Abstract

This research aims to analyze how criminal responsibility is applied to children who commit acts of sexual abuse, as well as how the restorative justice approach is implemented in resolving such cases. The method used is normative legal research, by analyzing legislation, legal doctrines, and relevant court decisions. The research results show that child offenders can still be held accountable, but the diversion process must be prioritized in accordance with the Child Protection and Juvenile Justice Law (UU SPPA). The restorative justice approach is considered capable of providing a more humane resolution focused on recovery, although there are still obstacles in its application to sensitive cases such as sexual abuse. This research concludes that the mechanism still provides legal certainty and is more proportional for all parties.

Abstract

This study analyzes the authority of prosecutorial intelligence within the Indonesian constitutional system following Law Number 11 of 2021. The main issue lies in normative ambiguity and overlapping authority with other institutions, affecting legal certainty. The findings show that prosecutorial intelligence authority is a legally attributed power but lacks clear limitations in scope, procedures, and oversight. This condition potentially leads to conflicts of authority and abuse of power. Therefore, harmonization of laws and strengthening of oversight mechanisms are necessary to ensure legal certainty and the effectiveness of the criminal justice system.

Abstract

This research is motivated by the widespread circulation of illegal and adulterated liquor (miras oplosan) that triggers public disorder, criminality and sexual violence. The primary issues lie in the limited judicial authority of the Municipal Police, the methods of illegal alcohol sales via social media and the weak interagency synergy in law enforcement. This study is analyzed using the Theory of Authority, Lawrence M. Friedman’s Legal System Theory and Soerjono Soekanto’s Legal Effectiveness Theory to examine the legitimacy of authority, the law enforcement system, as well as the inhibiting and supporting factors of legal effectiveness. The findings indicate that the Municipal Police’s authority is attributive, encompassing administrative supervision, non-judicial actions and judicial authority through Civil Servant Investigators (PPNS) in minor offense (Tipiring) hearings. However, law enforcement remains constrained by recidivism due to sanctions that fail to create a deterrent effect. Therefore, optimizing the authority of the Municipal Police requires regulatory reinforcement, human resource capacity building and cross-sectoral synergy with the National Police (Polri) through a Memorandum of Understanding (MoU).

Abstract

The increasing use of information technology in the digital era has had an impact and influence on the increase in cases of cyberbullying, which places minors as the most vulnerable group. This study aims to analyze the form of legal protection for children who are victims of cyberbullying, as well as to examine the provisions of criminal sanctions against perpetrators of these crimes based on laws and regulations in Indonesia. The research method used is normative juridical with a statute approach and a case approach. The focal point of the study is directed at Law Number 17 of 2016 concerning the Stipulation of Government Regulation in Lieu of Law Number 1 of 2016 concerning the Second Amendment to Law Number 23 of 2002 concerning Child Protection to Become Law. The results of this study indicate that this law provides legal protection in the form of preventive and repressive efforts, as well as the right to restitution and rehabilitation to restore the psychological condition of children who are victims. Regarding criminal sanctions, acts of psychological violence in the form of bullying can be prosecuted through Article 76C jo. Article 80 of the law, in addition to the imposition of articles in the Electronic Information and Transactions Law (UU ITE), does not specifically define the nomenclature of cyberbullying. Therefore, legal reform and changes are recommended by inserting or adding a specific article regarding cybercrimes based on child bullying and strengthening criminal sanctions to provide a comprehensive deterrent effect, as well as requiring social media platform providers to restrict access for underage users.

Abstract

The digitalization of petitioner access in judicial review at the Constitutional Court (MK) creates a paradoxical impact: procedural efficiency increases, yet due process guarantees become fragmented. This normative juridical research analyzes MK internal regulations (PMK No. 2/2021) and the implementation of e-filing and hybrid hearing systems. The main findings reveal that the absence of standardized electronic document authentication, algorithmic legal standing verification without clarification mechanisms and inadequate petitioner data protection constitute primary sources of procedural fragmentation. This study recommends reforming PMK to accommodate cybersecurity standards and alternative access mechanisms for petitioners with digital limitations.

Abstract

Medical malpractice is a legal problem that is getting more and more attention because it can cause losses for patients as well as implications for the legal liability of doctors. In the practice of health services, the relationship between doctor and patient is born through a therapeutic agreement that gives rise to rights and obligations for the parties. If there are deviations from professional standards, service standards, or standard operating procedures, doctors can be held accountable both in the realm of criminal law and civil law. This study aims to analyze and compare the legal responsibilities of doctors in medical malpractice cases based on the perspective of criminal law and civil law in Indonesia. The research method used is normative juridical with a legislative approach and a conceptual approach. The data used is in the form of secondary data consisting of primary, secondary and tertiary legal materials that are analyzed juridically qualitatively. The results of the study show that the criminal liability of doctors is based on the existence of mistakes that meet the elements of criminal acts as well as the causal relationship between medical actions and the losses caused. Meanwhile, civil liability is oriented towards recovering patient losses through default mechanisms and unlawful acts. Law Number 17 of 2023 concerning Health emphasizes that the assessment of medical personnel errors must be based on compliance with professional standards, service standards and operational procedure standards. Therefore, the application of dual liability must be carried out proportionately by considering criminal, civil, ethical and professional discipline aspects in order to realize legal certainty and balanced protection for doctors and patients.

