Abstract

The circulation of prohibited items within correctional institutions poses a serious threat to security, order, and the achievement of rehabilitative objectives. At Class IIA Kupang Penitentiary, repeated confiscations of contraband—such as improvised weapons, razor blades, ropes, lighters, and mobile phones—indicate the suboptimal implementation of supervisory mechanisms as mandated under Minister of Law and Human Rights Regulation No. 6 of 2013. This study aims to identify factors hindering effective supervision and to examine preventive strategies adopted by the institution. It employs an empirical legal method with a socio-legal approach, integrating normative analysis with field data obtained through interviews with correctional officers, inmates, and visitors. The findings reveal internal constraints, including limited personnel, integrity issues, inadequate facilities, and excessive leniency, as well as external challenges such as sophisticated smuggling methods and limited visitor awareness. In response, the institution has implemented revised Standard Operating Procedures (2025), strengthened supervision, enhanced detection measures, reinforced officer integrity, and expanded regulatory outreach to ensure effective and sustainable prevention.

Abstract

The appointment mechanism of constitutional court judges represents a critical intersection between judicial independence and democratic legitimacy. In Indonesia, the tripartite nomination model involving the President, the House of Representatives, and the Supreme Court was originally designed to embody checks and balances. However, recent institutional developments raise concerns regarding structural vulnerabilities within this design. This article examines whether Indonesia’s appointment model adequately safeguards judicial independence or instead generates institutional dependency. Employing normative juridical analysis combined with a functional comparative approach, the study compares Indonesia’s system with those of Germany and South Korea, both of which operate centralized constitutional review mechanisms. This article argues that Indonesia’s fragmented yet majoritarian appointment structure structurally produces appointment dependency, distinguishing it from the institutionalized political constraint models found in Germany and South Korea. While political involvement in judicial selection is not inherently incompatible with judicial independence, the absence of supermajoritarian consensus requirements and structured public scrutiny increases the risk of majoritarian capture. The article proposes a reconstruction of Indonesia’s appointment design through the introduction of qualified majority requirements and institutionalized public deliberation mechanisms. Such reforms aim to recalibrate the balance between democratic legitimacy and judicial autonomy within Indonesia’s constitutional framework.

Abstract

Divorce decided by default judgment against a party whose whereabouts are unknown raises issues of legal certainty and rights protection. Research on the Religious Court of Sumber Decision Number 5924/Pdt.G/2022/PA.Sbr using normative legal methods shows that formally the decision has complied with procedural law provisions. However, from a material aspect, there are still weaknesses in summons transparency, protection of respondent's rights, and application of the precautionary principle. Strengthening summons standards, optimizing the ex officio role of judges, and regulatory updates are needed to achieve a balance between judicial efficiency, legal certainty, and substantive justice in default divorce cases in Religious Courts.

Abstract

This article analyzes the principle of legal certainty (Rechtszekerheid) through a procedural review of the Cilacap Religious Court Decision No. 2557/Pdt.G/2024/PA.Clp., in comparison with the Appeal Decision No. 49/Pdt.G/2025/PTA.Smg and the Cassation Decision No. 559 K/Ag/2025. The study examines key civil procedural principles, including passive judge, open trial, judicial independence, “audi et alteram partem”, efficiency, clear reasoning, and execution after 14 days. The case involves a dispute between Ritma Nungki Ekasari and Roni Dwi Arifin regarding alimony. The findings reveal inconsistencies in the application of civil procedural principles and discrepancies with SEMA RI No. 3 of 2018, particularly concerning the consideration of the husband’s economic capacity and fairness. The study concludes that judges must apply procedural principles more consistently and carefully to avoid legal defects and to ensure legal certainty from the first-instance court.

Abstract

This study analyzes the role of law enforcement officials in Indonesia in ensuring justice and legal certainty. It focuses on the effectiveness of law enforcement officials in addressing issues of corruption, drug abuse, and human rights violations. The methodology used is descriptive qualitative coupled with comparative analysis. Findings indicate structural challenges such as limited resources, integrity issues, and lack of coordination between institutions. Recommendations are provided for improving professionalism and reforming the law enforcement system.

