Abstract

This study aims to analyze the implementation of drug rehabilitation programs through the lens of maqāṣid al-sharī‘ah, emphasizing the protection of the five essential objectives of Islamic law. The research focuses on the rehabilitation practices at the Amelia Foundation in North Sumatra as a case study. A qualitative approach was employed, combining conceptual and case study methods. Data were collected through in-depth interviews with counselors and residents, as well as documentation of the rehabilitation activities. The findings reveal that the Therapeutic Community (TC) model applied at the foundation aligns with the five principles of maqāṣid al-sharī‘ah: hifẓ al-dīn (protection of faith) through spiritual development and worship guidance; Hifẓ al-nafs (protection of life) through medical care and social support; hifẓ al-‘aql (protection of intellect) through counseling and mental education; hifẓ al-nasl (protection of progeny) through family responsibility formation; and hifẓ al-māl (protection of wealth) through vocational training and entrepreneurship programs. This study contributes to the development of a holistic rehabilitation framework that integrates spiritual, moral, and economic dimensions. It highlights the significance of maqāṣid al-sharī‘ah as an alternative Islamic paradigm for sustainable and meaningful drug recovery programs.

Abstract

This study aims to examine the development of religious freedom in Indonesia and the relationship between human rights (HR) principles in Islam and international HR standards. According to SETARA Institute data from 2023, there has been a significant increase in violations of religious freedom, with 217 incidents and 329 violation acts, mostly perpetrated by non-state actors. Although this right is protected by the constitution and Law Number 39 of 1999, serious challenges remain. This research employs a qualitative method with a descriptive-analytical approach to explore expert perspectives on religious freedom in Islam, integrating legal document analysis, academic literature, and a comparative approach between Islamic law and international HR standards. Findings indicate that HR principles in Islam have a strong foundation through the maqasid al-shariah principles, which encompass the protection of life, religion, intellect, lineage, and property, aligning with universal HR despite distinct theological bases. In Indonesia, as a country that recognizes religious pluralism and is founded upon Pancasila, religious freedom is guaranteed through the 1945 Constitution. The study concludes that harmonizing Islamic and international HR principles in religious freedom necessitates an integrative, dialogical, and contextual approach, especially through collaboration between Muslim scholars and international HR experts. Despite ongoing challenges such as radicalism and the politicization of religion, legal reform and moderate approaches in some Muslim countries demonstrate that a synthesis between Islamic values and modern HR can be achieved with balance and inclusivity

Abstract

Productive waqf has emerged as a promising financial instrument for socio-economic development in Muslim-majority countries. However, existing studies are fragmented and lack a comprehensive synthesis of models and practices. This study aims to bridge this gap by conducting a Systematic Literature Review (SLR) on productive waqf management models published between 2019 and 2024. Using the PRISMA protocol, 51 eligible articles were selected from Scopus, Google Scholar, and SciSpace via Publish or Perish (PoP), and analyzed through VOSviewer for bibliometric mapping. The findings reveal that while productive waqf practices in Indonesia are evolving beyond the traditional 3M (Mosques, Madrasahs, and Tombs) model, they remain predominantly focused on cash-based waqf and business units. The utilization of waqf land for productive purposes is still significantly underexplored. Keyword mapping indicates emerging research trends around digitalization, governance, and nazir professionalism. This study contributes a synthesized framework of productive waqf models and highlights the need for standardization, certification of nazir, and innovation in land-based waqf development. The implications offer strategic insights for waqf stakeholders to align Islamic philanthropy with the Sustainable Development Goals (SDGs).