Abstract

Therapeutic agreements are legal relationships between medical personnel and patients that are the basis for the implementation of medical actions in health services. Although doctrinally qualified as an engagement of efforts (inspanningsverbintenis), in practice there are still differences of understanding between medical personnel and patients that often lead to disputes regarding the limits of medical liability. This study aims to analyze the position of therapeutic agreements as an engagement effort and formulate the limits of medical liability in the Indonesian legal system. The research method used is normative legal research with a legislative approach, a conceptual approach and a case approach. The legal materials used consist of primary, secondary and tertiary legal materials that are analyzed juridically qualitatively. The results of the study show that therapeutic agreements are basically an engagement of efforts that require medical personnel to make their best efforts according to professional standards, service standards and operational procedure standards without guaranteeing patient recovery. The validity of the therapeutic agreement is largely determined by the fulfillment of informed consent as a form of patient consent that is given consciously after obtaining adequate information. Failure to perform medical procedures does not necessarily give rise to legal liability if the action has been carried out in accordance with professional standards and the principles of prudence. The limit of medical liability is determined based on deviations from professional standards, negligence, or violation of patient rights, which can lead to civil, criminal, administrative, or ethical consequences. Therefore, it is necessary to affirm the concept of commitment and optimize the implementation of informed consent in order to realize legal certainty and balanced protection for medical personnel and patients.

Abstract

MSMEs contribute 60.5% of Indonesia's total GDP, with a national workforce absorption rate of 96.9% in 2022. This makes MSMEs a critical engine for national economic progress. The government's enthusiasm for supporting MSMEs is demonstrated, among other things, through special wage regulations for MSMEs, which are lower than the minimum wage, as outlined in Government Regulation Number 36 of 2021 concerning Wages. The policy is beneficial for MSMEs with limited capital because they are exempt from the usual minimum wage obligations. However, this wage is a tragedy for MSME workers, as it is low and insufficient to meet a decent standard of living. This research examines in depth whether the wage policy for MSME workers has met the aspect of justice in industrial relations, considering that Article 27, paragraph 2 of the 1945 Constitution firmly states that "every citizen has the right to work and a decent living for humanity." The research results show that the aspect of justice in wages must include aspects of distributive justice, where equal work must be paid equally, substantive justice, where the nominal wage received must be appropriate, procedural justice, where the wage determination process must be fair and transparent and relational justice, where the social status of workers does not become an obstacle in determining a decent wage. MSMEs are exempted from minimum wage obligations to maintain their sustainability due to limited capital and competitiveness. However, for workers, this policy results in the aspects of substantive, distributive, procedural and relational justice in wages not being fully met. A gradual wage policy and work flexibility are needed for MSMEs so that the economic interests of workers and the sustainability of MSMEs can be balanced.

Abstract

Regional Regulation of North Lampung Regency Number 07 of 2016 concerning the Village Consultative Body and Village Community Institutions aims to position community institutions as partners of the village government in community empowerment. In practice, however, the implementation of Regional Regulation Number 07 of 2016 in Tanjung Beringin Village has not been carried out optimally. Karang Taruna, as one of the village community institutions, has not been able to perform its community empowerment function as mandated in Article 25 of the Regulation. This condition is reflected in the low level of youth participation, the lack of sustainable empowerment programs, weak coordination between the village government and Karang Taruna administrators and organizational activities that tend to be incidental and more oriented toward entertainment rather than social empowerment. Consequently, there is a discrepancy between the normative provisions that position Karang Taruna as a strategic partner of the village government in community development and the empirical realities found in the field. This study aims to analyze the implementation of Article 25 of the Regional Regulation concerning the role of Village Community Institutions and to examine its implementation from the perspective of fiqh siyasah. This research employs a qualitative method with an empirical approach through field research conducted in Tanjung Beringin Village, Tanjung Raja District. Data were collected through interviews, observations, and documentation. Interviews were conducted with the Village Head, the Head of Karang Taruna, Karang Taruna members, and members of the village community. The collected data were analyzed descriptively and analytically using the perspective of fiqh siyasah. The findings indicate that Karang Taruna in Tanjung Beringin Village has not optimally carried out its community empowerment function as mandated by Regional Regulation Number 07 of 2016. The activities conducted tend to be unsustainable, incidental and more oriented toward entertainment activities rather than community empowerment efforts. From the perspective of fiqh siyasah, this condition reflects the suboptimal implementation of the principles of trustworthiness (amanah), justice and public welfare (maslahah) in the management of village community institutions.

Abstract

This normative-juridical study analyzes the criminal liability of a Land Deed Official (PPAT) regarding the forgery of an authentic deed, based on Kalianda District Court Decision No. 346/Pid.B/2022/PN KLA. The central issue lies in the judge's ratio decidendi, which failed to apply the criminal sentencing enhancement for public officials (Article 58 of Law No. 1/2023) regarding the crime of document forgery (Article 444 paragraph 1 of Law No. 1/2023); consequently, the 2.5-year prison sentence failed to provide a deterrent effect or substantive justice for the victim of a land mafia scheme. It is recommended that the Supreme Court issue a Circular Letter establishing specific minimum sentencing guidelines for officials who abuse their authority, and that PPATs mandate biometric verification via the National Land Agency (BPN) application to prevent negligence.
