Abstract

This research aims to identify the factors that cause the low level of safety of environmental defenders in Indonesia, as well as exploring the negative impacts of natural damage on communities and ecosystems. Apart from that, this research also provides an overview of the social, political and economic challenges faced by environmental defenders in the context of fighting against activities that destroy nature, as well as how policies and regulations related to the protection of environmental defenders need to be improved. The natural damage that occurs in Indonesia is greatly influenced by unsustainable natural resource exploitation practices, such as illegal mining, land clearing for plantations, and industrial activities that pollute the environment. However, environmental defenders who try to stop this destruction often face high risks, including legal and physical threats from parties who have an interest in destroying nature. In many cases, environmental defenders are often blamed or falsely accused, as well as persecuted or killed by parties who feel threatened by their cause.

Abstract

This legal writing examines and addresses the Supreme Court of the Republic of Indonesia Decision Number 1644 K/Pid/1988 dated May 15, 1991. In the ratio decidendi of the decision, it is stated that if someone violates customary law and is subsequently subjected to customary sanctions (customary punishment) by the customary leader, that individual cannot be prosecuted again (for the second time) in a state court (District Court) for the same customary law violation and be sentenced to imprisonment under the provisions of the Indonesian Penal Code (Article 5 paragraph (3) sub b of Emergency Law Number 1 of 1951). Based on this background, the issue addressed in this paper is: how does the customary legal system resolve criminal cases? Referring to the aforementioned jurisprudence, in the case of TC, who abused Category 1 narcotics resulting in the death of another person, criminal prosecution should not have proceeded, as the matter had already been resolved through customary law. The approach used by the author is a socio-juridical approach, which emphasizes research intended to empirically understand the law by directly engaging with the object. Socio-juridical research uses secondary data as its initial source, followed by primary data collected from the field or society.

Abstract

Marriage constitutes a sacred bond between men and women governed by the Indonesian legal system. Law No. 16 of 2019 establishes a minimum marriage age of 19 years for both men and women, yet provides exceptions through marriage dispensation mechanisms for those who have not reached that age. This research examines the juridical aspects of granting marriage permits for children below the minimum age through normative juridical methods with qualitative analysis of statutory regulations and legal literature. Research findings indicate that marriage dispensation is regulated under Article 7 paragraph (2) of the Marriage Law and Supreme Court Regulation No. 5 of 2019, with contributing factors including economic aspects, low education levels, and cultural traditions. Underage marriage generates negative impacts including school dropout, reproductive health disorders, and sustained poverty. Strengthened regulations and comprehensive prevention efforts are required to protect the best interests of children.

Abstract

The development of information and communication technology creates new legal challenges, particularly in the spread of radical ideology through digital platforms. This article examines the application of the principle of legality in law enforcement against digital radicalism with implications for terrorism in Indonesia. Using normative legal research with legislative, conceptual, and analytical approaches, this research focuses on the Criminal Code, the Electronic Information and Transactions Law, and the Terrorism Law. The research findings reveal regulatory gaps, unclear legal provisions, and difficulties in distinguishing between protected expression and radical content, which hinder effective law enforcement. These gaps allow perpetrators to exploit the digital space and evade legal accountability. The research concludes that comprehensive legal reform, a progressive legal approach, and stronger international cooperation are needed to ensure that criminal law remains adaptive to technological developments while upholding legal certainty and human rights.

Abstract

This study aims to analyze the synchronization of the national legal framework in the field of labor by examining the alignment between the Manpower Act, the Job Creation Act, and their implementing regulations. The introduction of the omnibus law brought substantial changes to labor governance, particularly regarding employment relationships, wage systems, contract flexibility, and worker protection. However, these reforms have not been fully accompanied by adequate harmonization at the level of implementing rules, resulting in inconsistencies and potential legal uncertainty. This research employs a normative legal method with statutory and comparative approaches to identify points of divergence, normative conflicts, and their implications for regulatory implementation. The findings indicate that although the Job Creation Act aims to improve regulatory efficiency and the investment climate, significant gapsremain between the primary legislation and its derivative regulations, especially in terms of worker protection and policy coherence. These results highlight the need for strengthened harmonization through regulatory evaluation, refinement of implementing rules, and alignment of legal norms to ensure a balanced relationship between economic flexibility and labor protection. The study contributes theoretically by mapping regulatory disharmony and offering analytical foundations for policymakers in shaping future labor law reforms in Indonesia.