Abstract

تتداعى الأمم والدول في العصر الحديث إلى الاعتراف بحقوق الإنسان واحترامها وحمايتها وصيانتها. وصدرت المواثيق الدولية العديدة في التأكيد على أهمية حقوق الإنسان وضرورة توفيرها في حياة المجتمعات، ودعوة دول العالم لموافقتها والالتزام بها. وفي هذا السياق، يهدف هذا البحث إلى دراسة مركزية مقاصد الشريعة الإسلامية بوصفها مرجعية أصيلة لبناء مفهوم حقوق الإنسان في المجتمعات المسلمة، بعيدا عن التأثر الحصري بالنماذج الغربية. ولا يقتصر البحث على التحليل النظري فقط، بل يتجاوز ذلك إلى بحث إمكانات وآليات تفعيل مقاصد الشريعة كأساس مرجعي لحقوق الإنسان في المجتمعات الإسلامية. ويتبع الباحث المنهج الاستنباطي التحليلي ضمن دراسة مكتبية، حيث يتم الرجوع إلى المصادر الشرعية والمراجع العلمية المعتمدة، لاستنباط المبادئ الكلية التي يمكن أن تبنى عليها حقوق الإنسان من منظور إسلامي. وقد خلص البحث إلى أن لمقاصد الشريعة دورا محوريا في تأسيس الحقوق الإنسانية، وأن تفعيل هذه المركزية يتم من خلال مسارين: الأول، إلحاق مفاهيم حقوق الإنسان القائمة ضمن مقاصد الشريعة؛ والثاني، توليد مفاهيم حقوقية جديدة تنبع من المنظومة المقاصدية نفسها، بما يحقق تكاملا بين البعد القيمي والتشريعي في تصور الحقوق

Abstract

Getting Married via teleconference is considered as a practical solution for couples separated by distance. However, Majma‘ al-Fiqh al-Islāmī al-Dawlī has issued a fatwa stating that teleconference marriage contracts are not permissible. This research aims to analyze the relevance of this fatwa in the context of modern Muslim society, by focusing on the problem formulation: 1) What was the opinion of the Majma‘ al-Fiqh al-Islāmī al-Dawlī on the marriage contracts via teleconference, 2) How was the discourse of Islamic institutions and contemporary Ulama’ regarding this issue, and 3) What was the relevance is this fatwa for today's Muslim society. The method used in this research was qualitative research. with a normative theological approach, emphasizing Qaidah Fiqhiyah such as Taghayyur al-Fatwa bi Taghayyur al-Zaman wa al-Makan, Sadd Dhari‘ah, and maslahah, alongside a normative juridical approach based on Indonesian marriage law. Primary data were obtained from official documents of Majma‘ al-Fiqh al-Islāmī al-Dawlī, complemented by secondary data. The result of this research showed that: 1) Majma‘ al-Fiqh al-Islāmī al-Dawlī considers teleconference marriage contracts invalid, 2) there are differing opinions among contemporary Ulama and Islamic institutions, and 3) the fatwa is not relevant to the needs of modern Muslim society, especially in the context of globalization and technological advancements.

Abstract

Artikel ini bertujuan untuk menganalisis perspektif Jonathan AC Brown tentang pluralisme dalam pemahaman hadis dan tantangan yang muncul dalam konteks globalisasi. Fokus utamanya adalah pada bagaimana penafsiran hadis dapat mengakomodasi berbagai sudut pandang tanpa mengorbankan integritas teks. Penelitian ini menggunakan pendekatan kualitatif dengan analisis tekstual. Data dikumpulkan dari karya-karya utama Jonathan AC Brown, khususnya tentang pluralitas penafsiran hadis dan dampaknya terhadap studi Islam kontemporer. Metode analisis membandingkan pandangan Brown dengan pendekatan tradisional dan modern terhadap studi hadis. Penelitian ini menemukan bahwa, menurut Jonathan AC Brown, pluralisme dalam pemahaman hadis merupakan aspek yang tidak dapat dihindari di era globalisasi, di mana penafsiran yang lebih fleksibel dan inklusif diperlukan untuk mengatasi tantangan sosial dan budaya. Brown menganjurkan pendekatan yang lebih terbuka terhadap perbedaan pendapat dalam pemahaman hadis. Artikel ini menyimpulkan bahwa globalisasi menghadirkan tantangan yang signifikan bagi pemahaman hadis, tetapi juga membuka peluang bagi dialog yang lebih inklusif dan komprehensif. Pendekatan hadis yang lebih fleksibel dan kontekstual sangat penting untuk menjaga relevansi ajaran Islam di tengah keragaman budaya.

