learning of the final decision. However, the provisions in Supreme Court Regulation Number 1 of 2022 are open to multiple interpretations, particularly the phrase "from the date the plaintiff learned of the decision," potentially creating legal uncertainty. This study aims to examine the implications of this provision and formulate clearer phrasing. The method used is normative juridical based on relevant legal materials to produce a formulation that guarantees legal certainty.

Abstract

The development of financial technology (fintech) has shifted contractual relationships from bilateral to multi-party digital arrangements. This transformation raises new issues in understanding breach of contract, which can no longer be fully explained by classical contract law. The involvement of digital platforms as intermediaries adds complexity, particularly in determining liability and evidentiary aspects. This study aims to examine the construction of breach of contract in digital relationships and to identify normative gaps in Indonesian contract law. It uses a normative legal method with statutory and conceptual approaches. The findings show that the legal framework does not adequately regulate platform liability and still faces weaknesses in electronic evidence. Therefore, a reconstruction of contract law through a more adaptive digital contractual liability concept is necessary.

Abstract

Law of The Republic Indonesia concerning Local Taxes and Retribution mentioned that Acquisition Duty of Right on Land and Building (BPHTB) basis over the transaction is using the transaction value. The BPHTB collection in Karanganyar regency is based on The Local Regulation Number 14 the Year 2010 concerning BPHTB. However, the mechanism of determining the transaction value has not been concretely regulated in the Rule of Laws or KTUN. This research aims to analyze the legal certainty in determination policy of transaction value as the BPHTB basis in Karanganyar regency and what kind of legal implications will arise in the determination policy of transaction value as BPHTB basis in Karanganyar region, which is contrary to the legal certainty. The method of normative legal research, with the typical characteristics of perspective by using primary and secondary legal materials which analyzed by deductive logic reasoning method is being used to conduct this research. The legal material collection technique used is literature study and in-depth interviews that being done with the Local Government Finance Office and Land Deed Official (PPAT).

Abstract

This study examines the comparative implementation of the transit passage regime under the United Nations Convention on the Law of the Sea in the Strait of Hormuz, the Strait of Malacca and Bab el-Mandeb, as well as the legal and nonlegal factors affecting the effectiveness of the international strait governance. Using normative legal research with statutory, conceptual, comparative and lawin-context approaches, this study finds that the implementation of transit passage varies across regions. The Strait of Hormuz reflects a contestative model shaped by geopolitical rivalries, the Strait of Malacca demonstrates a cooperative model through institutionalized regional cooperation, while Bab el-Mandeb represents a fragile model due to non-state security threats. The effectiveness of strategic strait governance is therefore determined not only by the normative force of UNCLOS, but also by geopolitics, institutional capacity, regional cooperation and the nature of security threats. This study affirms that the effectiveness of international maritime law depends heavily on political and security contexts, requiring an integrative approach to ensure freedom of navigation and sustainable stability of international trade.
