Abstract

The purpose of this study is to determine and analyze: 1) the legal regulation of khulu' in the perspective of the applicable laws and regulations in Indonesia, and 2) the urgency of the regulation of khulu' explicitly stated in the National legal system in Indonesia. The type of research is normative juridical. The results of the study indicate that the legal regulation of khulu' in the perspective of the applicable laws and regulations in Indonesia refers to Article 116, Article 148 and Article 161 of the Compilation of Islamic Law, while in Indonesian Civil Law there is no regulation regarding khulu', either in the Civil Code, the Marriage Law or in Government Regulations. The urgency of regulating khulu' is explicitly stated in the National legal system in Indonesia to clarify and provide legal force for the implementation of khulu', to help wives who have difficulty divorcing their husbands, to provide a balance of rights between husband and wife, to be a means to protect the wife's rights from unfair or inhumane treatment from her husband, and to minimize conflict between husband and wife because the wife has a clear way out if the marriage does not go well.

Abstract

The implementation of Electronic Traffic Law Enforcement (ETLE) reflects a digital transformation in traffic law administration aimed at enhancing efficiency, transparency, and accountability. However, the system raises legal concerns related to administrative responsibility based on vehicle registration data, particularly when ownership records are outdated. This study aims to examine administrative legal protection for registered vehicle owners within the ETLE system in the jurisdiction of the Central Sulawesi Regional Police. This research employs a normative juridical method using statute and conceptual approaches. The findings reveal that reliance on registration-based data may lead to administrative inaccuracies and legal uncertainty for vehicle owners. In addition, the lack of integrated data verification and limited access to objection mechanisms weakens administrative legal protection. Therefore, strengthening administrative safeguards requires integrated inter-agency data systems, accessible verification and objection procedures, and improved regulatory governance to ensure fairness and legal certainty in ETLE implementation.

Abstract

This research aims to determine and analyze the legal regulations regarding the principle of good faith in the execution auction of mortgage rights according to the Indonesian legal system, as well as the considerations of the Panel of Judges in Decision Number 375/PDT/2023/PT DKI in assessing the application of the principle of good faith in the execution auction of mortgage rights. The method employed is normative legal research, utilizing a statutory approach, a case approach, and a conceptual approach. The research results indicate that the principle of good faith in the execution auction of mortgage rights is not only regulated in Article 1338 paragraph (3) of the Civil Code, but also in the Mortgage Law, the Banking Law, the Minister of Finance Regulation, and SEMA Number 4 of 2016. However, its application still heavily relies on the judicial interpretation. Decision Number 375/PDT/2023/PT DKI affirms that a buyer of an auctioned property who is aware of a dispute is not a bona fide purchaser; thus, the auction is declared void. Conversely, at the appellate levels, the Supreme Court considered that the auction procedure was in accordance with regulations and that the auction buyer was considered a bona fide purchaser. This difference in consideration shows the inconsistency of Judges in applying the principle of good faith. This research suggests that the parameters of the principle of good faith include compliance with procedures and legal regulations, transparency of information regarding the legal status of the auctioned object, and prohibition against profiting from the disadvantages of other parties.

Abstract

This research concerns the resolution of the Denza trademark dispute that has been transferred in the case of BYD vs. PT. Worcas. This research aims to analyze the impact of the transfer of Denza trademark rights based on Law Number 20 of 2016 concerning Trademarks and Geographical Indications in Indonesia after the transfer of trademark rights. The problem formulation includes a legal analysis of the dispute reviewed based on Indonesian trademark law and the legal implications of the transfer of trademark rights. The research method uses a normative juridical approach with a study of primary legal materials of the Law on Trademarks and secondary materials from IPR literature. The results of this research are first, that the transfer of rights has been recorded in the DJKI and is constitutive, second, the court determined that the lawsuit was an error in persona which caused a formal defect in the lawsuit. With the transfer of rights, the lawsuit was rejected due to an error in persona, making it difficult for multinational companies to register their trademarks in Indonesia. The government should also strengthen the mechanism for recognizing well-known trademarks to prevent trademark squatting.