Abstract

The concepts proposed by Paul Feyerabend have great relevance in interfaith dialogue, especially in the era of globalization. This idea is very much needed because the flow of developments in the era of religion makes religion increasingly plural and dynamic, so the potential for conflict will be more significant. Not infrequently, many worrying cases arise from differences in belief or faith. This article uses qualitative research methods with literature studies to explore the concepts of "Anything Goes" and "Proliferation Theory" by Paul Feyerabend and their implications in interfaith dialogue. Data were collected through a literature review that included books, journal articles, and other relevant academic sources. Data analysis was carried out descriptively with a content analysis approach, identifying the main themes, key concepts, and theoretical implications that support the diversity of perspectives in interfaith dialogue. This study found that both of Feyerabend's theories encourage recognizing and accepting the diversity of perspectives and interpretations in religious practice, acknowledging that no method or perspective holds absolute truth. By accepting the plurality of views, interfaith dialogue can achieve a deeper understanding of the complexity of human spirituality, enriching the exploration of universal values ​​that underlie various religious traditions. In addition, the methodological flexibility offered by these concepts allows for the inclusion of multiple perspectives and creative approaches, creating space for non-traditional approaches that can overcome the limitations of conventional methodologies and stimulate innovation in engaging in interfaith dialogue.

Abstract

This study aims to examine the understanding of the academic community of the As-Sunnah Islamic College Deli Serdang regarding the hadith on sutrah in prayer and to reveal the practice of using sutrah in prayer as a manifestation of living hadith in the environment of the As-Sunnah Islamic College Deli Serdang. This study employs a qualitative approach and phenomenological method, with data collected through participatory observation, in-depth interviews, and documentation. The results indicate that understanding of the hadith regarding sutrah is quite strong among the academic community, influencing its practical application in daily life, particularly in prayer practices. These findings demonstrate how hadith is not only used as a source of law but also brought to life within the social and cultural context of Islamic education

Abstract

Ahmadiyya Qur’anic exegesis presents a distinctive hermeneutical framework that diverges significantly from mainstream Islamic interpretations, particularly in relation to ideological intrusions (al-dakhi>l) embedded in its exegetical narratives. This study critically investigates the patterns of ideological intrusion in the exegesis of both the Qadiani and Lahori branches, using a qualitative textual analysis. Primary sources include Haqiqat al-Wahy and Tadhkirah by Mirza Ghulam Ahmad, along with exegetical works by Maulawi Sher Ali, Malik Ghulam Farid, and Muhammad Ali. Anchored in the classical theory of al-dakhi>l fi> al-tafsi>r and informed by critical hermeneutics, the analysis identifies three dominant patterns of ideological intrusion: allegorical reinterpretations of miracles, historical reconstruction of the figure of Prophet Isa a.s., and the redefinition of khatam al-nabiyyi>n. While the Qadiani faction tends to affirm Ghulam Ahmad’s prophethood explicitly, the Lahori branch emphasizes rationalism and the role of mujaddidism. The study concludes that Ahmadiyya exegetical methodology, marked by a synthesis of modern rationalism, spiritual subjectivity, and historical reinterpretation, reveals a persistent tension between interpretive innovation and commitment to traditional principles such as sanad and ijma>‘. These findings offer a significant contribution to contemporary Islamic hermeneutics.

Abstract

This research aims to analyse and discover the views of members of the Komunitas Mahasiswa Pecinta Ilmu (KMPI) Jember on the sacredness of marriage and the decline in marriage rates among young people, as well as the factors that cause KMPI Jember members to decide not to get married. Society, especially youth, no longer considers marriage as something sacred. Marriage is increasingly viewed merely as a biological imperative, achievable outside marital bonds. This view encourages the younger generation to be reluctant to get married. This research uses a qualitative approach. The criteria for the informants chosen in this study are members of KMPI Jember who are not married in the age category between 16 sixteen to 30 (thirty) years. The results of this research show that the views of KMPI Jember members on the sacredness of marriage include (1) something serious and full of responsibility, (2) irrelevant to current conditions and (3) influenced by religious and cultural education. KMPI Jember members' views on the decline in marriage rates among young people include (1) having a close relationship with social and cultural values, (2) being influenced by economic factors and (3) the role of education and career. Factors that cause KMPI Jember members to decide not to get married are (1) economic and emotional stability, (2) family and neighbourhood pressure and (3) education and career
