Abstract

The purpose of this study is to determine and analyze the application of the death penalty to perpetrators of narcotics crimes according to Indonesian positive law. In discussing this research, the author uses the theory of legal certainty and the theory of punishment. This research is a normative legal study using library methods that focus on reading and analyzing primary and secondary legal materials. The results indicate that the death penalty remains in Indonesian positive law, as seen in various provisions in the Criminal Code and other laws and regulations. With the enactment of Law No. 1 of 2023 concerning the Criminal Code, the death penalty is no longer a principal punishment but a special punishment threatened using an alternative system. This means the execution can be postponed with a 10-year probationary period; if the convict shows improvement, it can be commuted to life imprisonment or 20 years' imprisonment, but if no behavioral improvement is shown, the death penalty can be carried out. The Criminal Code and Law No. 35 of 2009 explicitly impose the death penalty for serious drug offenders. This penalty is the harshest sanction for drug offenders because it deprives them of their right to life; however, it is commensurate with the consequences of their actions.

Abstract

Background: The practice of illegal polygamy, conducted without court permission or the wife's knowledge, remains a persistent issue in Indonesia, undermining the legal protection of women's rights in marriage. The enactment of Law Number 1 of 2023 concerning the National Criminal Code (KUHP) introduces new provisions that criminalize such actions, potentially shifting the paradigm from viewing polygamy violations as mere administrative or civil offenses. Objective: This research aims to analyze the legal protection afforded to wives involved in illegal polygamy under the current marriage law regime and to assess the relevance and direction of enforcing Articles 402 and 403 of the 2023 KUHP in strengthening this protection. Methods: This study employed a normative juridical approach with a legislative and conceptual focus. It examines primary legal materials, including the Marriage Law, the Compilation of Islamic Law (KHI), and the 2023 KUHP, alongside secondary legal materials such as scholarly articles and legal expert opinions. Data were analyzed qualitatively through interpretation of legal norms and assessment of normative synchronization. Findings: The research reveals that while the Marriage Law and KHI provide preventive and repressive civil mechanisms for wife protection, these instruments have structural limitations, particularly when polygamy is conducted secretly. Articles 402-403 of the 2023 KUHP introduce an additional layer of protection by criminalizing marriage conducted despite a lawful obstacle or concealment of marital status. However, the effectiveness of these criminal provisions depends on a synchronized interpretation with marriage law, particularly regarding the concept of "lawful obstacle."

Abstract

Indonesia's rice industry faces significant challenges in enhancing its competitiveness in the global market. This study aims to develop an integrative model that explains the influence of differentiation strategies and dynamic marketing capabilities on Indonesia's rice competitiveness, considering the role of sustainable marketing moderation and global business ethics. The method employed is qualitative descriptive, pursued through a qualitative design that involves an in-depth assessment of primary and secondary data from the rice industry. The study finds that differentiation strategies and dynamic marketing capabilities exert a positive and significant impact on the competitiveness of Indonesian rice, with sustainability principles and global business ethics reinforcing these effects. This research goes beyond traditional price- and productivity-based approaches by developing an integrative model that positions sustainable marketing and global business ethics as moderating variables. The findings highlight the strategic role of adaptive marketing and value innovation in strengthening national rice competitiveness amid inflation and policy uncertainty, underscoring the need for evidence-based policy briefs addressing the rice trade industry and shifting consumer preferences. These findings contribute theoretically to the development of dynamic marketing capability in the agribusiness sector, as well as practically, informing sustainable food policy formulation in Indonesia.

Abstract

This study aims to analyze the marketing strategy of catfish (Clarias sp.) cultivation products as a culinary business in Batu Kumbung Tourism Village, Lingsar District, West Lombok. The research uses a descriptive qualitative approach with observation, interview, FGD, and documentation techniques. Data analysis is carried out using the SWOT method to identify internal and external factors of the business. The results of the study show that the main strength lies in the stable availability of raw materials and the innovation of processed products, while the weaknesses include limited capital and suboptimal digital marketing. Opportunities come from the development of tourism and information technology support, while threats include rising feed prices and business competition. The recommended strategy is the SO strategy through digital marketing optimization, product and packaging innovation, and educational tourism development. This strategy is expected to increase competitiveness and strengthen the village's identity as a fishery-based culinary destination.