Abstract

The rapid development of online loan (Pinjol) services in Indonesia has been accompanied by widespread use of detrimental standard clauses in consumer agreements. This normative legal research aims to (1) identify the forms of unfair standard clauses in online loan agreements, (2) analyze their legal compliance with Law Number 8 of 1999 concerning Consumer Protection (UUPK) and OJK Regulation Number 30 of 2024, and (3) formulate effective legal protection and dispute resolution for consumers. The results show that exoneration clauses and liability transfer clauses to third parties (e.g., debt collectors) are the most common forms of detrimental clauses. These clauses violate Article 18 of the UUPK and the principle of good faith in contracts, making them void by law. The study concludes that there is a significant gap between the legal framework and its implementation. A comprehensive approach is needed, including strengthening ex-ante supervision by OJK, standardizing contracts, empowering vulnerable. consumers, and creating integrated, accessible dispute resolution mechanisms to build a fair and transparent digital lending ecosystem.

Abstract

Massive forest degradation in Sumatra has increased ecological vulnerability and intensified the frequency of flash floods. These disasters are not solely caused by extreme rainfall but are closely linked to the loss of forest functions in upstream watershed areas due to illegal logging and uncontrolled land-use change. This study examines the causal relationship between forest degradation and flash floods and evaluates the effectiveness of environmental law enforcement in addressing such damage. The research employs a normative juridical method with statutory and conceptual approaches, using data from legal regulations, court decisions, and institutional reports. The findings show that although Indonesia has a relatively comprehensive environmental legal framework, its enforcement remains suboptimal. Weak supervision, inconsistent sanctions, and the lack of deterrent effects on business actors allow forest degradation to persist. Strengthening firm and consistent environmental law enforcement is therefore essential to prevent ecological disasters and protect the public’s right to a good and healthy environment.

Abstract

llegal wildlife trade has become a serious environmental crime that threatens biodiversity conservation and ecological sustainability, particularly in urban areas such as Jakarta where trade networks are highly developed. This article aims to analyze the role of the Jakarta Natural Resources Conservation Agency (Balai Konservasi Sumber Daya Alam Jakarta) in preventing and combating illegal wildlife trade and to assess the effectiveness of conservation law enforcement in an urban context. This research employs a normative legal research method using statutory and conceptual approaches, supported by secondary data derived from legislation, official government reports, and relevant scientific literature. The findings indicate that although BKSDA Jakarta has implemented supervisory and enforcement measures in accordance with Law Number 5 of 1990, its effectiveness remains constrained by limited human resources, weak inter-agency coordination, and inadequate capacity to address digital-based wildlife trade. In addition, the increasing use of online platforms for wildlife trafficking presents new challenges that are not fully accommodated by existing legal instruments. This study concludes that strengthening institutional capacity, improving cross-sectoral coordination, and adapting law enforcement strategies to technological developments are essential to enhance the effectiveness of wildlife protection and conservation law enforcement in urban areas.

Abstract

This study examines the disharmony between Gorontalo City Regional Regulation No. 1 of 2018 on Public Order and Mayoral Regulation No. 4 of 2010 on nighttime entertainment operations. Although regulating similar matters, the two instruments lack coherence, causing uncertainty in implementation, particularly in Leato Selatan Village. The research employs a normative legal method through statutory and conceptual approaches, supported by interviews with relevant authorities. The findings reveal vertical, substantive, normative, and hierarchical inconsistencies resulting from weak institutional coordination, inadequate legislative scrutiny, and outdated provisions. This disharmony is both normative and structural, indicating deficiencies in the regional legislative framework. Accordingly, reform is necessary, including revising the Mayoral Regulation, strengthening inter-institutional cooperation, and enhancing the role of legislative drafters to ensure coherent, adaptive, and socially responsive regulations.

Abstract

This study analyzes the form and implementation of legal protection for election supervisors in the 2024 General Election in Bone Bolango Regency and formulates an ideal model for future protection. It adopts a normative legal approach supported by empirical data, using statutory and conceptual methods. The findings indicate that existing protection is inadequate due to a normative gap in Law No. 7 of 2017, which does not explicitly regulate the occupational safety of supervisors. Furthermore, Article 491 remains repressive and limited to the campaign stage. In practice, supervisors experience psychological pressure and intimidation without effective advocacy mechanisms. The proposed model consists of three main pillars: regulatory reconstruction through the introduction of a *lex specialis* addressing violence against election officials; institutionalization of preventive and repressive protection measures, including hotlines and advocacy units; and optimization of institutional synergy, particularly through strengthening the role of the Gakkumdu Center and enhancing support from local governments.