Abstract

The digital economy has positioned Big Data as a primary strategic asset that creates new market entry barriers in the form of "data fortresses." The assessment of company acquisitions in this sector demands a paradigm shift from physical asset parameters to data control parameters. This study aims to analyze and compare the approaches employed by the Business Competition Supervisory Commission (Komisi Pengawas Persaingan Usaha/KPPU) of the Republic of Indonesia and the German Federal Cartel Office (Bundeskartellamt) in evaluating data access. The research employs a normative juridical method with a comparative law approach. The findings reveal that the KPPU continues to rely on traditional quantitative parameters, such as sales-based market share indicators (HHI), which have demonstrably exhibited gaps in detecting data-driven market power, as evidenced in the case of TikTok's acquisition of Tokopedia. In contrast, the Bundeskartellamt has adopted explicit qualitative criteria through Section 18(3a) of the Gesetz gegen Wettbewerbsbeschränkungen (GWB) to assess data access and network effects, as illustrated in the Parship-ElitePartner case. It is concluded that the KPPU must reform its assessment guidelines by incorporating data access as a primary qualitative factor to ensure fair competition in the digital market.

Abstract

This study aims to analyze the form of legal protection for good faith buyers in the Indonesian civil law system, focusing on the case study of the Mulia Bali Hotel. Legal problems arise when buyers who have made transactions legally and fulfill the elements of good faith still experience legal losses due to third party lawsuits or legal defects in the object of the transaction. The method used is a normative legal approach and case studies, with an analysis of court decisions and relevant national civil regulations. The results of the study indicate that the Indonesian civil law system has not provided maximum guarantees for good faith buyers, especially in disputes over ownership of immovable objects. Therefore, it is necessary to reformulate norms and strengthen the principle of justice in legal protection for good faith buyers.

Abstract

This article discusses the implementation of agreements between parties in divorce cases through a case study of the Cikarang Religious Court Decision Number 2145/Pdt.G/2022/PA.Ckr. This study aims to analyze how mediation agreements can be used as a basis for court decisions by a panel of judges. The research method used is normative juridical with a case study approach. The results of the discussion show that the judges not only recognized the mediation agreement as a legal fact, but also integrated its entire substance into the verdict to ensure justice and legal protection, especially for children. The verdict shows that the results of mediation as outlined in the lawsuit and ratified in the verdict have permanent legal force and can be executed without the need for a new lawsuit. These findings emphasize the importance of mediation as an effective and responsive instrument for resolving family disputes.

Abstract

The purpose of this study is to examine the legal provisions concerning the custody of minor children in Indonesia and to analyze the basis for determining the custody of minor children in child possession cases in Decision Number 685/Pdt.G/2022/PA.Lahat. The problem of this research is how the legal regulation regarding the custody of minor children in Indonesia is arranged and what is the basis for determining the custody of minor children in child possession cases based on Decision Number 685/Pdt.G/2022/PA.Lahat. The research method is normative juridical. The results of the study explain that the legal regulation regarding the custody of minor children can be found in Law Number 1 of 1974 concerning Marriage, Law Number 23 of 2002 concerning Child Protection, and the Compilation of Islamic Law (KHI). As for the basis for determining the custody of minor children, which was originally granted to the mother, the court, based on the judge’s legal considerations and trial facts, decided to grant custody to the father because the mother was deemed unfit for caregiving. The minor child in the case was proven not to be directly cared for by the mother but was instead cared for by a third party, namely the grandmother.

Abstract

This study aims to analyze the criteria for sound mark registration in Indonesia and compare them with the legal framework applicable in the European Union (EU) jurisdiction. Sound marks, as a type of non-traditional trademark, pose challenges concerning representation, distinctiveness criteria, and substantive examination. The research method employed is normative legal research with a comparative approach. Secondary data was gathered through literature review, covering relevant legislation, legal doctrines, and case studies. The findings reveal significant differences in the formal and substantive requirements for sound mark registration between Indonesia and the EU. Indonesia still faces limitations, particularly regarding the representation requirement, which necessitates visualization, and the distinctiveness criteria, which have not been specifically detailed for aural elements. Conversely, EU regulations, particularly within the European Union Trademark (EUTM) framework, have demonstrated more progressive adaptation, allowing for non-visual representation and providing clearer guidelines on how a sound can be considered distinctive. The study concludes that Indonesia needs to review and reform its sound mark registration criteria to accommodate technological advancements and global business practices, specifically by adopting more flexible representation standards and developing more aural-specific examination guidelines for distinctiveness, mirroring the best practices implemented in the European Union.