Abstract

Occupational Safety and Health (OSH) constitutes a fundamental workers’ right that must be guaranteed by theState as part of its human rights obligations. Within the employment relationship, the State bears a constitutional duty to ensure safe, healthy, and dignified working conditions. This article examines State responsibility for OSH protection under Indonesian labour law. It aims to identify the normative basis and forms of State responsibility, evaluate the effectiveness of the regulatory framework, and assess the implementation of OSH standards across employment sectors. The research adopts a normative juridical method, employing statutory and conceptual approaches, with data derived from legislation and scholarly literature published within the last decade. The study finds that although Indonesia has established OSH obligations through various legislative instruments, enforcement remains suboptimal, particularly in the informal sector, small and medium enterprises, and regions with limited supervisory capacity. Insufficient labour inspection mechanisms and the limited number of labour inspectors contribute to recurrent non-compliance with statutory OSH standards. The article concludes that State responsibility in ensuring effective OSH protection requires regulatory reinforcement, strengthened supervisory institutions, and enhanced inter-agency coordination to secure comprehensive labour protection.

Abstract

This research is intended to look into the legal aspects of certainty peace agreements (akta van dading) made outside the court in resolving disputes over marital property and inheritance. The research focuses on The judgment delivered by Tigaraksa’s Religious Court, Case No: 657/Pdt.G/2022/PA.Tgrs, as a concrete example of how the judiciary legitimizes informal agreements reached through deliberation between parties. The research uses a normative juridical approach, meaning it studies written laws and legal principles. involving An examination of the legal rules set by statute, legal doctrines, and court decisions. The findings reveal that although the peace agreement was made without the involvement Conducted by a qualified mediator, the court may still ratify the agreement as long as it meets the legal requirements of a valid contract and does not conflict with positive law. Judicial ratification provides legal legitimacy and executorial power to the agreement, while also strengthening the protection of vulnerable parties. These results highlight the importance of flexibility within the legal system to accommodate consensus-based dispute resolution, and reinforce. The judiciary functions as the protector of genuine fairness.

Abstract

The rapid advancement of information technology has intensified children’s use of social media, increasing their exposure to various digital risks, including inappropriate content, cyberbullying, online exploitation, misuse of personal data, and internet addiction. This situation highlights the urgency of regulating a minimum age for social media access that balances children’s freedom of expression with the protection of their best interests. This study analyzes the regulation of age verification for children’s access to social media as stipulated in Government Regulation Number 17 of 2025 on the Governance of Electronic System Operation for Child Protection (PP TUNAS), as well as the gap between legal norms and their implementation. Using a normative legal research method with a descriptive qualitative approach, this study examines statutory regulations, legal doctrines, and relevant secondary sources. The findings indicate that PP TUNAS establishes a foundational legal framework through mandatory age verification and parental consent requirements; however, its effectiveness is limited by the absence of clear technical standards, effective supervision, and concrete audit and sanction mechanisms. Therefore, this study recommends the formulation of detailed technical regulations, the enhancement of parental digital literacy, and the strengthening of inter-agency coordination to ensure effective child protection in the digital environment.

Abstract

This study examines the role of indigenous peoples in the management of customary forests, as well as the government’s efforts to provide legal protection for indigenous peoples’ rights over communal (ulayat) forests. The research employs a normative legal method, using statutory, conceptual, and legal-sociological approaches through a literature review of primary, secondary, and tertiary legal materials. The findings indicate that indigenous peoples play an active role in managing customary forests based on customary law and local wisdom, which has proven to support both ecological and social sustainability. Legal protection provided by the government is grounded in constitutional and juridical foundations, including Constitutional Court Decision Number 35/PUU-X/2012; however, its implementation remains constrained by regulatory disharmony, reliance on regional administrative recognition, and sectoral policies that have yet to be fully integrated. This study underscores the need to strengthen a coherent national legal framework to ensure effective protection of indigenous peoples’ communal forests.

Abstract

The Constitutional Court Decision (MK) No. 105/PUU-XXII/2024 has introduced a fundamental change in the enforcement of criminal law concerning defamation offenses, particularly with regard to the subject authorized to file a complaint. Prior to this decision, reports of defamation offenses under the Law on Information and Electronic Transactions (ITE Law) could be submitted by third parties. However, through this ruling, the Constitutional Court affirmed that only direct victims possess legal standing to report defamation offenses. This study aims to examine the regulation of defamation offenses under the ITE Law before and after Constitutional Court Decision Number 105/PUU-XXII/2024, as well as to analyze its juridical implications for the enforcement of the ITE Law. This research employs normative legal research with a statutory approach and a historical approach. The findings indicate that following the Constitutional Court’s decision, the authority to file complaints in defamation cases under the ITE Law is strictly limited to individuals who are directly harmed. Furthermore, the decision implies the necessity for regulatory adjustments through a revision of the ITE Law by the Government and the House of Representatives (DPR), particularly to clarify provisions that have generated multiple interpretations, in order to ensure legal certainty and the protection of human rights.
